Item No. 13

AGENDA REPORT
DATE: June 23, 2025
TO: Honorable Mayor and City Council
FROM: Megan Wolfe, Director of Community Services
Sarah Martinez, Community Services Recreation Superintendent SUBJECT: Community Services User Fees
RECOMMENDATION:

That the City Council conduct a Public Hearing and subsequently approve Resolution No. 2025-35, rescinding Resolution No. 2024-45, and adopting an update to the Community Services User Fee Schedule and amending fees and charges for services rendered in relation to Community Services and making related determinations pursuant to the California Environmental Quality Act.

BACKGROUND/DISCUSSION:

The Community Services Department (CSD) is committed to offering quality programs and services at competitive rates while simultaneously meeting the needs of the community and maximizing participation.

On June 24, 2024, City Council conducted a Public Hearing and adopted Resolution No. 2024-45, pertaining to various Community Services User Fees (CSUF). Since then, costs have increased to operate some of the programs and services resulting in the need to increase CSUF.

A Public Hearing is required for revisions to the CSUF. The Public Hearing notices were published in the Yucaipa News Mirror on June 13, 2025, and June 20, 2025. Additionally, it was made available for public review at the City Clerk's Department public counter on June 12, 2025.

FISCAL IMPACT:

The CSUF schedule is the mechanism, which allows the CSD to recover costs for programs and services. The recommendation is consistent with the City Council's cost recovery directive.

RESOLUTION NO. 2025-35

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, RESCINDING RESOLUTION NO. 2024-45 AND ADOPTING

AN UPDATE TO THE COMMUNITY SERVICES USER FEE SCHEDULE

AND AMENDING FEES AND CHARGES FOR SERVICES RENDERED IN

RELATION TO COMMUNITY SERVICES (TAXPAYER PROTECTION

AND GOVERNMENT ACCOUNTABILITY ACT)
WHEREAS, the City of Yucaipa has conducted an analysis of services provided by the Community Services Department, the costs reasonably incurred in providing those services, the beneficiaries of these services, and the revenues produced by those paying fees and charges for special services; and
WHEREAS, certain current fees charged for services provided by the City do not fully recover the actual costs of providing such services; and WHEREAS, due to the consumer price index increase of approximately 2.5% since 2024 and the minimum wage increase in the subsequent years, actual costs of certain services have risen; and
WHEREAS, the proposed revised Community Services User Fees do not exceed the reasonable costs of providing services; and
WHEREAS, the City Council held a duly noticed public hearing on June 23, 2025, concerning the increase in Community Services User Fees.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YUCAIPA HEREBY RESOLVES AS FOLLOWS:

Section 1. The Community Services User Fee Schedule for various Community Services programs provided by the City is hereby amended to account for increased costs.

Section 2.

Adoption of Fees and Charges. The City Council hereby adopts the City of Yucaipa Community Services User Fee Schedule ("CSUF") as set forth in attached Exhibit "A" and incorporated by this reference. Unless otherwise stated in the CSUF, all CSUF shall be paid to the City by the customer prior to the City's performance of the requested services.

Section 3. The City Council finds that the CSUF does not exceed the reasonable costs of providing Community Services programs.

Section 4.

Repeal of Conflicting Resolutions. It is the desire of the City Council that all fees and charges for services, programs or products be set forth in one document for ease of reference. Accordingly, any and all provisions of prior Resolutions of the City Council establishing or modifying fees for the services, programs or products set forth in Exhibit "A," are hereby repealed and replaced as of the effective dates as set forth in Section 7 of this Resolution in the manner set forth in Exhibit "A;"

Page 1 of 2 ends

provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity. The City Council desires to clarify that in adopting this Resolution, it is acting only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect and are hereby restated for convenience so that all fees are set forth in one document.

Section 5. Policies and Procedures. Staff is hereby authorized and directed to establish policies and procedures for implementation and collection of CSUF.

Section 6.

Section 7.

CEQA. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the User Fees is merely establishing fees to meet operating expenses.

Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.

Section 8. Effective Date. The CSUF shall be effective on July 1, 2025.

Section 9. Certification. The Mayor shall sign this Resolution and the City Clerk shall attest and certify to the passage and adoption thereof.

PASSED, APPROVED and ADOPTED this 23rd day of June, 2025.
