SUBJECT: Acceptance of Contract Work — Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel Phase 2— Project No. 11098 RECOMMENDATION:
That the City Council:
1) Accept the contract work completed by IE General Engineering Inc. in the amount of $2,220,372 for the Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel Phase 2 — Project No. 11098 (Phase 2 Project); and 2) Authorize the recordation of the Notice of Completion for the Phase 2 Project; and 3) Accept the as -built documents for the Project.
BACKGROUND/DISCUSSION:
The Dunlap Boulevard Bridge Removal and Replacement Project at Wilson Creek Channel (Project) is an important drainage infrastructure project that removes a significant number of properties in the City's Dunlap area from the FEMA designated floodplain/floodway and is included in the adopted FY26 Capital Improvement Program (CIP). The Dunlap Boulevard Bridge over Wilson Creek was "under sized" and did not provide sufficient capacity for Wilson Creek to convey storm flows under Dunlap Boulevard. The Project included the removal and replacement of the Dunlap Boulevard Bridge at Wilson Creek Channel. The replacement bridge is taller and longer to allow more storm water to flow in the channel under the bridge, while maintaining vehicular (one way) and pedestrian access over the channel. This pedestrian access also provides connectivity to the existing multi -use trail along the north side of Wilson Creek from the south side of the channel.
The properties located between Oak Glen Road and the Wilson Creek Channel are currently being developed as a commercial center (Yucaipa Gateway Commercial Center). The Conditional Use Permit for this development project approved by the Planning Commission requires a third point of access to a public street in addition to the current existing access points on Oak Glen Rd and 14th Street. At the February 23, 2019, City Council Meeting, Council approved a development agreement between the City of Yucaipa and the developer of the Yucaipa Gateway Commercial Center. The agreement includes an obligation for the City to complete the removal and replacement of the Dunlap Boulevard Bridge. The Project satisfies both requirements. The Yucaipa Gateway Commercial
Center includes the development of a 92-room LaQuinta Hotel, fuel station, convenience store, car wash, Starbucks, and a proposed fast -casual restaurant located at the corner of Oak Glen Road and 14th Street.
The Project was completed in two phases. Phase 1 construction was completed and accepted by the City Council at the February 27, 2023, City Council Meeting. The Phase 1 improvements included the construction of the new bridge foundation, bridge structure and utility casings in anticipation of the utility relocations planned with the Phase 2 improvements. The Phase 2 improvements include the transfer of the existing utilities onto the new bridge structure, fabrication and installation of the steel trusses on the new bridge, Dunlap Boulevard intersection and drainage improvements, removal of the existing bridge, and construction of channel improvements under the new bridge.
After going through the public competitive bid process, on April 24, 2023, the City Council awarded the contract to IE General Engineering Inc. in the amount of $2,098,054 to complete the Phase 2 Project.
The City Council also approved a contract contingency amount of $275,000 for the Phase 2 Project, for a total construction contract budget in the amount of $2,373,054.
Prior to the Phase 2 Project, a significant amount of utility relocations were required to be completed.
These utility relocations were completed between February and November of 2023 by various utility agencies, including the relocation of a high-pressure gas transmission line and fiber optic communication lines within the new bridge structure. The construction of the Phase 2 Project began in November of 2023, immediately after the completion of this utility work. Subsequently, weather related delays were experienced during the construction as a result of winter weather and associated stormwater in Wilson Creek Channel, impacting access to work within the channel.
Staff inspections were performed during construction and upon completion to ensure that the work was completed in accordance with the plans and contract specifications. The work was not completed within the amount of contract working days, and as a result a total of $38,500 in penalties (liquidated damages) will be deducted from IE General Engineering's fmal payments(s) in accordance with the contract specifications. The contract work has been completed for a total cost of $2,220,372, which is under the authorized construction contract budget for the Project.
Several other CIP public infrastructure projects have been completed by the City over the past several years to promote economic development resulting in the development in this area of several commercial projects that provide benefits to residents such as sales tax revenue, employment opportunities and retail services. These private land development commercial projects include the following:
• SG Opal Commercial Center includes the development of a fuel station and convenience store, quick -service restaurant, and office space, an express carwash, and a 66-room hotel with a rooftop bar and restaurant at the corner of Oak Glen Road and 13th Street. • Sabbah Commercial Center includes the development of a fuel station and convenience store, car wash, 20EV(Tesla) covered charging spaces, quick -service restaurant and an office/retail building located on Oak Glen Road between 13th Street and 14th Street.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.
