SUBJECT: Professional Services Agreement Between the City of Yucaipa and San Bernardino County Department of Public Works - Surveyor for Land Survey Related Services
RECOMMENDATION:
That the City Council:
1. Approve and authorize the City Manager to execute a professional services agreement between the City of Yucaipa and the San Bernardino County Department of Public Works - Surveyor for land survey related services; or
2. Provide further direction to staff.
BACKGROUND/DISCUSSION:
The City's Development Services Department processes applications for lot line adjustments, lot mergers and proposed private development projects within the City, including subdivisions. In order to ensure compliance with the Subdivision Map Act, the City has historically worked with San Bernardino County Department of Public Works — Surveyor (County Surveyor) to facilitate the reviews of these applications. On March 23, 1998, the City of Yucaipa entered into an agreement with the County Surveyor for land survey related services. In addition to these services, this agreement also includes provisions for the County Surveyor to review land survey related documents to support the City's Capital Improvement Program (CIP).
The County Surveyor has continued to provide these services for the City of Yucaipa since 1998. The County Surveyor has recommended that an updated agreement be executed to continue these services, and to update the language with respect to the agreement expiration date, and updated fee schedule for services provided under the agreement. The fees associated with the cost for these services related to private (non -city) projects will be paid for directly by the applicants at cost rates as identified by the 02/23/2026 City Council Agenda
applicable County Surveyor fees in place when the survey services are provided. City staff has coordinated with the County Surveyor to prepare a new, updated agreement. The proposed agreement includes provisions similar to the terms of the 1998 agreement, as well as identifying a "not to exceed" amount of $25,000 per year for the County Surveyor to provide land survey related services to support the City's CIP projects on as -needed basis. Execution of the proposed agreement would not impact the adopted budget.
If approved, the proposed agreement will commence on the date signed and executed by both parties and the term of agreement is through June 30, 2030, with the option to extend the term for additional years upon written agreement by both parties. Extension(s) of the proposed agreement beyond 2030 could be administratively approved at the staff level, unless substantial revisions are proposed which would require City Council recommended.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.

MINUTES OF THE BOARD OF SUPERVISORS
OF SAN BERNARDINO COUNTY, CALIFORNIA
May 5, 1998
FROM: KEN A. MILLER, Director
Transportation/Flood Control - County Surveyor
SUBJECT: AGREEMENT WITH THE CITY OF YUCAIPA FOR SURVEYING SERVICES RECOMMENDATION: Approve agreement with City of Yucaipa for subdivision map review and other survey related services through June 30, 2003 in the estimated annual range of $10,000 to $30,000.
BACKGROUND: Under the terms and conditions of this proposed agreement, the County Surveyor shall perform the review and approval of subdivision maps for the City of Yucaipa and be compensated by subdividers whose projects are located within the City at current rates as identified by the San Bernardino County Fee Ordinance. Additional survey services requested by the City of Yucaipa will be billed directly to the City at the current departmental rate. This additional workload will allow the County Surveyor to maintain adequate professional staffing and provides the local surveying community continuity in the mapping process. The County Surveyor provided these same services from December 16, 1991 to June 30, 1997 under a previous Board approved agreement. Subsequent to the lapsing of this earlier agreement, the City considered other options in procuring survey services but decided to continue contracting with the County.
This agreement will be effective on the date of execution and will continue through June 30, 1998.
Unless terminated by action of the City or County, this agreement will be automatically renewed annually through June 30, 2003.
Section 66431 of the Government Code (Subdivision Map Act) provides that the County Surveyor may perform any or all of the duties of the City Engineer upon approval of their respective legislative bodies. Board of Supervisors approval is required per Section 66431 of the Government Code and County Policy No. 11-10.
Section 66442 and 66450 of the Government Code requires the review and approval of Final Maps and Parcel Maps as being technically correct. This is to be performed under the direction of the person authorized to practice land surveying pursuant to the Professional Engineers and Land Surveyors Acts of Division 3, Business and Professions Code. The current City Engineer for the City of Yucaipa is not authorized to perform this state mandated function. cc: Transportation — Ken Miller
