LIST OF NOTES:
01) PERC staff monitored lift station wet well throughout the month. 02) PERC staff received notification of a sewer backup located at 11719 Bartlett. The sewer line to the south and to the east along both sides the business was free flowing with no backup indicated on the upstream manholes. PERC staff cleaned both the sewer lines to the south and east anyways and did not find any indication of a blockage or restriction. The business was notified that the issue was either their lateral or their interceptor.
03) PERC staff received and reviewed 189 USA dig alerts. 263

Job Narrative
570-184918-1
Analytical test results meet all requirements of the associated regulatory program listed on the Accreditation/Certification Summary Page unless otherwise noted under the individual analysis. Data qualifiers are applied to indicate exceptions. Noncompliant quality control (QC) is further explained in narrative comments. · Matrix QC may not be reported if insufficient sample or site-specific QC samples were not submitted. In these situations, to demonstrate precision and accuracy at a batch level, a LCS/LCSD may be performed, unless otherwise specified in the method.
· Surrogate and/or isotope dilution analyte recoveries (if applicable) which are outside of the QC window are confirmed unless attributed to a dilution or otherwise noted in the narrative.

Regulated compliance samples (e.g. SDWA, NPDES) must comply with the associated agency requirements/permits.

Receipt
The sample was received on 5/17/2024 9:50 AM. Unless otherwise noted below, the sample arrived in good condition, and, where required, properly preserved and on ice. The temperature of the cooler at receipt time was 2.7°C.

General Chemistry
Method 7196A: The following sample was diluted due to sample color interference : C4E2153-01 (570-184918-1).

No additional analytical or quality issues were noted, other than those described above or in the Definitions/ Glossary page.

GPA 24-01 and Ordinance No. 652 amending the Adelanto Municipal Code and approving Zone Change No. ZC 24-01, based on the findings.

ANALYSIS & REVIEW:

BACKGROUND:

The Planning Commission approved this item at Special Meeting on June 20th.

Applicant: City of Adelanto
Location: City-wide, and the following two properties:
• Assessor Parcel ID 3128-131-19 (8.73 acres, northwest corner of Bellflower Street & Primrose Road)
• Assessor Parcel ID 3128-141-22 (9.99 acres, southeast corner of Bellflower Street & Primrose Road)
The City of Adelanto in conjunction with its contractor, Bowman (formerly Infrastructure Engineers) has prepared an update to the city’s Housing Element. California's Government Code section 65580 mandates each jurisdiction to prepare a Housing Element that is incorporated into its General Plan. This is to ensure adequate planning for projected housing demand throughout the state. Unlike other elements of the General Plan, the Housing Element must be updated by deadlines set forth by the state agency, the Department of Housing and Community Development 333
(HCD). The process begins with the Regional Housing Needs Assessment (RHNA), which is the estimated number of housing units that must be planned for to accommodate over the planning period of usually eight years. This allocation is further subdivided among five household income categories: extremely low, very low, low, moderate, and above moderate, with affordable housing income limits determined by the U.S. Department of Housing and Urban Development (HUD) and adjusted for family size.

The Southern California Association of Governments is responsible for the public process by which this regional allocation is apportioned to each jurisdiction within its boundaries. The policies outlined in the Housing Element must not only demonstrate how the allocated number of units can be accommodated, but also address the removal of governmental barriers to housing production, ensure the jurisdiction's housing stock is maintained, and guarantee that housing is available to all economic classes of the community on an equitable basis.

The City’s RHNA allocation is a planning requirement based on housing need and not a construction mandate. The Housing Element must provide an evaluation of potential capacity for additional housing based on land use designations, development regulations, infrastructure availability, environmental conditions, and real estate market trends at a parcel-specific level.

The "sites analysis" is the evaluation of properties where additional housing could be built consistent with city regulations. The Housing Element document must demonstrate that the city has adequate sites with appropriate zoning to fully accommodate additional housing development in each income category.

Appendix B of the Housing Element is a parcel-level analysis of sites where additional housing could potentially be built. The sites analysis shows that with the rezoning of properties as described in Program 20, Adelanto's land use plans and zoning regulations will provide enough capacity to fully accommodate the RHNA allocation in all income categories.

City of Adelanto 6th Cycle Regional Housing Needs Allocation Number of Units by Income Level
Very Low Low Moderate Above Moderate Total
394 566 651 2,152 3,763
Currently, Adelanto has residential sites zoned to accommodate the housing need in the moderateand above moderate-income affordability categories, but currently there is a shortfall in sites accommodating the housing need in the low- and very low-income affordability categories, which is considered together and referred to as “lower RHNA.” The Adelanto lower RHNA is 960 units.

Existing vacant R3-30 zoned sites contribute 876 units toward the lower RHNA. As none of these vacant R3-30 zoned sites have been identified in the sites inventory of two or more consecutive prior housing elements, no action is needed to change the zoning of these sites. Currently, Adelanto has a lower RHNA shortfall of 84 units. Adelanto will need to rezone eligible sites accommodating at least 84 units to zoning that can accommodate lower income units as specified in the Housing Element Law and Program 20 of the Housing Element.

HCD Review
A significant distinction between the Housing Element and other components of the General Plan lies in the level of State oversight. Recognizing the importance of ensuring an adequate housing supply, the State legislature has granted authority to HCD to review city Housing Elements to ensure their compliance with state law. The certification of a Housing Element by HCD signifies a finding of compliance. Certification holds substantial significance as it enables a city to be eligible for grant funds and reinforces local land use authority. Several federal, state, 334
and regional funding programs consider housing element compliance as an eligibility or ranking criteria. For example, the CalTrans Senate Bill (SB) 1 Sustainable Communities grant, the Affordable Housing and Sustainable Communities programs, and HCD’s Permanent Local Housing Allocation consider housing element compliance and/or annual reporting requirements pursuant to Government Code section 65400. With a compliant housing element, the City will meet housing element requirements for these and other funding sources.

A review of Housing Elements by HCD is required both prior to and after the final adoption by the City Council. Following an extensive public participation process including a 30-day public review described in Appendix C of the Housing Element, the City submitted an initial draft of the housing element to HCD in December 2022, and in response to comments by HCD, the City submitted subsequent drafts in November 2023, March 2024, and May 2024. On May 10, 2024, HCD confirmed that the draft Housing Element with revisions received on May 7, 2024 would satisfy the statutory requirements and be compliant with State Housing Element Law upon adoption by the City, provided that Program 20 to rezone sites to accommodate the regional housing needs allocation (RHNA) is completed (Attachment C).

Upon adoption by the City Council, the Housing Element and necessary rezoning actions must undergo HCD review. HCD is allotted 60 days to complete its review of the adopted Housing Element for certification of the City’s compliance with housing element law, which is retroactive to the date that the City has completed all of the actions.

Identified Sites
Pages 281-283 in Appendix B of the Housing Element identifies over 30 sites for potential rezoning with the addition of an Affordable Housing Overlay to accommodate a portion of the City’s RHNA in the lower income affordability categories. These sites, which are required to be at least 0.5 acres and less than 10 acres, are generally located between the older northern portion and more recently developed southern portion of the city, south of Rancho Road and powerlines, with the majority west of U.S. Highway 395 and a few clustered east of U.S. Highway 395, as seen in Figure B-1 on page 261 of the Housing Element. This middle portion of the city was chosen as the location for affordable housing sites because of the general proximity of utilities connecting the northern and southern portions of the city, as well as the requirement for the City to affirmatively further fair housing by locating these sites away from TCAC Areas of High Segregation and Poverty in the northern portion of the City, to avoid further concentrating segregation and poverty in those areas.

The following two sites are recommended for rezoning with the addition of an Affordable Housing Overlay:
3128-131-19 (Parcel ID)
• NWC Bellflower and Primrose
• 8.73 AC
• Existing Zoning = R-M12
• Proposed Zoning = R-M12-AHO
3128-141-22 (Parcel ID)
• SEC Bellflower and Primrose
• 9.99 AC
• Existing Zoning = R-S5
• Proposed Zoning = R-S5-AHO
335
An aerial view of the two sites is shown in the May 31, 2024 Sites Recommendation (Attachment D). The sites are in a residentially zoned neighborhood as shown in the following image:

The two sites are adjacent to a paved road (Bellflower Street) and utilities including a sewer line and electricity. A handful of existing single-family residences are adjacent to the sites as seen in the aerial view.

PROJECT COMPONENTS:

The project is to adopt the 2021-2029 Housing Element and take the related actions necessary to obtain certification of Adelanto’s compliance with state housing element law, which include adopting General Plan Amendment GPA 24-01 and adopting Ordinance No. 652 (draft attached) to amend the Adelanto Municipal Code and approve ZC 24-01, as described below:

General Plan Amendment to adopt the City of Adelanto 2021-2029 6th Cycle Housing Element Update and revise the Adelanto North 2035 Comprehensive Sustainability Plan, Figure LC-2, Land Use Plan and General Plan Land Use & Zoning Map to establish an AHO (Affordable Housing Overlay) land use on the following properties: Assessor Parcel ID 3128-131-19 (8.73 acres, northwest corner of Bellflower Street & Primrose Road) and Assessor Parcel ID 3128-141-22 (9.99 acres, southeast corner of Bellflower Street & Primrose Road), including required minimum density of 20 units per net acre, consistent with the Housing Element
Zoning Code Amendment to establish the AHO (Affordable Housing Overlay) zone with appropriate development standards including a required minimum density of 20 units per net acre and establish a ministerial by-right review procedure applicable to eligible affordable housing projects including those in the AHO zones as required by state housing element law and consistent with the Housing Element Zone Change to establish the AHO (Affordable Housing Overlay) zone on the following properties: Assessor Parcel ID 3128-131-19 (8.73 acres, northwest corner of Bellflower Street & Primrose Road, existing zone: R-M12, proposed zone: R-M12-AHO) and Assessor Parcel ID 3128-141-22 (9.99 acres, southeast corner of Bellflower Street & Primrose Road, existing zone: R-S5, proposed zone: R-S5-AHO), which shall be reflected in a revised General Plan Land Use & Zoning Map

Housing Element Content
The Housing Element and associated land use regulations pertaining to housing are governed by comprehensive California state laws. The Final 2021-2029 Housing Element (available online at the location noted below the attachments) encompasses the following key elements:
- Chapter 1 – Introduction. The Introduction provides a summary of the key issues and civic engagement that the Housing Element aims to address. - Chapter 2 – Housing Needs Assessment. This chapter explains the assessment of multiple factors in housing trends. Special analysis and considerations are made for population groups such as farm workers and persons with disabilities. An overview is provided of the RHNA, the city’s growth needs, and an assessment of the demographics in relation to Affirmatively Furthering Fair Housing.
- Chapter 3 – Resources and Opportunities. This section highlights the different opportunities that are available to the public in order to facilitate housing in Adelanto. - Chapter 4 – Constraints. This chapter explains the constraints to housing development in the city. This includes an analysis of governmental, environmental, and nongovernmental constraints. - Chapter 5 – Housing Action Plan. This chapter includes the City’s quantified housing objectives and programs (City actions) that address housing in the city. - Appendix A – Evaluation of the Prior Housing Element. A comprehensive evaluation of the previous housing element, including the status of its program implementation including with regard to special needs groups, is provided. - Appendix B – Residential Sites Inventory. An inventory of sites that have been assessed to meet the future demand and RHNA is outlined in this chapter. - Appendix C – Public Participation Summary. A summary of all activities for public outreach that have taken place for the 6th cycle update.

The Housing Element’s primary purpose is to analyze and create programs to address housing issues within the city. The Housing Element’s Chapter 5 consists of a Housing Action Plan which includes goals, policies, and programs (City actions) that will target the 2021 to 2029 planning period. These programs have been updated to reflect current and new commitments. These programs satisfy state housing element law requirements to include programs that:
• Ensure adequate sites for housing
• Assist in the development of housing to accommodate extremely low-, very low-, low- or moderate-income households, including special needs populations • Address governmental and non-governmental constraints to the maintenance, improvement, and development of housing
• Conserve and improve the condition of the existing affordable housing stock • Preserve units at risk of conversion from affordable to market-rate rents • Incentivize and promote the creation of accessory dwelling units that can be offered at an affordable rent
• Promote and affirmatively further fair housing opportunities Proposed Zoning Code Amendment
The proposed zoning code text amendment will establish a new Affordable Housing Overlay (AHO) zone (the new Chapter 17.46 in Exhibit 1 of Ordinance No. 652) which will implement the state housing element law requirements for properties that need to be rezoned to a higher residential density in order to provide adequate sites to accommodate the housing needs of lower income households. These zoning requirements applicable to Adelanto include a required minimum residential density of new development of 20 units per acre, a zone density of at least 30 units per acre, zoning to accommodate at least 16 units on each site, and zoned to allow 337
owner-occupied and rental multifamily residential use by right for developments that include at least 20% of units affordable to lower income households. (Use by right means that the local government’s review cannot require a conditional use permit, planned unit development permit, or other discretionary local government review that would constitute a “project” under the California Environmental Quality Act.) The ministerial “by right” procedure is set forth in the new Section 17.100.090 (in Exhibit 1 of Ordinance No. 652), which would also be used whenever state law requires ministerial review of a housing project.

Proposed Rezoning
The proposed rezone will apply an AHO (Affordable Housing Overlay) zone over the two proposed properties. The overlay will require any new development on those properties to achieve a minimum residential density of 20 units per net acre and apply the development standards of the R3-30 zone to those properties. It will also require the “by right” ministerial processing of certain affordable housing projects as noted above. The rezone will not change the zoning regulations of any other properties in the neighborhood of the properties to be rezoned.

PROJECT ANALYSIS:

RECOMMENDATION:

Staff is recommending approval of General Plan Amendment GPA 24-01 as this will adopt the 2021-2029 Housing Element which is necessary for the City to be certified in compliance with housing element law. Compliance with housing element law is critical for funding eligibility. Several federal, state, and regional funding programs consider housing element compliance as an eligibility or ranking criteria. Furthermore, the general plan amendment will establish the consistent land use on the properties to be rezoned which is also necessary prior to the City’s compliance with housing element law.

Staff is recommending approval of Ordinance No. 652 as the ordinance will provide the necessary rezoning of sites, including necessary regulatory requirements, required for the City to be certified in compliance with state housing element law.

Staff is recommending the two identified sites to be rezoned with the addition of the AHO zone because these two sites are in a residentially zoned neighborhood adjacent to a paved road (Bellflower Street) and utilities including a sewer line and electricity. Other sites identified in the Housing Element were either on the east side of U.S. Highway 395 in the current MU zone or farther from paved roads and electricity, or in the case of 3128-131-14, closer to major power lines.

Rezoning of either of these sites alone would accommodate the lower RHNA shortfall of 84 units and meet the City’s obligations, but rezoning of both sites would result in a larger number of sites suitable to accommodate affordable housing development and make it less likely to need to rezone additional sites in the event of a “net loss” during the planning period.

Findings necessary for approval are included in the resolution and ordinance.

ENVIRONMENTAL CONSIDERATIONS:

In accordance with the California Environmental Quality Act (CEQA), an Initial Study and Draft Mitigated Negative Declaration (MND) was prepared and made available for public review on the City Planning website from November 21, 2023 to December 21, 2023 for a 30-day review as well as distributed to relevant State agencies pursuant to State CEQA Guidelines. Comments were received from the Department of Toxic Substances Control and the Department of Fish 338
and Wildlife, some of which resulted in additional or revised mitigation measures which are reflected in the final Initial Study/Mitigated Negative Declaration. A copy of the final Initial Study/Mitigated Negative Declaration is available online at the location noted below the attachments.

With the implementation of mitigation measures mitigating potential impacts in the areas of biological resources, geology and soils, hydrology and water quality, tribal cultural resources, and utilities and service systems, which would apply to housing development contemplated in the Housing Element, the project will have a less than significant impact on the environment.

PUBLIC NOTICE:

A public hearing notice was published in the newspaper, posted on the City’s public service electronic billboard on State Route 395, posted on the Planning Department’s website, mailed to property owners of properties within 300 feet of the properties proposed to be rezoned, and sent to relevant agencies. As of the writing of this report, no comments have been received by staff.

FISCAL IMPACT:

Reviewing and adopting the Housing Element will not have any immediate fiscal impact.

However, ongoing implementation of the programs and periodic monitoring and reporting will require City staff to take actions that will be funded by the General Fund through the annual budget review and approval process. Any new development will be subject to development impact fees, which will be collected to fund public facilities, infrastructure improvements, and school facilities.

RESOLVE AS FOLLOWS:

SECTION 1. The above recitals are all true and correct and incorporated herein.
342
RESOLUTION NO. P-24-08
June 20, 2024

Page 3 ends

SECTION 2. The Planning Commission hereby finds and determines that the Initial Study/Mitigated Negative Declaration reflects the independent judgment of the Planning Commission and is adequate for making decisions on the merits of the proposed actions and determines that the project would not have a significant effect on the environment with the proposed mitigation measures.

SECTION 3. The Planning Commission hereby finds and determines that the rezoning of the sites as provided in Ordinance No. 652 will accommodate 449 units toward Adelanto’s “lower RHNA” of 960 units, making up for the shortfall of 84 units, and that no action is needed for the existing R3-30 zoned sites contributing 876 units toward the “lower RHNA” as none of these vacant sites have been identified in the sites inventory of two or more consecutive prior housing elements.

SECTION 4. The Planning Commission hereby finds and determines the following:
a) That the proposed general plan amendment is in the public interest, and that there will be a community benefit resulting from the amendment, in that City adoption of the amendment and related actions is necessary for the City’s compliance with state housing element law and eligibility for funding tied to the City’s compliance with state housing element law. b) That the proposed general plan amendment, zoning code amendment, and zone change is consistent with the goals, policies, and objectives of the General Plan, in that the proposed actions align internally with the General Plan, are consistent with one another, and further the goals of conserving existing housing, removing government constraints related to the production of housing, providing adequate sites for housing, promoting the development of affordable housing, and furthering equal and fair housing. c) That the proposed general plan amendment will not conflict with provisions of the Zoning Code, subdivision regulations, or any applicable specific plan, in that the proposed amendment does not affect subdivision regulations or a specific plan, and that Zoning Code regulations will be updated to be consistent with the general plan amendment.
d) That the proposed general plan amendment (change to the land use policy map) and zone change will not adversely affect surrounding properties, in that these actions are planning an exclusively residential use in a residential neighborhood.

SECTION 5. For the foregoing reasons, the Planning Commission recommends that the City Council adopt the Mitigated Negative Declaration, (MND), SCH No. 2023110567, and approve General Plan Amendment No. GPA 24- 01 and Ordinance No. 652 amending the Adelanto Municipal Code and approving Zone Change No. ZC 24-01, based on the above findings.

Dear Jessie Flores:

RE: City of Adelanto’s 6th Cycle (2021-2029) Subsequent Draft Housing Element Thank you for submitting the City of Adelanto’s (City) revised draft housing element update received for review on March 13, 2024, along with revisions received on May 7, 2024. Pursuant to Government Code section 65585, subdivision (b), the California Department of Housing and Community Development (HCD) is reporting the results of its review. Our review was facilitated by a conversation on April 23, 2024 with Sean Reardon and Jason Wasmund, the City’s consultants.

The housing element addresses most statutory requirements described in HCD’s January 16, 2024 review. However, the housing element cannot be found in full compliance until the City has completed Program 20 (Adequate Sites) to rezone sites to accommodate the regional housing needs allocation (RHNA) pursuant to Government Code section 65583.2, subdivision (c). Pursuant to AB 1398, a jurisdiction that failed to adopt a compliant housing element within one year from the statutory deadline cannot be found in compliance until rezones pursuant to Government Code sections 65583, subdivision (c)(1) and 65583.2, subdivision (c) are completed. Once the City completes the program, a copy of the resolution or ordinance should be transmitted to HCD. HCD will review the documentation and issue correspondence identifying the updated status of the City’s housing element compliance.

Public participation in the development, adoption and implementation of the housing element is essential to effective housing planning. Throughout the housing element process, the City must continue to engage the community, including organizations that represent lower-income and special needs households, by making information regularly available while considering and incorporating comments where appropriate. Please be aware, any revisions to the element must be posted on the local government’s website and to email a link to all individuals and organizations that have previously requested 349

notices relating to the local government’s housing element at least seven days before submitting to HCD.

Several federal, state, and regional funding programs consider housing element compliance as an eligibility or ranking criteria.

HCD looks forward to receiving the City’s adopted housing element. If you have any questions or need additional technical assistance, please contact Clare Blackwell, of our staff, at [email protected].

Melinda Coy

Re: City of Adelanto HEU Adoption Parcel Rezoning Recommendations Bowman is recommending the following two sites for rezoning consideration:
3128-141-22 (Parcel ID)
• SEC Bellflower and Primrose
• 9.99 AC
• 239 units towards RHNA
• Existing Zoning = R-S5
• Proposed Zoning = R-S5-AHO
3128-131-19 (Parcel ID)
• NWC Bellflower and Primrose
• 8.73 AC
• 210 units towards RHNA
• Existing Zoning = R-M12
• Proposed Zoning = R-M12-AHO
Both identified sites are adjacent to a paved road (Bellflower Street) which suggests closer availability of utilities and are on the residential (west) side of U.S. Highway 395. Other sites identified in the Housing Element were either on the east side of 395 in the current MU zone or farther from paved roads, or in the case of 3128-131-14, closer to power lines.

SUBJECT: OPEN A PUBLIC HEARING, APPROVE PROPOSED CHANGES TO MAXIMUM RATES, AND ADOPT RESOLUTION 24-58 ORDERING THE LEVY AND COLLECTION OF SOLID WASTE CHARGES ON THE PROPERTY TAX ROLL FOR FISCAL YEAR 2024-25.

STAFF RECOMMENDATION:

It is recommended that the City Council open a public hearing, and pass a motion to (1) approve the proposed changes to maximum rates for solid waste collection and (2) adopt Resolution 24-58 ordering the levy and collection of solid waste charges on the property tax roll for Fiscal Year 2024-2025.

BACKGROUND:

Beginning in Fiscal Year 2010-11 the City began placing the annual charges for solid waste collection services in accordance with Ordinance 499, which amended Chapter 8 of the Adelanto Municipal Code to allow for collection of those charges on the County tax rolls. In FY2016-17 annual street sweeping charges were also added to that annual tax levy.

The annual tax roll billing method has significant cost advantages, which translate into lower rates to City residents. One advantage is lower administrative processing costs of approximately 8,000 bills on a monthly basis and another advantage is lower delinquency and collection costs. The benefit to our residents is lower trash rates because of the reduced administrative costs of providing the service.

Attached as Attachment 1 for the Council’s approval are the proposed maximum rates Burrtec may charge for solid waste collection services in FY 24-25. Attached as Attachment 2 for the Council's adoption is Resolution No. 24-58, ordering the levy and collection of solid waste charges assessments on the property tax roll for Fiscal Year 2024-2025.

NO INCREASE TO RESIDENTIAL SERVICES; CPI INCREASE FOR ALL OTHER SERVICES.

The City’s recently revised franchise agreement with Burrtec (the “Franchise”) provides for automatic increases each year to the maximum rates Burrtec may charge residents for solid waste collection, based on increases to the Consumer Price Index (“CPI”). As part of the negotiations for the Franchise, and in order to lessen the burden of new regulations imposed by the State related to recycling of Organic Waste, Burrtec agreed to spread the costs associated with organic waste recycling on residents over 4 353
RESOLUTION NO. 24-58

years, and that there would be no increase to residential rates for FY 2024-25. The proposal reflects this agreement, and the fact there are no changes the maximum rates for collection of three containers (trash, recyclables and organics) at single family residential properties.

The Franchise also includes an automatic increase to the maximum rates Burrtec may charge other customers based on increases to the CPI, with a cap of 6%. In FY 23-24 CPI increased 8.70% but maximum rates only increased 6% because of the cap included in the franchise. Burrtec proposes an increase of 6% (the cap) to maximum rates for FY 24-25 based upon a 4.65% increase in CPI and a discretionary

1.35% carryover of unrealized CPI increase from FY 23-24 or permitted by the Franchise.

FISCAL IMPACT:

City General Fund receives approximately $1,000,000 annually in Franchise Fees on Residential, Commercial, Recycling and Roll-off services.

RESOLUTION NO. 24-58

A RESOLUTION OF THE ADELANTO CITY COUNCIL, ORDERING

THE LEVY AND COLLECTION OF SOLID WASTE FEES BY THE

COUNTY TAX COLLECTOR IN THE SAME MANNER AND AT THE
SAME TIME AS GENERAL TAXES.

WHEREAS, in 2010 the City of Adelanto executed a solid waste handling agreement with AVCO Disposal, a.k.a. Burrtec Waste Industries (Burrtec), which has been amended twice, for the provision of solid waste collection and recycling services; and WHEREAS, City staff have historically rendered billing and collection services for all solid waste accounts within the city limits and have included those charges on the monthly water bills; and WHEREAS, Burrtec offers the service of direct billing customers for their solid waste charges via property tax rolls at no additional cost to the City; and WHEREAS, California Health and Safety Code section 5473 authorizes the City of Adelanto to adopt an ordinance or resolution by a two-thirds vote of the City Council to collect solid waste rates in a manner, and at the same time, as its general taxes; and WHEREAS, on May 26, 2010, the Council approved Ordinance 499 which amended Chapter 8 of the Adelanto Municipal Code to allow the City to collect solid waste receipts on the County tax rolls.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ADELANTO AS FOLLOWS:

Section 1. The foregoing recitals are true and correct and incorporated into the body of this Resolution by this reference.

Section 2. The City Council hereby requests the San Bernardino County Tax Assessor to place collection of rates charged by its franchisee for solid waste handling services at residential and commercial properties in the City and for street sweeping services in City on the County’s tax rolls.

SUBJECT: ACCEPTING GRANT AND APPROVING GRANT AGREEMENT FOR SAFE STREET AND ROAD FOR ALL (SSR4A)
STAFF RECOMMENDATION:

Staff recommends accepting grant and approving grant agreement for Safe Street and Roads for All (SSR4A)
BACKGROUND:

The Bipartisan Infrastructure Law (BIL) established the Safe Streets and Roads for All (SS4A) discretionary program with $5 billion in appropriated funds over 5 years, 2022-2026. The SS4A program funds regional, local, and Tribal initiatives through grants to prevent roadway deaths and serious injuries. Over $3 billion is still available for future funding rounds.

City applied for the grant to do Safety Action Plan for the City in order to prioritize street rehabilitation based on the need and safety of the segment. Safety action Plan is also needed to apply for the street rehabilitation funds in next cycle. City received $300,000 grant to do Safety Action Plan. Funding agreement will be executed between the City and Federal Highway Administration (FHWA), the funding agency.

Staff is requesting accepting grant and approving grant agreement for Safe Street and Roads for All (SSR4A)
