11. Conditional Use Permit Findings
A. Conditionally Permitted
The subject property is located within the applicable commercial zoning designation where o<-sale alcohol uses may be conditionally permitted sub ject to approval of a Conditional Use Permit. The proposed Type 21 license upgrade is therefore an allowed conditional use subject to Planning Commission review.
B. Zone Integrity and Character
The property has long operated as a neighborhood market serving the surrounding area. The request does not introduce a new land use, but only e xpands the range of alcoholic beverages that may be sold for o<-site consumption within the existing market. With the site improvements identified on the revised plans, the pro ject will not impair the integrity or character of the zone.
C. Site Suitability
The site is already developed as a retail market with established access, parking, and utility service. The property is physically suitable for the requested license upgrade.
D. Existing Compatibility
Alcohol sales are already permitted under the existing Type 20 license. The upgrade to a Type 21 license does not alter the primary retail function of the market and remains compatible with the existing operation.
E. Future Compatibility
The continued operation of Happy’s Market with an upgraded license will remain consistent with surrounding commercial uses along Los Angeles Str eet. The proposed improvements
to storefront visibility, landscaping, and parking lot condition further support compatibility with the surrounding neighborhood.
F. Utilities and Services
The property is currently served by adequate public utilities and services. No unusual increase in demand on public utilities or services is anticipated from the requested license upgrade.
G. Public Access
The site maintains established vehicular and pedestrian access and existing on-site parking.
No changes are proposed to ingress, egress, or parking layout.
H. General Plan Consistency
The continued operation of an existing neighborhood- serving market with an upgraded o<- sale alcohol license remains consistent with the City’s commercial land use objectives and supports continued neighborhood-serving retail activity.

STAFF REPORT
TO: Honorable Mayor and Members of the City Council
FROM: Manuel Carrillo Jr, Chief Executive Officer
Okina Dor, Director of Community Development
PREPARED BY: Okina Dor, Director of Community Development DATE: August 5, 2026
SUBJECT: Consideration of Mobile Food Truck Vendors and direct staff to bring back an ordinance for City Council's adoption
SUMMARY:
Over the past several years, the City of Baldwin Park and its community have continued to address and refine food truck vending regulations within the city limits. Concerns have persisted regarding enforcement efforts, the strictness of existing regulations, and the challenges posed by late operational hours. In response, the Community Enhancement Division and the Police Department have coordinated closely, including multi-agency collaborations, to address compliance and public safety issues.
To further evaluate and discuss these matters, the City Council held two study sessions—one on March 4, 2026, and another on May 6, 2026. During these sessions, Council provided direction to staff to return with a comprehensive summary report to finalize discussions and present recommended next steps.
RECOMMENDED ACTION:
It is recommended that the City Council:
1. Approve the proposed discussion matrix outlined in the staff report below, along with the site locations provided in the attached document.
2. Direct staff to return at a later date with a draft ordinance for Council consideration and potential adoption.
FISCAL IMPACT:
There is no fiscal impact associated with this item, but due to late-hours enforcement efforts, staff's overtime cost will be affected.
BACKGROUND:
There have been numerous complaints by residents and community members regarding mobile food truck vendors, food cart members and many other vendors throughout the city limits. The community have expressed ongoing concerns, especially regarding mobile food truck vendors that are parked stationary along Baldwin Park Boulevard directly in front of the Sierra Shopping Center (Target Center). As a result, the City Council have held two (2) study sessions, once on March 4, 2026, and the second one on May 6, 2026.
DISCUSSION:
On March 4, 2026, the City Council held a Special Meeting to conduct a Study Session. At said meeting, staff provided an overview of the current requirements and regulations pertaining to time limits for the vending of food from food trucks. The City’s food truck vending regulations that limit the parking of food trucks in the City to no more than ten (10) minutes in a single location. Those provisions are contained in Section 122.04(H) of the Baldwin Park Municipal Code and provide as follows:
“(H) No vending from such vehicle shall be permitted for a period of time in excess of ten minutes in any one location and said vehicle must be moved a distance of not less than 100 feet between consecutive stops at which vending occurs."
Questions were also asked of staff as to how many food truck businesses are currently licensed in the City. The City's Business License records confirmed seven (7) total food trucks are legally licensed within the city limits.
Two of which are constantly parked along Baldwin Park Boulevard directly in front of Sierra Center, exceeding the ten (10) minute time limit.
On May 6, 2026, the City Council held another Special Meeting to conduct another Study Session in order to fine- tune Council's directive to staff. At said meeting, Council directed staff to bring back a finalized summary matrix that captured the Council's directives. The items were directed to be brought back to a regularly scheduled City Council Meeting under Report of Officer's. The final matrix is as follows:
