AGENDA ITEM
AGENDA MATTER:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW, CALIFORNIA, AMENDING AND ESTABLISHING SPECIFIED FEES FOR CITY SERVICES (FY 2024/2025) EXECUTIVE SUMMARY:
Staff has completed the annual process of thoroughly reviewing the City's current fees effective for the 2024/2025 fiscal year. The annual review is conducted to ensure that fees cover the processing costs of the service request or, at minimum, that the level of subsidy being provided for services by the City Council desires to maintain adequate and at amounts that the City Council desires to maintain. The Resolution to adopt the Fiscal Year 2024/2025 Master Fee Schedule is included in the attachment for the Council's review and consideration.
DISCUSSION:
The City of Barstow’s Master Fee Schedule is reviewed annually by city staff to determine if fees that are being charged continue to cover the processing costs of the service request or, at minimum, that the level of subsidy being provided for services by the City are adequate and at amounts that the City Council desires to maintain. Attached to the staff report is the City Council Resolution (Attachment A) which contains the proposed Master Fee Schedule for FY 2024/2025. The Master Fee Schedule contains all the fees the City charges for various functions and services performed for the community. An annual review is conducted whereby each department provides suggested changes to the Master Fee Schedule and the proposed fee schedule has been collectively amended to reflect staff’s recommendations. The list of proposed changes from FY 2023/2024 is contained within the Table of Amendments to the Master Fee Schedule. If approved, the newly adopted fee schedule will go into effect on July 1, 2024.
FISCAL IMPACT:
Any fees, existing or newly proposed, which are charged by the City of Barstow help to offset the actual cost of providing the service. Most fees are partially subsidized and do not fully cover the actual cost of service. For any fee increases adopted, the City will receive additional revenue to reduce the amount of the subsidy, if any. If the attached Fee Schedule is not approved, corresponding cuts in the City's budget may need to be considered to offset the associated loss of resources.
RECOMMENDED ACTION:
Staff recommends that City Council adopt the attached Resolution No. XXXX-2024 amending and establishing the Master Fee Schedule for Fiscal Year 2024/2025, and waive the full reading. 20 Packet Pg. 372

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BARSTOW, CALIFORNIA ADOPTING A MASTER
FEE SCHEDULE (FY 2024/2025)
WHEREAS, the City Council of the City of Barstow has the authority to establish fees for City services; and
WHEREAS, the City finds it necessary to recover the costs of providing certain City services and said fees do not exceed the reasonable costs of providing the services for which fees are imposed; and
WHEREAS, the consolidation of all City fees will assist the public, as well as City staff in readily locating fees and continue the City's quest for governmental transparency; and WHEREAS, the proposed Master Fee Schedule will supersede any previously adopted or established fee for specified City services; and WHEREAS, the Master Fee Schedule is evaluated each year to ensure that services are provided while consideration is taken into account in regard to cost recovery for services provided by the City; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BARSTOW DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The foregoing recitals are true and correct, and the City Council so finds and determines:
A. For the convenience of the public it is desirable to gather in a single document a comprehensive list of fees and service charges imposed by the City for City services.
B. The document known as the "Master Fee Schedule" is attached to this resolution and is made a part hereof by this reference. Each fee or service charge is identified and a new or increased fee is shown in green font.
C. In developing new or increased fees for the Master Fee Schedule, City staff has analyzed the cost to administer the various programs, activities and applications for which the City has proposed a new or increased fee or service charge and that the increased fee or charge does not exceed the estimated cost of providing such service.
D. It is not the intention to repeal previously adopted fees and adopt new fees of exactly the same amount from one fiscal year to the next, but is simply repeating these fees with the Resolution so that the Master Fee Schedule can be a comprehensive source of City fees and service charges.

SpecPro generates a monthly stray animal monitoring report detailing the results of monitoring conducted along with actions taken, if any, based on results of monitoring.
SpecPro monitors all seven subdivisions at least once a day. Patrols consist of 30 min drives throughout each area.
Foot patrols and canvassing are done within all areas to ensure full coverage behind and around housing where the view is hidden from the road.
Conduct Live Trapping: SpecPro conducts trapping activities for stray animals, based on survey results and reports received. Using the appropriately sized humane box-type trap for the target animal, SpecPro conducts trapping activities for stray animals. Traps are positioned in areas where stray animals are known to occur or are frequently seen.
Management of Captured Animals: SpecPro develops and maintains a daily log of all animals captured to include species, sex, estimated age, whether microchipped or not, date of capture, vaccinations, and final disposition at a minimum. Within one hour of capture, SpecPro examines/scans the animal with a microchip reader to determine if the captured animal has ever been microchipped or tagged to identify the animal’s owner.
Within two hours of capture, SpecPro takes the animal to the Fort Irwin Veterinary Services Clinic to determine if the animal’s health poses a threat to other animals in the temporary holding facility or on the installation. For animals captured during non-duty hours, the animals are held in isolation until the next operational duty day for the Veterinary Services Clinic then the animal is taken immediately to Vet Services for assessment. If the animal is in poor health and not recoverable Veterinary Services euthanizes the animal via humane lethal injection and disposes of the animal carcass in accordance with established guidelines.
Stray Animal Owner Contact: If the stray animal is micro-chipped and the owner identifiable, SpecPro attempts to contact the animal owner to inform them of the location of their animal. SpecPro makes repeated attempts (minimum twice per day) to contact the animal’s owner over the course of three business days. All attempts to contact the owner are annotated in a daily log that includes the date, time, telephone number, name of person that was attempted to be contacted and the results of the effort.
Stray Animal Vaccination: If the stray animal is not micro-chipped SpecPro views the Fort Irwin Facebook page to determine if the owner has posted a message looking for their pet. If no posts are identified for the stray SpecPro within 24 hours vaccinates the animal (canine: Da2PPV, Bordetella, Dewormer) (feline: FVRCP, Bordetella, Dewormer) and conducts a basic health exam (For strays remaining in the facility an extended period a second or third set of vaccinations shall be given as appropriate according to veterinary guidelines). All vaccinations given are recorded both on the stray animal’s kennel card and in an electronic database and reported to the COR and CO no later than the 5th working day of each month for the preceding month.
Control and Care of Privately Owned Animals: Upon identification of the animal owner or an adopter, SpecPro drafts a letter, in accordance with paragraph 6. e. of United States Army Garrison, Fort Irwin and National Training Center Policy #5, Control of and Care for Privately Owned Animals on Fort Irwin, for submittal to the COR. The letter is reviewed, approved and staffed through the Directorate of Public Works, Environmental Division, to the Garrison Commander for signature. The letter is submitted no later than five (5) days after owner pick-up of stray animal and is submitted digitally in MS Word format.
Animal Control Facility Operations: SpecPro maintains a log of all animals transferred to such facilities/organizations to include type animal, breed, identifying marks, chip number, owner if known, date of capture, date and time for notification of owner/attempts to contact owner, date of transfer, and the name of the individual at the receiving facility/organization accepting the animal. A copy of the animal transfer log is submitted to the COR and CO digitally within 5 working days of transfer of any animals to such facilities/organizations.

Animal Control Facility Cleaning: Good sanitation is an integral part of humane animal housing. Proper cleaning and disinfection practices help reduce the transmission of infectious diseases to both animals and people, and result in a cleaner and healthier environment. A clean facility also has the added benefits of increasing the comfort level of the animals and presenting a positive image of the facility to the public. Protocols for proper sanitation are essential for any animal control program. Providing education and training as well as ensuring compliance with those protocols is also essential.

7. Chapter 7 - Proposal Exceptions
SpecPro assumes animal control only applies to domestic/stray cats and dogs SpecPro assumes a veterinary office will be contracted by the City of Barstow for spay, neuter, and wellness exams at the Shelter in compliance with American Veterinary Medical Association guidelines
SpecPro assumes that the vaccines DA2PPV, FVRCP, Bordatella, and Pryantel will be provided by City of Barstow or its Veterinary partner and administered by SpecPro personnel.

SpecPro assumes that a staff of 4 ACOs and 8 Kennel Technicians is sufficient to support the volume of cats and dogs covered through the animal services and shelter operations. If there is excessive volume of cats/dogs, the number of Full-Time Equivalents may need to be re-evaluated.
SpecPro assumes that there will be up to 12 on-call events any given week, and that each on-call event will require an ACO respond with 2 hours of overtime. Any additional overtime hours beyond 24-hours per week will be invoiced per the optional services schedule.
SpecPro assumes that any facility maintenance or repairs will be completed and provided in a timely manner by the City of Barstow or its contractors. SpecPro will provide facility improvement recommendations. It is the responsibility of the City of Barstow to maintain an effective Animal Control Shelter facility, compliant with all federal and state regulations. SpecPro will place customer satisfaction survey cards in the ACF lobby. SpecPro will review satisfaction cards monthly and respond with corrective actions as necessary.
A.2 Plan for Volunteer Services
SpecPro will focus on operations and execution during the initial 6 months. A volunteer plan will be re-evaluated after 6 months. The following may be used as a starting point for the plan for volunteer services. However, this plan will evolve with time. SpecPro may establish a volunteer service plan to provide the Barstow community with an opportunity to enrich and care for the animal populations in the City of Barstow. All volunteers must meet minimum qualifications and training requirements as prescribed by a Volunteer Services Plan.
Volunteers must:
Be at least 18 years of age
Complete a volunteer application
Be able to pass a criminal background check
Participate in required trainings
Sign a waiver of liability
Must love dogs and cats
Attend an orientation (held monthly)
To ensure the safety of the organization’s people and property, and the animals in our care, SpecPro would conduct a background check of our volunteers’ criminal history. Additional background check components will be included based on the scope of the volunteer work. SpecPro will consider volunteer applicants with a criminal record on a case-by-case basis. Typically, crimes against people or animals, or crimes of a more recent nature, may be cause for us to decline a volunteer application.
Duties of volunteers:
Kennel technician
Take dogs on walks
Social media posts
Housekeeping duties such as dish washing and laundering services Support adoption events
Animal-handling roles are available to volunteers that meet minimum qualifications. Onboarding and training for these roles is more comprehensive as they involve animal handling and advanced customer service knowledge. More details of this plan will be provided prior to implementation of a volunteer program.
A.3 Standard Operating Procedure for the Isolation and Separation of Animals All facilities should have a means of providing isolation and separation of animals that allow for the humane care and not put other animals at risk. The isolation may be accomplished by sequestering a specific block of kennels for both dog and cats to ensure that the control of

Allowing animals with severe infectious diseases to remain in the general population is not humane or acceptable and depending on the severity of the disease, SpecPro will determine if euthanasia is more humane than separation/isolation.
Any animal with mild clinical signs (as denoted by a veterinary technician or veterinarian) will be isolated in the marked quarantine area. In the event of an outbreak, physical separation will be established between exposed, at-risk and unexposed groups of animals. In some rare cases, adoptions will be put on hold to prevent further spread of communicable diseases or pathogens.
A.4 Behavioral Assessment System
SpecPro will utilize the Fear, Anxiety, Stress (FAS) scale for behavioral assessments from Fear Free, as pictured in the following figure.
Figure 2: Fear, Anxiety, and Stress Scale from Fear Free A.5 Foster Care Program
SpecPro will focus on operations and execution during the initial 6 months. Implementation of a foster care plan will be re-evaluated after 6 months. The following may be used as a starting point for the plan for foster services. However, this plan will evolve with time. Foster parents may provide temporary homes for animals who are too young for adoption or need time to recover from a health issue. Fostering a shelter animal can be a very rewarding experience! Placing these animals into foster homes not only helps with their growth and recovery, but also opens kennel space so

Fostering pets may occur during periods of high capacity, citizens of the City of Barstow may volunteer to foster animals. Foster parent applications will be submitted to the facility through an online or paper form and additional interviews may be conducted. Foster parents will be required to abide by city and state regulations for maximum number of animals on the property. Food and water must be provided by the foster home, but veterinary costs will be handled through the Animal Services and Shelter Operations veterinary provider. Home checkups will be conducted by the ACOs on a regular basis.
A.6 Euthanasia Methodology and Policies
SpecPro will ensure all animals are held for a minimum of 7-days for redemption to owner. Barring capacity, animals will be up for adoption for an additional 7-days (or more if availability in the facility allows). However, if there is no capacity, stray animals may be euthanized after the initial 7-day holding period. Owner surrendered animals may be euthanized immediately if no capacity exists. Animals with severe communicable diseases or injuries determined by the initial comprehensive exam may be euthanized immediately, waiving the 7-day redemption to owner period. Attempts to contact the owner will be completed prior to any euthanasia determination.
Because it is not possible to predict the number of animals that SpecPro may euthanize over the course of a year, SpecPro has proposed a firm fixed price fee schedule per animal for euthanasia services, including options for carcass disposal and cremation packages. The total number of animals euthanizes by species will be invoiced monthly with back up documentation included.
A.7 Policies and Procedures for Disease Control and Sanitation SpecPro will maintain and operate the shelter in a manner that the shelter facility is clean, attractive, and welcoming to the community in order to best control for disease and promote a sanitary facility. To best meet sanitation requirements, SpecPro recommends that the City of Barstow provide a facility with kennel areas that have floors that slope to a drain for that can be easily disinfected. Additionally, the walls should be sealed with paint or wall coverings that may be properly cleaned, free of gaps or cracks that can harbor disease. SpecPro will use disinfectants and cleaning products that are generally acceptable in the animal control industry such as bleach.
SpecPro will take all reasonable precautions to prevent and control spread of infectious diseases among the animal population at the Barstow ACF. Any infectious outbreak such as kennel cough or cat flu will be immediately treated, the animal will be isolated, and the outbreak will be investigated to prevent further spread. Early detection and immediate isolation and thorough cleaning is critical to disease control.
All dogs, cats, puppies and kittens entering your shelter should be treated for certain parasites in order to protect the rest of the animals, prevent environmental infestation and minimize health threats to staff, volunteers and the public. A minimum shelter parasite control protocol should consist at least of a de-wormer effective against roundworms, tapeworms and hookworms, and flea preventive (and tick preventive for dogs). All of these parasites are common in dogs and cats

The law firm of Colantuono, Highsmith & Whatley, PC., and its predecessor firms and professionals have provided general legal services to the City of Barstow since 1997, with the contract most recently amended and rates last changed in 2022.
At this time, the Firm has proposed an amendment to the contract to adjust the rates to provide for a monthly fixed retainer amount of $10,935 and for special projects services at $245 per hour and labor and employment, litigation, and other pre-litigation disputes or specialized legal services at $310 per hour.
Appellate litigation services, if necessary, will be provided at $375 per hour. Work for the City to be reimbursed by others, such as developers, will be provided at $395 per hour, a higher rater allowing work completed at the City’s sole expense to be kept at lower rates. The agreement also provides for an annual inflationary adjustment per the consumer price index, but capped at 4%, and contingent on a positive annual performance evaluation of the firm and City Attorney by the City Council. All other substantive terms remain the same.
Legal Service Type Current Rate Proposed Rate
General City Attorney Services $10,125 per month $10,935 per month Special Projects $225 per hour $245 per hour

R E C I T A L S:
A. The City desires to retain the Firm to discharge the duties of the office of City Attorney and General Counsel to the City’s subsidiary agencies and to designate a member of the Firm as City Attorney and General Counsel to the City’s subsidiary agencies.
B. The attorneys of the Firm are duly licensed under the laws of the State of California and are fully qualified to discharge the duties of the office of City Attorney and General Counsel to the City’s subsidiary agencies and to provide the services contemplated by this Agreement.
NOW, THEREFORE, the parties hereto agree as follows:
1. Scope of Services.
A. The Firm shall discharge the duties of the office of City Attorney and General Counsel to the City’s subsidiary agencies and shall use its best efforts to provide legal services in a competent and professional manner. The Firm shall provide all legal services to the City of the kind and nature typically provided by an in-house City Attorney's office unless specifically stated otherwise in this Agreement or otherwise directed by the City. Except where conflict of interest rules require otherwise, the Firm shall supervise the activities of all other counsel retained by or for the City and shall review the work of such counsel on behalf of the City.
B. The legal services to be provided by the Firm shall consist of those set forth in Exhibit “A” attached hereto and shall be billed at the rates set forth therein.
2. Designation of City Attorney.
Matthew T. Summers is designated by the Firm as City Attorney and General Counsel to the City’s subsidiary agencies. Mr. Summers will attend all regularly scheduled Council meetings and make best efforts to attend all special Council meetings unless excused by Council or the City Manager or absent due to illness, an annual vacation or to a once-or-twice-per-year business commitment (such as a conference of the League of California Cities) and will supervise all services rendered under this Agreement. The parties understand and agree that the Firm may, from time to time, utilize other attorneys within the Firm to assist Mr. Summers in the performance of this Agreement.

faxes will be charged at $1 per page. All other expenses will be billed at cost, without markup. The Firm will not charge for word-processing services or secretarial overtime. The Firm will make best efforts to avoid the use of outgoing faxes, and the costs associated with them, by use of email, U.S. Mail, and other means. These items will be separately designated on the Firm's monthly statements as "disbursements," and will be billed in addition to fees for professional services. The Firm will not charge the City for routine computerized legal research such as Lexis-Nexis or Westlaw research, but will pass through to the City at cost, without markup, its cost for use of specialized databases outside the Firm's contract with Westlaw or a similar provider.
b) Time will be charged by the Firm in increments of 1/10 of an hour (i.e., six-minute units). The rate structure in general, or the rates of particular attorneys, may be increased or altered from time to time, after written notice to the City. No such change shall affect the terms of Exhibit A to this Agreement absent amendment of this Agreement pursuant to Section 8 below. To the extent feasible, such adjustments will be made so as to coincide with the beginning of the City's fiscal year. c) The Firm will not charge the City for the time devoted to travel to and from the City's offices.
4. Resolution of Fee Disputes.
The City is entitled to require that any fee dispute be resolved by binding arbitration in San Bernardino County pursuant to the arbitration rules of the San Bernardino County Bar Association for legal fee disputes. In the event that City chooses not to utilize the San Bernardino County Bar Association's arbitration procedures, City agrees that all disputes regarding the professional services rendered or fees charged by the Firm shall be submitted to binding arbitration in San Bernardino County to be conducted by JAMS or another mediation service agreed upon by both parties in accordance with commercial arbitration rules.
5. Term of the Agreement.
This Agreement shall be effective as of July 1, 2024 and shall be and remain in full force and effect until terminated in accordance with the provisions of Section 6 hereof.
6. Termination of the Agreement.

The Firm has the same right, subject to the Firm's ethical obligations to allow the City sufficient notice prior to termination so that City will be able to arrange alternative representation. In either circumstance, City agrees to secure new counsel as quickly as possible and to cooperate fully in the substitution of the new counsel as counsel of record in any action in which the Firm may represent the City. The Firm agrees to cooperate fully in any such transition, including the transfer of files. ·Great news! Capacity data will be submitted to CalRecycle as the state continues to strive towards meeting the target of recovering at least 20% of all edible food that would otherwise go to waste. A big thank you to the food recovery organizations in Barstow and surrounding areas who continue to accept donations from food generators to feed those in need!

Question: What is necessary to sell whole fruit as a vendor? Answer: A BUSINESS LICENSE! Previously, the health department provided a health permit for all food sales. However, now, items classified as low risk, like whole fruit, do not require a permit. For other products, a health permit is needed before obtaining a business license.

Regrettably, the City of Barstow lacks the necessary infrastructure to support ZEVs daily, presenting a significant challenge that we are actively working to resolve. We are closely monitoring the strategies implemented by other municipalities, such as transitioning to Electric Charging Stations or establishing Hydrogen Fuel Stations. By observing these initiatives, we aim to formulate a five-year plan that must be submitted to the state, essential for our future sustainability and environmental commitment.
