• Proposed Entertainment Uses
The following briefly explains the activities associated with the requested Entertainment Permit:
Live Musical Performers – There are no specific musical groups or persons intended to be permanent performers, and it is the request of the applicant to allow for flexibility in which groups or persons may be permitted to perform on any given date and period of time. It is anticipated that performers will range in size from one to 12 musicians.
Additionally, the type of music played, and the specific instruments used may vary based upon the specific performer(s). All musical performers will be situated in the prescribed performance area located in the northwest portion of the floor plan, opposite the bench bar and adjacent to the dining area.
DJ and Karaoke – A DJ booth is proposed to be located to the far side of the performance area, near the end of the bench bar. The applicant anticipates that two to three DJs will actively play recorded music in rotating shifts as necessary. Additionally, the DJ will play recorded music for the purposes of allowing guest to sing along while lyrics are played on screens.
Dancing – The applicant is proposing that dancing be permitted while musicians are performing live, and/or while DJs are playing recorded music. Dancing would be restricted to the area between the performance area and the dining area while live performances are occurring or while DJs are playing recorded music.
• Business & Operations
Mirame Sports Cantina & Restaurant will offer a blend of American cuisine with a Spanish fusion twist, coupled with a full bar featuring specialty cocktails, craft beers, and premium spirits. According to the Applicant, the proposed hours of operation are as follows:
Sunday through Wednesday: 11:00 a.m. to 12:00 a.m.
Thursday through Saturday: 11:00 a.m. to 1:00 a.m.
• Security Personnel and Security Plan
Mirame Sports Cantina & Restaurant proposes safety standards to ensure a safe environment for patrons and staff. The establishment will employ controlled access for patrons where access to the building will only be made from the primary entrance facing Bellflower Boulevard. This will allow for staff to monitor all individuals entering and exiting the premises. Additionally, a camera system will be set-up throughout the establishment to monitor all keys areas including the entrance/exit, the bar area, dining room, and the exterior of the building. During peak hours and any special events, trained security personnel will be employed for additional measures.

BACKGROUND – Continued
• Existing Site Conditions
The property is located on the east side of Bellflower Boulevard bounded by Flower Street to the south and Belmont Street to the north. Bellflower Boulevard generally consists of contiguous buildings which create a continuous street frontage along the boulevard as is typical in a traditional downtown setting. The space proposed for this restaurant is an existing space approximately 5,400 square foot, single-story building with no onsite parking spaces. City owned public parking lots and city streets, may be utilized by customers patronizing the establishment.
• Floor Plan Layout
The restaurant space is rectangular in shape and is accessible from a front (primary) entrance facing Bellflower Boulevard and a rear entrance facing the alley adjacent to the City’s public parking lot. The primary entrance opens to the dining area that is generally located on the north side of the space and consists of a variety of table sizes and shapes that are designed to accommodate small, medium, and large parties, communal tables and benches, and small tables for couples. The kitchen runs along the south side of the space, as does an extensive bench bar. The performance area and DJ booth are located to the east of these areas. The performance area on the north side , and the DJ booth on the south side adjacent to the bench bar. The performance area is designed to be an open area (no stage) that may accommodate musical performers of varying sizes, as well as patrons who wish to participate in Karaoke. On the far east side are located the restrooms and a lounge.
ANALYSIS
• Bellflower Municipal Code
Bellflower Municipal Code (BMC) Chapter 5.36 regulates Entertainment Permits. The City Council may issue a permit if the application is found to be complete in accordance with BMC Chapter 5.36, there are no grounds for denying the permit, and the applicant accepts the permit approval or conditions of approval in writing.
• Proposed Entertainment Request and Hours of Operation
The Applicant is requesting approval for an Entertainment Permit to allow for live musical performers with various instruments, DJ’s for playing recorded music, Karaoke, and dancing. It is the intention to allow for any of these entertainment types to be conducted each night of the week, providing flexibility in scheduling as the demand for a specific type of entertainment warrants, without needing to modify the Entertainment Permit in the future. All entertainment will be conducted inside the existing restaurant and no cover charge will be required for entrance (Resolution No. 25-08, Condition No. 11).

ANALYSIS – Continued
Additionally, all patrons are required to use the entrance fronting Bellflower Avenue for access to the establishment (Resolution No. 25-08, Condition 11). The business owner understands that live entertainment draws additional customers to the restaurant creating a vibrant atmosphere and makes the establishment stand -out amongst the competition.
Any changes to the proposed Entertainment Permit regarding the type of entertainment provided will require a modification to this Entertainment Permit (Resolution No. 25-08, Condition No. 8).
Pursuant to BMC § 5.36.190(F), all entertainment must be closed between the hours of 2:00 a.m. and 6:00 a.m. of any day. As proposed, the business will be open Sunday through Wednesday from 11:00 AM to 12:00 AM, and Thursday through Saturday from 11:00 AM to 1:00 AM. Any changes to the business hours will require a modification to the Entertainment Permit (Resolution No. 25-08, Condition No. 3).
• Public Safety Comments
Comments received from the Public Safety Department focused on the public’s access into and out of the establishment, and the size of musical performers (groups) as big as 20 members. The applicant has proposed that public access will only be available from the primary entrance facing Bellflower Boulevard, which will employ security measures to ensure safety. Additionally, the applicant states that musical performers will not exceed 12 members.
Calls for service – according to the Public Safety Department, no calls for service were received for the past establishment during its tenure at this location.
• Other Recommended Conditions of Approval
The Director recommends approval of the Entertainment Permit with the understanding the Applicant will comply with all the Conditions outlined in the attached Resolution (Attachment A).

City of Bellflower
Resolution No. 25-08
SECTION 2. Factual Findings and Conclusions. The City Council finds as follows:
A. As conditioned, the conduct of the establishment or the granting of the permit would not be contrary to the public health, safety, or welfare because the subject site is an existing restaurant within the TOD SP that is consistent and compatible with the existing surrounding commercial uses; and
B. The application was deemed complete in accordance with BMC Chapter 5.36 and as conditioned, there are no grounds for denying the permit.
SECTION 3. Environmental Assessment. Based on the facts identified in Section 2 of this Resolution, the proposed project is exempt from the requirements of CEQA because it is categorically exempt under the CEQA Guidelines Section 15301 (a Class 1 Categorical Exemption for Existing Facilities).
SECTION 4. Notice of Exemption. The City Manager, or designee, is directed to file a Notice of Exemption in accordance with CEQA Guidelines § 15062 and any other applicable law.
SECTION 5. General Plan Findings. The City Council finds the following facts exist:
A. That the proposed entertainment use is harmonious with the proposed General Plan Land Use designation and is consistent with the following goals and policies of the General Plan – Land Use Element:
(1) General Policy 2.2, to “provide commercial facilities to meet the retail and service needs of the community”;
(2) Town Center Policy 1.1, to “accommodate and promote a full diversity of specialty retail, restaurant and food sales, general merchandise, new apparel and accessories, personal services, entertainment, and cultural uses”; and
(3) Town Center Policy 1.3, to “promote entertainment activities.”
SECTION 6. Approval. Subject to the Conditions listed on the attached “Exhibit A” and the conditions set forth in BMC §§ 5.36.190 and 5.36.200, which are incorporated into this Resolution by reference, the City Council approves the Entertainment Permit.
SECTION 7. Reliance On Record. Each and every one of the findings and determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole.
City of Bellflower
Resolution No. 25-08
SECTION 8. Limitations. The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are the limitations on the City’s ability to solve what are in effect regional, state, and national problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.
SECTION 9. Preservation. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before, this Resolution's effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.
SECTION 10. Severability. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.
SECTION 11. This Resolution will remain effective until superseded by a subsequent resolution.
SECTION 12. The City Clerk is directed to mail a copy of this Resolution to the Applicant and to any other person requesting a copy.
SECTION 13. The Mayor, or presiding officer, is hereby authorized to affix his signature to this Resolution signifying its adoption by the City Council of the City of Bellflower, and the City Clerk, or her duly appointed deputy, is directed to attest thereto.
SECTION 14. This Resolution is the City Council's final decision and will become effective immediately upon adoption. Any challenge brought to this resolution must be filed within 90 days pursuant to Code of Civil Procedure § 1094.6.

SUBJECT: Consideration and possible action to conduct a public hearing to receive comments during the development of the 2025 -2029 Consolidated Plan for the allocation of Community Development Block Grant and HOME Investment Partnership Program funds, and the Analysis of Impediments to Fair Housing Choice.
DATE: February 10, 2025
EXECUTIVE SUMMARY
Every five years, the City must complete two documents to receive its annual entitlement of Community Development Block Grant (“CDBG”) and HOME Investment Partnership Program (“HOME”) funds from the United States department of Housing and Urban Development (“HUD”): A five-year Consolidated Plan (“ConPlan”) and an Analysis of Impediments to Fair Housing Choice. The City is required to conduct two public hearings during the development of these documents to receive public input. This is the first of the two public hearings in this process.
RECOMMENDATION TO CITY COUNCIL
1) Open the public hearing to receive public input on the Five-Year Consolidated Plan and Analysis of Impediments to Fair Housing Choice; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
The U.S. Department of Housing and Urban Development (“HUD”) has not yet announced allocations for local jurisdictions. It is anticipated that the City of Bellflower (“City”) will receive approximately $4.4 million in CDBG entitlement funds, and approximat ely $1.8 in HOME entitlement funds, from HUD over a five-year period, for FYs 2025-2030. The CDBG and HOME activities and some administrative costs will be funded solely by grant funds and will not impact the General Fund.

1 Staff Report – 2025-2029 CONPLAN
February 10, 2025
BACKGROUND
The City of Bellflower is considered an entitlement jurisdiction and receives an annual allocation from HUD for the operations of its CDBG and HOME programs. The funding is determined by a formula calculated by HUD based on population, age of the city, poverty levels, etc. The City’s allocation can fluctuate year-to-year causing funding to increase or decrease in various programs.
As a recipient of the federal funds, the City is required to submit a five -year ConPlan and Annual Action Plans (“AAP”), and monitor their progress, outcomes, and expenditures through the Consolidated Annual Performance and Evaluation Report s (“CAPER”).
The purpose of the ConPlan is to identify the City’s housing and community development needs, priorities, goals, and strategies and to stipulate how funds will be allocated to housing and community development activities over the next five (5) years. The C DBG Program provides Federal funds for local improvement projects and programs. Activities assisted with CDBG funds must meet one of the three (3) national objectives:
1. Benefit low and moderate-income persons; or
2. Aid in the elimination of slum and blight; or
3. Meet a particular urgent community need because existing conditions pose a serious threat, and no other source of funds is available. This national objective is rare and is designated only for activities that alleviate emergency conditions, e.g., fire, flood, earthquake.
The HOME program provides formula grants, often in partnership with local nonprofit groups, to fund a wide range of activities including building, buying, and/or rehabilitating affordable housing or providing direct rental assistance to low-income persons. HOME is the largest Federal Block Grant to State and Local Governments designed exclusively to create affordable housing for low-income households.
In addition to the ConPlan, HUD requires the development of a Five -Year Analysis of Impediments to Fair Housing Choice.
DISCUSSION
The Consolidated Plan is a HUD required plan assessing affordable housing and community development needs for the next five-year (2025-2029) period. The ConPlan determines how funds from HUD will be used.
The following table shows the current 2020-2024 Consolidated Plan goals and outcomes.
Where applicable, the City’s programs are listed in parentheses in the “Needs Addressed” column.

The Analysis of Impediments to Fair Housing Choice is a review of policies, procedures, and practices within the community that affect the location, availability and accessibility of housing and current residential patterns and conditions related to fair housing choice. Fair Housing Choice is a condition in which individuals and families of similar income levels in the same housing market have a like range of choices available to them regardless of protected status. Federal and State Law define protected status as:
• Race

• National Origin
• Religion
• Sex
• Age
• Disability
• Familial Status
• Marital Status
• Sexual Orientation
• Source of Income
• Any other arbitrary factor

Over the past five years (2020-2024) the City received an annual average of $895,576 in CDBG funds and $375,389 in HOME funds. Although HUD has not yet announced allocations for local jurisdictions, staff anticipates that over the next ConPlan period (2025-2029), the City will receive similar CDBG and HOME program allocations totaling approximately $4.4 million in CDBG entitlement funds and $1.8 million in HOME entitlement funds.
Additionally, during the current ConPlan period (2020-2024), the City’s Section 108 Loan was paid off, therefore the City will have about $500,000 available annually for the following qualified CDBG activities:
• Acquisition, construction, reconstruction, rehabilitation, or installation of public facilities and improvements.
• Providing loans and grants to businesses.
• Funding job training.
• Making improvements to commercial/retail districts.
• Financing efforts that attract/retain workers in devastated communities. • Acquisition of real property.
• Relocation and demolition.
• Rehabilitation of residential and non-residential structures. • Construction of public facilities and improvements.

DISCUSSION – Continued
The City Council may choose to use these funds annually for eligible projects and programs, or consider taking out another Section 108 loan that could be used on activities eligible under Section 108 that include the following:
• Acquisition of real property
• Rehabilitation of publicly owned real property
• Housing rehabilitation eligible under CDBG
• Construction, reconstruction, or installation of public facilities (including street, sidewalk, and other site improvements)
• Related relocation, clearance, and site improvements
• Loan to for-profit businesses for economic development purposes
As part of this process, staff is reviewing the potential of taking out another Section 108 loan for the rehabilitation of Town Center Plaza or other public facilities.
HUD requires two public hearings during the development of the Consolidated Plan. The first public hearing taking place today will receive input from the public, and City Council may provide direction to city staff on the five -year ConPlan and Analysis of Impediments to Fair Housing Choice. After receiving input and direction from City Council, the drafts of the aforementioned plans will be finalized. The City will then conduct a 30 -day comment period and conduct the second public hearing to receive any additional input to adopt the five-year Consolidated Plan and the Analysis of Impediments to Fair Housing. The FY 2025-2026 Annual Action Plan will be considered as part of the ConPlan. Additionally, staff will present an updated Citizen Participation plan, if applicable. Following City Council adoption, the five-year Consolidated Plan, 2025-2026 Annual Action Plan and Citizens Participation Plan will be submitted to HUD.

SUBJECT: Consideration and possible action to create a two Council Member ad hoc committee to review and evaluate the City’s Cannabis Business Permit (“CBP”) policies and procedures.
DATE: February 10, 2025
EXECUTIVE SUMMARY
This action would establish an ad hoc committee comprised of two Council Members that will review and evaluate the City's Cannabis Business Permit (“CBP”) policies and procedures. The committee will evaluate items such as the cannabis tax rates, application and administrative review fees and processes, and the number and types of authorized cannabis business permits allowed. The committee will convene as necessary to provide recommendations to the full City Council concerning CBP policies and procedures.
RECOMMENDATION TO CITY COUNCIL
1) Create an ad hoc committee consisting of two Council Members to review and evaluate the City’s Cannabis Business Permit (“CBP”) policies and procedures; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
No fiscal impact with respect to this action.
BACKGROUND
In March 2017, voters (with a 74% margin) approved a Cannabis Tax within the City of Bellflower. In December 2017, the City Council approved 10 cannabis permits (though one permit was revoked in January 2018).
On August 12, 2019, the City Council approved commercial cannabis activities for recreational cannabis. As a result, the City Council allowed permittees with an existing medical cannabis business permit (MCBP) to apply for a change in use from a medicinal to recreational cannabis business permit (CBP). Ultimately, all MCBPs were converted to recreational CBPs, and no MCBPs are currently issued. There are a total of seven permittees and nine issued CBPs. Below are the currently approved cannabis vendors in the City of Bellflower:

The City Council has not conducted a comprehensive review of the City’s CBP policies and procedures since their initial implementation in 2017. Additionally, the Council adopted Resolution Nos. 20-63 and 21-35, which suspended the annual cannabis business tax rate increase for manufacturing, distribution, and retail dispensary operations. To stay aligned with evolving cannabis laws and remain competitive with neighboring jurisdictions, the City Manager recommends the formation of a two Council member ad hoc committee. The ad hoc committee would assess the current state of the City’s cannabis policies and procedures and identify any necessary adjustments that should be considered by the full City Council. The committee would convene as needed to review the policies and provide recommendations as needed to the City Council for consideration.

RATES FOR MANUFACTURING AND DISTRIBUTION
PURSUANT TO BELLFLOWER MUNICIPAL CODE § 3.37.100
THE CITY COUNCIL RESOLVES AS FOLLOWS:
SECTION 1. The City Council finds and declares as follows:
A. To ensure that the City's cannabis tax rates are both competitive and reasonable, the City retained Harris & Associates to study the City's overall cannabis business tax rate structure and, if warranted, provide estimated revenue impacts of its recommended tax rate reductions and suspension of annual rate increases;
B. Based on its research and analysis, Harris & Associates recommends that the cannabis business tax rates for manufacturing and distribution be reduced from 7.5% to 2% and 1%, respectively, and suspend annual increases for all other cannabis tax rates to remain competitive with the other cities; C. Harris & Associates also determines that even with the tax rate reductions, similar and somewhat higher tax revenues are anticipated for the City due to much greater volumes of business activities forecasted with the lower tax rates; and
D. The City Council desires to temporarily implement the rate reductions recommended by Harris & Associates.
SECTION 2. Pursuant to Bellflower Municipal Code ("BMC") § 3.37.100, the cannabis business tax rates for manufacturing and distribution are hereby temporarily reduced to 2% and 1%, respectively.
SECTION 3. The City Council may repeal or modify this resolution at any time in accordance with the BMC. Nothing in this Resolution is intended to, nor does it, affect the maximum tax rates set forth within the BMC.
SECTION 4.

DATE: February 10, 2025
EXECUTIVE SUMMARY
This action would award a contract to Cal-City Construction, Inc., to perform the construction and necessary work described in the Specification documents for the Bellflower Youth and Senior Center Facility at Simms Park (“the Project”).
RECOMMENDATION TO CITY COUNCIL
1) Award a contract to Cal-City Construction, Inc., for the Project and authorize the City Manager to execute said contract in a form approved by the City Attorney; or
2) Alternatively, discuss and take other action related to this item.
FISCAL IMPACT
Cal-City Construction, Inc. submitted the lowest responsive bid in the amount of $10,703,500. The Engineer’s estimated cost to perform the work was $10,755,000.
Funds are available in Account Nos. 011-47604-9000-116 (General Fund Savings/ARPA Funding) and 030-47604-9000-116 (California Department of Parks and Recreation and California Department of Aging Grant Funds).
DISCUSSION
The Parks and Recreation Department received Measure A grant funds from the Los Angeles County Regional Park and Open Space District (RPOSD) for the planning and design of the Bellflower Youth and Senior Center. On June 27, 2022, the City entered into agreements with Pretty Smart and NCA Studio Inc. for design architectural services for the Project. The plans, specifications and preliminary engineer’s estimate were subsequently completed.

DISCUSSION – Continued
On May 13, 2024, the City Council adopted Resolution No. 24-23 authorizing solicitation of bids for the construction of the Project. The City advertised Specification No. 23/24-07 for bids in accordance with BMC section 3.28.090. Twelve (12) bids were submitted for the formal bid opening on August 14, 2024. Due to irregularities in the bid document, the City Council rejected all bids at it’s October 14, 2024 meeting and directed Public Works staff to make non-structural technical changes to the plans and specifications document and re-advertise the Project.
On December 6, 2024, the revised plans and specifications were advertised and the City received 15 bids for the Project at the formal bid opening on January 16, 2025.
The results of the bid opening are listed below:
BIDDER AMOUNT
Monet Construction Inc. $9,984,923.00
PCN3 Inc. $10,175,000.00
The Nazerian Group $10,244,123.00
D.F. Perez Construction, Inc. $10,261,294.87
CABD Construction, Inc. $10,337,000.00
Keystone Builders Inc. $10,353,000.00
Cal-City Construction, Inc. $10,703,500.00
New Dynasty Construction Co. $10,873,005.00
Woodcliff Corporation $10,916,000.00
Morillo Construction, Inc. $11,056,000.00
Archico Design Build Inc. $11,090,000.00
Construction Contractors Corporation $11,190,000.00
Construct One Corporation $11,338,043.00
FEC Future Contractors & Engineers, Inc. $11,700,000.00 Newman Midland Corporation $11,786,836.00
BID ANALYSIS
After an extensive analysis of all bids received, Public Works staff has determined that the six lowest bids received are non-responsive. Five of the bids listed a non -certified subcontractor to perform the work associated with the operable partition doors. City staff contacted the equipment manufacturer and equipment distributor in California and confirmed that the subcontractors listed were not certified installers of the product. The other bidder failed to follow bidding instructions for Bid Item #1 (General Condition Requirements) which specifically noted that the line-item amount cannot exceed 5% of their total bid amount. Accordingly, Public Works staff recommends that the Project be awarded to Cal-City Construction as its bid submittal represents the lowest responsive bid received.
2 Staff Report – Award of Contract – Spec. No. 23/24-07 February 10, 2025
SPECIFICATIONS
The Plans and Specification documents are available for public inspection at the Public Works Department Office, 9944 Flora Vista Street, Bellflower, California until completion of the Project and, subsequently, as official records, will be maintained by the City Clerk’s Office.
CEQA
Pursuant to the California Environmental Quality Act (CEQA) (Public Resources Code §§ 21000, et seq.) and CEQA Guidelines (California Code of Regulations, Title 14, §§ 15000, et seq.), the City conducted an environmental assessment for the project consisting of an Initial Study and Mitigated Negative Declaration. The Initial Study determined that the project would not result in any significant effect on the environment with incorporation of mitigation measures contained in the Mitigated Negative Declaration.

CITY OF BELLFLOWER
ORDINANCE NO. 1439
AN ORDINANCE AMENDING BELLFLOWER MUNICIPAL CODE
CHAPTER 15.40 AND REAFFIRMING THE CITY COUNCIL’S
DETERMINATION THAT THE CITY COMPLY WITH REGULATIONS
PROMULGATED BY THE STATE OF CALIFORNIA TO PROTECT
PUBLIC HEALTH, SAFETY AND FROM THE DEVASTATION OF
UNCONTROLLED FIRE INCIDENTS
THE CITY COUNCIL DOES ORDAIN AS FOLLOWS:
SECTION 1. Findings. The City Council finds, determines and declares as follows:
A. On January 7, 2025, the Governor proclaimed a State of Emergency to exist in Los Angeles and Ventura Counties due to fire and windstorm conditions that have now caused multiple fires, including the Palisades, Eaton, Hurst, Lidia, Sunset, and Woodley Fires (the “Emergency”).
B. The fires causing the Emergency have collectively burned more than 40,000 acres, devastating communities throughout the Los Angeles Basin by destroying or damaging more than 12,000 structures. Initial estimates suggest that the resulting economic impact will exceed $200 billion making this Emergency the most destructive in California history and, potentially, the United States.
C. The destruction of homes by the fires burning in Los Angeles and Ventura Counties will reduce the available housing in the region, which is likely to further increase the cost of housing and the related crisis of homelessness if housing is not expeditiously rebuilt.
D. The City Council, the City’s officials, and the entire Bellflower community is committed to helping families and individuals who have lost their homes and businesses rebuild and recover without facing unnecessary costs and delay.
E. Historically, the City Council took extraordinary actions to protect the City’s residents from intrusive government policies and regulations. This includes, without limitation, the City Council’s decision in 2019 to reject the bureaucracy and policies instituted by the Consolidated Fire Protection District of Los Angeles County (the “Fire District”) when reviewing building plans submitted by businesses and residents seeking to construct structures within the City’s jurisdiction.
F. Instead of utilizing the Fire District’s unwieldy, imprecise, and illogical fire regulations, the City Council opted instead to adopt the California Fire Code (“CFC”) codified in Title 24 of the California Code of Regulations (“CCR”).

Ordinance No. 1439
G. The City Council has further eliminated barriers and bureaucracy by, among other measures, adopting a Self-Certification Program to eliminate unnecessary and redundant plan reviews.
H. The CFC reflects the collective experience and expertise of fire and building officials led by the Office of the State Fire Marshal (“OSFM”) in cooperation with the Department of Housing and Community Development (“HCD”).
Such regulations are developed for only one purpose: protection of the public.
I. Previously, the California Legislature empowered HCD to eliminate barriers within local jurisdictions that unduly delay the rapid construction of homes through various pieces of legislation.
J. Separately, on January 12, 2025, the Governor issued Executive Order N-4-25 (the “EO”). Among other things, the EO mandates that the OSFM and HCD:
i. “review and provide a report to [the Governor] with recommendations regarding any provision of the [California] Building Standards Code, Title 24 of the California Code of Regulations, that should be suspended for projects … in order to facilitate rapid, safe, and cost-effective rebuilding and recovery.”
ii. “coordinate with local governments to identify and recommend procedures, including but not limited to exploring the use of pre - approved plans and waivers of certain permitting requirements, to establish rapid permitting and approval processes to expedite the reconstruction or replacement of residential properties destroyed or damaged by fire. The recommended procedures shall have the ultimate goal of issuing all necessary permits and approvals within 30 days.”
K. These requirements are collectively referred to as the “Sensible Permits, Advice, Regulations and Knowledge” or “SPARK.” The City Council finds that the City’s actions since 2019 as to fire and building regulations and review procedures should be considered by OSFM and HCD as a model for SPARK. It is apparent that rejecting the Fire District’s bureaucracy and policies allows building plans to be processed expeditiously and inexpensively. Implementing such SPARK removes barriers to developing commercial and residential structures – whether routine or resulting from the Emergency – and ultimately will make construction and redevelopment of much needed housing and commercial structures more affordable.
L. Since Bellflower’s SPARK utilizes the CFC, it implements statewide regulations that are objective, widely implemented, and which may be best enforced by the experts familiar with such standard regulations. While Bellflower itself has not (yet) been directly affected by the Emergency, its practice of utilizing SPARK serves as an example for other communities within the Greater Los Angeles Area and across the State of California. -3-
City of Bellflower
Ordinance No. 1439
M. On November 5, 2024, the voters approved Measure B which adopted the City Charter for the City of Bellflower (the “Charter”). The voters’ approval of the Charter confirms the City Council’s intent via this Ordinance to continue the City’s implementation of SPARK as to utilizing the CFC – rather than the Fire District’s policies – to help protect persons, buildings, and property from events such as the Emergency.
N. Section I of the Bellflower City Charter states that “the People assert their desire for local control over the City’s municipal affairs; their freedom to decide their own destiny; and their rejection of efforts by agencies outside of the City’s jurisdiction seeking to impose policies upon the City’s residen ts without their approval.” Adopting this Ordinance , and by extension, those previously adopted is squarely within the City Council’s legal authority and fulfills the voters’ directive.
O. Articles II, III, and IV of the Charter provide that the City may enact all laws governing its municipal affairs. Pursuant to Article III(B) of the Charter, the City Council finds that the law enacted by this Ordinance will not unduly burden a person’s ability to pursue economic opportunities and safe and legal residential housing.
P. The City Council takes notice of the plethora of authority confirming that the Charter has the force of California law (see, e.g., Cal. Const., art. XI, § 3, subd. (a); Coalition of County Unions v. Los Angeles County Bd. of Supervisors (2023) 93 Cal.App.5th 1367; and State Building & Construction Trades Council of California v. City of Vista (2012) 54 Cal.4th 547).
Ordinances implementing the Charter’s municipal affairs section may only be preempted when there is a pressing matter of statewide concern (California Fed. Savings & Loan Assn. v. City of Los Angeles (1991) 54 Cal.3d 1).
Q. While the California Constitution and the Charter gives broad authority to the City Council to “make and enforce within [its] limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws,” special districts have only the power conferred by statute. (see, e.g., Baldwin v. County of Tehama (1994) 31 Cal.App.4th 166).
R. In considering this Ordinance, the City Council takes note of the unprecedented threats made by the Fire District to the City’s implementation of the CFC (see, Item No. 14-O from the October 14, 2024 City Council meeting agenda). Challenging the City Council’s plenary role in protecting – and representing – Bellflower residents is repugnant to democracy and contrary to the oaths taken by every public official within the state of California.

City of Bellflower
Ordinance No. 1439
S. While the Fire District’s true intent in challenging the City’s decision to implement California law – rather than the Fire District’s policies – may never be identified, the City Council finds that it is imperative to combat the Fire District’s threats. Additionally, providing an example for implementing the EO in responding to the Emergency is in the immediate public interest.
T. This Ordinance implements California law that is of statewide concern and, further constitutes a municipal affair as contemplated by the Charter. The Fire District lacks any legal authority whatsoever to compel the City Council to adopt regulations other than those set forth in the CFC, as amended by this Ordinance.
U. The regulations adopted by this Ordinance are intended to be immediately implemented to accelerate City approvals for local businesses, housing, and economic development, and to further the intent of the EO.
SECTION 2. Environmental Assessment. This Ordinance was reviewed pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq., “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regulations §§15000, et seq., the “CEQA Guidelines”). Adopting this Ordinance is exempt from further environmental review because it establishes rules and procedures for operation of existing facilities; minor temporary use of land; minor alterations in land use; new construction of small structures; and minor structures accessory to existing commercial facilities. The Ordinance, therefore, is categorically exempt from further CEQA review under CEQA Guidelines §§ 15301; 15303, 15304(e); 15305; and 15311.
Further, the adopting the ordinance is also exempt from review under CEQA pursuant to CEQA Guidelines § 15061(b)(3) because the ordinance is for general policies and procedure-making. It can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment. Individual projects utilizing the SPARK will each be separately subject to an environmental assessment. Finally, this Ordinance is exempt from further review pursuant to CEQA Guidelines § 15269(a) because the protection of public and private property is necessary to maintain service essential to the public, health and welfare.1
SECTION 3. Authorizations. The City Manager and City Attorney are authorized to take the following actions:
A. Demand public records from the Fire District as desirable.
B. Issue legislative subpoenas as authorized by separate City Council Resolution.
1 CEQA findings regarding an anticipated imminent emergency are valid (see, CalBeach Advocates v.
City of Solana Beach (2002) 103 Cal.App.4th 529).
