ADMINISTRATIVE REPORT
MEETING DATE: March 25, 2026 AGENDA CATEGORY: Miscellaneous TO: Honorable Mayor and City Council
FROM: Christian Clegg, City Manager
DATE: March 19, 2026
SUBJECT: Appropriation for Deposit for Acquisition of 1430 and 1440 Truxtun Avenue 1 Appropriate and transfer $425,000 from the Capital Facility Reserve Fund to the Capital Outlay Fund for the payment for earnest deposit to begin the acquisition of the property. (Ward 2) RECOMMENDATION:

Staff recommends Council approve the appropriation
BACKGROUND:

On March 11, 2026, City Council approved the lease and option to purchase the Real Property located at 1430 and 1440 Truxtun Avenue. The property consists of a 10-story office building with approximately 127,504 square feet with a parking garage located on 2.3 acres of land on a prime corner in downtown Bakersfield in near proximity to City Hall.

Council approved the due diligence period for the purchase of the building to begin and the appropriation of funds to contract vendors to perform inspections. However, prior to the start of due diligence the City needs to formally exercise the option to purchase, open escrow, and submit an earnest money deposit of 3% of the sales price ($425,000) to the escrow company. In the event our inspections reveal items that cause the purchase to be cancelled, during the due diligence period, the deposit will be refunded to the City. In the event we purchase the building the deposit will be applied to the sales price.

City Council approved appropriation adjustments in the Capital Facility Reserve fund which have available unallocated fund balances. The City will use the same source of funds to pay for costs to properly examine the building during due diligence and provide for the deposit which will ultimately be used to purchase the building.

Staff is seeking City Council approval to appropriate the additional $425,000 necessary for the earnest money deposit to enable staff to open escrow and enter the due diligence period for the acquisition of the building.

FISCAL IMPACT:

The earnest money deposit of $425,000 will be applied to the sales price at close of escrow for the acquisition of the building. In the event our inspections reveal items that cause the purchase to be cancelled, during the due diligence period, the deposit will be refunded to the City.

Only one bid may be submitted as a “prime contractor” for the same work by any firm, individual, partnership or corporation, or combination thereof. A contractor submitting a bid as a prime contractor may not also submit bids as a subcontractor to other competing prime contractors. Reasonable grounds for believing that any individual, firm, partnership, corporation, or combination thereof is interested in more than one bid for the work contemplated will cause the rejection of all bids in which such individual, firm, partnership, corporation, or combination thereof is interested. Nothing in this clause shall preclude a firm acting as subcontractor to be included as a subcontractor for two or more primary contractors submitting a bid for the work. A contractor who is not submitting a bid as a prime contractor may submit any number of bids as a subcontractor to competing prime contractors.

If a prime contractor fails to specify a subcontractor, or if the prime contractor specifies more than one subcontractor for the same portion of work to be performed more than one-half (1/2) of one percent (1%) of the prime contractor’s total offer, the prime contractor agrees that he or she is fully qualified to perform that portion himself or herself, and that the prime contractor shall perform that portion himself or herself. If after the award of contract, the prime contractor subcontracts, except as provided in Sections 4107 or 4109, any such portion of the work, the prime contractor shall be subject to the penalties named in Section 4111. The substitution of a subcontractor shall not be allowed except as provided by Section 4107 of the Public ContractCode.

• Question: The floor plan does not show what happens to the North wall after the built-in countertop and cabinets are removed. Per A-232 it appears that the HST equipment is sitting in front of a hole in the wall. Please advise for the North wall floor plan as the drawings are unclear. • Answer: Serving window and framing below to be removed. Opening to be patched with gypsum board as required and painted.

RFI #7
• Question: Please advise if the pass through roll up window is to be removed. • Answer: Yes, it is to be removed.

RFI #8
• Question: At the North Wall, will the walls on either side of the HST equipment need to be infilled to abut against the HST equipment as shown on A-121 or will it need space between the equipment and walls as shown on A-232? Please provide detail if infilled on the sides. • Answer: HST equipment will not be “built-in”. No need for infill. Patch opening with gypsum board and paint.

RFI #9
• Question:
a) New Panel in Kitchen is spaced to be a series rated Square D. The main is Zinsco. Does the new panel have to be series rated same type or just 42K?
b) Demo plan shows one door into kitchen be relocated. Floor plan has no new location. Please clarify. c) What is the height of W03 2X wall in kitchen? Does it go past the T-Bar? Is there connection detail? d) Will a 2X wall be needed to cover exposed new gas line at south wall interior of building? e) Will the COB provide the flooring material for the kitchen and the restroom? • Answer:
a) The new Panel ‘K’ has a 200A/3P main breaker. This main breaker will be 42KAIC rated. It will need to be series rated with downstream branch circuit breakers. The panel, panel main, and branch circuit breakers to be Square-D equipment.
b) Door to be removed only. No reuse.
c) Wall to go to underside of T-Bar. Wall to be mounted to CMU Block wall Angles and Powder-driven pins. Note that FRP goes to +8’-0”, then wall is painted above that. d) No gas line on South Masonry wall (only the fridge is on that side). West wall is a 2X stud wall. e) Yes, COB will provide the flooring material for the kitchen and the restroom. Contractor to seal kitchen floor per plans and specifications.

EXHIBIT B

ADMINISTRATIVE REPORT
MEETING DATE: March 25, 2026 AGENDA CATEGORY: Reports
TO: Honorable Mayor and City Council
FROM: Christian Clegg, City Manager
DATE: March 19, 2026
SUBJECT: Community Choice Aggregation Update
and Utility-Scale Distributed Energy Resources Pathways/Feasibility Study Introduction RECOMMENDATION:

Staff recommends that City Council:
 Receive and file the update regarding the Community Choice Aggregation (CCA) feasibility and Utility-Scale Distributed Energy Resources (DER) pathways/feasibility studies;  Provide direction to staff regarding whether to proceed with CCA implementation planning, and if so, authorize staff to begin preliminary community outreach and education efforts; and,  Provide direction to staff regarding whether to proceed with Utility-Scale Distributed Energy Resources (DER) implementation planning.

BACKGROUND:

In 2023, City Council directed staff to continue evaluating the feasibility of Community Choice Aggregation (CCA) following a referral to explore innovative energy strategies that could provide greater local control, increased customer choice, and potential cost savings for Bakersfield residents and businesses. In addition, Council requested staff to explore creative solutions to larger scale energy production, microgrids, and other energy solutions that would create greater savings and serve as economic development tools.

CCA allows participating local governments to procure electricity generation on behalf of customers within their jurisdiction while the incumbent investor-owned utility—Pacific Gas & Electric (PG&E)— continues to provide transmission, distribution, billing, and infrastructure maintenance. Under this model, customers are automatically enrolled but retain the ability to opt out and remain with PG&E for generation services.

Council previously authorized staff to pursue further analysis of whether a CCA structure could be successfully implemented in Bakersfield, including review of financial viability, risk exposure, customer rate competitiveness, and long-term sustainability.

Since the last report, staff engaged the California Choice Energy Authority (CalChoice) to conduct a comprehensive feasibility study evaluating:
 Financial viability and pro forma modeling
 Customer rate competitiveness compared to PG&E
 Risk exposure and reserve requirements
 Governance structure and operational considerations
 Implementation timeline and regulatory requirements
Additionally, staff engaged Willdan to evaluate pathways and the feasibility of utility-scale Distributed Energy Resources (DER) implementation. The intent of this analysis is to determine whether locally generated renewable energy could be leveraged either in coordination with a CCA model, or as standalone programs, to:
o Increase long-term rate stability
o Provide additional local energy cost savings
o Enhance renewable energy portfolio offerings
Furthermore, staff has identified several ways in which a CCA could support local sustainability and economic development goals:
 Easier facilitation of private microgrids for large development projects without reliance on cumbersome utility processes
 Offer local timeline improvement and/or guarantees for power connectivity for new development projects
 More control in pursuing innovative, game-changing industry cluster projects  More flexibility in the creation of economic development or community development incentives through CCA revenues
 More funding flexibility for creating community energy reduction or support programs in alignment with the City Council Goals and the General Plan This update is presented in two parts:
 CalChoice Presentation – Findings and recommendations regarding CCA implementation feasibility
 Willdan Presentation – Pathways and feasibility of utility-scale DER and potential integration with a future CCA
Should Council direct staff to move forward, next steps would include:
 Initiate preparation of a formal Implementation Plan;  Solicit proposals for preparation of the final Implementation Plan to be submitted to the California Public Utilities Commission (CPUC)
Following preparation and Council approval of the Implementation Plan, the Plan would be submitted to the CPUC for certification. Based on regulatory timelines, staff would target a January 2028 CCA implementation date.

FISCAL IMPACT:

The Implementation Plan is estimated to cost between $50,000 and $100,000 and can be funded by existing General Fund appropriations in the non-departmental fund. Some savings can be achieved if community outreach and education efforts can be completed by internal Communications & Marketing staff, limiting the impact to the General Fund.
