CITY OF
STAFF REPORT
Item No. 21
DATE: June 8, 2026
TO: Honorable Mayor and City Council
FROM: Dr. Sean M. Moore, City Manager
PREPARED BY: Ana V. Sauseda, Director of GerieraI Services/City Clerk, kJ SUBJECT: Yucaipa Disposal 2025 Annual Report, Solid Waste Rate Adjustment, Annual Single -Family Residential Property Tax Roll Billing for Fiscal Year 2026-27 RECOMMENDATION:
That the City Council conduct a public hearing and subsequently:
Receive the 2025 Solid Waste Annual Report from Yucaipa Disposal; and
2. Discuss the Solid Waste Rates for Fiscal Year 2026/2027; and Adopt Resolution No. 2026-13, approving the rates and requesting the County of San Bernardino to place collection of costs for single-family residential solid waste, organic waste, and recycling services for Fiscal Year 2026-2027 on the County of San Bernardino property tax roll pursuant to Chapter 8.28 of the Yucaipa Municipal Code; or
4. Provide further direction to staff.
BACKGROUND/DISCUSSION:
Pursuant to the California Supreme Court Decision in 2006, refuse collection rates are subject to Proposition 218 requirements. To comply with the requirements of Prop 218, the City must conduct a public hearing not less than 45 days after mailing the notice, which must include the amount of the highest proposed fee; the basis upon which the fees were calculated; the reason for the fees; and the date, time and location of the public hearing on the proposed fees. Yucaipa Disposal (YD) mailed out notices to Yucaipa customers by April 21, 2026 (Attachment 5). If written or verbal protests against the proposed fees are not presented by a majority of parcel(s) owners, the City may authorize the proposed fee increases.
On March 30, 2026, members of the Solid Waste Ad -Hoc Committee (Committee) met with City staff and representatives of Yucaipa Disposal to review and discuss the 2025 Annual Report, proposed rates for Fiscal Year 2026-27 (FY26/27), and SB 1383 program updates.
The following details the issues discussed at the Committee meeting:
2025 Annual Report (AR)
The AR (Attachment 2) focuses on YD's performance and quality of service over the prior year.
Issues discussed in terms of the AR include a Summary of the Years Activities, Revenue Statements, Program Highlights, AB 939 Reporting Requirements, etc.
Proposed Commercial & Residential Rate Adjustments — FY26/27 Per the City Council adopted rate -setting procedures, which are detailed in Section 17(C) of the current FA, the annual adjustment of rates is implemented July 1 st of each year. Pursuant to the FA, the annual rate adjustment is based on: (1) increase/decrease in the landfill fee charged by the County of San Bernardino or other authorized landfill; (2) Operator fee shall be adjusted by 90% of the annual change in the Consumer Price Index (CPI) for the prior calendar year; and (3) recycling rate adjustments based on collection, transportation, processing, non -recyclable disposal, community education, state/county/city reporting and recyclable revenue credits.
This year, YD is recommending an increase to the various commercial rates outlined in Resolution No. 2026-13 — Exhibit A and no increase to residential rates however, there was no official recommendation from the Committee.
Single -Family Residential (SFR) Tax Roll Billing
On March 11, 2019, the City adopted Ordinance No. 373, amending Chapter 8.28 of the Yucaipa Municipal Code, to include provisions pertaining to County of San Bernardino property tax -roll billing for SFR solid waste, organic waste, and recycling service fees. As depicted in Table 1 of the AR, a total of 13,345 residential customers paid for services through tax roll billing and 665 customers pre -paid to prevent the fees from going on their tax bill.
Tax roll billing provides an efficient and streamlined billing method and addresses delinquent service fee collections. Over the past 6 years, the solid waste lien list for SFR has had a significant reduction in delinquencies, as detailed below:

Resolution No. 2026-13 requests that the County of San Bernardino place the collection of costs for SFR solid waste, organic waste, and recycling services for FY26/27 on the County of San Bernardino tax roll, pursuant to Yucaipa Municipal Code Chapter 8.28. Upon Council approval of the residential rate adjustments and Resolution No. 2026-13, residents will pay refuse collection charges for the July 1, 2026 — June 30, 2027, service period when they remit their property tax payments to the San Bernardino County Auditor/Controller Treasurer/Tax Collector office, typically in October 2026 and April 2027.
Residents will also have the option to pay the annual costs up front (payment must be received by YD on/before July 10, 2026) to avoid payments via tax roll billing.
Franchise Fee to Remain Unchanged
The City Council approved an increase to the Franchise Fee on June 24, 2024. There is no recommended change to the Franchise Fee for FY26/27.
Representatives from YD will present the 2025 Annual Report, program updates, and will respond to any questions that the Council may have.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.

WHEREAS, the City of Yucaipa has adopted an exclusive franchise agreement ("Agreement") with Yucaipa Disposal, Inc. ("Yucaipa Disposal"); and WHEREAS, under the Agreement, Yucaipa Disposal provides solid waste collection services for the City of Yucaipa; and
WHEREAS, pursuant to the provisions of State law, including but not limited to Health & Safety Code Sections 5470 et seq., the City of Yucaipa may adopt and implement fees and charges to cover the cost of collection of solid waste within the City and, when adopted, may collect such fees for residential service on the property tax rolls; and WHEREAS, the City desires to adopt and implement such fees and charges to cover the cost of collection of solid waste within the City and;
WHEREAS, the proposed solid waste fees are set out on Exhibit "A", attached and incorporated hereto; and
WHEREAS, a written report of prospective solid waste collection fees has been prepared and filed with the City Clerk; and
WHEREAS, on June 8, 2026, the City Council conducted a duly noticed public hearing and heard all comments/protests regarding the solid waste fees; and WHEREAS, the City Council finds from such reports that the amount of fees is the reasonable cost of service provided, plus direct and indirect overhead; that amounts collected will be used only for immediately available (and not standby) solid waste collection services; that such fees and charges are proportionate to the amount of service received, and that such fees and charges are not for traditional governmental services such as police, fire, or libraries; and WHEREAS, the City Council further finds that this increase in rates is for the purpose of meeting operating expenses, including wage rates and fringe benefits, required for the collection of solid waste within the City pursuant to its existing franchise, and that such action therefore is statutorily exempt from CEQA under Public Resources Code Section 21080(b) and Section 15273 of the CEQA guidelines.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YUCAIPA HEREBY RESOLVES AS FOLLOWS:
Section 1. The Recitals set out above are true and correct and are a substantive part of this Resolution.

Section 3. CEQA EXEMPTION: The adoption of this Resolution is exempt from the Requirements of the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b) and Section 15273 of the State CEQA Guidelines because the Resolution pertains to the adoption of rates necessary to maintain services within the City's existing service area.

As of December 2025, there were 489 single-family customers and 95 multi -family and mobile home park customers who were using the 15-gallon trash barrel option. This option is available as a cost -saving alternative for low -volume residential trash generators while also maximizing recycling and waste reduction efforts. A list of the mobile home parks and their current services is included in Exhibit A. Additionally, there are special services available, which include accounts with extra trash, extra recycling, and/or extra organic waste barrels, livestock manure waste, as well as accounts with bear -resistant barrels.
There are 32 direct bill residential barrel customers that were not included in the 2025 tax roll billing for one of the following reasons: vacant property/non-billed account at the time of tax roll submittal, new residential service started after tax roll submittal, or residential service level changes during the tax roll year.
B. Commercial and Multi -family (5+) customers may select from a range of barrel sizes, including 30-gallon barrel, 60-gallon barrels, and containers ranging from 1.5 cubic yards to 40 cubic yards. Depending on the customer's needs, service can be provided once a week or up to six times a week. Additionally, customers can choose from various service options, including trash, recycling, green waste, organic and food waste. Table 2 summarizes the containers provided as of December 31, 2025.

1 C. Mandatory Commercial Recycling (AB341) and Mandatory Organics Recycling (AB 1826)
In October 2009, a subsidy program for commingled recycling services was launched.
This program allows businesses, mobile home parks, and multi -family facilities that subscribe to trash bin services to receive a recycling barrel or bin at no additional cost.
This initiative supports state legislation AB 341, known as Mandatory Commercial Recycling (MCR), with the corresponding City Ordinance No. 314 that became effective on July 1, 2012. The table below shows the AB 341 status as of December 31, 2025.

The all-inclusive program, where recycling services are provided without extra charges, continues to be an ideal solution for businesses and multi -family establishments. The costs of recycling are included in the trash service, creating financial incentives based on avoided trash disposal fees and allowing for more accurate tracking of recycling and diversion activities.
In July 2016, the commercial food waste recycling program was initiated in response to the Mandatory Organic Recycling (MORe) legislation, AB 1826, which took effect on April 1, 2016. AB 1826 mandates organics recycling services for certain commercial and multi- family establishments. Table 4 provides the AB 1826 Compliance Snapshot as of December 31, 2025.

To remove barriers to participation, the City adopted a subsidized rate structure for food waste recycling bins, offering them at rates comparable to those for trash bins. The program's implementation involved customer identification, outreach, and development efforts.
In December 2020, the City approved a mandatory organics recycling program (Ordinance No. 398) requiring all businesses that generate more than two cubic yards of solid waste per week to recycle organics, as mandated by MORe.
D. Short -Lived Climate Pollutant Reduction Strategy SB 1383 Senate Bill 1383 is intended to improve air quality by reducing greenhouse gas emissions from the disposal of organic waste, including food and landscape waste. The bill also encourages the recovery and redistribution of edible food, the preservation of natural resources, and the conservation of limited landfill space. On January 10, 2022, the City of Yucaipa passed Ordinance No. 403 to implement the regulatory requirements.
Compliance
Yucaipa Disposal has sent educational and outreach materials to all residential, commercial, and multi -family customers regarding the Mandatory Organics Recycling requirements under SB 1383. Follow-up efforts included customer subscriptions and participation in required service programs.
The following table summarizes the City's SB 1383 status as of December 31, 2025, with 96% compliance. Yucaipa Disposal and city staff continue collaborating with new customers to meet state mandates.

24 Procurement
SB 1383 mandates that every City must purchase a specific amount of recovered organic waste products (ROWP) annually to meet their procurement targets. AB 1985 created a phase -in timeline for jurisdictions to procure the quantity of recovered organic waste products required by SB 1383 regulations. For 2025, 100 percent of the jurisdiction's procurement target is required and was attained. Please note that the procurement target and tonnage procured vary due to the products procured on behalf of the City.
Table 6 shows the completed procurement trend for the last three years.

Compliance Monitoring & Enforcement
SB1383 requires the City's designee to monitor compliance through the use of compliance reviews, route review, investigation of complaints, and inspections.
Specifically, generators shall not place prohibited container contaminants in a collection container and shall subscribe to the appropriate waste diversion programs.
M
SB1383 also mandates that jurisdictions have an inspection and enforcement program that is designed to ensure overall compliance. Jurisdictions must complete an annual compliance review of all solid waste collection accounts.
In 2025, Yucaipa Disposal conducted route reviews for 11.71 % of the residential and 28% of the commercial/multi-family sectors. Yucaipa Disposal will continue to work cooperatively with city staff to maximize voluntary compliance in residential, commercial, and multi -family sectors. Attached in Exhibit D is a copy of the 2025 Route Review Reports.
Education, Outreach, & Community Involvement
Throughout the year, Yucaipa Disposal proactively prepared and distributed outreach materials to residential, commercial, and multi -family customers. Our informative newsletters clearly outlined the requirements for Mandatory Organics Recycling (SB 1383) and were conveniently available in digital format. In addition, we successfully engaged the community by providing postcards promoting our Compost Giveaways and Bulky Item Pick Up week. For your convenience, copies of the newsletters and all other outreach materials are available in Exhibits B and C.
The education and outreach topics covered in the newsletters included, but were not limited to, the following:
• Free Compost and Mulch Giveaway details
• Shred and Compost event details
• Information about the state's required monitoring of recyclable contamination, including how monitoring is conducted and why it is essential. • Edible Food Recovery Requirements and responsibilities for different types of businesses.
• New adjusted rate reminder with a detailed list of barrel rates. • Detailed information explaining the environmental impacts associated with the landfill disposal of organic waste, including methane reduction benefits • Information on the organic waste generator's requirements to properly separate materials in appropriate containers for both residential, muti-family, and commercial customers.
• Food waste prevention and tips for both businesses and residences that included public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters.
• Street Sweeping Program details including reminders and resources. • Information about the Sharps Collection Program, including "What are Sharps?", "How to Obtain a Sharps Container", how to use a sharps container, and even "How to Create Your Own Sharps Container".
Additional community involvement information is included in Table 19.

To discourage scavenging of recyclables to third -party entities, Yucaipa Disposal will maintain its anti -scavenging program, focusing on educating commercial and multi- family businesses through strategic messaging aimed at reinforcing responsible recycling practices.
Table 13 includes a recap of both residential organics and commercial food waste tonnages collected and diverted from the County landfill. Some of the organic waste material that is processed into compost and mulch is used by Yucaipa residents and the City of Yucaipa as part of the organic waste recycling sustainability program, which helps support SB1383 procurement requirements.

0 Christmas tree recycling took place between December 26th and January 17th. During this time, the trees were collected through curbside collection for single family residents.
To ensure all customers had the same opportunity a special collection was arranged for the convenience of mobile home parks and multi -family complexes.
The collected Christmas trees were delivered to green waste processors to ensure they received diversion credit. Additionally, residents were offered special Christmas mulch on a first -come, first -served basis until the end of January at the Agua Mansa Material Recovery Facility.

In 2025, Yucaipa Disposal developed four residential and two commercial and multi- family newsletters. The residential and commercial newsletters were also readily accessible online through Burrtec's website. This is part of our standard Public Outreach and Education Program. With the reinforcement of SB1383 programs, additional outreach materials were distributed that included general information on organic recycling, the benefits of organic recycling, and edible food recovery. Additionally, tutorial videos and best practices for residential, commercial, and multi -family food waste recycling were posted on Burrtec's social media channels.
Throughout 2025, Yucaipa Disposal participated in a variety of community events and outreach activities to promote SB1383 organic waste program elements. These activities are summarized in Table 19, along with a list of outreach materials provided. 10 Table 19 — Outreach and Community Involvement_

BARRELS
The State of California has passed laws
regulating the disposal and processing
of Solid Waste including Trash,
Recyclables and Organics. In turn,
localjurisdictions have now mandated
the separate collection and processing
of these materials.
While metal bin containers are less
likely to be stolen, barrels can be
easily rolled away or placed in a
vehicle. Please keep barrels in a
locked enclosure/building or secure
them with a lock and chain to a fixed
structure until service day and re -
secure them once service is completed.
Please contact customer service to
provide your key/lock combination for
the container.

Attention Food Service Providers
Existing state law requires food establishments that provide trash containers for products purchased and consumed on the premises to also provide properly labeled containers for recyclables and organic waste (food waste). These containers must be placed adjacent to trash containers.
AB 827 applies to limited -service restaurants such as those restaurants where customers order and pay at the counter and bus their own tables after eating. The law will affect restaurants, malls, and other businesses that serve food. Full -service food establishments that do not provide access to trash containers for products consumed on the premises will be exempt, as food workers will likely separate post -consumer food waste and recyclables in the dish washing areas.
Highlights:
• AB 827 requires collection containers at the front -
of -house to be visible, accessible and labeled.
• This law affects businesses that sell products I10-
that are meant for immediate consumption.
• Full -service restaurants where employees bus
and clean tables are exempt but must provide
labeled collection containers adjacent to trash
containers for employees/staff to separate post -
consumer recyclables and organics.
For further information regarding this law, please visit https://www.calrecycle.ca.gov •°"=` State Required Contamination
Monitoring of Recyclables
California state law SB 1383 requires jurisdictions to monitor trash, IMPORTANT! recycling, and organics barrels to minimize contamination. Trash and other contaminants in the recycling or organics collection container(s) could result in a fee and non -collection due to contamination. If Cs` contamination is found, contamination tags (as shown to the left) will G,. ,,^`~ be affixed to the container. After ongoing contamination, customers may — be charged a contamination fee and the container will not be serviced as recyclable; it will be subsequently serviced as trash. Please note: the contamination fee will be automatically assessed if hazardous or bio- _ hazardous materials are placed in any collection container. Notsure about ®-6 what goes in each container? SENATE BILL 1383 ORGANICS DIVERSION AND RECYCLING /*
ARE YOU IN COMPLIANCE. to 4t
............ T 1 1 1 1 I I I ji
• The state agency CalRecycle reports that organic waste in landfills accounts for 20 percent of the methane gas generated in California which contributes to public health and safety concerns such as asthma. Methane emission reduction helps in combating climate change.
Businesses and multifamily properties are required to:
• Subscribe to trash collection service and recycling and/or organic waste collection services provided by Burrtec, unless approved for a self -haul exemption or de minimis or space constraint waiver. (Solid waste collection containers must be provided by Burrtec. If lost or stolen, customers are responsible for container replacement cost). • Annually provide information to employees, contractors, tenants, and customers about recycling, organic waste collection requirements and proper sorting of materials.
• Ensure employees, contractors, tenants, and customers have access to an adequate number, size, and location of containers with appropriate labels and container color.
• Provide containers for the collection of all waste streams including trash, food waste and recyclables in all areas where disposal containers are provided for customers, except for restrooms. • Provide information to new tenants before or within 14 days of occupation of the premises. • Prohibit employees from placing recycling and organic waste in a container not designated to receive those materials types.
Here are some ways businesses can reduce food waste:
• Plan and track: Plan meals based on demand and track waste to identify areas for improvement. • Menu design: Create menu specials that use ingredients that are close to their expiration date. Remove items that don't sell well. • Staff training: Train staff on how to minimize food waste, including proper temperature management and stock rotation. • Store food properly: Store food in the refrigerator and use airtight containers for grains. • Reduce packaging: Use reusable items and reduce packaging. • Compost and recycle: Compost and recycle food waste.
• Monitor production: Weigh food at each stage of production to identify and correct production loss.
California produces nearly half of the nation's fruit and vegetables, yet 1 in 8 Californians struggle with food insecurity, or lack of access to food that one needs to live a healthy lifestyle.
With the passing of Senate Bill 1383 (SB 1383), the State of California has mandated surplus food recovery to help combat the effects of methane gas on the environment. The bill requires commercial edible food generators to:
1. Arrange to recover the maximum amount of excess edible food that would otherwise go to landfills.
2. Establish a written agreement with any/all partnering organizations/services that accept edible food from your business.
3. Maintain records of all edible food recovery activities and receipts.
4. Provide copies of written agreement(s) with food recovery organizations) each year. • California Association of Food Banks (cafoodbanks.org) • Community Action Partnership of San Bernardino County Food Bank (capsbc.org) • Feeding America (Inland Empire) (feedingamericaie.org) • Food Finder (foodfinder.us)

SENATE BILL 1383
The California Senate passed a bill requiring a 75% reduction in organic waste disposal by 2025.
All residences and commercial businesses will be required to participate in this program to recycle organic waste, including food waste. %6"01
Organic waste that decomposes in a landfill releases a significant amount of greenhouse gas emissions that contribute to public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters. By composting organic waste, instead of sending it to landfills, we can close the loop on SCAN TO LEARN MORE sustainability while creating a nutrient -rich soil amendment that's ready for use in farms and gardens.
TIPS TO PREVENT FOOD WASTE Ai rIOME
• Plan ahead: Before you go to the grocerystore or order out check the fridge and pantryfor anything that needs to be cooked or that you already have and do not need to purchase. • Serve smart: Aim to cook and serve the right portions for the number of people you are feeding.
• Store food wisely: Different foods require different conditions. • Check your fridge often: Keep track of what you have and what needs to be used. Eal or freeze items before you need to throw them away.
• Use your freezer: Your freezer can help save your food and time.
Your recycling efforts contribute to the reduction of greenhouse gas emissions in landfilled organic waste. This includes methane, a greenhouse gas 80 times more potent than carbon dioxide.

Please review the "What Goes Where" guide for reminders of acceptable items in each barrel. Recycling loads containing unacceptable items may be rejected for processing and sent to the landfill, which eliminates the recycling programs benefits. High contamination of your recyclables could result in increased processing costs which may impact your trash and recyclables collection fees. Sorting information is available on the Burrtec website http://www.burrtec.com or call Burrtec Customer Service at (909) 797-9125 for assistance. As always, thank you for your continued support and cooperation!

SENATE Bltl 1383
The California Senate passed a bill requiring a 75% reduction in organic waste disposal by 2025.
All residences and commercial businesses are required to recycle organic waste, including food waste. Organic waste decomposes in a landfill releasing a significant amount of greenhouse gas emissions that contribute to public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters. By composting organic waste, instead of sending it to landfills, we can close the loop while SCAN ❑TO LEARN MORE creating a nutrient -rich soil amendment that's ready for use in farms and gardens.
TIPS TO PREVENT FOOD WASTE AT HOME+
• Plan ahead: Before you go to the grocery store or order out, check the fridge and pantry for food items that need to be cooked or that you already have and do not need to purchase. • Serve smart: Aim to cook and serve the right portions for the number of people you are - feeding. 1
„ • Store food wisely: Different foods require different conditions. • Check your fridge often: Keep track of what you have and what needs to be used. Eot or freeze items before you need to throw them away.
• Use your freezer. Your freezer can help save food and time.
Your recycling efforts contribute to the reduction of greenhouse gas emissions from landfilled organic waste.
This includes methane, a greenhouse gas 80 times more potent than carbon dioxide.

BARRELS
The State of California has passed laws
regulating the disposal and processing
of Solid Waste including Trash,
Recyclables and Organics. In turn,
local jurisdictions have now mandated
the separate collection and processing
of these materials.
While metal bin containers are less
likely to be stolen, barrels can be
easily rolled away or placed in a
vehicle. Please keep barrels in a
locked enclosure/building or secure
them with a lock and chain to a fixed
structure until service day and re -
secure them once service is completed.
Please contact customer service to
provide your key/lock combination for
the container.
Please note, Burrtec does not supply the
lock/key.

Enclosure Maintenance
Follow these simple tips to keep your business enclosures clean:
• Breakdown allcardboard. This helps preventoverflow
that causes the wheels to get stuck and helps save
room in the recycle bin for more recyclables.
• Pick up litter in and around your enclosure and
parking lot. Ensure that no litter enters the streets or the storm drain system.
• If your bin is full before your next scheduled pickup, you can call Burrtec and requestan additional pick up
for an extra fee.
• Do not fill dumpster bins or compactors with liquid
waste or hose it out. Keeping liquids out helps reduce
leakage into the surroundings as well as reduces odor.
• Sweeping instead of hosing the enclosure with water
not o n ly conserves water, it also prevents any material from entering the storm drain system.
Attention Food Service Providers
Existing state law requires certain businesses to implement a recycling and organics program. The law which went into effect July 1, 2020, requires food establishments that provide trash containers for products purchased and consumed on the premises to also provide properly labeled containers for recyclables and organic waste (food waste). These containers must be placed adjacent to trash containers.
AB 827 applies to limited -service restau rants such as those restaurants where customers order and pay at the counter and bus their own tables after eating. The law will affect restaurants, malls, and other businesses that serve food. Full -service food establishments that do not provide access to trash containers for products consumed on the premises will be exempt, as food workers will likely separate post -consumer food waste and recyclables in the dish washing areas.
Highlights:
• AB 827 requires collection containers at the front -
of -house to bevisible, accessible and labeled.
• This law affects businesses that sell products
that are meant for immediate consumption.
• Full -service restaurants where employees bus
and clean tables are exempt but must provide
labeled collection containers adjacent to trash
containers for employees/staff to separate post -
consumer recyclables and organics.

SENATE BILL 1383 ORGANICS DIVERSION AND RECYCLING If*
ARE YOU IN COMPLIANCE? fm4'
• The state agency CalRecycle reports that organic waste in landfills accounts for 20 percent of the methane gas generated in California which contributes to public health and safety concerns such as asthma. Methane emission reduction helps in combating climate change.
Businesses and multifamily properties are required to:
• Subscribe to trash collection service and recycling and/or organic waste collection services provided by Burrtec, unless approved for a self -haul exemption orde minimis orspace constraint waiver.

How to Recycle Food Waste at Home
1. Collect- Begin collecting food waste separate from your trash and recycling. This includes: fruits, vegetables, meats, seafood, bread, dairy, eggshells, coffee, plate scrapings, peels, rinds, and food soiled paper such as napkins and coffee filters.
2. Add & Secure- Collect food waste & food soiled paper in its own separate plastic bag. Store it in a convenient place, such as on your counter top, in your refrigerator or under your sink. Secure plastic bag by tying it off. Remember bags do not have to be compostable or biodegradable. They can be any color. We encourage you to re -use bags you may already have such as bread bags and produce bags.
3. Discard- Place your bagged food waste & food soiled paper into your green barrel. Continue using your green waste barrel for non -bagged landscape waste. Remember, food waste no longer belongs in your trash barrel.

California's Climate Food Fight
Organic waste that decomposes In a landfill releases a
significant amount of greenhouse gas emissions that
contribute to public health and safety concerns such as asthma, global climate change, extreme weather, and natural disasters. By composting organic waste, instead of sending it to landfill% we can close the loop on sustalnability while creating a nutrient -rich soil amendment that's ready for use in farms and gardens.
Food Waste Recycling
California passed a law, Senate Bill 1383, to Improve air quality by reducing greenhouse gas emissions from organic waste disposal such as food waste and landscape waste.
CalRecycle reports that Iandfilled organic waste (including food waste) decomposes In landfills and generates
greenhouse gases contributing to global climate change.
Reducing methane gas through actions like organic waste recycling will reduce emissions and the Impacts of climate change. To comply with this mandate, communities are
required to have a Food Waste Recycling Program for
residential customers. For more Information, please visit:
www.calrecyc le.ca gov/clim atelslc p

CITY OF YUCAIPA
NOTICE OF PUBLIC HEARING
MODIFICATION AND ADJUSTMENTS OF RATES FOR SOLID WASTE SERVICES IN ACCORDANCE WITH SECTION 6(a) OF ARTICLE XIIID OF THE CALIFORNIA CONSTITUTION (PROPOSITION 218) & GOVERNMENT CODE SECTIONS 53755 & 53756, NOTICE IS HEREBY GIVEN THAT the City Council of the City of Yucaipa will conduct a public hearing at its regularly scheduled meeting on June 8, 2026, at 6:00 p.m. or as soon thereafter as it may be heard. The meeting will take place in the City Council Chambers at City Hall, located at 34272 Yucaipa Blvd, Yucaipa, CA 92399. At the public hearing, the Council will consider the adoption of a resolution to approve modifications and adjustments to solid waste service fees commencing Julyl, 2026.
INFORMATION ABOUT THE CHARGES
A. Basis upon which the charges were calculated — The City Council has previously determined that the collection and disposal of refuse in the City is a service to be performed by a private company, under an exclusive franchise agreement.
The monthly residential curbside collection charge is comprised of six components:
1. An amount for the administration and operation of automated curbside refuse collection service, which includes the provision of three collection carts; the option of either a 15, 30, or 60-gallon refuse cart, one 90-gallon recycling cart and one 60-gallon green & food waste cart, with weekly pick-up service,
2. An amount for the hauler to dispose of the refuse and process the green & food waste and recyclables (the "tipping fee"),
3. An amount to administer the State mandated requirements of Senate Bill 1383,
4. An amount to operate the curbside bulky item collection service,
5. An amount for the administration and operation of a Household Hazardous Waste Program, and
6. The solid waste franchise fee ("franchise fee").
The monthly commercial collection charge is comprised of four components:
1. An amount for the administration and operation of commercial bin refuse and recycling collection service,
2. An amount for the hauler to dispose of the solid waste (the "tipping fee"),
3. An amount to administer the State mandated requirements of Senate Bill 1383, and
4. The franchise fee.
The charges represent the amount the City has negotiated with the private company franchisee for refuse collection services.
B. Reason for the charges — The City uses the refuse collection charges for the operation and administration of the refuse disposal, recycling, organics and household hazardous waste programs. The proposed increases per month represent the additional costs, as negotiated with the franchisee, to provide refuse, recycling, green waste, food waste, and manure collection service in compliance with state mandates. The proposed increases will be finalized after the public hearing but will not exceed the amounts set forth in this notice.
The 2026-2027 proposed increases are due to changes in the consumer price index (CPI). In addition, rate adjustments are impacted by state diversion and compliance mandates related to organics and recyclables diversion programs that also include SB 1383 programming such as compliance monitoring, compost procurement, edible food recovery, contamination monitoring, and ongoing education.
C. Charge per parcel — The City proposes to adopt a revised Exhibit D for fiscal year 2026-2027.
The current and maximum residential curbside collection services charges are as follows:
Current
Maximum Option
Monthly curbside collection charge 15gallon)
$25.74
$32.29
Monthly curbside collection charge 30gallon)
$32.56
$33.40
Monthly curbside collection charge 60gallon)
$43.03
$43.74
The City will also consider the charges for residential bin service and commercial bin service for fiscal year 2026-2027. A complete listing of all proposed charges for commercial and residential services is included with this notice. If you need assistance determining the charge for your property or parcel, please contact Yucaipa Disposal by calling (909) 797-9125.
WRITTEN REPORT
The City has caused a written report to be prepared and filed with the City Clerk regarding the proposed increased commercial and residential cart and bin collection service charges. The written report also provides data indicating the amount of cost, or estimated cost, to provide solid waste collection service and the revenue sources anticipated to provide the service. A copy of the written report will be available on the city website at www.yLicaipa.gov and at City Hall by May 28, 2026.
PROPOSITION 218

Consistent with the provisions of Proposition 218 and Government Code Section 53755, this notice has been mailed to the record owners of the property at the addresses as they appear on the latest equalized assessment roll. If you object to the proposed fees as described in this Notice you may file a written protest with the City at or before the time set for the public hearing.
Protests can be mailed or personally delivered to:
City of Yucaipa
Office of the City Clerk
34272 Yucaipa Blvd
Yucaipa, CA 92399
A valid protest must include:
1. The name of the person submitting the protest and their interest in the property (e.g. owner or tenant), and
2. Identification of the property by either assessor's parcel number or street address, and
3. A statement of protest ("I/we protest" will suffice), and
4. The original signature of the protesting owner or tenant (photocopies will not be accepted).
Please note that pursuant to Government Code section 53755(b) only one written protest will be counted per parcel. Multiple protests returned for a single property will be disallowed and the City Clerk will only accept one protest per property.
The City Clerk will determine the validity of all protests submitted and exclude any invalid protests from the final tabulation. The City Clerk may confer with the City Attorney in determining the validity of written protests. As part of this process, the City Attorney may view contested or suspect protest forms. The City Clerk's decision shall be final and binding.
PUBLIC HEARING
At the public hearing, the City will hear and consider all objections or protests to the proposed rate increases. All interested persons shall be afforded the opportunity to hear and be heard.
INQUIRIES: For any and all information relating to the proceedings, including relating to protest procedure, contact the City Clerk at (909) 797-2489. For all inquiries relating to the rate increase, method of calculation and proposed fees, contact Yucaipa Disposal at (909) 797-9125.

CITY OF YUCAH'A
NOTICE OF PUBLIC HEARING
MODIFICATION AND ADJUSTMENTS OF RATES FOR SOLH) WASTE SERVICES IN ACCORDANCE WITH SECTION 6(a) OF ARTICLE XIHD OF THE CALIFORNLA CONSTITUTION (PROPOSITION 218) 8c GOVERNMENT CODE SECTIONS 53755 8c 53756, NOTICE IS HEREBY GIVEN TXAT the City Council o£ the City of Yucaipa will conduct a public hearing at its regularly scheduled meeting on June 8, 2026, at 6:00 p.m. or as soon thereafter as it may be heard.
A. Basis upon which the charges were calculated —The City Council has previously determined that the collection and disposal of refuse in the City is a service to be performed by a private company, under an exclusive franchise agreement.
The monthly residential curbside collection charge is comprised of six components:
1. An amount for the administration and operation of automated caarbside refuse collection service, which includes the provision of three collection carts; the option o£ either a 15, 30, or 60-gallon refuse cart, one 90-gallon recycling cart and one 60-gallon green 8c food waste cart, with weekly pick-up service,
2. An amount for the hauler to dispose of th.e refuse and process the green 8c Food waste and recyclables (the "tipping fee"),
1. An amount for the administraion and operation of commercial bin refuse and re —--IlecfiTin srvrcq
2. An amount for the haulea- to dispose of the solid waste (the "tipping fee"),
3. An amount to administer the State mandated requirements of Senate Bill 1383, and
4. The franchise fee.
The charges represent the amount the City has negotiated with the private company franchisee for refuse collection services.
B. Reason for the charg¢a —The City uses the refuse collection charges for the operation and administration of the refuse disposal, recycling, organics and household hazardous waste programs. The proposed increases per month represent the additional costs, as negotiated with the franchisee, to provide refuse, recycling, green waste, food waste, and manure collection service in compliance with state mandates. The proposed increases will be finalized after the public hearing but will not exceed the amounts set {orth in this notice.

RE: Protest of Proposed Solid Waste Rate Increase for Bel Aire Mobile Estates —13060 2nd Street, Yucaipa, CA 92399 Dear City of Yucaipa:
I am writing on behalf of Bel Aire Mobile Estates, LLC, owner of Bel Aire Mobile Estates located at 13060 2nd Street, Yucaipa, CA 92399, and on behalf of our residents who ultimately bear most of the financial burden of these continued increases, to formally protest the proposed increase in solid waste service rates scheduled for consideration at the June 8, 2026 public hearing.
We strongly oppose any further increase in rates. Yucaipa Disposal already charges substantially higher rates than refuse providers servicing other communities we operate, including communities located in San Diego, areas with significantly higher costs of living. Due to the exclusive franchise arrangement with the City, property owners and residents have no meaningful ability to seek competitive pricing or alternative providers.
While the notice references CPI increases and compliance costs associated with state mandates, these continued increases place an ongoing financial burden on property owners and residents alike. As these expenses continue to rise year after year, residents are left with little choice but to absorb the additional costs.
It is also difficult to reconcile the City's reliance on CPI as justification for these increases while maintaining restrictive mobile home rent control regulations that historically did not allow park owners to reasonably keep pace with CPI for decades and now continue to impose caps on increases. The City cannot reasonably argue that CPI -based increases are necessary and appropriate for municipal franchise services while simultaneously restricting housing providers from recovering comparable inflationary increases in their own operations.
Additionally, the proposed increases appear disproportionate given the limited market competition available to consumers within the City of Yucaipa. Without the ability to obtain competing bids or select alternate waste haulers, customers are effectively required to absorb annual increases without any market -based check on pricing.
For these reasons, we respectfully request that the City Council reject the proposed rate increases or, at minimum, require further justification and review before approving additional charges. Please accept this letter as our formal written protest pursuant to Proposition 218 and Government Code Section 53755.
Sincerely,
A_A 'Oy
