Ground-borne noise is not likely to be a problem because noise arriving via the normal airborne path will usually be greater than ground-borne noise. Ground-borne vibraƟon has the potenƟal to disturb people and damage buildings. Ground-borne vibraƟon is usually measured in terms of vibraƟon velocity, either the root-mean-square (RMS) velocity or peak parƟcle velocity (PPV). The RMS velocity is best for characterizing human response to building vibraƟon, and PPV is used to characterize potenƟal for damage. Decibel notaƟon acts to compress the range of numbers required to describe vibraƟon.

NOISE AND VIBRATION REGULATIONS
Local Noise RegulaƟons
City of Beverly Hills
General Plan Noise Element. The City’s General Plan Noise Element (2010) contains noise-related goals and policies that address unnecessary, excessive, and annoying noise levels and sources from construcƟon. Applicable construcƟon noise-related goals and policies are described below.

Goal N 1 Land Use Conflicts. Minimize land use conflicts between various noise sources and other human acƟviƟes.

Policy N 1.6 ConstrucƟon. In Beverly Hills, it is against the law to operate equipment or perform any outside construcƟon or repair work on any building, structure, pneumaƟc hammer, derrick, steam or electric hoist, or other construcƟon type devices, between the hours of 6:00 p.m. of one day and 8:00 a.m. of the next day, or at any Ɵme on any public holiday so as to cause discomfort or annoyance in a residenƟal zone, unless beforehand a permit therefore has been obtained.

LSA
8/6/26 (P:\2026\20263059-One Beverly Hills\Product\Noise\Noise Memo_20260806.docx) 7 Goal N 4 ConstrucƟon Noise. Minimize excessive construcƟon-related noise.

Policy N 4.1 Enforce Hours of ConstrucƟon AcƟvity. ConƟnue to enforce restricƟons on hours of construcƟon acƟvity to minimize the impact of noise and vibraƟon from trucks, heavy drilling equipment, and other heavy machinery on adjacent noisesensiƟve receptors, parƟcularly in and near residenƟal areas.

Local VibraƟon RegulaƟons
City of Beverly Hills
The City does not establish specific vibraƟon criteria within the General Plan or Municipal Code.

Consistent with the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), the project would result in excessive ground-borne vibraƟon if vibraƟon levels exceed the thresholds shown in Table C. In addiƟon, consistent with the approach of the original environmental documentaƟon and the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), the FTA vibraƟon annoyance criterion of 72 VdB was used to assess nighƫme human annoyance impacts at places where people sleep, including hotel rooms and residences from nighƫme construcƟon acƟviƟes.

THRESHOLD OF SIGNIFICANCE
ConstrucƟon Noise
Consistent with the City’s construcƟon noise regulaƟons above and the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), the project would result in a significant noise impact if project construcƟon acƟviƟes generate a noise increase of 5 dBA outside the permiƩed construcƟon hours specified in SecƟon 5-1-205 of the City’s Municipal Code or would increase noise by 5 dBA or more during dayƟme hours at a school, hospital, church, or insƟtute of learning.

ConstrucƟon VibraƟon

EXISTING SETTING
Overview of the ExisƟng Noise Environment
The primary exisƟng noise sources in the project area are transportaƟon faciliƟes. Traffic on Wilshire Boulevard, North Santa Monica Boulevard, and South Santa Monica Boulevard is a consistent source of ambient noise in the project area.

ExisƟng Land Uses in the Project Vicinity
The route for the extension of the underground electrical infrastructure along the exisƟng public roadway rights-of-way on South Santa Monica Boulevard and Charleville Boulevard is surrounded by commercial uses, a hotel (The Peninsula), and residenƟal uses. The closest residences are located on the southwest corner of the intersecƟon of South Santa Monica Boulevard and Charleville Boulevard and single-family residences on the west side of North Santa Monica Boulevard and north of Wilshire Boulevard. The hotel (The Peninsula) is located on the south side of South Santa Monica Boulevard, between Charleville Boulevard and Wilshire Boulevard. The underground electrical infrastructure work will not be performed in proximity to any schools, hospitals, churches or insƟtutes of learning.1 Ambient Noise Measurements
Long-Term Noise Level Measurements
The long-term (24-hour) noise level measurement at LT-2 from the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021) is provided below. The noise measurement was conducted from September 3 to September 4, 2020, using an Extech Model 407780A, ANSI Type 2 integraƟng sound level meter to document the exisƟng noise environment 1 Construction noise impacts would be less than significant at the JEM Community Center, which is located over 300 feet to the west of the intersection of Charleville Boulevard and South Santa Monica Boulevard.

A short-term (15-minute) noise level measurement conducted at ST-5 for the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021) recorded a noise level of 64 dBA Leq, as shown in Table E. This noise level is 9 dBA lower than the measured noise level at LT-2 during the corresponding hour. Applying this adjustment to the long-term monitoring results at LT-2, the esƟmated lowest hourly ambient noise levels at ST-5 were 61 dBA Leq during the evening period (6:00 p.m. to 9:00 p.m.) and 52 dBA Leq during the nighƫme period (9:00 p.m. to 6:00 a.m.). These noise levels are representaƟve of the residences located west of North Santa Monica Boulevard north of Wilshire Boulevard. Figure 3 shows the noise monitoring locaƟon at ST-5.

ExisƟng Traffic Noise Level
The Federal Highway AdministraƟon (FHWA) Highway Traffic Noise PredicƟon Model (1977; FHWA RD-77-108) was used to evaluate highway traffic-related noise condiƟons along roadway segments in the project vicinity. This model requires various parameters, including traffic volumes, vehicle mix, vehicle speed, and roadway geometry to compute typical equivalent noise levels during dayƟme, evening, and nighƫme hours. The resultant noise levels are weighted and summed over 24-hour periods to determine the CNEL values. ExisƟng average daily traffic (ADT) volumes and the vehicle mix for roadways in the project area were obtained from traffic counts (Beverly Hills 2019). Table F provides the exisƟng traffic noise levels in the project vicinity. These noise levels represent the worstcase scenario, which assumes that no shielding is provided between the traffic and the locaƟon where the noise contours are drawn. AƩachment C provides the specific assumpƟons used in developing these noise levels and model printouts.

The hotel and the residences at the intersecƟon of South Santa Monica Boulevard and Charleville Boulevard would have an esƟmated exisƟng ambient noise level of 67.8 dBA CNEL at a distance of approximately 32 feet from the centerline of South Santa Monica Boulevard, based on the traffic noise levels shown in Table F. Based on the daily noise level, the lowest hourly ambient noise level was esƟmated to be 61 dBA Leq during the evening period (6:00 p.m. to 9:00 p.m.). The lowest hourly ambient noise level during the nighƫme period (9:00 p.m. to 6:00 a.m.) was esƟmated to be 52 dBA Leq, based on the observed difference between evening and nighƫme noise levels at ST-5.

IMPACTS
ConstrucƟon Noise Impacts
Two types of short-term noise impacts could occur during construcƟon on the project site. First, construcƟon crew commutes and the transport of construcƟon equipment and materials to the site for the proposed project would incrementally increase noise levels on roads leading to the site. The pieces of heavy equipment for construcƟon acƟviƟes will be of limited quanƟƟes and will not meaningfully add to the daily traffic volume in the project vicinity. Although there would be a relaƟvely high single-event noise exposure potenƟal causing intermiƩent noise nuisance (passing trucks at 50 feet would generate up to a maximum of 84 dBA), the effect on daily ambient noise levels would be small because the daily construcƟon-related vehicle trips are small compared to the exisƟng daily traffic volume on South Santa Monica Boulevard, North Santa Monica Boulevard, and Wilshire Boulevard, which would be used to access the project site. The results of the California Emissions EsƟmator Model (CalEEMod) (Version 2022.1) contained in AƩachment B of the Underground Electrical Infrastructure Extension ConstrucƟon Air Quality and Greenhouse Gas Impact Analysis for the One Beverly Hills Project (LSA 2026) indicate that the drainage, uƟliƟes, and subgrade phase would generate the most trips compared to the trenching phase. Those trips are calculated to have an acousƟcal equivalent traffic volume of 6,882 passenger car equivalent vehicles on South Santa Monica Boulevard, North Santa Monica Boulevard, and Wilshire Boulevard. South Santa Monica Boulevard, North Santa Monica Boulevard, and Wilshire Boulevard have exisƟng average daily traffic volumes of 21,270, 41,857, and 22,574, respecƟvely, near the project site based on the City’s Average Daily Traffic (City of Beverly Hills 2021). Based on the informaƟon above and the calculaƟons provided in AƩachment D, construcƟon-related traffic would increase noise levels by up to 1.2 dBA. A noise level increase of less than 3 dBA would not be percepƟble to the human ear in an outdoor environment. In addiƟon, this noise increase would not exceed the 5 dBA noise increase threshold. Therefore, short-term construcƟon-related noise impacts associated with worker commute and transport of equipment and materials to and from the project site would be less than significant. No addiƟonal miƟgaƟon measures are required.

The second type of short-term noise impact is related to noise generated from construcƟon acƟviƟes. ConstrucƟon is performed in discrete steps, each of which has its own mix of equipment and, consequently, its own noise characterisƟcs. The project anƟcipates uƟlity potholing, saw cuƫng, asphalt milling and removal, trench excavaƟon, installaƟon of underground electrical conduits, construcƟon and placement of precast electrical vaults, installaƟon of vent line conduits, slurry backfilling, aggregate base placement, asphalt pavement restoraƟon, and final pavement striping. These various sequenƟal phases change the character of the noise generated on a project site. Therefore, the noise levels vary as construcƟon progresses. Despite the variety in the type and size of construcƟon equipment, similariƟes in the dominant noise sources and paƩerns of operaƟon allow construcƟon-related noise ranges to be categorized by work phase. Table G lists the anƟcipated construcƟon equipment provided by Bali ConstrucƟon, Inc. along with the Leq noise level at 50 feet, which was calculated based on the reference instantaneous maximum (Lmax) noise level at 50 feet obtained from the FHWA Highway ConstrucƟon Noise Handbook (FHWA 2006) or the equipment manufacturer specificaƟons and were adjusted using the acousƟcal use factor for each piece of equipment.

Based on the detailed construcƟon plan provided by Bali ConstrucƟon, Inc., included as AƩachment E, the extension of the underground electrical infrastructure associated with the project would take approximately 39 days to complete consisƟng of eight construcƟon areas. During the first 19 days, construcƟon would occur between the hours of 9:00 a.m. and 9:00 p.m. in ConstrucƟon Areas 1, 2, 3, and 5, as depicted in AƩachment E. In ConstrucƟon Area 4, work would occur between the hours of 9:00 a.m. and 6:00 p.m. on Days 11 and 12. During the remaining 20 days (Day 20 through Day 39), construcƟon would occur between the hours of 9:00 p.m. and 6:00 a.m. predominately in ConstrucƟon Areas 6 through 8, with final striping occurring on Days 38 and 39. Saw cuƫng, asphalt milling, and hydro excavaƟon acƟviƟes within the first 17 days would be limited to between the hours of 9:00 a.m. and 6:00 p.m. and quieter construcƟon acƟviƟes, such as trenching, would occur between the hours of 6:00 p.m. and 9:00 p.m. In addiƟon, paving acƟviƟes on Days 18, 19, and 29 in ConstrucƟon Areas 1 through 5 for the remaining construcƟon areas near the residences and the Peninsula would occur between the hours of 9:00 a.m. and 6:00 p.m. The detailed construcƟon schedule, construcƟon hours, list of construcƟon equipment each day, and the descripƟon of acƟviƟes each day are provided in AƩachment E. AƩachment F provides the esƟmated daily construcƟon noise levels for work occurring both within and outside the City's permiƩed construcƟon hours based on the detailed construcƟon schedule, construcƟon hours, daily construcƟon equipment list, and acƟvity descripƟons provided in AƩachment E.

LSA
8/6/26 (P:\2026\20263059-One Beverly Hills\Product\Noise\Noise Memo_20260806.docx) 14 Table H shows the construcƟon noise levels for each construcƟon area during the 39 days of construcƟon assuming the operaƟon of the loudest piece of equipment. ConstrucƟon noise levels were calculated based on the specific equipment expected to be operaƟng in each construcƟon area on a given day, as documented in the detailed construcƟon plans provided by Bali ConstrucƟon, Inc. (AƩachment E). Because construcƟon acƟviƟes differ between work periods within and outside of the City’s permiƩed construcƟon hours, two reference construcƟon noise levels are provided in Table H for ConstrucƟon Areas 1 through 5. The first value represents the loudest dayƟme construcƟon acƟviƟes occurring between 9:00 a.m. and 6:00 p.m., including saw cuƫng, asphalt milling, hydro excavaƟon, paving, and other equipment-intensive operaƟons. The second value represents the quieter trenching and uƟlity installaƟon acƟviƟes that would occur outside of the City’s permiƩed construcƟon hours, which involve smaller construcƟon equipment and lower overall noise levels. As shown in Table H, project construcƟon noise levels range between 59.8 to 97.0 dBA Leq for construcƟon acƟviƟes undertaken between 9:00 a.m. and 6:00 p.m. in ConstrucƟon Areas 1 through 5 along with paving acƟviƟes would comply with the permiƩed hours specified in SecƟon 5- 1-205 of the City’s Municipal Code. Noise generated from these project construcƟon acƟviƟes would be less than significant. However, project construcƟon noise levels range between 43.1 to 69.2 dBA Leq for construcƟon acƟviƟes undertaken between 6:00 p.m. and 9:00 p.m. and would increase ambient noise levels by up to 8.8 dBA before miƟgaƟon based on the lowest ambient noise level of

61.0 dBA Leq. In addiƟon, project construcƟon noise levels range between 44.3 to 69.7 dBA Leq for construcƟon acƟviƟes undertaken between 9:00 p.m. and 6:00 a.m. for ConstrucƟon Areas 6 through 8 and would increase ambient noise levels by up to 17.8 dBA before miƟgaƟon based on the lowest ambient noise level of 52.0 dBA Leq. These noise increases exceed the 5 dBA threshold above exisƟng ambient noise levels, and noise generated from project construcƟon acƟviƟes during this period without miƟgaƟon would be potenƟally significant.

ImplementaƟon of MM-Noise-1, which is idenƟfied in the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), requiring all equipment, fixed or mobile, be operated with closed engine doors and be equipped with properly operaƟng and maintained mufflers consistent with manufacturers’ standards and portable sound enclosures for all generators and air compressors would reduce the noise increase to less than 5 dBA. Therefore, noise generated from project construcƟon acƟviƟes outside of the City’s permiƩed construcƟon hours would be less than significant with the implementaƟon of MM-Noise-1.

MM-NOISE-1 Prior to issuance of grading permits, the Developer shall submit a ConstrucƟon Management Plan saƟsfactory to the Director of Community Development and the Building Official. The Building Official shall enforce noise aƩenuaƟng construcƟon requirements. The ConstrucƟon Management Plan shall include, but not be limited to, the following noise aƩenuaƟon measures:
• ExcavaƟon, grading, and other construcƟon acƟviƟes related to the proposed project shall comply with SecƟon 5-1-206, RestricƟons on ConstrucƟon AcƟvity, of the Beverly Hills Municipal Code. Any deviaƟons from these standards shall require the wriƩen approval of the City Building Official.

ConstrucƟon VibraƟon Impacts
This construcƟon vibraƟon impact analysis assesses the potenƟal for building damage and human annoyance using vibraƟon levels in PPV (in/sec). Also, the analysis assesses nighƫme human annoyance using vibraƟon levels in RMS (VdB).

Project construcƟon is expected to require the use of loaded trucks and a vibratory roller. Loaded trucks would generate ground-borne vibraƟon levels of up to 0.076 in/sec PPV (86 VdB) when measured at 25 feet based on the Transit Noise and VibraƟon Impact Assessment Manual (FTA 2018). The proposed vibratory roller, a BOMAG BW 900-50, is expected to generate a vibraƟon level of approximately 0.080 in/sec PPV (86 VdB) at 25 feet. This esƟmate is based on the reference vibraƟon level for vibratory rollers provided in the Transit Noise and VibraƟon Impact Assessment Manual (FTA 2018). The BOMAG BW 900-50 has a lower operaƟng weight and centrifugal force than larger vibratory rollers. Therefore, the FTA reference vibraƟon level is considered a conservaƟve esƟmate of the vibraƟon that could be generated by the proposed roller.

The distance to the nearest buildings for vibraƟon impact analysis is measured between the nearest off-site buildings and the project boundary (assuming the construcƟon equipment would be used at or near the project boundary) because vibraƟon impacts normally occur within the buildings. The formula for vibraƟon transmission is provided below:

LvdB (D) = LvdB (25 Ō) - 30 Log (D/25)
PPVequip = PPVref x (25/D)1.1

LSA
8/6/26 (P:\2026\20263059-One Beverly Hills\Product\Noise\Noise Memo_20260806.docx) 18 Table I lists the projected vibraƟon levels from various construcƟon equipment expected to be used on the project site in the acƟve construcƟon area to the nearest buildings in the project vicinity. As shown in Table I, vibraƟon levels would not exceed the damage thresholds of 0.5 in/sec PPV for transient sources at the closest buildings (residences, hotel, and commercial). Also, vibraƟon levels would not exceed the vibraƟon annoyance threshold of 0.240 in/sec PPV for transient sources at the closest buildings (residences, hotel, and commercial).

In addiƟon, vibraƟon levels would not exceed the nighƫme vibraƟon annoyance threshold of 72 VdB at the residences located west of North Santa Monica Boulevard and north of Wilshire Boulevard.

For the residences and the hotel located at the intersecƟon of South Santa Monica Boulevard and Charleville Boulevard, the nighƫme vibraƟon annoyance threshold of 72 VdB does not apply because project construcƟon acƟviƟes would not occur outside of the City’s permiƩed construcƟon hours. Therefore, construcƟon vibraƟon impacts during project construcƟon would be less than significant. No miƟgaƟon measures are required.

CONCLUSION
ConstrucƟon Noise
ConstrucƟon-related traffic noise from worker commute and transport of equipment and materials would increase noise levels by up to 0.7 dBA.

Similar to the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), project construcƟon noise levels range between 59.8 to 97.0 dBA Leq for construcƟon acƟviƟes undertaken between 9:00 a.m. and 6:00 p.m. in ConstrucƟon Areas 1 through 5 along with paving acƟviƟes would comply with the permiƩed hours specified in SecƟon 5-1-205 of the City’s Municipal Code. Noise generated from project construcƟon acƟviƟes would be less than significant.

However, project construcƟon noise levels range between 43.1 to 69.2 dBA Leq for construcƟon acƟviƟes undertaken between 6:00 p.m. and 9:00 p.m. and would increase ambient noise levels by up to 8.8 dBA before miƟgaƟon based on the lowest ambient noise level of 61.0 dBA Leq. In addiƟon, project construcƟon noise levels range between 44.3 to 69.7 dBA Leq for construcƟon acƟviƟes undertaken between 9:00 p.m. and 6:00 a.m. for ConstrucƟon Areas 6 through 8 and would increase ambient noise levels by up to 17.8 dBA before miƟgaƟon based on the lowest ambient noise level of

52.0 dBA Leq. These noise increases exceed the 5 dBA threshold above exisƟng ambient noise levels, and noise generated from project construcƟon acƟviƟes during this period would be potenƟally significant. ImplementaƟon of MM-Noise-1, which is idenƟfied in the One Beverly Hills Overlay Specific Plan Final Supplemental EIR (Rincon Consultants, Inc. 2021), requiring all equipment, fixed or mobile, be operated with closed engine doors and be equipped with properly operaƟng and maintained mufflers consistent with manufacturers’ standards and portable sound enclosures for all generators and air compressors would provide the necessary noise reducƟon so that project construcƟon acƟviƟes would not increase ambient noise levels by 5 dBA or more. Therefore, noise LSA
