RESOLUTION NO.2026-03

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YUCAIPA, CALIFORNIA, RESCINDING RESOLUTION NO. 2024-07 AND

ADOPTING AN UPDATE TO THE COMPREHENSIVE USER FEE

SCHEDULE AND AMENDING FEES AND CHARGES FOR SERVICES

RENDERED IN RELATION TO COMMUNITY DEVELOPMENT,

BUILDING AND SAFETY, FIRE PREVENTION AND PLANNING,

BUSINESS LICENSE ADMINISTRATION, YARD SALE PERMITS,

FALSE ALARMS, CONSTRUCTION AND DEMOLITION RECYCLING,

AND VARIOUS OTHER GENERAL OR ADMINISTRATIVE CITY

SERVICES, AND MAKING RELATED DETERMINATIONS PURSUANT

TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
WHEREAS, the City Council has determined that it is necessary to assess fees for the process of private development related requests, planning, engineering, building and safety -related requests, and other services; and
WHEREAS, the City Council has conducted an extensive analysis of its services, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, the City Council has determined that City staff provides many types of services ("Services") involving requests by City customers ("Applicants"); and WHEREAS, the City currently imposes various user fees (the "User Fees") upon Applicants to recover the costs of staff time and other expenses related to providing these Services; and
WHEREAS, current User Fees charged for the City's Services do not adequately recoup the City's costs of providing certain Services and thus, a certain amount of these costs are currently paid out of the City's General Fund and, therefore, borne by the general public; and WHEREAS, the City Council desires to better recover the costs of providing these Services from Applicants who have sought the City's Services by revising its schedule of User Fees; and
WHEREAS, the proposed User Fees are based upon the information contained in a document by City staff and Consultant ("Consultant") entitled "User Fee Study", dated January 30, 2026; and
WHEREAS, pursuant to Government Code Sections 66016, 66017 and 66018, the specific fees to be charged for certain regulations, services and products must be adopted by resolution, following notice and public hearing; and
04/13/2026 City Council Agenda 278

WHEREAS, notice of public hearing has been given pursuant to Government Code Section 6062a, and written notice has been provided to interested parties who filed written requests for mailed notice of meetings on new or increased development -related fees or service charges; and
WHEREAS, the City Council conducted a duly noticed Public Hearing on February 9, 2026, at which time the public was invited to make oral and written presentations as part of the regularly scheduled meeting prior to the adoption of this Resolution; and WHEREAS, the City published notice of the public hearing as described above in accordance with Government Code Sections 6062(a), 66016, 66017 and 66018 for the various User Fees; and
WHEREAS, the approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment; and WHEREAS, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the Resolution is merely establishing fees to meet operating expenses.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YUCAIPA HEREBY RESOLVES AS FOLLOWS:

Section 1. Adoption of Fees and Charges. The City Council hereby adopts the City of Yucaipa Comprehensive User Fee Schedule ("CUFS" or "User Fee Schedule") as set forth in the attached Exhibit "A" and incorporated by reference, plus a 3.2% CPI increase applied to all fees. Unless otherwise stated in the User Fee Schedule, all User Fees shall be paid to the City by the Applicant prior to the City's performance of the requested Services.

Section 2. Repeal of Conflicting Resolutions. Resolution No. 2024-07 is hereby rescinded. It is the desire of the City Council that all fees and charges for services, programs or products be set forth in one document for ease of reference. Accordingly, any and all provisions of prior Resolutions of the City Council establishing or modifying fees for the services, programs or products set forth in Exhibit "A," are hereby repealed and replaced as of the effective dates as set forth in Section 7 of this Resolution in the manner set forth in Exhibit "A;" provided, however, that such repeal shall not excuse or affect the failure of any person or entity to pay any fee heretofore imposed upon such person or entity. The City Council desires to clarify that in adopting this Resolution, it is taking action only on those fees for the services, programs or products set forth in Exhibit A which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect and are hereby restated for convenience so that all fees are set forth in one document. 2 04/13/2026 City Council Agenda 279

Section 3. Policies and Procedures. Staff are hereby authorized and directed to establish policies and procedures for implementation and collection of User Fees.

Section 4. CEQA. The approval of the User Fees established in this Resolution does not constitute a "project" under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15378(b)(4) because such actions involve the creation of a government funding mechanism which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Furthermore, the approval of the User Fees established in this Resolution is statutorily exempt from CEQA under CEQA guidelines Section 15273 (a)(1) because the approval of the User Fees is merely establishing fees to meet operating expenses.

Section 5. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Resolution or any part hereof is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portion of this Resolution or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invalid or unconstitutional.

Section 6. Effective Date. All User Fees listed in the User Fee Schedule in Exhibit A — plus a 3.2% CPI increase applied to all fees - are effective July 1, 2026. This date is more than 60 days after approval of this Resolution for fees imposed on a development project and which apply to the filing, accepting, reviewing, approving or issuing of an application, permit, or entitlement, and more than 30 days after approval for all other User Fees listed in the User Fee Schedule in Exhibit A.

Section 7. Annual Inflation Adjustment. The User Fees attached as Exhibit "A" —plus a 3.2% CPI increase applied to all fees - will be effective on the dates set forth in Section 6, above, and shall thereafter be adjusted annually, beginning in 2027, to increase on July 1st of each year consistent with the year -over -year percentage increase in the CPI index for the most recently available month of CPI data for the Riverside - San Bernardino -Ontario area as published by the Bureau of Labor Statistics, or five percent (5%), whichever is lower. If the CPI does not change or goes down in a given year, no change shall be made to the User Fee Schedule that year unless a public hearing is held to consider amendment of fees. The City Manager, or City Manager designee, is hereby authorized to annually update the User Fees accordingly.

FEE SCHEDULE
FISCAL YEAR 2025-2026
(Effective as of January 1, 2026)

MASTER FEE SCHEDULE
Fiscal Year 2025-2026
The City of Rancho Cucamonga can impose fees under the authority granted by California Government Code Section 66000 et. Seq. Fees are allowed to be imposed in order to recover costs associated with the provision of specific services benefiting the user, thereby reducing the use of General Fund monies for such purposes.

The City of Rancho Cucamonga has established fees by authority of the Municipal Code, City Ordinances, City Resolutions, City development/funding agreements, and State and Federal statutes. As a matter of routine, City departments revisit fees at least once per year to ensure that minor adjustments can be made over time to keep up with operational and construction costs. Certain fees are adjusted annually by applying a fee escalator approved by prior resolutions to provide greater consistency and streamline the annual fee update process.

The annual fee adjustments will be effective on the first day of each fiscal year, July 1, as set forth in fee resolutions, and staff will update the Master Fee Schedule accordingly.

Fees included herein have been adjusted in accordance with previous City Council action and are effective as of January 1, 2026.

Cost index factors applied (effective July 1, 2025):

Cost index Price Index (CPI) at 2.5%
Employment Cost Index (ECI) at 4.7%
Engineering New Record (ENR) was not applied.
