PREVIOUS CITY COUNCIL ACTION
On May 27, 2025, the City Council received a presentation from the Orange County Fire Authority (OCFA) about the publication of the fire severity zone maps by the California State Fire Marshal.

DISCUSSION
The California Public Resources Code requires CAL FIRE to classify areas within the state into Fire Hazard Severity Zones ("FHSZ"), with areas potentially designated as Moderate, High, or Very High Fire Hazard Severity Zones. These classifications are based on factors such as topography, vegetation, fire history, and weather patterns. According to CAL FIRE, “hazards” are assessed in the FHSZ, not “risk”. “Hazard” is based on the physical conditions that create a likelihood and expected fire behavior over a 30- to 50-year period without considering mitigation measures such as home hardening, recent wildfire, or fuel reduction efforts. “Risk” is the potential damage a fire can do to the area under existing conditions, accounting for any modifications such as fuel reduction projects, defensible space, and ignition-resistant building construction.” The goal of the legislative scheme is to reduce fire "risk" in hazardous areas through education and home hardening efforts.

Local governments are required to adopt the updated maps for "local responsibility areas" ("LRA") zones under Government Code Section 51179. The updated FHSZ maps affect building codes, defensible space requirements, and disclosure obligations for property transactions. For example, LRA High and Very High FHSZs require California's Wildland Urban Interface (WUI) building codes to be applied to the design and construction of new buildings. Government Code 51182 also requires a 100-foot defensible space clearance and wildland fire safety practices for buildings in high fire zones.

CAL FIRE recently released the 2025 Local Responsibility Area (LRA) Fire Hazard Severity Zone (FHSZ) Maps, starting with regions in northern California and releasing Maps for southern California at the end of March. The most recent updates to these Maps reflects changes in climate, development, and scientific modeling. Staff received the updated LRA FHSZ Map for Buena Park on March 24, 2025. The updated FHSZ Maps include a small section in the northern part of Buena Park that is designated as a Very High Fire Severity Zone. As required by law, staff posted the updated Maps online for public comment and review for 30 days. The City is obligated to adopt the Map, as published by the State Fire Marshal, and can only modify the Map by increasing the fire severity of an area; the City cannot reduce or eliminate high or very high severity designations made by the State.

Staff has consulted with OCFA and recommends the City Council adopt the FHSZ Map for Buena Park, as published by the State Fire Marshal.

CALIFORNIA, ADOPTING THE CALIFORNIA DEPARTMENT OF FORESTRY

AND FIRE PROTECTION FIRE HAZARD SEVERITY ZONE MAP FOR LOCAL

WHEREAS, on March 25, 2025, the California Department of Forestry and Fire Protection released updated Fire Hazard Severity Zone maps;

WHEREAS, the City of Buena Park is the entity responsible for Fire Protection Service in the Local Responsibility Area (LRA); and

WHEREAS, in accordance with California Government Code Section 51179, the City of Buena Park is required to adopt these maps by ordinance.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BUENA PARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS:

SECTION 1. Pursuant to Government Code Section 51179, the City of Buena Park hereby adopts the Fire Hazard Severity Zone Map for Local Responsibility Areas as developed and designated by the California Department of Forestry and Fire Protection (CAL FIRE), as said map is set forth in Exhibit “A” attached to this ordinance and incorporated by this reference.

SECTION 2. The adopted map shall be maintained on file with the City Clerk and made available for public inspection during normal business hours. The map may also be accessed on the CAL FIRE website.

SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, the remaining portions of this ordinance shall nonetheless remain in full force and effect. The City Council hereby declares that it would have adopted each section, subsection, sentence, clause, phrase, or portion of this o rdinance, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phr ases, or portions of this o rdinance be declared invalid or unenforceable.

SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to published as required by law.

SECTION 5. The City Clerk is directed to forward a copy of this ordinance to the California Department of Forestry and Fire Protection.

DISCUSSION
The City Council adopted a policy titled, “Creation of Preferential Parking Districts,” on August 8, 2017. The intent of the policy is to create a framework for a consistent evaluation and approval process for staff and residents to adhere to. At the time the policy was adopted, requests for Preferential Parking Districts (PPDs) were becoming more and more frequent, but there were no clear guidelines on how to establish each PPD. Since the policy was adopted, staff has been able to evaluate each PPD request against a consistent standard. The policy was also drafted to be in compliance with California Vehicle Code (CVC) Section 22507, which is the code section that authorizes local agencies to establish PPDs.

The policy outlines two primary requirements:

1. Resident Petition: A petition must be submitted by residents of the area, with at least two-thirds (66.6%) of residents in favor.

2. Self-Contained Area: The proposed area must be “reasonably self-contained.” The petition requirement is straightforward to evaluate. The requirement to be a self-contained area requires more staff evaluation. The goal is to ensure that PPDs are not too small, which could displace parking problems to neighboring areas. For example, staff typically avoids approving PPDs that apply only to one side of a street or to just a few homes, rather than the entire street.

In addition to the two requirements, the policy mandates a staff investigation after receiving a valid petition.

This investigation evaluates:

Peak-hour parking demand;
Any unusual conditions contributing to high parking demand; and, Whether the area is reasonably self-contained.

While high parking demand or unusual conditions are not required for approval, staff considers them in every case.

In general, the policy is flexible for implementing approved PPDs. It allows each PPD to be reviewed on a case-by- case basis and for the specific terms of each PPD to fit the needs of the area in question. For example:

Parking restrictions may apply 24/7 or only on certain days or during specific hours.

Residents may receive one or two permits per household, with unlimited temporary (one-day) permits.

Permit fees are set uniquely to each PPD to eventually offset the cost of the program.

A PPD may be removed through a new petition process.

The policy was developed by staff based on reviewing similar policies in other Orange County agencies at that time.

Since being directed to review the policy, staff has obtained information about the permit parking policies in six other Orange County Cities (Cypress, Anaheim, Orange, Santa Ana, Costa Mesa, and Huntington Beach, see Attachment 2). As shown in the attachment, key findings include:

All six cities require a resident petition.

Two require a 2/3 majority, three require a 3/4 majority, and one requires only 51% support.

Two cities charge a fee to submit a petition, and one charges an additional fee if the PPD is approved.

Three cities charge no fees aside from the cost of permits.

All cities charge a fee for permits, most of which are higher than those in Buena Park.

BUDGET IMPACT
Excluding staff time, there are two main costs associated with PPDs:

Procuring parking permits
Installation of signs in the affected neighborhoods
Staff reviewed costs for calendar years 2021 through 2025, and has determined that the City expended:
$28,418.24 on parking permits
$12,250 on signage
Total Expenditures: $40,668.24
The intent of the policy has been to offset costs through the sale of parking permits to the affected neighborhoods.

The Public Works Department is responsible for sale of regular parking permits, and the Police Department is responsible for the sale of temporary (one-day) parking permits. The total revenue from both departments from 2021 through 2025 was $50,169. Overall, the City has a net revenue of $9,500.76 over the past 5 years from the PPD program.

Please note that, as stated above, this figure does not include staff time to review and administer PPD requests.

Although not explicitly stated in the policy, staff's goal when setting parking permit costs has been to offset the cost of the PPDs over a period of years.

It is the policy of the City of Buena Park that the creation of Preferential Parking Districts (PPD
’s) shall be allowed in conformance with California Vehicle Code (CVC) Section 22507.

Establishment of PPD’s shall be the responsibility of the Public Works Department, and shall comply with guidelines set forth in this policy.

Background
Requests for the Creation of PPD’s has become more and more frequent. A PPD is one method that may help alleviate problems with on-str eet parking in certain areas of the City. It is noted that the creation of a PPD does not guarantee that a resident will be able to park dir ectly in front of their residence; it establishes a prefe rence for that resident in a given area. In order to effectively process these requests, a set of uni form guidelines shall be established. These guidelines will ensure that all requests are processed in a similar manner.

Procedure / Approval Process
The following process shall be used to request/approve a PPD:

1. The interested party submits a formal request, i n writing, to the Traffic & Transportation Division.

2. Staff shall give the interested party a petition form to circulate in the area of the request

3. The interested party will submit the petition ba ck to staff. a. If the petition does not have a minimum of 2/3 ( 66.6%) support of the local residents, staff shall reject the request for a PPD.
b. If the petition does meet the 2/3 (66.6%) minimu m requirement, staff shall proceed with the remaining steps.
c. See the “Criteria” section for details on the 2/ 3 (66.6%) requirement.

4. Staff shall conduct an investigation into the PP D request (see “Investigation” section).

5. After the investigation is complete, the request shall be brought to the Traffic & Transportation Commission (TTC) for review.
a. The TTC shall review the request and make a reco mmendation that the City Council either approve or deny the request.

6. After review by the TTC, the City Council will m ake a final review of the request and either approve or deny it.

Criteria
When a request is made for a PPD, there are several criteria that must be met. They include:

1. The person making the request must identify the following items:
a. The reasons for the request.
b. The exact boundaries of the proposed PPD.
c. The requested effective days and hours of the pa rking restriction.

2. The area of the request must be reasonably self- contained.

3. The petition must be signed by a minimum of 2/3 (66.6%) of the residents in the proposed PPD area.
a. Each property in the PPD is allowed one signatur e – additional signatures from the same property will not be counted.
b. A signature may be made by the property owner or by a renter.

Investigation
When staff receives a petition that has met the min imum 2/3 (66.6%) requirement, staff shall investigate the area of the proposed PPD. The inve stigation should include, but is not limited to traffic volume counts, parking studies, field obser vations, and resident interviews. The intent of the investigation is to establish the amount of par king use in the given area, and whether or not it is in-use by people who are not living in the immediate area.

Conditions where a PPD may be warranted include:
• High Demand: The peak parking demand is normally a t least 75% of the available parking spaces.
• Unusual Condition: The area for the proposed PPD i s near by some location that causes an unusual parking demand (park, school, theme park, etc.). • Self-Contained Area: The area for the proposed PPD is a reasonably self-contained area of parking demand and supply.

Additional conditions may be relevant depending on the nature of the proposed PPD.

The investigation should also review other options (alternates to a PPD) that may address resident concerns. These options may include creat ing additional off-street parking or creating angled parking.

Permit Conditions
Permits shall be of a type approved by the Director of Public Works. Parking permits shall follow these guidelines:

• Parking Permits shall be divided into two types:
o Resident/Visitor: A permit for exclusive use of re sidents and guests. These permits shall be renewed biennially.
o Temporary (one-day): A permit for exclusive use of residents and guests for special occasions in which a resident may require a dditional permits. These Policy Statement

permits shall only be valid for the date specified on the permit. There is no maximum number of temporary permits that may be obtained in one year. • All resident/visitor permits shall be issued by th e Department of Public Works; all temporary permits shall be issued by the Police Dep artment. These departments shall maintain all records necessary to issue and track permits. • The maximum number of Resident/Visitor permits ava ilable to each household in a PPD shall be two (2).
o Notwithstanding the above, the Director of Public Works shall have the authority to lower the number or parking permits available to residents of a PPD on a district-by-district basis. This information shall be included in the resolution for each PPD.
o In addition, any resident may request, in writing, to be allowed to have more than the number of resident/visitor permits that is norm ally allowed in that district.

These permits may be issued at the discretion of the Director of Public Works. • Costs: The Director of Public Works shall determin e the costs of the permits on a district-by-district basis. However, in no case sh all the cost of a resident/visitor permit be less than $10.00, and in no case shall the cost of a temporary permit be less than $1.00
• To obtain any permit, the resident must bring evid ence that they live within the borders of the PPD.
• Permits are non-transferable. Misuse of permits ma y result in revocation. • All permits shall display the name of the PPD that they are valid for. All permits shall be valid for one district only.
• Any vehicle which displays a valid parking permit may not park in violation of another law or ordinance, such as on a street sweeping day or in a red curb zone.

Removal of a PPD
Residents within an approved PPD may desire to disb and the district. This may be accomplished by using the following procedures.

1. The interested party submits a request in writin g to the Director of Public Works. The interested party will be given a petition form to c irculate for disbanding the district. This petition will follow the same rules established in the “criteria” section above.

2. After receiving the completed petition, the item will be brought to City Council for review.

3. If so approved by the City Council, the PPD shal l be removed.

DISCUSSION
The City currently operates a community garden on leased property within the Southern California Edison (SCE) Right-of-Way (ROW), located south of Thelma Avenue between Knott Avenue and Holder Avenue. The site spans approximately 4.4 acres and contains a total of 169 garden lots out of which 120 are large plots, 16 are medium, and 32 are small plots. Plots are leased to community members on an annual basis, with fees scaled by plot size.

Established in 1969, the purpose of the community garden is to provide residents - particularly those with limited yards - the space and opportunity to grow vegetables, fruits, flowers, and herbs.

In 2021, community meetings were held as part of the Community Gardens Master Plan process to develop a Capital Improvement Project (CIP) for the site.

Although funding was allocated for the CIP in 2022, the project was temporarily paused as other projects took precedence. The project was reactivated last year under new direction. Since the site is within the SCE ROW, there has been added complexity throughout the design process. SCE needed to thoroughly review the plans and progress has been slower than anticipated. Nonetheless, after addressing these challenges, 100% Plan, Specifications, and Engineering was achieved and was put out to bid on June 5, 2025.

The project includes several key enhancements to safety, accessibility, and aesthetics:

Removing and replacing chain link fence on the west and east sides of the community gardens Removing chain link fence along Thelma Avenue and replacing with new steel fencing and decorative columns
Existing landscaping along Thelma Avenue to be removed and replaced with new landscaping and irrigation Existing driveways and gates to be removed and replaced with new decorative and electrically actuated gates New pedestrian gates will be added
New lighting will be added to the interior of the garden area Three bids were received and publicly opened on July 9, 2025. The apparent low bidder is:

Green Giant Landscaping, Inc. (La Habra, CA)
Base Bid: $836,415.00
Additive Bid Item A (Privacy Screening): $30,000.00
Total Recommended Award: $866,415.00
If project is awarded, staff would recommend awarding the construction contract inclusive of Additive Bid Item A, for privacy screening.

BUDGET IMPACT
Just over $660,000 is allocated in the project budget (Account No. 32-290158-9806). Due to design costs, the amount currently available for the project is $635,563. As previously stated, the apparent low bid for the project is $866,415. Staff recommends a 20% contingency for the project, which would bring the total construction cost to $1,039,698. This results in a funding shortfall of $404,135 compared to the available project budget.

During the design phase, staff anticipated the potential for construction costs to exceed the budget and performed value engineering to reduce overall project costs. One cost-saving measure was the reclassification of certain decorative elements as Additive Bid Item B, which staff does not recommend pursuing at this time.

Staff has reviewed the bid documents and references of Green Giant Landscaping, Inc. Staff found the bid documents to be in order, and that the company has satisfactorily completed other similar projects for other agencies.

If the City Council chooses to proceed with the award, a budget amendment or identification of additional funding sources will be necessary to fully fund the project.
