SUBJECT: Grant of Easement - Utility Easement to the Yucaipa Valley Water District for Well No. 44 on City owned Property (APN 0303-181-28)
RECOMMENDATION:
That the City Council:
1. Approve a Grant of Easement for public utility purposes on City owned property (APN 0318- 181-28) to the Yucaipa Valley Water District; and
2. Authorize the City Manager or his designee to execute all necessary documents to record the Grant of Easement document; or
3. Provide further direction to staff.
BACKGROUND/DISCUSSION:
The City Yard Relocation Project (City Yard Project) was completed in phases with several construction contracts being awarded to contractors beginning in July of 2020. The City Yard Project included the installation of utilities connections and drainage improvements required to serve the City Yard and to not affect adjacent properties.
During the construction of the City Yard Project, the Yucaipa Valley Water District (YVWD) notified City staff of an existing storm drain system that services their property, including the site of Well No. 44. This storm drain system is partially located within the City owned property where the City Yard Project was constructed and it was determined that an easement in favor of the YVWD was not in place to allow the YVWD to maintain and operate the storm drain system.
The proposed easement will allow the YVWD to access the storm drain system as required to maintain their utility infrastructure, including the Well No. 44 infrastructure.
FISCAL IMPACT:
The recommendations do not result in a fiscal impact.

City of Yucaipa, owner of record of the herein described parcel of land, hereinafter called GRANTOR, hereby grant and convey to YUCAIPA VALLEY WATER DISTRICT, its heirs, successors, and assigns, hereinafter called GRANTEE, an casement and right-of-way to construct, reconstruct, alter, replace, use, operate, inspect, and repair underground water pipelines, conduits, and appurtenances together with the right of ingress and egress, across, along, over, under, through, and within that certain real property in the City of Yucaipa, County of San Bernardino, State of California, described as follows:

GRANTEE covenants to maintain the easement and right-of-way in good repair so that no damage will result to the adjacent land of the GRANTOR, his heirs, successors, and assigns, from its use. GRANTEE reserves the right to clear all brush, plants, shrubs, trees, trash, and other obstructions from the easement and right-of-way. GRANTOR, his heirs, successors, and assigns, covenants that they will not erect, place, or maintain, or allow to be erected, placed, or maintained, within the boundaries of said easement and right-of-way, any structure, without first securing written permission of the GRANTEE. GRANTOR agrees that GRANTER, its heirs, successors and assigns, and its agents or employees, may trim or remove any plants, shrubs, or trees that encroach on the easement and right-of-way only if necessary construct, reconstruct, alter, replace, use, operate, inspect, and repair underground water pipelines, conduits, and appurtenances.
Any use hereinabove permitted to be made of the surface of said land by GRANTOR, his heirs, successors, and assigns, shall be exercised so as not to impair, endanger, or interfere with the present or prospective exercise of any of the rights herein granted.
Notwithstanding the description of the rights granted to GRANTEE hereunder, nothing in this Grant of Easement shall be construed to confer to GRANTEE, or be construed to confer to GRANTEE, the right to erect, construct or maintain any above -ground structure or improvement upon the easement or with respect thereto.
The terms and covenants of this easement and right-of-way shall bind and inure to the benefit of the heirs, successors, executors, administrators, and assigns of GRANTOR and the heirs, successors, and assigns of GRANTEE.

A strip of land 20.00 feet in width over a portion of Lot 11, Block B of Yucaipa Water and Lumber Company Subdivision No. 1, as per plat recorded in Book 17 of Maps at Page 27 thereof, Records of San Bernardino County, California, also being a portion of those parcels granted to San Bernardino County Flood Control District by document recorded August 19, 1940 in Book 1431, Page 10, Records of said County, in Section 36, Township 1 South, Range 2 West, San Bernardino Meridian, lying in the City of Yucaipa, County of San Bernardino, State of California, the east line of said 20.00 foot wide strip of land being more particularly described as follows:
COMMENCING at the northeast corner of said Lot 11;
