RECOMMENDATION:
That the City Council:
1) Authorize the Interim City Manager to execute a contract, and the Interim City Manager or their designee to administer the terms of the contract to the lowest responsive bidder, Matich Corporation of Highland, CA, in the amount of $2,695,598 for the FY25/26 Pavement Rehabilitation Program, AC Berm Program and Patching Program — Project No. 11238; and
2) Approve the amounts of $130,000 for construction contract contingency and $65,000 for construction contract administration, surveying, staff time, and inspection, for a total construction budget in the amount of $2,890,598; and
3) Authorize the Interim City Manager or their designee to administer the distribution of the contract contingency; and
4) Approve the plans and specifications prepared for the contract for Project No. 11238.
BACKGROUND/DISCUSSION:
On April 28, 2025, the City Council approved the FY25/26 Pavement Management Program (PMP).
Included as a part of the PMP is the FY25/26 Pavement Rehabilitation Program (Rehabilitation Program), Asphalt Concrete Berm Program (AC Berm Program) and Patching Program. The approval and implementation of the PMP sub -programs are aimed at repairing, repaving and extending the service life of paved public streets maintained by the City in alignment with the adopted 2024 City Council goal to improve road maintenance.
The Rehabilitation Program includes repaving streets, and also includes the partial or full removal of existing pavement to prepare the streets for repaving. The AC Berm Program includes construction or reconstruction of asphalt berms to improve drainage on public streets, extending the useful life of the
street by preventing water from undermining the asphalt. The Patching Program includes removal and replacement of pavement sections where the soil/base underneath the pavement requires replacement, to improve the structural stability of the roadway prior to repaving.
Staff prepared the bid documents, plans and specifications for the FY25/26 Rehabilitation, AC Berm, and Patching Programs to be completed as one project (Project). The Project was publicly advertised for construction bids and on August 5, 2025, five (5) bids were received from contractors as follows:

On the basis of sealed competitive bids received after publicly advertising the Project, Matich Corporation of Highland, CA, is the apparent lowest responsible bidder. Staff has reviewed the bid documents and determined that the documents meet the requirements of the contract specifications.
Matich Corporation has completed similar work for the City in the past and their work has been deemed satisfactory. Consequently, staff recommends the award of the contract to Matich Corporation in the amount of $2,695,598. A contract contingency of $130,000 is recommended in order to accommodate for any required amendments to the contract work that arise from unanticipated field conditions.
Additionally, contract administration, inspections, surveying, and staff time costs are estimated to be $65,000. The total proposed Project construction budget totals $2,890,598.
FISCAL IMPACT:
The recommendations result in a fiscal impact of $2,890.598 which is included in the FY26 Budget in the Street Maintenance (PMP) Fund.

WITNESSETH, in this consideration of their covenants, the parties hereto agree as follows:
The contract documents for the Project shall consist of the Notice Inviting Sealed Bids, Instructions to Bidders, Proposal, General Specifications, Standard Specifications, Special Provisions, Plans, and all referenced specifications and appendices; together with this Agreement and all required bonds, insurance certificates, permits, notices, and affidavits; and also including any and all addenda or supplemental agreements clarifying, amending, or extending the work contemplated as may be required to insure its completion in an acceptable manner (collectively, the "Contract Documents"). The Contract Documents are made a part hereof as though fully set forth herein.
In consideration of such work, City agrees to pay Contractor and Contractor agrees to accept the sum of Two Million Six -Hundred and Ninety -Five Thousand Five -Hundred and Ninety -Eight Dollars and No/Cents, ($2,695,598.00) in the manner provided in the Contract Documents and subject to adjustment provided therein.
Concurrently with the execution of this Agreement, Contractor shall file with the City the bonds and certificates of insurance specified in the Contract Documents and subject to adjustment provided therein.
This Contract shall not be assigned without the written permission of the City Council.
IN WITNESS WHEREOF, the parties hereto have executed this instrument the day and year first above written.
