AGENDA REPORT
DATE: June 23, 2025
TO: Honorable Mayor and City Council
FROM: Fermin Preciado, Director of Development Services / City Engineer L1( Fort F. P.

Benjamin Matlock, Deputy Director of Community Development / City Planner,✓ Ryan Miller, Housing & Economic Development Analys
SUBJECT: Declaration of Surplus Land: City -Owned Properties (APNs 0319-101-01, 0318-143- 12, Former 0319-012-20, 0319-371-10, 0319-271-58, Former 0319-253-13, 0321-142- 22)
RECOMMENDATION:

That the City Council:

1. Adopt Resolutions No. 2025-18, No. 2025-19, No. 2025-33, No. 2025-41, No. 2025-42, No. 2025-43, No. 2025-36, declaring City -owned properties as "Surplus Land" in accordance with the California Surplus Land Act (Government Code Sections 54220-54234); and

2. Direct the Interim City Manager or her designee to comply with the notification and disposition procedures outlined in the Surplus Land Act, including submittal of a notice to the California Department of Housing and Community Development (HCD).

BACKGROUND / DISCUSSION:

The City of Yucaipa holds fee title ownership to several real properties that were acquired through City Council action to support three major Capital Improvement Program (CIP) projects: the Avenue E Intersection Improvement Project, the County Line Road Project, and the Pendleton Low Water Crossing Project. While portions of these City -owned properties have been identified and/or recorded as public right-of-way in order to accommodate the necessary public improvements required to complete these CIP projects, the remaining portions of these City owned properties will no longer be needed for municipal purposes. As such, staff recommends initiating the Surplus Property Disposition process.

This action represents the first step in complying with the California Surplus Land Act (SLA), which requires a structured notification and offering process to eligible public agencies and housing entities. The City Council will have the opportunity to review and consider the disposition of each individual property at a future meeting. Only the City Council holds the authority to purchase or sell City -owned property.

The subject properties were acquired through negotiated transactions authorized by the City Council.

Following a staff review, these sites have been deemed suitable for disposition in accordance with the SLA.

Under the SLA, public agencies must formally declare properties as either "Exempt Surplus Land" or "Surplus Land" before initiating a sale. For properties declared "Surplus Land," as is the case here, the City is required to notify a list of state -qualified entities, such as the California Department of Housing and Community Development, affordable housing developers, park and recreation agencies, and school districts, to offer the properties for public -benefit use.

If an eligible entity expresses interest, it must submit a Letter of Intent (LOI) to the City. Upon receipt, staff will review the LOI and schedule a Closed Session meeting of the City Council to discuss any proposals that are received. If a proposal is deemed feasible, and Council provides direction to proceed after it's review, staff will prepare a formal response and initiate good faith negotiations, which are required to continue for a minimum of 90 days.

In 2019, Assembly Bill 1486 significantly expanded the SLA's requirements, placing greater emphasis on transparency and prioritizing the development of affordable housing. If negotiations proceed with an affordable housing developer, additional oversight and documentation is required by the California Department of Housing and Community Development (HCD), that may potentially extend the timeline. It is important to note that the full SLA process, from initial declaration to final authorization for disposition, can take up to 12 months per parcel or longer in rare cases. This duration may vary depending on the level of interest from eligible entities, the negotiation period, and HCD's review timeline for affordable housing projects.

Recognizing the potential length of the SLA process, staff suggests promptly beginning the process to stay on track with project close-out timelines and support the City's General Plan and it's broader Economic Development efforts.

The following parcels are recommended for declaration as "Surplus Land":

In accordance with the Surplus Land Act:
• The properties must first be declared either "Exempt Surplus Land" or "Surplus Land."

• Upon declaration as "Surplus Land," the City must send a Notice of Availability (NOA) to a list of entities specified by the HCD, including affordable housing developers and public agencies. • If an eligible entity expresses interest, the City must enter into a good faith negotiation period of at least 90 days.
• If no agreement is reached, the City may move forward with the disposition of the property upon receiving the notice to proceed from the HCD, subject to all applicable provisions of the Surplus Land Act (SLA).

If approved as presented today, the declaration of these properties as "Surplus Land" is the first step in compliance with the SLA and allows the City to proceed with necessary notices and potential disposition strategies.

If no offers are received, or if a Letter of Intent (LOI) is submitted but the proposed project is determined to be unviable (due to factors such as property size, infrastructure limitations, or other economic challenges) the HCD will notify the City that it may proceed with disposing of the property at fair market value to the general public. At that time, staff will approach City Council for directions on how to move forward with the disposition.

There is no immediate fiscal impact to the General Fund from declaring these properties as Surplus Land. Any future revenue from their sale will be credited to the CIP Project funding source used for the original acquisition. In addition, all sale proceeds will be evaluated and presented to the City Council for consideration upon completion of the statutory process.

FISCAL IMPACT:

The recommendations do not result in a fiscal impact.
