CITY OF
Item No. 1
STAFF REPORT
DATE: August 17, 2026
TO: Honorable Mayor and City Council
FROM: Dr. Sean M. Moore, City Manager j
PREPARED BY: Ana V. Sauseda, Director of General Services/City Clerk SUBJECT: November 3, 2026 General Municipal Election — District 2 Options RECOMMENDATION:
That the City Council:
1. Receive and file the certification that there are not more candidates than offices to be elected in District 2 for the November 3, 2026 General Municipal Election; and
2. Discuss the options as defined by § 10229 of the Elections Code (EC); and
3. Provide further direction to staff.
BACKGROUND/DISCUSSION:
On May 11, 2026, under the provisions of the laws relating to General Law cities in the State of California, the City Council adopted Resolution No. 2026-09, calling and giving notice of a General Municipal Election to be held on Tuesday, November 3, 2026, for the purpose of electing one City Council Member for District 1 and 2. As of the close of the Nomination Period on Friday, August 7, 2026, at 12:00 p.m., only one person filed nomination papers to run for the office of City Council District 2.
According to EC § 10229, if by the 88th day prior to the election, no one or only one person has been nominated for any office, the City's Elections Official shall submit a certificate of these facts to the governing body and publish a notice of the same in a newspaper of general circulation. After the 5th day following publication and 75 days prior to the election, at a regular or special meeting, the City Council may adopt one of the following courses of action:
1. Appoint to the office the person who has been nominated;
2. Appoint to the office an eligible elector if no one has been nominated; or
3. Hold an election, if either no one or only one person has been nominated. 08/17/2026 City Council Agenda C
Pursuant to EC § 10229(a), on August 7, 2026, the City Clerk executed a Certificate of Facts that there are not more candidates than offices to be elected for City Council Member — District 2 (Attachment 1).
On August 11, 2026, a notice was published in The SUN newspaper advising that there are not more candidates than offices to be filled for City Council Member — District 2. The notice advises the City Council may, as a result of this fact:
1. Appoint to the offices the individuals who have been nominated; or
2. Hold the Election
Option 1
Should the City Council choose to make the appointment, Chris Venable would take office and serve exactly as if elected at the General Municipal Election, starting his term in December 2026 and representing District 2. The election for the office of Member of the City Council, District 2, shall not be held and the Elections Official shall not accept for filing any statement of write-in candidacy that is submitted after the appointment is made. The recommendation for this option is that the City Council adopt Resolution No. 2026-35, Appointing Chris Venable as the Qualified Candidate in District 2 as Elected to the Yucaipa City Council, and Cancelling the November 3, 2026 District 2 Election, as a Result of not Having More Candidates than Offices.
Option 2
Should the City Council choose to hold the election instead of making the appointment, there would be a limited opportunity for one or more write-in candidates to qualify for the election. Only write-in candidates who have properly qualified, pursuant to Elections Code Sections 8600-8606, may be considered in the vote tally and must file their completed forms between 57 and 14 days prior to the election. if no official write-in candidates are qualified, the nominee would only need a single vote to be elected to the office. The recommendation for this option is that the City Council direct staff to proceed with the election scheduled as -is.
FISCAL IMPACT:
Should the Council choose Option 1, the City would see a cost saving in the invoice for the General Municipal Election as the election in District 2 would be not be held. Should the Council choose Option 2, there would be no additional costs incurred as the cost for the November 3, 2026 election has already been included in the budget for FY 26/27.
