Item No. 27
AGENDA REPORT
DATE: June 9, 2025
TO: Honorable Mayor and City Council
FROM: Ana V. Sauseda, Director of General Services/City Clerk SUBJECT: Yucaipa Disposal 2024 Annual Report, Solid Waste Rate Adjustment, Annual Single - Family Residential Property Tax Roll Billing for Fiscal Year 2025-26 RECOMMENDATION:
That the City Council conduct a public hearing and subsequently:
1. Receive the 2024 Solid Waste Annual Report from Yucaipa Disposal; and
2. Approve the Residential Rate Adjustments, recommended by the Solid Waste Committee, implementing an increase of 1.9% resulting in a 15-gallon rate increase of $0.48 (from $25.26 to $25.74), 30-gallon rate increase of $0.60 (from $31.96 to $32.56) and a 60-gallon rate increase of $0.80 (from $42.23 to $43.03) and
3. Approve the proposed Commercial Refuse Rate Adjustment, which includes Food Waste and Recycling (Recommended by Solid Waste Committee); and
4. Adopt Resolution No. 2025-17, approving the rates and requesting the County of San Bernardino to place collection of costs for single-family residential solid waste, organic waste, and recycling services for Fiscal Year 2025-2026 on the County of San Bernardino property tax roll pursuant to Chapter 8.28 of the Yucaipa Municipal Code.
BACKGROUND/DISCUSSION:
Pursuant to the California Supreme Court Decision in 2006, refuse collection rates are subject to Proposition 218 requirements. To comply with the requirements of Prop 218, the City must conduct a public hearing not less than 45 days after mailing the notice, which must include the amount of the highest proposed fee; the basis upon which the fees were calculated; the reason for the fees; and the date, time and location of the public hearing on the proposed fees. Yucaipa Disposal (YD) mailed out notices to Yucaipa customers by April 22, 2025 (Attachment 4). If written or verbal protests against the proposed fees are not presented by a majority of parcel(s) owners, the City may authorize the proposed fee increases.
On April 7, 2025, members of the Solid Waste Ad -Hoc Committee (Committee) met with City staff and representatives of Yucaipa Disposal to review and discuss the 2024 Annual Report, proposed rates for Fiscal Year 2025-26 (FY26), and SB 1383 program updates.
The following details the issues discussed at the Committee meeting:
2024 Annual Report (AR)
The AR (Attachment 2) focuses on YD's performance and quality of service over the prior year.
Issues discussed in terms of the AR include:
Commercial Food Waste Bin and Barrel Service — AB 1826 mandates organics recycling services (MORe) for certain commercial and multi -family establishments. In 2018 and 2020, the City adopted ordinances to meet the State mandates, which require all businesses generating more than 4 cubic yards (in 2018) and 2 cubic yards (in 2020) of solid waste per week to recycle organics. As of December 2024, there are 142 commercial customers subscribed to food waste recycling compared to 145 customers in 2023. The marked increase is reflective of SB1383 organics diversion implementation. YD continues to coordinate with City staff to address account compliance statuses as needed.
Recycling Revenues, Processing Fees, and Contamination — The commercial and residential recycling revenues and processing fees comparisons from 2022 to 2024 are located on pages 6 - 7 of the AR. The commercial commingled recycling revenues (Table 8) increased over the prior year from $86,473.09 in 2023 to $100,851.75 in 2024. The residential commingled recycling revenues (Table 9) increased over the prior year from $65,213.25 in 2023 to $119,076.38 in 2024. Residential recycling revenue is based on the recyclables recovered and sold from the blue barrels. The 2024 processing fees of $589,276.55 to sort residential commingled recyclables and dispose of all residential recycling residue (trash) creates an overall net cost of $470,200.17.
In addition, residential contamination (Table 10) increased from 36% in 2023 to 39% in 2024. Total residue tons increased from 2,105.81 tons in 2023 to 2,374.12 tons in 2024. The Committee is recommending ongoing public education and outreach programs to minimize contamination along with running the "Right Stuff' campaign for another year.
SB 1383 Compliance - SB 1383 mandates that every city must purchase a specific amount of recovered organic waste products (ROWP) annually to meet their procurement targets.
AB 1985 created a phase -in timeline for jurisdictions to procure the quantity of recovered organic waste products required by SB 1383 regulations. For 2024, 65 percent of the jurisdiction's procurement target is required and was attained (Table 6). For 2025, 100 percent of the procurement target is required and equivalent to 2,581 tons of compost.
Proposed Commercial & Residential Rate Adjustments — FY26 Per the City Council adopted rate -setting procedures, which are detailed in Section 17(C) of the current FA, the annual adjustment of rates is implemented July 1st of each year. Pursuant to the FA, the annual rate adjustment is based on: (1) increase/decrease in the landfill fee charged by the County of San Bernardino or other authorized landfill; (2) Operator fee shall be adjusted by 90% of the annual change in the Consumer Price Index (CPI) for the prior calendar year; and (3) recycling rate adjustments based on collection, transportation, processing, non -recyclable disposal, community education, state/county/city reporting and recyclable revenue credits.
The proposed residential rate, recommended by the Committee, would implement an increase of
1.9% resulting in a 15-gallon rate increase of $0.48 (from $25.26 to $25.74), 30-gallon rate increase of $0.60 (from $31.96 to $32.56) and a 60-gallon rate increase of $0.80 (from $42.23 to $43.03). The Committee is also recommending the various commercial rates outlined in Resolution No. 2025-17 — Exhibit A.
Single -Family Residential (SFR) Tax Roll Billing
On March 11, 2019, the City adopted Ordinance No. 373, amending Chapter 8.28 of the Yucaipa Municipal Code, to include provisions pertaining to County of San Bernardino property tax -roll billing for SFR solid waste, organic waste, and recycling service fees. As depicted in Table 1 of the AR, a total of 13,147 residential customers paid for services through tax roll billing and 654 customers pre -paid to prevent the fees from going on their tax bill.
Tax roll billing provides an efficient and streamlined billing method and addresses delinquent service fee collections. Over the past 6 years, the solid waste lien list for SFR has had a significant reduction in delinquencies, as detailed below:

Resolution No. 2025-17 requests that the County of San Bernardino place the collection of costs for SFR solid waste, organic waste, and recycling services for FY26 on the County of San Bernardino tax roll, pursuant to Yucaipa Municipal Code Chapter 8.28. Upon Council approval of the residential rate adjustments and Resolution No. 2025-17, residents will pay refuse collection charges for the July 1, 2025 — June 30, 2026, service period when they remit their property tax payments to the San Bernardino County Auditor/Controller Treasurer/Tax Collector office, typically in October 2024 and April 2025. Residents will also have the option to pay the annual costs up front (payment must be received by YD on/before July 11, 2025) to avoid payments via tax roll billing.
Franchise Fee to Remain Unchanged
The City Council approved an increase to the Franchise Fee on June 24, 2024. There is no recommended change to the Franchise Fee for FY26.
Representatives from YD will present the 2024 Annual Report, program updates, and will respond to any questions that the Council may have.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.

3 C. Mandatory Commercial Recycling (AB341) and Mandatory Organics Recycling (AB 1826)
In October 2009, a subsidy program for commingled recycling services was launched.
This program allows businesses, mobile home parks, and multi -family facilities that subscribe to trash bin services to receive a recycling barrel or bin at no additional cost.
This initiative supports state legislation AB 341, known as Mandatory Commercial Recycling (MCR), with the corresponding City Ordinance No. 314 that became effective on July 1, 2012. The table below shows the AB 341 status as of December 31, 2024.

The all-inclusive program, where recycling services are provided without extra charges, continues to be an ideal solution for businesses and multi -family establishments. The costs of recycling are included in the trash service, creating financial incentives based on avoided trash disposal fees and allowing for more accurate tracking of recycling and diversion activities.
In July 2016, the commercial food waste recycling program was initiated in response to the Mandatory Organic Recycling (MORe) legislation, AB 1826, which took effect on April 1, 2016. AB 1826 mandates organics recycling services for certain commercial and multi- family establishments. Table 4 provides the AB 1826 Compliance Snapshot as of December 31, 2024.

3 Compliance Monitoring & Enforcement
SB1383 requires the City's designee to monitor compliance through the use of compliance reviews, route review, investigation of complaints, and inspections.
Specifically, generators shall not place prohibited container contaminants in a collection container and shall subscribe to the appropriate waste diversion programs.
SB1383 also mandates that jurisdictions have an inspection and enforcement program that is designed to ensure overall compliance. Jurisdictions must complete an annual compliance review of all solid waste collection accounts.
In 2024, Yucaipa Disposal conducted route reviews for 6% of the residential and 10% of the commercial/multi-family sectors. Yucaipa Disposal will continue to work cooperatively with city staff to maximize voluntary compliance in residential, commercial, and multi -family sectors. Attached in Exhibit D is a copy of the 2024 Route Review Reports.
Education, Outreach, & Community Involvement
Throughout the year, Yucaipa Disposal prepared and distributed outreach materials to residential, commercial, and multi -family customers. These informative newsletters outlined the requirements for Mandatory Organics Recycling (SB 1383) and were readily available in digital format for convenience. To enhance community engagement, Yucaipa Disposal also mailed postcards promoting Compost Giveaways and flyers regarding food waste prevention and tips. For your reference, copies of the newsletters and all other outreach materials can be found in Exhibit B.
The education and outreach topics covered in the newsletters included, but were not limited to, the following:
• Free Compost and Mulch Giveaway details
• Shred and Compost event details
• Edible Food Recovery Requirements and responsibilities for certain businesses • Detailed information explaining the environmental impacts associated with the landfill disposal of organic waste, including methane reduction benefits • Information on the organic waste generator's requirements to properly separate materials in appropriate containers for both residential and commercial customers
• Green Barrel cutouts featuring a QR code that links to an informative video on food waste recycling were mailed out to encourage residents to recycle at home • Food waste prevention and tips for both businesses and residences that included public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters.
Additional community involvement information is included in Table 19.

9 In 2024, Yucaipa Disposal developed four residential and three commercial and multi- family newsletters. The residential and commercial newsletters were also readily accessible online through Burrtec's website. This is part of our standard Public Outreach and Education Program. With the reinforcement of SB1383 programs, additional outreach materials were distributed that included general information on organic recycling, the benefits of organic recycling, and edible food recovery. Additionally, tutorial videos and best practices for residential, commercial, and multi -family food waste recycling were posted on Burrtec's social media channels.
Newsletters highlight Yucaipa Disposal's programs, compost giveaways, and emphasize recycling opportunities for residential and commercial customers. Copies of the newsletters are included in Exhibit B.
Throughout 2024, Yucaipa Disposal participated in a variety of community events and outreach activities to promote SB1383 organic waste program elements. These activities are summarized in Table 19.

Public street sweeping services commenced in July 2019, with the aim of removing all debris from approximately 588 miles of curbs on designated residential, collector, and arterial streets.
Table 20 provides a detailed breakdown of the tons of sweeping debris collected throughout 2024.
11 Currently, 42 mobile home parks have subscribed to solid waste service, out of which 38 use bin service while three use both barrel and bin service. The mobile home parks have been successfully implementing their recycling programs. It is worth noting that all of these 42 mobile home parks continue to make available both recycling service and organics waste service to their residents.
Table 23 shows the three-year trend for mobile home park recycling and organic waste services subscriptions.

Electronic Waste (E-waste)
Electronic waste may contain potentially toxic substances such as lead, copper, and other heavy metals. This is why they must be disposed of properly! Electronic waste, or e-waste, may include computers, monitors and televisions. Residents may place e-waste items out with their bulky items for pickup. Please do not place e-waste in any of the barrels. Please Contact our Customer Service Department for more information.
State Required Contamination
Monitoring of Recyclables
California state law SB 1383 requires jurisdictions to monitor trash, recycling, and organics barrels to minimize contamination. Please review the "What Goes Where" guide for reminders of acceptable items in each barrel. Recycling loads containing unacceptable items may be rejected for processing and sent to the landfill, which eliminates the recycling programs benefits. High contamination of your recyclables could result in increased processing costs which may impact your trash and recyclables collection fees. Sorting information is available on the Burrtec website http://www.burrtec.com or call Burrtec Customer Service at (909) 797-9125 for assistance. As always, thank you for your continued support and cooperation!

SENATE BILL 1383
The California Senate passed a bill requiring a 75% reduction in organic waste disposal by 2025.
All residences and commercial businesses will be required to participate in this program to recycle organic waste, including food waste.
SCAN TO LEARN MORE
Organic waste that decomposes in a landfill releases a significant amount of greenhouse gas emissions that contribute to public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters. By composting organic waste, instead of sending it to landfills, we can close the loop on sustainability while creating a nutrient -rich soil amendment that's ready for use in farms and gardens.
TIPS TO PREVENT FOOD WASTE AT HOME
• Plan ahead: Before you go to the grocery store or order out check the fridge and pantry for anything that needs to be cooked or that you already have and do not need to purchase. • Serve smart: Aim to cook and serve the right portions for the number of people you are feeding.
• Store food wisely: Different foods require different conditions. • Check your fridge often: Keep track of what you have and what needs to be used. Eat or freeze items before you need to throw them away.
• Use your freezer Your freezer can help save your food and time.
Your recycling efforts contribute to the reduction of greenhouse gas emissions in Iandfilled organic waste. This includes methane, a greenhouse gas 80 times more potent than carbon dioxide.
Tear off here, save and place on your fridge!
REMINDER: RECYCLE RIGHT!

CITY OF YUCAIPA
NOTICE OF PUBLIC HEARING
MODIFICATION AND ADJUSTMENTS OF RATES FOR SOLID WASTE SERVICES IN ACCORDANCE WITH SECTION 6(a) OF ARTICLE XIIID OF THE CALIFORNIA CONSTITUTION (PROPOSITION 218) & GOVERNMENT CODE SECTIONS 53755 & 53756, NOTICE IS HEREBY GIVEN THAT the City Council of the City of Yucaipa will conduct a public hearing at its regularly scheduled meeting on June 9, 2025, at 6:00 p.m. or as soon thereafter as it may be heard. The meeting will take place in the City Council Chambers at City Hall, located at 34272 Yucaipa Blvd, Yucaipa, CA 92399. At the public hearing, the Council will consider the adoption of a resolution to approve modifications and adjustments to solid waste service fees commencing Julyl, 2025.
INFORMATION ABOUT THE CHARGES
A. Basis upon which the charges were calculated — The City Council has previously determined that the collection and disposal of refuse in the City is a service to be performed by a private company, under an exclusive franchise agreement.
The monthly residential curbside collection charge is comprised of six components:
1. An amount for the administration and operation of automated curbside refuse collection service, which includes the provision of three collection carts; the option of either a 15, 30, or 60-gallon refuse cart, one 90-gallon recycling cart and one 60-gallon green & food waste cart, with weekly pick-up service,
2. An amount for the hauler to dispose of the refuse and process the green & food waste and recyclables (the "tipping fee"),
3. An amount to administer the State mandated requirements of Senate Bill 1383,
4. An amount to operate the curbside bulky item collection service,
5. An amount for the administration and operation of a Household Hazardous Waste Program, and
6. An amount to compensate the City for managing the solid waste franchise, including contract administration, compliance with state regulatory mandates, public outreach and education, illegal dumping and clean-up activities, and impacts to City infrastructure such as tree trimming and street repairs (the "franchise fee").
The monthly commercial collection charge is comprised of four components:
1. An amount for the administration and operation of commercial bin refuse and recycling collection service,
2. An amount for the hauler to dispose of the solid waste (the "tipping fee"),
3. An amount to administer the State mandated requirements of Senate Bill 1383, and
4. An amount to compensate the City for managing the solid waste franchise, including contract administration, compliance with state regulatory mandates, public outreach and education, illegal dumping and clean-up activities, and impacts to City infrastructure such as tree trimming and street repairs (the "franchise fee").
The charges represent the amount the City has negotiated with the private company franchisee for refuse collection services.
B. Reason for the charges — The City uses the refuse collection charges for the operation and administration of the refuse disposal, recycling, organics and household hazardous waste programs. The proposed increases per month represent the additional costs, as negotiated with the franchisee, to provide refuse, recycling, green waste, food waste, and manure collection service in compliance with state mandates. The proposed increases will be finalized after the public hearing but will not exceed the amounts set forth in this notice.
The 2025-2026 proposed increases are due to changes in the consumer price index (CPI), the San Bernardino County landfill tip fee, and declining recyclables commodity markets. In addition, rate adjustments are impacted by state diversion and compliance mandates related to organics and recyclables diversion programs that also include SB 1383 programming such as compliance monitoring, compost procurement, edible food recovery, contamination monitoring, and ongoing education.
C. Charge per parcel — The City proposes to adopt a revised Exhibit D that increases the residential curbside collection services charges for fiscal year 2025-2026 as follows:

The City also proposes to increase the charges for residential bin service and commercial bin service for fiscal year 2025-2026. A complete listing of all proposed charges for commercial and residential services is included with this notice. If you need assistance determining the charge for your property or parcel, please contact Yucaipa Disposal by calling (909) 797-9125.
WRITTEN REPORT
The City has caused a written report to be prepared and filed with the City Clerk regarding the proposed increased commercial and residential cart and bin collection service charges. The written report also provides data indicating the amount of cost, or estimated cost, to provide solid waste collection service and the revenue sources anticipated to provide the service. A copy of the written report will be available on the city website at www.yucaipa.gov and at City Hall by May 29, 2025.
PROPOSITION 218
Record Owners, as defined under Proposition 218, and tenants may respond to the proposed fees in writing prior to or during the public hearing. Consistent with the provisions of Proposition 218 and Government Code Section 53755, this notice has been mailed to the record owners of the property at the addresses as they appear on the latest equalized assessment roll. If you object to the proposed fees as described in this Notice you may file a written protest with the City at or before the time set for the public hearing.
Protests can be mailed or personally delivered to:
City of Yucaipa
Office of the City Clerk
34272 Yucaipa Blvd
Yucaipa, CA 92399
A valid protest must include:
1. The name of the person submitting the protest and their interest in the property (e.g. owner or tenant), and
2. Identification of the property by either assessor's parcel number or street address, and
3. A statement of protest ("I/we protest" will suffice), and
4. The original signature of the protesting owner or tenant (photocopies will not be accepted).
Please note that pursuant to Government Code section 53755(b) only one written protest will be counted per parcel. Multiple protests returned for a single property will be disallowed and the City Clerk will only accept one protest per property.
The City Clerk will determine the validity of all protests submitted and exclude any invalid protests from the final tabulation. The City Clerk may confer with the City Attorney in determining the validity of written protests. As part of this process, the City Attorney may view contested or suspect protest forms. The City Clerk's decision shall be final and binding.
PUBLIC HEARING
At the public hearing, the City will hear and consider all objections or protests to the proposed rate increases. All interested persons shall be afforded the opportunity to hear and be heard.
INQUIRIES: For any and all information relating to the proceedings, including relating to protest procedure, contact the City Clerk at (909) 797-2489. For all inquiries relating to the rate increase, method of calculation and proposed fees, contact Yucaipa Disposal at (909) 797-9125.

Occasionally, trucks pull away before cans have been completely replaced on the street, meaning they fall over on their sides.
I have family in Rancho Cucamonga, also served by Burrtec. Their rates are similar to those proposed here. Their neighborhoods are free from spilled refuse, and their cans appear to be in good condition.
One might suggest that I complain directly to Burrtec. I would if I was Burrtec's service provider does its job better.
Thank you for your consideration.

• Absence of Competitive Bidding:
Continuing sole -source relationship with Burrtec without exploring competitive bidding options or considering other service models denies the city the opportunity to secure better pricing or improved service standards.
Proposed Solutions:
• immediate Reassessment of Current increase:
Suspend the current rate increase and initiate a public review to assess its necessity, impact, and alignment with community expectations.
• Renegotiation of the Franchise Agreement:
Reopen negotiations with Burrtec to revise the agreement to include stricter caps on allowable rate increases, performance metrics tied to service quality, and greater public oversight provisions.
• Formation of a Solid Waste Services Review Committee:
Establish a citizen -Led committee composed of Yucaipa residents, business owners, and city staff to:
a Monitor Burrtec's service performance.
o Review and recommend changes to the current franchise agreement. • Explore alternative waste management models, ineludingcompetitive bidding or municipally -operated waste services.
o Ensure full public transparency for any future rate adjustments or service changes. • Increased Public Communication:
Require the City and Burrtec to provide clear, advance communication to ail residents regarding proposed changes in service rates or terms, and guarantee opportunities for public comment before decisions are finalized.
Yucaipa's residents and business owners deserve to have their voices heard, their needs prioritized, and their financial well-being considered in all public service agreements. I respectfully urge you to take swift action to address these concerns, protect the interests of your constituents, and restore trust in the citv's stewarrw-i-• •,f • • ~'al services.
Thank you for your attention to a ursunt matter.

DELIVERY AGREEMENT (WDA) CONTRACT RATE
The purpose of this letter is to notify you the FISCAL YEAR 2025-26 Final WDA rate of $42.07 per ton will be effective July 1, 2025 through June 30, 2026, for waste disposal services provided to your city pursuant to the WDA agreement with San Bernardino County.
The Department of Public Works — Solid Waste Management Division has calculated the Cost of Living Adjustment as prescribed in Amended Section 4.2(B) Calculation of Escalation of the amended WDA from June 2022 (Amendment). The Amendment provides that in no case will the adjustment to the WDA rate exceed 85% of the County's approved general public gate rate (without the current CDSDP recycling fee of $12.00). On April 25, 2023, the Board of Supervisors approved the current gate rate of $49.49 per ton.
No gate rate increase is proposed for Fiscal Year 2025-26. Therefore, the WDA rate for the upcoming fiscal year will remain capped at $42.07 per ton for 2025-26. The calculation worksheet is attached for your information.
The $42.07 per ton final Contract Rate will be applied to your July 2025 tonnage on your WDA credit accounts that will be billed approximately on August 15, 2025. If you have any questions about this notice or the rate calculation, please call me at (909) 386-8701 or Jennifer Munoz at (909) 387-1871.
Sincerely,
7i'Ga4..G 4./2&daeaufW
