As a Special Districts Department (SDD) of San Bernardino County, our mission directs us to implement the county wide vision through improvement of our own county government operations. We achieve the County Vision with this program by providing for the Health and Social Service needs of our local community with meals for low/moderate income seniors in cooperation with the Department of Aging (DAAS), another county department. We are mandated to provide these services in a fiscally responsible manner through a sound balanced budget. Our materials for this program, i.e. meals, are sourced through local businesses, allowing them to expand or maintain jobs, adding to the economic value of the county.

Big Bear Valley Recreation & Park District (BBVRPD) requests funds for this project to augment the funding (provided by The Dept of Aging) that provides meals for low/moderate income persons attending the Big Bear Senior Center. The sub activity are Seniors (60 yrs. & over) from low/moderate income households. Our target population are persons from households who are 60 years and above who meet the program criteria. BBVRPD has been serving the sub section of the Big Bear community since receiving funding from The Dept of Aging (DAAS) to implement this program since early 200's. We serve low-cost meals to seniors participating in the Senior Meal program at the Big Bear Valley Senior Center.
Public Services Program Application Fiscal Year –
Describe how this project meets the priority population and activities selected.
Explain why this project is needed and what evidence can you substantiate the need.
Describe what gaps of service in the county this project fills.
What are the critical factors for the success of your project (include both financial and human resources)? For instance, is this the only funding for this project? What happens if funding decreases? Does this project rely on only one source of leveraging? Is there adequate staff involved with the project if there is project turnover? Please address any factor that is critical to project success.
7 Denial of funding from CDBG will not cause the program to cease operating. Donations and financial support from the Dept of Aging will see the program continue but with a reduction of service. CDBG funding would allow an additional day of service to be added to the program for the heavily attended summer months of the yearly program. 2024 2025
This program provides meals for low/moderate income seniors who often are malnourished, with 3-5 nutritious meals a week. It enhances quality of life, through interactions with peers, program staff, nutrition education, which helps in home meal preparation. Additionally, it enhances the living environment of clients with sustainability directly improved with regard to mental & physical health.
Continued funding of this program will augment program revenue supplied by the Dept of Aging and program donations. This enables the program to serve about 7000 meals annually with a goal of serving one meal a day to eligible seniors throughout the course of the year.
Funding from the Dept of Aging is limited and the demand for this quality and vital nutritious program is increasing. A full award will expand and improve the delivery of this service to an increased number of qualified low/moderate income participants. Seniors from other communities are provided with similar programs that service their clients every weekday, this would assist in moving towards that goal.

Priority groups are McKinney-Vento (homeless) youth/families & low income students.
BVUSD supports the basic needs of our students & families with grocery cards, school supplies, clothing, backpacks, shoes & snow boots, socks, underwear & hygiene items.
Students/families are referred to community resources such as food banks, health, mental health, social services & thrift stores and the Bear Valley Holiday Giving Program. The Student Support Program Liaison and Clerk will lead and participate in established community partnerships including the Bear Valley Community Collaborative, Holiday Giving Collaborative, Lutheran Social Services Coalition and Mountain Homeless Coalition meetings to sustain resources. Over 400 students/family members will receive food baskets, provided by churches & community organizations, at Thanksgiving & Christmas. Up to 250 children/youth will receive gifts/clothing/toys at Christmas. McKinney-Vento students are also identified through the Holiday Giving Program. BVUSD supports daily attendance & builds programs to support students as they prepare for a career, trade school &/or post-secondary education. In addition, field trips to explore career opportunities & colleges are offered.

BVUSD’s has identified & offered services to homeless students & those living in poverty for over 13 years. The Student Services Liaison facilitates Community Collaborative Meetings to maintain a referral network of supports, donations & basic needs items. The Program is sustained with MKV, American Rescue Plan (ARP) & Education for Homeless Children & Youth (EHCY) funds. ARP II funding ends in Sept. 2024. CDBG funds will help sustain the Program. ARP funds are ending in September 2024. The CDBG Grant will help sustain services, by covering part of the Liaison salary.
Bear Valley is an isolated, mountain resort community of about 18,000 residents in the San Bernardino Mountains, 45 mountain miles from county services in San Bernardino. We have no Transitional Assistance Dept. or Workforce Dev. Dept. & very limited bus service off the mountain. Families in poverty survive on seasonal jobs, lack insurance and have limited access to cash aid & welfare support. Big Bear agencies and BVUSD collaborate to meet residents’ needs through coordinated referrals to health, mental health and social services.
BVUSD has 2,162 students; with 210 students qualifying as MKV as of December 2022, higher than the number of students identified at this time last year. Students challenged by homelessness & poverty are at risk of school failure, increased mental health & behavioral issues. Supporting this population with services & basic needs increases their success and future opportunities.
BVUSD’s Student Support Program (SSP) identifies & outreaches to all students qualifying for MKV homeless services or are affected by poverty. 68% of enrolled students live in poverty indicating a very high level of need. Big Bear lacks county Transitional Assistance Dept. and Workforce Dev. Dept. resources for families. SSP links students/familiesto community based resources & basic needs. ARP funds will be gone by Sept, 2024 2024

SUBJECT: Resolution of the City Council of the City of Big Bear Lake Authorizing Amendment No. 6 to the Operating Agreement No. 1 Between the Big Bear Area Regional Wastewater Agency, Big Bear Lake Sanitation District, Big Bear City Community Services District and County of San Bernardino, and Seventh Amendment to the Joint Exercise of Powers Agreement Between Big Bear City Community Services District, City of Big Bear Lake and San Bernardino County Creating the Big Bear Area Regional Wastewater Agency
BACKGROUND & DISCUSSION
On March 22, 1974, Big Bear City Community Services District (the “BBCCSD”), the Big Bear Lake Sanitation District (the “Sanitation District”) and the County on behalf of San Bernardino County Service Area 53 (the “County”) entered into a joint exercise of powers agreement (the “Agreement”) creating the Big Bear Area Regional Wastewater Agency (“BBARWA” or the “Agency”), and subsequently amended the Agreement by the First Amendment to the Agreement dated April 28, 1975, between the BBCCSD, the Sanitation District and the County (the “JPA First Amendment”), the Second Amendment to the Agreement dated January 15, 1979, between BBCCSD, the Sanitation District and the County (the “JPA Second Amendment”), the Third Amendment to the Agreement dated July 7, 1980, between BBCCSD, the Sanitation District and the County (the “JPA Third Amendment”), the Fourth Amendment to the Agreement dated July 19, 1982, between BBCCSD, the City of Big Bear Lake (the “City”), as successor to the Sanitation District, and the County (the “JPA Fourth Amendment”), the Fifth Amendment to the Agreement dated January 10, 2012, between BBCCSD, the City and the County (the “JPA Fifth Amendment”), the Sixth Amendment to the Agreement dated July 25, 2018, between BBCCSD, the City and the County (the “JPA Sixth Amendment,” and collectively with the Agreement, JPA First Amendment, JPA Second Amendment, JPA Third Amendment, JPA Fourth Amendment, JPA Fifth Amendment, and as may be further amended, supplemented or modified from time to time, the “JPA”).
On May 3, 1977, the Agency, the Sanitation District, the BBCCSD, and the County entered into Operating Agreement No. 1 (“Operating Agreement No. 1”), Operating Agreement No. 2 (“Operating Agreement No. 2”), and Operating Agreement No. 3 (“Operating Agreement No. 3,” Item 3.1
and collectively with Operating Agreement No. 1 and Operating Agreement No. 2, the “Operating Agreements”), which were subsequently amended on September 20, 1997 (“Amendment No. 1”), July 7, 1980 (“Amendment No. 2”), July 19, 1982 (“Amendment No. 3”), October 15, 1984 (“Amendment No. 4”), and July 25, 2018 (“Amendment No. 5”).
The Agency, BBCCSD, the City and the County have acknowledged that they are in need of additional water supplies and the Agency has undertaken the Replenish Big Bear program (the “Program”) to increase such water supplies by designing and constructing certain improvements which allow for the capture, reuse and recycling of water and wastewater. BBARWA has entered into and will be entering into indebtedness, which may include bonds, loans, notes, certificates of participation and other types of indebtedness, to finance the Program and other improvements to the Regional System (as defined in the Operating Agreement No. 1).
Currently, pursuant to Operating Agreement No. 1, each member agency of BBARWA is required to pay an annual charge. BBARWA must provide the member agencies with a budget for the following fiscal year, which may include amounts attributable to the payment of indebtedness, amounts required to meet bond debt service coverage requirements and amounts necessary to establish a reserve fund. Member agencies are required to levy and collect sufficient funds to pay the budgeted amounts presented by BBARWA and will make up any deficiencies in the Regional System Account, which is the account in which all annual charges are deposited in order to pay the regional system’s expenses. A member agency’s liability could shift under the current Operating Agreement No. 1, if a member agency withdraws participation in BBARWA. Currently, the Operating Agreement is silent as to what occurs if one member agency withdraws its participation from BBARWA. As such, if a member agency withdraws it would be presumed that the remainder of the member agencies would be required to increase their collections to meet any deficiencies in the Regional System Account. The shift in burden if one member agency withdraws could be substantial. Requiring the member agencies to wait to terminate participation in the Operating Agreement No. 1 until indebtedness is no longer outstanding, would ensure that each member agency continues to pay its fair share of indebtedness for the duration of the indebtedness.
Both Amendment No. 6 (of the Operating Agreement No. 1) and the Seventh Amendment (of the JPA) would facilitate debt service for the Program and would enable reliable and equitable financial contribution to the Regional System Account by the members of BBARWA without shifting financial burdens otherwise caused by withdrawal from BBARWA.
City Staff recommends that the City Council approve amending Operating Agreement No. 1 in order to (a) expressly acknowledge that the Regional System includes the Program, (b) modify the termination provisions and (c) include the holder of indebtedness, not solely revenue bonds, to become a third party beneficiary of the Operating Agreement No. 1 (“Amendment No. 6”).
City Staff also recommends that the City Council approve amending the JPA in order to similarly modify the termination provisions and the method of accomplishing purpose provision (the “Seventh Amendment”).
FISCAL IMPACT
Adopting the amendments to these agreements has no fiscal impact. The adopted budget includes the rate structure approved on June 29, 2023 which established rates through Fiscal Year 2027-28 based on BBARWA’s projected member agency cost over the next five years including the funding mechanisms for the Replenish Big Bear initiative. The amendments to the these agreements are designed to prevent a shift in financial burden and provide for equitable member contributions to the Regional System.
ENVIRONMENTAL CONSIDERATION
This Resolution is not a project within the meaning of Section 15378 of the State of California Environmental Quality Act (“CEQA”) Guidelines, because it has no potential for resulting in physical change in the environment, directly or indirectly. The City Council further finds, under Title 14 of the California Code of Regulations, Section 15061(b)(3), that this Resolution is exempt from the requirements of CEQA because it will not have a significant effect on the environment.

2. Enhance community engagement and local advocacy strategies, while bolstering partnerships with residents, businesses and regional partners
