Section 3. CEQA EXEMPTION: The adoption of this Resolution is exempt from the Requirements of the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b) and Section 15273 of the State CEQA Guidelines because the Resolution pertains to the adoption of rates necessary to maintain services within the City's existing service area.

The rates adopted above are based upon the cost assumptions and rate schedule set forth in Exhibit "A." The City Council acknowledges that the County of San Bernardino is currently considering approval of a Waste Disposal Agreement ("WDA") that may reduce certain disposal costs applicable to solid waste services within the City. In the event the WDA is approved and such approval results in a reduction of the costs underlying the rates adopted herein, the City Manager, or designee, is authorized and directed to implement the corresponding reduced rates identified in the "2026 Proposed Rate wl WDA" column of Exhibit "A," without further action of the City Council, effective upon the date such reduced rates become applicable under the franchise agreement and supporting rate calculations.

The City Council finds that any such adjustment constitutes a reduction in rates previously approved by the City Council and shall not result in any customer being charged an amount greater than the rates adopted by this Resolution. The City Manager, or designee, shall update Exhibit "A" administratively to reflect the applicable reduced rates and shall maintain the revised exhibit in the official records of the City.
