Honorable Mayor and City Council
Dr. Sean M. Moore, City
Ana V. Sauseda, Director of General Services/City Clerk Resolution Adopting Procedures for Voter Access to the Full Text of Legislative Acts Subject to the Referendums
RECOMMENDATION:
That the City Council:
1. Adopt Resolution No. 2026-04, Adopting Procedures for Voter Access to the Full Text of Legislative Acts Subject to the Referendums or;
2. Provide further direction to staff.
BACKGROUND/DISCUSSION:
On January 12, 2026, the City Council adopted Resolution Nos. 2025-61 and 2025-62 calling for a Special Municipal Referendum Election to be held on June 2, 2026.
In accordance with Section 4 (C) & (D) of Resolution Nos. 2025-61 and 2025-62, the City Clerk's Office submitted the adopted resolutions to the Board of Supervisors of the County of San Bernardino requesting their consent to consolidate the Special Municipal Election with the Statewide Primary Election on Tuesday, June 2, 2026, for the purpose of submitting to the voters the question relating to the City' s Measure and requesting election services from the San Bernardino County Registrar of Voters (ROV).
The ROV has requested express authorization by the City Council for the ROV to include the impartial analysis, arguments, and rebuttals in the voter information guide, and have the City Clerk provide a full copy of the relevant resolution, ordinance, and attachments (including several hundred pages of CEQA findings) to any interested voter upon request, as authorized by the Elections Code. Publication of the full resolution, ordinance, and attachments would be practically infeasible and financially prohibitive for the City.
02/23/2026 City Council Agenda
The City Council previously referenced California Elections Code Section 9280 in its order for the election, and authorized the election official to print an Impartial Analysis with a notation that there shall be printed immediately below the impartial analysis, in no less than 10-point bold type, a legend substantially as follows:
"The above statement is an impartial analysis of Ordinance or Measure . If you desire a copy of the ordinance or measure, please call the elections official's office at (insert telephone number) and a copy will be mailed at no cost to you."
The attached resolution amends the language from Resolution Nos. 2025-61 & 2025-62 to comply with the requests from the ROV.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.
