ORDINANCE NO. 478

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, AMENDING TITLE 2 (ADMINISTRATION AND

PERSONNEL) OF THE YUCAIPA MUNICIPAL CODE TO CHANGE THE
TITLE OF THE OFFICE OF "MAYOR PRO TEMPORE" TO "DEPUTY
MAYOR" AND UPDATING ALL REFERENCES THERETO
WHEREAS, the City of Yucaipa is a general law city organized under the laws of the State of California; and
WHEREAS, Government Code Section 36801 requires the City Council to meet and choose one of its number as mayor and one of its number as mayor pro tempore; and WHEREAS, the term "Mayor Pro Tempore" acts as a Latin designation for the Councilmember who assumes the duties of the Mayor in their absence; and WHEREAS, the City Council desires to update the title of this position to "Deputy Mayor" to provide greater clarity to the public regarding the role and hierarchy of City Council leadership, and to align with modern terminology used by many local jurisdictions; and WHEREAS, the City Council finds that this change is strictly titular and does not alter the method of selection, term of office, or the substantive powers and duties of the position as established by state law and local ordinance.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YUCAIPA DOES ORDAIN AS FOLLOWS:

Section 1. RECITALS.

The City Council hereby finds that the recitals set forth above are true and correct and are incorporated herein as substantive findings of this Ordinance.

Section 2. AMENDMENT TO MUNICIPAL CODE
Title 2 (Administration and Personnel), Chapter 2.04 (City Council) of the Yucaipa Municipal Code is hereby amended to add a new Section 2.04.050 to read as follows:

2.04.050 Office of Deputy Mayor.

A. Title Change. The office and title previously designated as "Mayor Pro Tempore" or "Mayor Pro Tem" is hereby renamed and redesignated as "Deputy Mayor." B. Duties and Powers. The Deputy Mayor shall exercise all powers, duties, and responsibilities vested in the Mayor Pro Tempore by the laws of the State of California and the Yucaipa Municipal 02/09/2026 City Council Agenda 20

Code. The Deputy Mayor shall perform the duties of the Mayor during the Mayor's absence or disability.

C. Selection. The selection of the Deputy Mayor shall occur in the same manner and at the same time as the selection of the Mayor Pro Tempore was previously conducted, consistent with State law and City Council policy.

Section 3. GLOBAL CONSTRUCTION AND REFERENCES
On and after the effective date of this Ordinance, all references to "Mayor Pro Tempore" or "Mayor Pro Tem" contained in the Yucaipa Municipal Code, any uncodified ordinances, resolutions, Council policies, contracts, or other official documents of the City of Yucaipa shall be deemed to refer to the "Deputy Mayor." The City Manager and City Clerk are hereby authorized to make such technical and conforming changes necessary to implement the intent of this Ordinance.

Section 4. CEQA EXEMPTION
The City Council finds that the adoption of this Ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption) because it can be seen with certainty that there is no possibility that the renaming of a Council officer position may have a significant effect on the environment.

Section 5. SEVERABILITY
If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional.

Section 6. EFFECTIVE DATE
This Ordinance shall take effect thirty (30) days after its adoption. 02/09/2026 City Council Agenda 21
