Staff Report
TO: City Council
FROM: Sean Thuilliez, Police Chief
DATE March 7, 2023
SUBJECT: Request to Approve Purchase of Restroom Modular for Police Department – Capital Improvement Project No. PS-08
Description Request to approve the purchase of a restroom modular to add sufficient restroom facilities to the Police Department, including the installation and connection to sewer and water.
Background and Analysis:
The Police Department facility currently serves over 80 employees, not including outside agency personnel, taskforce members, and guests that often visit the facility.
The police facility currently offers only two toilets for women and two toilets and uri nals for men. There are insufficient toilet facilities for the current and projected department staffing levels. This can lead to long wait times, as well as concerns about cleanliness and hygiene.
In considering various options, purchasing a restroom trailer would provide additional facilities to help address these issues. Multiple options were considered, and it was determined that a modular restroom trailer best fit the department’s needs. A modular will add an adequate number of toilets and sinks, handicap accessibility, climate control, and durability.
The procurement process utilized quotes from three vendors, as required by Beaumont Municipal Code 3.01.090. Upon review of the three options, it was determined that Mobile Modular offered the best solution with a modular trailer that provides three additional toilets for women, and three additional toilets and two urinals for men.
The total cost to purchase and deliver this modular restroom trailer is $89,262.53.
Once delivered and leveled, City staff will provide connection to the main facility’s sewer lateral line and water line. The cost for staff labor and supplies is estimated not to exceed $10,000 and will be charged to the project accounting.
Fiscal Impact:
The cost to purchase the modular restroom trailer, including delivery, is $89,262.53.
These funds will come from Capital Improvement Project PS-08.

DATE March 7, 2023
SUBJECT: Approve a Purchase Order to GameTime, A Play-Core Company for a New Playground at Shadow Creek Park – in an Amount Not to Exceed $196,866.14 – Capital Improvement Project No. P-16
Description Purchase order for playground equipment at Shadow Creek Park CIP No.
P-16.
Background and Analysis:
In Fall 2022, the City of Beaumont was awarded a grant through the 2022 California Parks and Recreation Society (CPRS) Statewide Training and Funding Initiative. The initiative provides reduced rates for playground equipment to serve as National Demonstration Sites (NDS). Shadow Creek Park was awarded the funding reduction fo r the purchase and installation of an inclusive playground.
The current Shadow Creek playground is located on an existing basketball court. The proposed design will expand the play area by relocating to the existing grass area and encompass 5,800 sq ft. The existing equipment will be removed, and the site will be refinished into a full basketball court.
As an NDS site, the design adheres to the 7 Principles of Inclusive Playground Design:
Be Fair, Be Included, Be Smart, Be Independent, Be Safe, Be Active, and Be Comfortable. To meet these goals, the site features accessibility ramps, a variety of slides, cozy spaces for sensory relief, musical elements, high -back equipment to maintain proper body position, and opportunities for social inclusion and interaction. The overall plan provides a play space that addresses the physical and social inclusion of people of all ages and abilities.
On January 18, 2023, staff held a Pop-Up in the Park event to gather feedback from local residents on the proposed design. DeAnn’s PAASS Kids, a local group dedicated to providing program and activities to people with special needs, along with the Shadow Creek community were invited to vote on equipment color palettes and accessory structures. Additional input was also sought on the site in general. Information gathered
indicated the need to increase accessibility by using poured in place surfacing and installing additional ADA ramps on Conner Court. Additional equipment suggested the inclusion of a wheelchair swing and additional seating. The feedback was taken into consideration and the project revised to include several suggestions.
The design and equipment are provided by A PlayCore Company, a PlayCore Company (GameTime). GameTime is a playground manufacturer and the exclusive distributor of this equipment in Southern California is Great Western Recreation. This exclusive distribution agreement between the manufacture and the distributer allows the primary vendor to be the sole provider of the PlayCore playground structures. In addition, the 2022 CPRS Statewide Training and Funding Initiative exclusively applies to GameTime playground structures supplied by Great Western Recreation. The Beaumont Municipal Code states in §3.01.070-D that if “the product or service is proprietary in nature and can be obtained only from a limited number of contractors, and that no equivalent products or services are available, the notice inviting bids may be sent exclusively to such contractor.”
At this time staff is recommending to purchase the playground equipment and the safety surfacing product. Staff intends to request bids for installation of the playground equipment and safety surfacing in accordance with the Beaumont Municipal Code.
The total cost of the playground equipment is $196,866.14 (Attachment B). The 2022 CPRS Statewide Training and Funding Initiative provided a discount of $126,262.19 for playground equipment. Staff anticipates the delivery of the playground equipment to take approximately 10 -12 weeks. Staff anticipates the installation of the playground to take place in summer 2023. The estimated installation process will take three weeks.
Fiscal Impact:
The total cost of the playground equipment reflects a discount of $126,262.19 through the 2022 CPRS Statewide Training and Funding Initiative. The purchase of the discounted equipment and installation in the amount of $196,866.14 is funded by CIP No. P-16.

Shadow Creek Park Playground Option 5D GRANT CWO
To Whom it may concern: 1-29-2023
Hello, my name is DeAnn Dobbins. I am the President of DeAnn’s PAASS Kids. Pass Area Activities Sports and Stuff for People with Special Needs. I’m also a proud mom of a wonderful 27-year-old Special needs daughter, Samantha. Samantha has brought much joy to our hearts and lives, teaching us many things and 1 of them is that she sees and utilizes the world differently than we do. That opened our eyes about more things. Samantha is Nonverbal, Physically and Intellectually Delayed. We have worked very hard over the years to get her to be as independent as possible and is still very unstable at times. She still needs much supervision and assistance.
I am writing to you today about your plans to build a new playground at Shadow Creek Park. We were invited by your Parks and Rec department to view the layout of the proposed plans and I am very appreciative to be included. I wanted to share my thoughts and opinion on the access of the play area.
We were hoping you would consider using Rubber Chips or some kind of padding to be placed around the ground as cover instead of Wood Chips. Wood Chips would be like pushing a stroller through the SAND at the BEACH. We have many Wheelchair bound Residents in Beaumont/ Cherry Valley communities, even some who use Walkers or Stroller Chairs. Rubber chips would COMPACT better as the Wheelchairs/Walkers roll across the Play area. This would help the playground be more accessible for ALL and allow them to get out and enjoy the playground as much as possible. We have spoken with many of our friends and families who have Special Needs children here in the Pass area and most of them are looking for Wheelchair Swings, Communication/Sign language board, and a Sensory Wall. If you are not able to provide the BEST accommodations and needs for ALL your residents who may frequent the PARKS in this Community, then maybe it shouldn’t be called an ALL-INCLUSIVE PLAYGROUND.
I’d like to also suggest HANDRAILS at the steps near the park on Conner Street. Without handrails my daughter and many others would not be able to independently walk down those steps without assistance. Along with a Wheelchair ACCESSIBLE RAMP closer to the Gazebo near Conner Street, and more Shaded Areas covering the Playground. Many families we have discussed this with mentioned more shade at ALL parks if possible. We feel this would really accommodate the children and Adults of ALL ages in this Community. Our Special Needs Families really want to and deserve to be involved and have more options in their neighborhoods. We have many Special Needs Families that I’m sure would love to hear about how the city is including them.
We look forward to hearing from you on how the plans for this park turn out. I hope this information serves you well. Thank you very much for your time and consideration.
Sincerely,
DeAnn Dobbins

Staff Report
TO: City Council
FROM: Jeff Hart, Director of Public Works
DATE March 7, 2023
SUBJECT: Agreement for Purchase of Mitigation Bank Credits Associated with Capital Improvement Program (CIP) No. 2017-009 Pennsylvania Avenue Widening
Description Authorize an agreement in an amount of $80,000 for purchase of mitigation bank credits associated with CIP 2017-009 Pennsylvania Avenue Widening.
Background and Analysis:
On August 17, 2022, City Council adopted the Initial Study/Mitigated Negative Declaration (IS/MND) and Mitigation Monitoring and Reporting Program (MMRP) for the Pennsylvania Avenue Widening Project. The MMRP identifies various mitigation measures required to ensure that the Pennsylvania Avenue Widening Project complies with all applicable environmental mitigation requirements identified in the IS/MND (see Attachment B).
One of the mitigation measures, BIO-2, requires the City to offset permanent impacts to
0.1-acres of riverine resources by purchasing 0.1 acres of re-establishment credits and
0.1 acres of re-habilitation credits from the Riverpark Mitigation Bank located within the San Jacinto watershed. On November 15, 2022 , the City Council authorized a letter of credit in an amount not to exceed $96,000 for future purchase in order to prevent a construction delay, as mitigation bank credits were not available for purchase at the time. While the mitigation bank was in the process of drafting the letter of credit, the mitigation credits were released and made available for purchase. As a result, a letter of credit was no longer needed, and the mitigation bank proceeded with preparing a purchase agreement for immediate purchase of the required mitigation credits.
The Riverpark Mitigation Bank has prepared the attached agreement for sale of mitigation credits (See Attachment A) for an amount of $80,000. Execution of the attached agreement will allow the City to purchase 0.2 re-establishment mitigation credits in compliance with the Mitigation Monitoring and Reporting Program for the Pennsylvania Avenue widening project.
Fiscal Impact:
Project funding is based on the approved five-year Capital Improvement Plan. An amount of $80,000 will be paid from the permit budget. The following is a summary of the funding and budget:

DESCRIPTION OF PROJECT TO BE MITIGATED
Name of Project:
Pennsylvania Avenue Widening Project
Project Location:
City of Beaumont, CA
Permitting Agencies File/Tracking Number:
CDFW: EPIMS-RIV-30361-R6
DBESP Reservation for City of Beaumont Pennsylvania Avenue Widening Project
Project Description:
The Project proposes to widen and add two additional lanes to Pennsylvania Avenue between 1st Street and 6th Street, a distance of approximately 2,800 feet. The additional lanes within these limits would result in a four-lane Major Highway per the City of Beaumont General Plan Circulation Element. The widening would require improvements to the existing UPRR at-grade crossing and freeway ramp terminals at the I-10 Freeway within Caltrans right-of-way. Construction of the Project would occur in three phases. Storm drain and utility relocations would occur prior to any major roadway improvements. The first phase would involve construction of the outer improvements for the widening to the north and south of the UPRR tracks with an estimated duration of four months. The second phase would involve the closure of the at-grade crossing to construct the improvements within UPRR right-of-way with an estimated duration of one month. The last phase would complete the remaining portion of construction within the center of the roadway north of the tracks and final paving (three months).
Within the USACE jurisdictional area, the project will include roadway widening, grading, culvert and headwall construction. This includes adding asphalt concrete (21” thick pavement section), curb and gutter, and sidewalk improvements. This also includes fill (514 cy) and excavation (102 cy) consisting of soil, subgrade, base material and asphalt within the USACE jurisdictional area, to accommodate the roadway widening.
An additional 42” RCP culvert (in the north/south direction, constructed using jack and bore construction methodology) is proposed parallel to the existing 42” CMP through UPRR right‐of‐way east of Pennsylvania Avenue, which will have a new rip rap area (up to 20 cy) on the downstream side to help dissipate water flows. Further, an additional 42” CMP and 18” RCP culverts under Pennsylvania Avenue (in the east/west direction) will be extended and associated headwalls will be removed and reconstructed in the new CMP and RCP locations. The Contractor will prepare and establish a
SWPPP.
Species/Habitat Affected:
Vegetation within the Project site primarily includes some ruderal and non-native vegetation, scattered ornamental trees, tall grasses, and invasive shrubs. None of the plant species observed are sensitive species but riparian/riverine habitat in the drainage area would be subject to the Fish and Game Code (FGC) under the jurisdiction of the California Department of Fish and Wildlife (CDFW) and be considered a riverine/riparian area under the MSHCP.
There are no features within the Project site that are dominated by riparian trees, shrubs, or emergent vegetation. However, some rushes are present near the box culverts immediately south of the UPRR tracks, and these drainage features connect to a larger drainage on the vacant lot to the east of the Project alignment. Due to the immediate connectivity of the drainages to a larger riverine/riparian area and the presence of some riparian vegetation, riverine/riparian resources are considered present on the Project site, and the Project would impact portions of this resource.

BIO-3 Bird nesting season generally extends from February 1 through September 15 in southern California and specifically, April 15 through August 31 for migratory passerine birds. In general, Projects should be constructed outside of this time to avoid impacts to nesting birds. If the Project cannot be constructed outside of nesting season, the project site shall be surveyed for nesting birds by a qualified avian biologist within five (5) days prior to initiating the construction activities. If active nests are found during the pre-construction nesting bird surveys, a Nesting Bird Plan will be prepared and implemented which at a minimum will include guidelines for addressing active nests, establishing buffers, monitoring, and reporting. The Nesting Bird Plan will include a copy of maps showing the location of all nests and an appropriate buffer zone around each nest sufficient to protect the nest from direct and indirect impact. The size and location of all buffer zones, if required, shall be determined by the biologist, and shall be based on the nesting species, its sensitivity to disturbance, and expected types of disturbance. The nests and buffer zones shall be field checked weekly by a qualified biological monitor. The approved buffer zone shall be marked in the field with construction fencing, within which no vegetation clearing or ground disturbance shall commence until the qualified biologist has determined the young birds have successfully fledged and a monitoring report has been submitted reviewed and approved by the City of Beaumont. Staff Report
TO: City Council
FROM: Elizabeth Gibbs, City Manager
DATE March 7, 2023
SUBJECT: Discussion and Direction on Sending a Legislative Delegation to Washington D.C. and Sacramento
Description Discussion and direction to staff on potentially sending a legislative delegation to Washington D.C. and Sacramento to lobby for funding for capital improvement projects.
Background and Analysis:
At the February 21, 2023, City Council meeting, Council awarded a contract to David Turch and Associates for lobbying services in Washington, D.C. At that meeting, the Mayor requested that staff return with an item on tonight’s agenda to discuss the detail s of sending a delegation to not only Washington, D.C., but also to Sacramento.
Washington, D.C.
In discussions with our Federal lobbyist, the week of April 24, 2023, would be an ideal week for our delegation to be in Washington, D.C. (Attachment A). The House of Representatives will be in session beginning April 25, 2023, and the City’s delegation could spend up to four days meeting with various elected officials and Federal agencies during that week.
Sacramento
CalCities is hosting a City Leaders Summit in Sacramento from April 12-14, 2023, and included in that event is a full day of meetings with legislators to discuss the most pertinent issues affecting our cities. An added benefit to that event includes two days of in-depth educational session to explore local solutions to statewide problems.
Having face-to-face meetings with our elected officials is one of the most powerful ways to advocate for Beaumont’s most important projects. Furthermore, it promotes Council’s ability to build a valuable relationship with not only our direct representatives, but our neighboring representatives and staff from State and Federal agencies that directly affect projects here in Beaumont.
In considering the size of the delegation, the City Attorney has opined that th e Brown Act does not allow for a quorum or more of the Council to attend private meetings with elected representatives in Sacramento and Washington, D.C. to discuss issues of City concern. Options would be to have less than a quorum attend the meeting or alternatively notice the meeting as a public Brown Act meeting.
It is recommended that Council hold a discussion, appoint members to the delegations and confirm dates of attendance for each trip. Staff will then coordinate with our respective lobbyists to compile a package of pertinent information and schedule appropriate meetings to hand deliver to various elected and staff representatives.
Fiscal Impact:
The current budget includes an allocation of $32,000 to 100-1235-7066-0000 specifically for travel to Washington, D.C. Additional funding is included in the budget for Council to travel to Sacramento for CalCities events.
Recommended Action:
Discuss and give direction to staff.

Staff Report
TO: City Council
FROM: Elizabeth Gibbs, City Manager
DATE March 7, 2023
SUBJECT: Discussion and Direction of Items to be Placed on the City Council’s Consent Calendar
Description Discuss and provide direction to staff on items generally appropriate for the consent calendar.
Background and Analysis:
At the February 21, 2023, City Council meeting, a public hearing was held on the adoption of an ordinance updating Beaumont Municipal Code Chapter 3.02 – Procurement of Professional Services. The proposed modifications and the first reading of the ordinance were approved by a majority of the City Council.
During the discussion, City Council directed staff to bring an item forth tonight to discuss staff reports that would be placed on the consent calendar moving forward once the new ordinance became effective in April.
For purposes of discussion, some of the proposed changes to Chapter 3.02 included:
(1) Section 3.02.060 Award of Contract – increasing City Council required approval to $75,000.
(2) Section 3.02.070 Term of Professional Services – increasing contract award from five years to five years with two one-year renewals, subject to City Council approval.
(3) Section 3.02.090 Contracts under Seventy-Five Thousand Dollars – increasing professional services contracts without competitive bidding process from $25,000 to $75,000.
In essence, the City Manager’s new signing authority would have the following thresholds:
(1) Professional Services Contracts – under $75,000
(2) Maintenance Services and Equipment – under $25,000
(3) Public Works Contracts – under $25,000
Agenda Setting
In the normal course of business building the agenda for each meeting (and under the previous ordinance still in effect tonight), staff generally places items on the consent calendar that have one or more of the following criteria:
(1) non-controversial in nature.
(2) are no more than $40,000 in expenditures.
(3) have been reviewed previously by City Council and are either an informational update or contract amendment.
Such items generally include meeting minutes, warrants, contract amendments to current contracts, maintenance expenditures or professional services contracts under $40,000, items approved in the adopted budget but over $25,000, and bond releases, etc.
Once the draft agenda is finalized by staff, the draft is then reviewed and discussed with the Mayor before posting the final agenda in accordance with the Brown Act.
It is important to note that should the second reading of the proposed ordinance be fully adopted tonight, Item No. 2 in the criteria above – “are no more than $40,000 in expenditures” – unless otherwise directed by Council, would be modified to only include maintenance services, equipment, and public works contracts.
Finally, for procurement of professional services, Item No. 2 would in essence become obsolete and unnecessary to agendize moving forward because the City Manager, by adopted ordinance, would have full authority by City Council to approve professional services expenditures under $75,000. However, City Council would maintain the ability as always to review those professional services expenditures through the warrant review and approval as part of the consent calendar.
Fiscal Impact:
The cost to prepare this staff report is approximately $350.
Recommended Action:
Discuss and provide direction to staff on items to agendize on City Council’s consent calendar.
