Naturally, we expect you to keep us reasonably informed of significant developments regarding this representation.

We review all statements before they are issued to ensure the amount charged is appropriate. The statement for fees is simply the product of the hours worked multiplied by the hourly rates for the attorneys and legal assistants who did the work.

Our hourly rates are based upon the experience, reputation and ability of the lawyer or legal assistant performing the services, and for 2025 range between $265 and $625 per hour for attorneys' time, and between $160 and $210 for the time of paralegals and legal assistants. As a courtesy to you, however, we agree to cap our standard rates at $450 per hour. Our rate structure in general and the rates of particular lawyers may be increased from time to time, and are usually adjusted as of the beginning of each calendar year.

It may be necessary to bill you for items such as, but not limited to, authorized travel, long distance telephone calls, filing fees, photocopying, computerized legal research outside the scope of our Westlaw contract and the like. These amounts will be billed in addition to our fees.

We will send you monthly statements, and expect payment within 15 days of the billing date. If payment is not received within 30 days of the billing date, we reserve the right to charge interest on the unpaid balance at the rate of 1% per month and to terminate our representation.

We rarely have disputes with clients over our fees. Nevertheless, you should be aware that you are entitled to require that any fee dispute be resolved by binding arbitration pursuant to the arbitration rules for legal fee disputes of the County Bar Association in any county in which we maintain an office. We agree that all disputes between us regarding the services rendered or fees charged not resolved via County Bar fee arbitration will be submitted to binding arbitration in Los Angeles County to be conducted by ADR Services, Inc. in accordance with its commercial arbitration rules.

YOU SHOULD REVIEW THIS PARAGRAPH CAREFULLY AND, IF YOU WISH,

SEEK INDEPENDENT LEGAL COUNSEL REGARDING IT, AS YOU AND WE ARE

AGREEING TO FOREGO SIGNIFICANT RIGHTS IN THE EVENT OF A DISPUTE BETWEEN US, INCLUDING THE RIGHT TO A JURY TRIAL.

CITY OF BELL GARDENS

OFFICE OF THE CITY MANAGER

EXECUTIVE SUMMARY
TO:Honorable Mayor and City Council Members
FROM:Manuel Acosta, Acting City Manager
BY:Elizabeth Nava, Director of Recreation and Community Services SUBJECT:Consideration of a Resolution Approving a Grant Agreement Between the City of Bell Gardens and the U.S. Department of Housing and Urban Development for the Veterans Park Refurbishment Project DATE:July 27, 2026
RECOMMENDATION:

It is staff’s recommendation that the City Council adopt the attached Resolution authorizing the Acting City Manager to execute a Grant Agreement between the City of Bell Gardens and the U.S. Department of Housing and Urban Development for the Veterans Park Refurbishment Project.

BACKGROUND/DISCUSSION:

In early 2024, the City of Bell Gardens (“City”) Recreation and Community Services staff submitted an application for the U.S. Department of Housing and Urban Development (HUD), Economic Development Initiative – Community Project Funding Grant (CPF Grant) through Congressman Robert Garcia’s Office for the Veterans Park Refurbishment Project (“Project”). Specifically, staff submitted the application for CPF Grant funds to be used for the refurbishment of the restrooms near the baseball field, as part of the larger Project. On August 28, 2024, the City was notified that it was the recipient of a $700,000 CPF Grant award.

In order to accept these funds, the City must enter into a Grant Agreement with HUD and adhere to the regulations of the grant funds that are set forth in the Grant Agreement.

These funds are reimbursable, which means that the City will pay for project costs and then be reimbursed for expenses made towards the Project.

CONCLUSION:

It is staff’s recommendation that the City Council adopt the attached Resolution, authorizing the Acting City Manager to execute a Grant Agreement with HUD for the restroom refurbishment phase, as part of the larger Project.

FISCAL IMPACT:

The general fund as well as State Proposition 68 grant funds will be used to pay for the baseball restroom phase of the Veterans Park Refurbishment Project work, which will then be reimbursed through the $700,000 CPF Grant.

H. Notwithstanding any other provision of this grant agreement, HUD will not be responsible for payment of any Grant Funds after the date Treasury closes the account in accordance with 31 U.S.C. § 1552. Because Treasury may close the account up to one week

ARTICLE VI. Program-Specific Reporting Requirements

In addition to the general reporting requirements that apply under other provisions of this Agreement, the following program-specific reporting requirements apply to the Grantee:

A. The Grantee must submit a performance report in DRGR on a semi-annual basis and must include a completed Federal financial report as an attachment to each performance report in DRGR. Performance reports shall consist of a narrative of work accomplished during the reporting period. During the Period of Performance, the Grantee must submit these reports in DRGR no later than 30 calendar days after the end of the 6-month reporting period. The first of these reporting periods begins on the first of January or June (whichever occurs first) after the date this Grant Agreement is signed by HUD.

B. The performance report must contain the information required for reporting program performance under 2 CFR 200.329(c)(2) and (d), including a comparison of actual accomplishments to the objectives of the Project as described in Article III, section A of this Grant Agreement, the reasons why established goals were not met, if appropriate, and additional pertinent information including, when appropriate, analysis and explanation of cost overruns or high unit costs.

C. Financial reports must be submitted using DRGR or such future collections HUD may require and as approved by OMB and listed on the Grants.gov website ( https://grants.gov/forms/forms-repository/post-award-reporting-forms) .

D. The performance and financial reports will undergo review and approval by HUD. If a report submission is insufficient, HUD will reject the report in DRGR and identify the corrections the Grantee must make.

E. No drawdown of funds will be allowed through DRGR while the Grantee has an overdue performance or financial report.

F. The Grantee must report and account for all property acquired or improved with Grant Funds as provided by 2 CFR part 200 using the applicable common forms approved by OMB and provided on the Grants.gov website ( https://grants.gov/forms/forms-repository/post-award- reporting-forms). This reporting obligation includes submitting status reports on real property at least annually as provided by 2 CFR 200.330, accounting for real and personal property acquired or improved with Grant Funds as part of Project Closeout, and promptly submitting requests for disposition instructions as provided by 2 CFR 200.311, 200.31, and 200.314.

9 ARTICLE VII. Project Closeout

A. The grant will be closed out in accordance with 2 CFR part 200, as may be amended from time to time, except as otherwise specified in this Grant Agreement.

B. The Grantee must submit to HUD a written request to close out the grant no later than 30 calendar days after the Grantee has drawn down all Grant Funds and completed the Project as described in Article III, section A of this Grant Agreement. HUD will then send the Closeout Agreement and Closeout Certification to the Grantee.

C. At HUD's option, the Grantee may delay initiation of project closeout until the resolution of any findings as a result of the review of semi-annual activity reports in DRGR. If HUD exercises this option, the Grantee must promptly resolve the findings.

D. The Grantee recognizes that the closeout process may entail a review by HUD to determine compliance with the Grant Agreement by the Grantee and all participating parties. The Grantee agrees to cooperate with any HUD review, including reasonable requests for on-site inspection of property acquired or improved with grant funds.

E. No later than 120 calendar days after the Period of Performance, Grantees shall provide to HUD the following documentation:

1. A Certification of Project Completion.

2. A Grant Closeout Agreement.

3. A final financial report giving:

i) the amount and types of project costs charged to the grant (that meet the allowability and allocability requirements of 2 CFR part 200, subpart E);

iii) the amounts and sources of other project funds.

4. A final performance report providing a comparison of actual accomplishments with the objectives of the Project, the reasons for slippage if established objectives were not met and additional pertinent information including explanation of significant cost overruns.

5. A final property report, if specifically requested by HUD at the time of closeout.

10 ARTICLE VIII. Default

A default under this Grant Agreement shall consist of any use of Grant Funds for a purpose other than as authorized by this Grant Agreement, any noncompliance with statutory, regulatory, or other requirements applicable to the Grant Funds, any other material breach of this Grant Agreement, or any material misrepresentation in the Grantee’s submissions to HUD in anticipation of this award. If the Grantee fails to comply with the terms and conditions of the Grant Agreement, HUD may adjust specific conditions of this Grant Agreement as described in 2 CFR part 200, as may be amended from time to time. If HUD determines that noncompliance cannot be remedied by imposing additional conditions, HUD may take one or more of the remedies for noncompliance described in 2 CFR part 200, as may be amended from time to time.

HUD may also terminate all or a part of this award as provided by 2 CFR 200.340 and other applicable provisions of 2 CFR part 200, as may be amended from time to time. Nothing in this Grant Agreement shall be construed as creating or justifying any claim against the Federal government or the Grantee by any third party.

ARTICLE IX. HUD Contact Information

Except where this Grant Agreement specifically states otherwise, all requests, submissions, and reports the Grantee is required to make to HUD under this Grant Agreement must be made in accordance with HUD’s grant instructions found in the document titled “FY2024 Economic Development Initiative - Community Project Funding Grant Guide” that accompanies the Grant Agreement.

As the duly authorized representative of the Grantee, I certify that the Grantee:
☐ Will not use an indirect cost rate to calculate and charge indirect costs under the grant. ☐ Will calculate and charge indirect costs under the grant by applying a de minimis rate as provided by 2 CFR 200.414(f), as may be amended from time to time.
☐ Will calculate and charge indirect costs under the grant using the indirect cost rate(s) listed below, and each rate listed is included in an indirect cost rate proposal developed in accordance with the applicable appendix to 2 CFR part 200 and, if required, was approved by the cognizant agency for indirect costs.

Instructions for the Grantee’s Authorized Representative:

You must mark the one (and only one) checkbox above that best reflects how the Grantee’s indirect costs will be calculated and charged under the grant. Do not include indirect cost rate information for subrecipients.

The table following the third box must be completed only if that box is checked. When listing a rate in the table, enter both the percentage amount (e.g., 10%) and the type of direct cost base to be used. For example, if the direct cost base used for calculating indirect costs is Modified Total Direct Costs, then enter “MTDC” in the “Type of Direct Cost Base” column.

If using the Simplified Allocation Method for indirect costs, enter the applicable indirect cost rate and type of direct cost base in the first row of the table.

If using the Multiple Allocation Base Method, enter each major function of the organization for which a rate was developed and will be used under the grant, the indirect cost rate applicable to that major function, and the type of direct cost base to which the rate will be applied.

If the Grantee is a government and more than one agency or department will carry out activities under the grant, enter each agency or department that will carry out activities under the grant, the indirect cost rate(s) for that agency or department, and the type of direct cost base to which each rate will be applied.

To learn more about the indirect cost requirements, see 2 CFR part 200, subpart E; Appendix III to Part 200 (for Institutions of Higher Education); Appendix IV to Part 200 (for nonprofit organizations); Appendix VII to Part 200 (for state and local governments and Indian Tribes); and Appendix IX to Part 200 (for hospitals).

15 APPENDIX 4 –
Award Term and Condition for Grantee Integrity and Performance Matters

Reporting of Matters Related to Grantee Integrity and Performance

(a) General Reporting Requirement.

(1) If the total value of your active grants, cooperative agreements, and procurement contracts from all Federal agencies exceeds $10,000,000 for any period of time during the period of performance of this Federal award, then you as the grantee must ensure the information available in the responsibility/qualification records through the System for Award Management (SAM.gov), about civil, criminal, or administrative proceedings described in paragraph (b) of this award term is current and complete. This is a statutory requirement under section 872 of Public Law 110-417, as amended (41 U.S.C. 2313). As required by section 3010 of Public Law 111-212, all information posted in responsibility/qualification records in SAM.gov on or after April 15, 2011 (except past performance reviews required for Federal procurement contracts) will be publicly available.

(b) Proceedings About Which You Must Report.

(1) You must submit the required information about each proceeding that—

(i) Is in connection with the award or performance of a grant, cooperative agreement, or procurement contract from the Federal Government;

(ii) Reached its final disposition during the most recent five-year period; and

(iii) Is one of the following—

(A) A criminal proceeding that resulted in a conviction;

(B) A civil proceeding that resulted in a finding of fault and liability and payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more;

(C) An administrative proceeding that resulted in a finding of fault and liability and your payment of either a monetary fine or penalty of $5,000 or more or reimbursement, restitution, or damages in excess of $100,000; or

(D) Any other criminal, civil, or administrative proceeding if—

(1) It could have led to an outcome described in paragraph (b)(1)(iii)(A) through (C);

(2) It had a different disposition arrived at by consent or compromise with an acknowledgment of fault on your part; and

FY 2024 COMMUNITY PROJECT FUNDING
GRANT AGREEMENT NO. B-24-CP-XX-####

16 (3) The requirement in this award term to disclose information about the proceeding does not conflict with applicable laws and regulations.

(c) Reporting Procedures.

Enter the required information in SAM.gov for each proceeding described in paragraph (b) of this award term. You do not need to submit the information a second time under grants and cooperative agreements that you received if you already provided the information in SAM.gov because you were required to do so under Federal procurement contracts that you were awarded.

(d) Reporting Frequency.

During any period of time when you are subject to the requirement in paragraph (a) of this award term, you must report proceedings information in SAM.gov for the most recent five-year period, either to report new information about a proceeding that you have not reported previously or affirm that there is no new information to report. If you have Federal contract, grant, and cooperative agreement awards with a cumulative total value greater than $10,000,000, you must disclose semiannually any information about the criminal, civil, and administrative proceedings.

(e) Definitions.

For purposes of this award term—

Administrative proceeding means a non-judicial process that is adjudicatory in nature to make a determination of fault or liability (for example, Securities and Exchange Commission Administrative proceedings, Civilian Board of Contract Appeals proceedings, and Armed Services Board of Contract Appeals proceedings). This includes proceedings at the Federal and State level but only in connection with the performance of a Federal contract or grant. It does not include audits, site visits, corrective plans, or inspection of deliverables.

Conviction means a judgment or conviction of a criminal offense by any court of competent jurisdiction, whether entered upon a verdict or a plea, and includes a conviction entered upon a plea of nolo contendere.

Total value of currently active grants, cooperative agreements, and procurement contracts includes the value of the Federal share already received plus any anticipated Federal share under those awards (such as continuation funding).

APPENDIX 5 – Specific Award Conditions
NONE.

APPENDIX 6 – Conflict of Interest Requirements

1. Conflicts Subject to Procurement Regulations. When procuring property or services, the grantee and its subrecipients shall comply with the applicable conflict-of-interest rules in 2 CFR 200.317 and 2 CFR 200.318(c). In all cases not governed by 2 CFR 200.317 and 2 CFR

FY 2024 COMMUNITY PROJECT FUNDING
GRANT AGREEMENT NO. B-24-CP-XX-####

17 200.318(c), the Grantee and its subrecipients must follow the requirements contained in paragraphs 2-5 below.

2. General prohibition. No person who is an employee, agent, consultant, officer, or elected or appointed official of the Grantee or subrecipient and who exercises or has exercised any functions or responsibilities with respect to assisted activities, or who is in a position to participate in a decision making process or gain inside information with regard to such activities, may obtain a financial interest or benefit from the activity, or have a financial interest in any contract, subcontract, or agreement with respect thereto, or the proceeds thereunder, either for himself or herself or for those with whom he or she has immediate family or business ties, during his or her tenure or for one year thereafter. Immediate family ties include (whether by blood, marriage, or adoption) the spouse, parent (including a stepparent), child (including a stepchild), sibling (including a stepsibling), grandparent, grandchild, and in-laws of a covered person.

3. Exceptions. HUD may grant an exception to the general prohibition in paragraph (ii) upon the Grantee’s written request and satisfaction of the threshold requirements in paragraph (iv), if HUD determines the exception will further the Federal purpose of the award and the effective and efficient administration of the Grantee’s Project, considering the cumulative effects of the factors in paragraph (v).

4. Threshold requirements for exceptions. HUD will consider an exception only after the Grantee has provided the following documentation:

a. A disclosure of the nature of the conflict, accompanied by an assurance that there has been public disclosure of the conflict and a description of how that disclosure was made; and

b. An opinion of the Grantee's attorney that the interest for which the exception is sought would not violate state or local law.

5. Factors to be considered for exceptions. In determining whether to grant a requested exception after the Grantee has satisfactorily met the threshold requirements in paragraph (iii), HUD will consider the cumulative effect of the following factors, where applicable:

a. Whether the exception would provide a significant cost benefit or an essential degree of expertise to the program or project that would otherwise not be available;

b. Whether an opportunity was provided for open competitive bidding or negotiation;

c. Whether the person affected is a member of a group or class of low- or moderate- income persons intended to be the beneficiaries of the assisted activity, and the exception will permit such person to receive generally the same interests or benefits as are being made available or provided to the group or class;

FY 2024 COMMUNITY PROJECT FUNDING
GRANT AGREEMENT NO. B-24-CP-XX-####

18 d. Whether the affected person has withdrawn from his or her functions or responsibilities, or the decision-making process regarding the assisted activity in question;

e. Whether the interest or benefit was present before the affected person was in a position as described in paragraph (ii);

f. Whether undue hardship will result either to the Grantee or the person affected when weighed against the public interest served by avoiding the prohibited conflict; and

g. Any other relevant considerations.

6. Disclosure of potential conflicts of interest. The Grantee must disclose in writing to HUD any potential conflict of interest.

CITY OF BELL GARDENS

OFFICE OF THE CITY MANAGER

EXECUTIVE SUMMARY
TO: Honorable Mayor and City Council Members

FROM: Manuel Acosta, Acting City Manager

BY: Elizabeth Nava, Director of Recreation and Community Services

SUBJECT: Consideration of a Resolution Approving a Grant Agreement Between the City of Bell Gardens and the LA84 Foundation for the Learn to Swim Program

DATE: July 27, 2026

RECOMMENDATION:

It is staff’s recommendation that the City Council adopt the attached Resolution approving a Grant Agreement with the LA84 Foundation.

BACKGROUND/DISCUSSION:

Staff was notified that the City of Bell Gardens (“City”) was awarded $20,000 in grant funds from the LA84 Foundation to go towards scholarships for the City’s Learn to Swim Program.

These funds allow the City the opportunity to provide approximately 600 free swim lessons to school-aged children currently enrolled in the City’s elementary, intermediate or high schools. To accept the grant funds, the City and the LA84 Foundation must enter into a Grant Agreement.

In 2023, the LA84 Foundation awarded the City $10,000, then awarded the City $20,000 in 2024 and $25,000 in 2025. This year the City was awarded a grant in the amount of $20,000. The grant decreased from the previous year due to LA84’s new requirements for the Learn to Swim Program (“Program”). The LA84 Foundation now requires the City to enter into a Memorandum of Understanding (“MOU”) with the Montebello Unified School District (“District”) and work with the schools to implement the Learn to Swim Program as part of their Physical Education curriculum. Staff is hopeful that the LA84 Foundation will increase funding in the coming years, once the new format for the program proves to be successful.

Staff has engaged the District and are awaiting formal approval of the Program. Once the District provides approval, staff will work with the District and the City Attorney’s office to create and execute the required MOU.

CONCLUSION:

It is staff’s recommendation that the City Council adopt the attached Resolution approving a Grant Agreement with the LA84 Foundation to fund scholarships for the City’s Learn to Swim Program.

FISCAL IMPACT:

None.

Accordingly, the Grantee shall notify the Foundation immediately, in writing, of any material change in the facts set forth in the Proposal or in any other information or document submitted to the Foundation.

Without the advance written consent of the Foundation, the Grantee shall not expend any part of the Grant or interest thereon whether for any purpose or item in excess of the amount budgeted for such purpose or item on the final budget for the Program submitted by the Grantee to the Foundation.

3. Conditions to Grant. Except as such conditions may be waived in writing by the Foundation, the Foundation’s obligations to make the Grant and, if the Grant is payable in installments, to pay each installment thereof shall be subject to each of the following conditions:

5. Representations of Grantee. The Grantee represents and warrants to the Foundation that:
(a) The Grantee is exempt from federal income tax under IRS Section 501(c)(3) and it is not a private foundation as defined in IRS Section 509(a). The Grantee further represents and warrants that (a) the facts supporting the Grantee’s tax-exempt and public charity status under IRS Sections 501(c)(3) and 509(a) have not changed since the issuance of its IRS determination letter, (b) it is not aware of any facts which could result in a change in its tax-exempt and public charity status under IRS Sections 501(c)(3) or 509(a) or relevant state law, or the imposition of excise taxes under IRS Section 4958 dealing with “intermediate sanctions,” (c) the receipt of the grant funds will not change the Grantee’s public charity status under IRS Section 509(a) and (d) that the Grantee does not support or conduct, directly or indirectly, violence or terrorist activities of any kind. Such representations and warranties shall continue through the completion date of this Grant.
(b) This Agreement has been duly authorized, executed and delivered by the Grantee, and constitutes a legal, valid, and binding obligation of the Grantee for the benefit of the Foundation.
(c) All proceedings legally required to be taken by the Grantee in connection with the authorization of this Agreement and of the transactions related thereto, and all approvals, authorizations, consents and other orders of public boards or bodies as may be legally required to be obtained by the Grantee prior to the date hereof with respect to all or any of such matters, have been taken or obtained.
(d) The execution and delivery of this Agreement by the Grantee, and the performance by the Grantee of its obligations hereunder, do not (i) violate any provisions of the Articles of Incorporation, Bylaws or other governing instrument of the Grantee, (ii) violate any law, rule or regulation having applicability to the Grantee or any order, writ, judgment, decree, determination or award to which the Grantee is a party or (iii) result in the breach of or constitute a default under any agreement, lease or instrument to which the Grantee is a party or by which the Grantee is bound.

In addition, the Grantee agrees to cooperate fully with the Foundation, and to allow the Foundation and any person designated by it full and complete access to the facilities, activities and operations of the Grantee, for the purpose of auditing, monitoring and evaluating the Program, the Grant and the compliance of the Grantee with the terms and conditions of this Agreement.

8. Termination. The Foundation shall have the right to terminate this Agreement and the Grant at its sole and absolute discretion, with or without cause. Upon termination of this Agreement by the Foundation, the Foundation shall be relieved from making any further payments to the Grantee in regard to the Grant. The parties agree that the liability of the Foundation hereunder shall be limited to the payment of the Grant pursuant to the terms and conditions of this Agreement. Any contracts entered into or other obligations or liabilities incurred by the Grantee in connection with the Program or otherwise relating to this Agreement shall be the sole responsibility of the Grantee, and the Foundation shall have no obligation or liability whatsoever thereunder or with respect thereto. The Grantee covenants that all contracts to which it shall become a party in regard to the Program and/or the Grant shall include the following clause:

11. Other Provisions. This Agreement and the Proposal together constitute the entire agreement of the parties with respect to the subject matter hereof, and the provisions hereof and thereof have superseded any and all prior and contemporaneous agreements or understandings relating to the matters specifically addressed herein or therein. Failure or inability of either party to enforce any right hereunder shall not waive any right with respect to any other or future rights or occurrences, nor shall waiver of any condition or right in any instance be deemed a waiver of any condition or right in any other instance. If any legal action or other proceeding is brought for the enforcement of this Agreement, or because of an alleged or actual dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party shall be entitled to recover reasonable attorney's fees and other costs incurred in such action or proceeding in addition to any other relief to which it may be entitled. This Agreement and the Grantee's rights, duties and obligations hereunder may not be assigned by the Grantee without the prior written consent of the Foundation. Any attempt at assignment shall be void and a material breach of this Agreement by the Grantee. This Agreement has been negotiated, executed, and delivered and will be performed in the State of California and shall be governed by and construed in accordance with its laws. The Schedules attached hereto are incorporated herein by reference and made a part of this Agreement as if fully set forth herein.

13. Survival. The obligations set forth in Sections 7, 9, 11, 14, 15 and 16 shall survive the termination of this Agreement.

14. Notice. All notices, requests or consents required or permitted under this Agreement shall be in writing and shall be given to the other party by personal delivery, overnight delivery, or regular certified mail, sent to such party’s address as is set forth below such party’s signature hereto or to any other address as any party to whom notice is to be given may have previously furnished to the other as set forth in this provision. OFFICE OF THE CITY MANAGER

EXECUTIVE SUMMARY
TO:Honorable Mayor and City Council Members
FROM:Manuel Acosta, Acting City Manager
BY:Alfonso Hernandez, Acting Director of Community Development SUBJECT:Consideration of Proposed Ordinance No. 972 Amending Chapter 5.63 (Tenant Eviction Protections) to Title 5 (Business Licenses, Regulations and Taxes) of the Bell Gardens Municipal Code
DATE:July 27, 2026
RECOMMENDATION:

It is staff's recommendation that the City Council:

1. Find that the proposed Ordinance No. 972 is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to California Code of Regulations, Title 14, § 15061(b)(3) (CEQA Guidelines), concluding no significant environmental impact would occur; and

2. Waive full reading and introduce Ordinance No. 972 amending Chapter 5.63 (Tenant Eviction Protections) to Title 5 (Business Licenses, Regulations and Taxes) of the Bell Gardens Municipal Code to establish a minimum threshold for evictions based on nonpayment of rent
BACKGROUND / DISCUSSION:

On September 12, 2022, the City Council of the City of Bell Gardens (“City”) adopted Ordinance No. 925, which added Chapter 5.62 (Rent Stabilization) and Chapter 5.63 (Tenant Eviction Protections) to Title 5 (Business Licenses, Regulations and Taxes) of the Bell Gardens Municipal Code (“BGMC”). Ordinance No. 925 became effective on October 12, 2022, establishing the City’s Rent Stabilization and Tenant Eviction Protections (“RSTEP”) Program.

On August 11, 2025, and April 13, 2026, staff presented discussion items to the City Council describing the City’s existing tenant eviction protection regulations and new practices established by the City of Cudahy. At both meetings, the City Council received public comments reflecting community interest to establish a minimum threshold for missed rent— commonly referred to as a nonpayment threshold—below which a landlord could not initiate an eviction.

Proposed Amendment
At the direction of the Mayor, the proposed Ordinance is being brought to the City Council for

consideration. The proposed Ordinance would expand the protections provided under Chapter

5.63 (Tenant Eviction Protections) of the BGMC by establishing a minimum threshold of unpaid rent that must accrue before a landlord may initiate an eviction on that ground. Under the proposed Ordinance, a landlord may only initiate an eviction if the amount of rent missed exceeds one month of the Fair Market Rent (FMR) for the Los Angeles metro area, as determined annually by the U.S. Department of Housing and Urban Development (HUD).

Proposed Ordinance No. 972 recognizes that many households experience temporary financial hardships that may result in a limited amount of unpaid rent. Rather than permitting eviction proceedings to commence immediately, the proposed Ordinance requires that the arrears exceed the applicable one-month FMR figure before the landlord may proceed. This approach mirrors protections that have been adopted in other jurisdictions, like the City of Cudahy.

The current fair market rent is based on the most recently published HUD Small Area Fair Market Rents for a comparable unit.

ENVIRONMENTAL REVIEW:

The City reviewed the environmental impacts of the proposed project pursuant to the California Environmental Quality Act (CEQA). The proposed Ordinance is exempt pursuant to CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption). This Section states that projects that do not result in a direct, or reasonably foreseeable indirect, physical change in the environment are not subject to CEQA review. The proposed amendments implement additional eviction thresholds to the City’s current regulations and do not authorize or approve a permanent and continuous physical activity, nor do they result in a physical change to the environment.

CONCLUSION:

If adopted, the proposed Ordinance would establish a minimum threshold for an eviction by landlord of a tenant for unpaid rent.

FISCAL IMPACT:

No fiscal impact.

EVICTION PROTECTIONS) OF TITLE 5 OF THE BELL GARDENS

MUNICIPAL CODE

WHEREAS, the City of Bell Gardens (“City”) is a general law city, incorporated under the laws of the State of California (“State”); and WHEREAS, California Constitution Article XI, Section 7, enables cities to make and enforce local regulations; and
WHEREAS, on September 12, 2022, the City Council adopted Ordinance No. 925, adding the Chapter 5.62 (Rent Stabilization) and Chapter 5.63 (Tenant Eviction Protections) to Title 5 (Business Licenses, Regulations and Taxes) of the Bell Gardens Municipal Code (“BGMC”), which became effective on October 12, 2022, and together established the City’s Rent Stabilization and Tenant Eviction Protections (“RSTEP”) Program; and
WHEREAS, since the adoption of Ordinance No. 925, the RSTEP Program has advanced the City’s housing stability objectives and created positive impacts for its residents; and
WHEREAS, the City desires to further expand the protections available under Chapter 5.63 (Tenant Eviction Protections); and
WHEREAS, the City finds that establishing a minimum threshold of unpaid rent, measured by reference to the Fair Market Rent published annually by the U.S.

Department of Housing and Urban Development, before a landlord may initiate eviction proceedings for nonpayment furthers the City’s objectives.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BELL GARDENS DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The recitals set forth above are true and correct and incorporated into the body of this Ordinance by this reference.

SECTION 2. Ordinance No. 972

1. Failure to Pay Rent. The tenant has failed to pay rent to which the landlord is entitled. SECTION 4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions might subsequently be declared invalid or unconstitutional.
