EXECUTIVE SUMMARY
Michael Baker International (Michael Baker) is under contract with the Town of Apple Valley (Town of Apple Valley) to conduct the Town Wide School Zone Analysis Local Roadway Safety Plan (LRSP). As part of this project, Michael Baker conducted a Compliance Review for School Zone Traffic Controls for the seventeen (17) school sites located throughout the Town. An essential aspect of a school zone's traffic control system is establishing roadway travel speeds and speed limits. As part of our initial work performing a School Zone Audit, it was noted several school locations had surrounding roadways (rural two-lane undivided roads) that do not meet the 25 mph prima facie speed limit and did not have a posted speed limit, which per CVC 22349, allows for vehicle travel up to 55 mph. As such, we are performing a follow-up spot Engineering and Traffic Survey (E&TS) to establish a posted speed limit and confirm appropriate School Zone and other Advance Warning signage for nine (9) locations near seven (7) schools noted below in Table 1:

INTRODUCTION
As part of the initial School Zone Audit, it was noted several school locations had surrounding roadways with no speed limit posted. An essential aspect of a school zone's traffic control system is establishing roadway travel speeds and speed limits. With several rural roads near schools without a posted speed limit, California Vehicle Code (CVC) 22349 allows for vehicle travel up to 55 mph on a two-lane undivided highway. As such, we are performing a follow-up spot Engineering and Traffic Survey (E&TS) to establish a posted speed limit and confirm appropriate School Zone and other Advance Warning signage for nine (9) locations near seven (7) schools:

Apple Valley High School – Sandia Road (Navajo Road to Mohawk Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, Sandia Road is a two-lane Collector and within the subject limits there is no posted speed limit.

High Desert Premier Academy – Nisqually Road (Navajo Road to Central Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, Nisqually Road is a Secondary Road and within the subject limits there is no posted speed limit.

Sandia Academy – Sandia Road (Mohawk Road to Kiowa Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, Sandia Road is a two-lane Collector with no posted speed limit and does not meet the CVC criteria for 25 MPH Prima facie.

Sycamore Rock Elementary School – Joshua Road (Zuni Road to South Road): Per the California Highway System Functional Roadway Classification, Joshua Road is a Major Road, and around the school, has no posted speed limit signs and does not meet the requirements for 25 mph prima facie.

Sycamore Rock Elementary School – South Road (Central Road to Joshua Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, South Road is a Local Road, and in the area of the school, has no posted speed limit signs and does not meet the requirements for 25 mph prima facie.

Vanguard Preparatory School – Mesquite Road (Pahute Road to Ottawa Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, Mesquite Road is a Collector Road, and in the area of the school, has no posted speed limit signs and does not meet the requirements for 25 mph prima facie.

Vanguard Preparatory School – Ottawa Road (Central Road to Joshua Road): Per the Town of Apple Valley Street System General Plan Exhibit II-6, Ottawa Road is classified as a Secondary Road, and in the area of the school, has no posted speed limit signs and does not meet the requirements for 25 mph prima facie.

Apple Valley Christian Academy – Outer Highway 18 N (Tao Road to Rimrock Road): Per the California Highway System Functional Roadway Classification, Outer Highway 18 North is a Major Collector, and in the area of the school, has no posted speed limit signs and does not meet the requirements for 25 mph prima facie.

Apple Valley County Education Center – Pahute Road (Navajo Road to Quinnault Road): Per the Town of Apple Valley Circulation Element Street System General Plan Exhibit II-6, Pahute Road is classified as a Collector with no posted speed limit and does not meet the CVC criteria for 25 MPH Prima facie.

METHODOLOGY
The method used for conducting this E&TS is based on the California Vehicle Code section 627 and is detailed in the CA MUTCD. In accordance with CVC Section 627, an E&TS consists of engineering measurements of the prevailing free flow speeds in the proposed roadway segment, a review of the collision history, and a review of roadside conditions.

Free Flow Speed Data: When a speed limit is to be posted, it shall be established at the nearest 5 mph increment to the 85th percentile speed of free-flowing traffic, rounding as standard mathematics directs. As such, free flow vehicle speeds were collected for each location, by the Town of Apple Valley staff, with a total of 100 spot speed measurements (50 per direction) in line with the CVC. The Town staff performed this work with radar equipment with current calibration certification. Town staff performed the measurements along the roadway and field documented other pertinent conditions, which were then provided to Michael Baker staff to post process and analyze.

Michael Baker used these to calculate for each segment and direction the 85th Percentile Speed (Prevailing Speed), 50th Percentile Speed, 10 MPH pace (Pace), Vehicles within Pace, and Percent Vehicles within Pace to allow for determination of appropriate prevailing speed to establish a speed limit.

Collision Data: An extensive Town wide collision analysis has already been performed as part of our LRSP being performed for the Town with specific collision analysis in the surrounding areas specific to our speed survey segments. As such, in compliance with CVC 627 we will report our findings for the proposed study segments, report any speed related issues that may justify the reduction of speed below the calculated 85th percentile prevailing speed (since there is no posted speed limit present), and compare with statewide collision rates.

Evaluating Existing Conditions: Speed limits are also established to advise those on the road of conditions which may not be readily apparent to a reasonable driver. Michael Baker conducted data analysis and field assessment of the existing conditions to provide sufficient documentation to ensure that all conditions not readily apparent to drivers are acknowledged in this report. Accident history, roadway geometry, traffic and road conditions, and land use were analyzed in determining speed limits.

In adopting CVC Section 22358.5, the Legislature aims to prevent special downward speed zoning due to any physical conditions such as width, curvature, grade and surface conditions, or any other condition that is readily apparent to a driver, in the absence of other factors.

SPEED MEASUREMENT PROCEDURES
Radar speed measurements were conducted in September, October, and December 2021 to obtain data regarding the prevailing speed of vehicles in the study area. The following describes the data collection process used to measure vehicle speeds with electronic radar on selected streets within the Town of Apple Valley. Traffic in both directions was recorded during the survey period. To ensure capture of free flow speed, the specific location of measurement for each segment was selected after considering the following:
• Minimal stop sign and traffic signal influence.
• Little to no visibility restrictions.
• Uncongested traffic flow.
• Avoid influence from curves or other roadway conditions that would affect the normal operation of a vehicle.

Page 493 of 530 ends

Page 5 ends

On each segment, speeds were measured for 100 vehicles, 50 in each direction, for a minimum of one hour. The exception was for Mesquite Road, which due to low volumes the sample only included 50 vehicles total. The surveys were conducted in good weather conditions during off-peak periods. Speeds were read directly from an electronic handheld radar unit in an unmarked vehicle on all of the segments. Speed survey data used in this report can be found in Appendix A.

ACCIDENT HISTORY
Accident history was obtained from the Statewide Integrated Traffic Records System (SWTRS) and Transportation Injury Mapping Data System (TIMS) for the period of January 2016 - December 2020. Using this data and collected/sourced average daily traffic volumes, accident rates on study segments were calculated and are expressed in accidents per million vehicle miles (mvm). To compare calculated accident rates to expected accident rates, the “2018 Collision Data on California State Highways” from Caltrans was used. The table below shows the expected 3-year average accident rates (from 2016, 2017, and 2018) for Rural Roadways according to this document. Accident rate comparisons and collision data for five years are found in Appendix B.

EXISTING CONDITIONS EVALUATION
Michael Baker conducted a field assessment of the existing conditions to provide sufficient documentation to ensure that all conditions not readily apparent to drivers are acknowledged in this report. A summary of the collected and evaluated segment data is outlined below in Table 4.

ESTABLISHING RECOMMENDED SPEED LIMITS
Per CVC 21400 (b) The Department of Transportation shall revise the California Manual on Uniform Traffic Control Devices, as it read on January 1, 2012, to require the Department of Transportation or a local authority to round speed limits to the nearest five miles per hour of the 85th percentile of the free-flowing traffic. However, in cases in which the speed limit needs to be rounded up to the nearest five miles per hour increment of the 85th-percentile speed, the Department of Transportation or a local authority may decide to instead round down the speed limit to the lower five miles per hour increment, but then the Department of Transportation or a local authority shall not reduce the speed limit any further for any reason.

Per the CA MUTCD section 2B.13 notes that “Speed limits are normally set near the 85th-percentile speed that statistically represents one standard deviation above the average speed and establishes the upper limit of what is considered reasonable and prudent.”. As part of our review also considered other statistical benchmarks to confirm appropriateness of any rounding down stated in CVC21400(b). Located in Appendix A also includes the calculations for Average/Mean Speed, one standard deviation above the average speed (Std Dev), 50th Percentile Speed, 10 MPH pace (Pace), Vehicles within Pace, and Percent Vehicles within Pace to allow for determination of appropriate prevailing speed to establish a speed limit. Based on the data collected and evaluated in this report, the recommended speed limits are summarized in Table 5.

standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. The recommended speed for the segment is 45 mph based on the nearest 85th percentile speed of 46 mph and other findings noted in Appendix A.

Sandia Academy – Sandia Road (Mohawk Road to Kiowa Road): The roadway segment is a rural two-lane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. Based on the near segment east of Mohawk Road being established at 40 mph, and the 85th percentile speed of 44 mph and Std Dev of 43.5 mph, it is recommended to round down to 40 mph as well.

Sycamore Rock Elementary School – Joshua Road (Zuni Road to South Road): The roadway segment is a rural twolane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. The recommended speed for the segment is 55 mph based on the nearest 85th percentile speed of 56 mph.

Sycamore Rock Elementary School – South Road (Central Road to Joshua Road): The roadway segment is a rural twolane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. The recommended speed for the segment is 50 mph based on rounding down the nearest 85th percentile speed of 54 mph.

Vanguard Preparatory School – Mesquite Road (Pahute Road to Ottawa Road): The roadway segment is a rural twolane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. The recommended speed for the segment is 45 mph based on the nearest 85th percentile speed of 47mph.

Vanguard Preparatory School – Ottawa Road (Central Road to Joshua Road): The roadway segment is a rural twolane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average, it was confirmed that conditions are not readily apparent to a reasonable driver that would justify a reduction in posted speed. The recommended speed for the segment is 45 mph. Though the 85th percentile speed was recorded as 48 mph, statistically the recordings only needed one vehicle lower than 48 MPH to have changed the 85th percentile to 47 mph.

Additionally, the Std Dev was 47.07 mph which further supports rounding down to a 45 mph speed limit.

Apple Valley Christian Academy – Outer Highway 18 N (Tao Road to Rimrock Road): The roadway segment is a rural two-lane undivided road near an existing school location and does not meet the 25-mph prima facie speed limit per CVC standards. Upon the review of the existing conditions of the segment and the collision rate being below the state average,

Town Council Agenda Report
Date: January 24, 2023
To: Honorable Mayor and Town Council
Subject: SUBSTANTIAL AMENDMENT TO THE 2021-2022 AND 2022-2023

ACTION PLANS

From: Douglas Robertson, Town Manager
Submitted by: Silvia Urenda, Housing and Community Development Supervisor Housing
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
It is recommended that the Town Council:

A. Conduct a public hearing and upon accepting public testimony; B. Approve a Substantial Amendment to the Community Development Block Grant (“CDBG”) 2021-2022 and 2022-2023 Annual Action Plans (“Action Plans”) by repurposing $909,947 to existing and newly proposed CDBG eligible activities; and C. Authorize the Town Manager, or designee, to execute and transmit all necessary documents, including the Substantial Amendment to the Action Plans, and any additional amendments, to ensure the Town’s timely expenditure of CDBG funds.

BACKGROUND
The U.S. Department of Housing and Urban Development (HUD) requires all entitlement communities receiving CDBG funds to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development activities. The Town Council adopted the 2022-2026 Consolidated Plan on May 10, 2022.

The Consolidated Plan is carried out through Annual Action Plans which provide a concise summary of the actions, activities, and the resources that will be used each year to address the priority needs and specific goals identified in the Consolidated Plan. The Town must submit an Annual Action Plan to HUD each year of the five-year Consolidated Plan period. The Town Council adopted and submitted the 2021-2022 and 2022-2023 Action Plans to HUD by the required deadline dates of each year.

Page 516 of 530 ends

In accordance with the Town’s Citizen Participation Plan, a Substantial Amendment to a Consolidated Plan and Action Plan is required when a “substantial” change is proposed to funding priorities, elimination or addition of activities not previously identified in the Action Plan, and changes to the goals and objectives. This substantial amendment to the Action Plans is necessary because the Town is proposing to cancel three (3) activities, reduce the funding of two (2) activity budgets and allocate unprogrammed and program income dollars in the combined amount of $909,947 to the Town’s existing 2022-2023 Residential Rehabilitation Program and Hilltop House Demolition Project and newly proposed ADA Golf Improvement Project.

ANALYSIS
Program and Project Summaries
2022-2023 Residential Rehabilitation Program
The additional funding will provide ongoing financial assistance to rehabilitate lowincome single family owner-occupied homes. Such improvements will address health and safety concerns as well as code violations. The RRLP program resumed to normal since the pandemic and has been a highly demanded and successful program for the Town.

Hilltop House Demolition Project
In November 2022, the Hilltop House demolition project was completed. The final costs included labor compliance, administrative time, and construction. Staff anticipated additional funding would be required, once the project was complete.

ADA Golf Improvement Project 2023
The proposed ADA project is focused on addressing accessibility standards at the Apple Valley Golf Course and Community Center. Accessibility improvements include but are not limited to replacing existing ADA asphalt parking stalls with concrete (for compliance and longevity), installing an ADA pathway from the north parking to the main entrance, and improving the ADA path of travel to the tennis courts and main building.

The project also includes installing new doors, providing water stations, and providing ADA compliant restrooms in the main building, Lloyd Mangrum Room, and golf course.

The accessibility improvements design, including asbestos and lead testing, have been completed using Quimby funds. Construction will begin on March 1, 2023, pending Council approval. CDBG will fund all construction, and staff will allocate additional monies as needed to complete.

Subtotal $909,947
Looking forward to 2023, the Town had to identify the impacts that Covid-19 had on spending HUD funding in a timely manner. Reprogramming the $909,947 will ensure that the Town’s CDBG funds are used to improve the quality of life for our residents. The Town Council’s approval of the recommended action adopts the Substantial Amendment to the Action Plans, thereby allocating those resources into the CDBG budget. While we focus on the projects proposed, staff will continue to prepare the following tasks for the upcoming Action Plan.
2022-2023 Village Sidewalk Project
The Village Sidewalk Project’s 2022-23 allocation will be cancelled; however, staff is closing out the Neighborhood Stabilization Program (NSP) funded under the Federal Housing and Economic Recovery Act of 2008, and the NSP balance will be reallocated to the CDBG program to fund the Village Sidewalk Project. Staff will continue to work with

Page 518 of 530 ends

the Engineering division to combine CDBG with other state grant funding to prepare the project for construction in late 2023.
2022-2023 Microenterprise Assistance Program
The Microenterprise Assistance Program was developed during the Covid-19 pandemic to assist small business owners (less than five employees), with emergency grant funds.

To date, the Town has funded four Microenterprise businesses along with using special Covid-19 HUD funding, to fund eleven Small Businesses (greater than five employees).

As businesses have moved forward and adjusted post pandemic, staff will work on reconstructing the Microenterprise Assistance Program to assist businesses with current and future needs unrelated to Covid-impacts.

FISCAL IMPACT
All entitlement funds (i.e., not program income), impacted by the Substantial Amendment have been awarded to the Town and budgeted to the activities in Action Plans and Substantial Amendments adopted by the Town Council. The Housing and Community Development Department is proposing to:

1. Decrease the following accounts:
a. 2120-4210-7430-0805 by $6,691
b. 2120-4210-7574-2100 through 2102 by $395,701
c. 2120-4210-7430-0806 by $40,000
d. 2120-4210-9218-0000 by $300,000
e. 2120-4210-7881-0000 by $167,555

2. Increase the following accounts:
a. 2120-4210-7570-2100 through 2102 by $113,340
b. 2120-4210-9220-0000 by $105,386

3. Create one (1) new account number under the 2120 CDBG Fund Account with the following budgets:
a. ADA Golf Improvement Project - $691,221

EXECUTIVE SUMMARY
Background
The U.S. Department of Housing and Urban Development (HUD) requires all entitlement communities receiving Community Development Block Grant (CDBG) funds, such as the Town of Apple Valley, to prepare and submit a Consolidated Plan every five (5) years to establish a unified, strategic vision for economic development, housing and community development actions.

The Consolidated Plan encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities.

The Consolidated Plan is carried out through Annual Action Plans which provide a concise summary of the actions, activities, and the specific federal and non-federal resources that will be used each year to address the priority needs and specific goals identified in the Consolidated Plan.

In compliance with the Town’s Citizen Participation Plan (CPP), a Substantial Amendment to a Consolidated Plan and Action Plan is required when a “substantial” change is proposed as it relates to funding priorities, proposed activities, goals, and objectives. This substantial amendment to the Action Plans is necessary because the Town is proposing to cancel three (3) activities, reduce the funding of two (2) activity budgets and allocate unprogrammed and program income dollars in the combined amount of $909,946.90 to the Town’s existing 2022-2023 Residential Rehabilitation Program and Hilltop House Demolition Project and the newly proposed ADA Golf Improvement Project.
