RECOMMENDATION:
That the City Council consider the following actions for emergency construction/maintenance services:
1. Approve and authorize the Interim City Manager to execute Contract Amendment No. 3 with Jeremy Harris Construction, Inc. (Jeremy Harris Inc.) in the amount of $70,000; and
2. Approve and authorize the Interim City Manager to execute Contract amendment No. 3 with MCC Equipment Rentals, Inc. (MCC Inc.) in the amount of $90,000; and
3. Approve and authorize the Interim City Manager to execute Contract amendment No. 3 with Three Peaks Corporation (Three Peaks) in the amount of $20,000; and
4. Authorize an amendment to the FY26 Budget of $180,000 for maintenance in the Engineering Division of the General Fund.
BACKGROUND/ DISCUSSION:
At the June 23, 2025 City Council Meeting, contract extensions and amendments were approved for the existing five (5) contracts for fiscal years 2026-2028. These contracts were originally approved in 2023 for on -call emergency construction/maintenance services, and these services have typically been utilized on as needed basis. These services have allowed the City to respond immediately to address public safety concerns related to public facilities maintained by the City such as roadways. As FY26 began, these contract extensions/amendments provided the funding levels in the amount of $20,000 for Jeremy Harris Inc., MCC Inc., Jeff Ott Constuction, Borden Excavating Inc. (Borden), and Three Peaks Corporation (Three Peaks).
On September 18, 2025, Tropical Storm Mario brought significant, intense rainfall to the region which resulted in flooding, and mud/debris flows in the Oak Glen community and northeasterly
portions of the City of Yucaipa along Oak Glen Road. Upon initial assessment of the impacted areas, City staff requested assistance from Jeremy Harris Inc. and MCC Inc. These resources and services were necessary to immediately begin emergency work to clear roadways and drainage facilities of mud/debris, and to re-establish emergency access and public access to City maintained roadways. Significant progress was made over the weekend, and work is anticipated to continue over the next week to ensure the roadways and drainage facilities are restored.
Mud and debris flows were primarily in two areas that required immediate emergency work: 1) Chagall Road adjacent to the Oak Glen Road Intersection; and 2) Oak Glen Road between Pendleton Road and the easterly City Limits. Emergency repair and maintenance costs are estimated in the amounts of $90,000 at Chagall Road, and $70,000 for Oak Glen Road.
Administratively, the City was prepared to immediately respond to the emergency. This item reloads the budget in order to be equally prepared should another emergency take place.
City staff is recommending that funding levels for all five of the on -call emergency construction/maintenance services be maintained at a minimum of $20,000 for future needs beyond what is necessary for this storm event. Due to on -call maintenance work performed previously by Three Peaks for approximately $20,000, a contract amendment in the amount of $20,000 is also recommended for Three Peaks. The remaining funding levels for the contracts with Borden and Jeff Ott Construction will remain at $20,000. Maintaining funding in these amounts will allow City staff to provide any future emergency construction/maintenance services with the quickest response time possible.
As with prior/recent emergency response work, City staff will continue to work with Ca1OES and other agencies for all required emergency work in an effort to apply for any emergency funding that may potentially result in the ability for the City to request future reimbursement for eligible expenditures.
FISCAL IMPACT:
The recommendations result in a FY26 budget amendment of $180,000 to the Engineering Division of the General Fund.
