SUBJECT: Camarillo Springs Golf Course New Urban West, Inc. 3rd Party Drainage Review – Final Observations
Submittal #4 references are provided at the end of this memo. The revised and updated Tentative Tract Map (TTM) dated August 17, 2022 has been received and reviewed as it relates to the 3rd Party Drainage Review.

EXECUTIVE SUMMARY
The purpose of this review is to provide final observations of the conceptual drainage system design, as well as review comments on Submittal #4.

In response to Kasraie Consulting’s (KC) 3rd Party Reviews, NUWI/PACE have provided several submittals including Submittal #4 dated 4/21/2022 and the revised TTM by ECG dated 8/17/2022. The latest submittal includes a new Master Drainage Plan and Floodplain Analysis Report, responses to the previous technical comments, floodplain maps and computer models for the existing pre-project condition and the proposed post-project future condition.

Additionally, several special what-if scenarios and failure analyses were conducted to demonstrate the potential risks of flooding in the event that certain drainage facilities were to fail or get clogged during a major storm event.

As a result of the 3rd Party Review process, the initial hydrology for the project had to be corrected. The magnitude of the incoming 100-year peak flow at Camarillo Springs Road was nearly doubled from 1,151 cfs to 2,250 cfs, with an 18% increase in the 100-year flood hydrograph volume.

The increase in the incoming runoff and hydrology resulted in a significantly larger drainage system required for the proposed development. For example, NUWI/PACE have revised the drainage system to include four additional 66” pipe culverts at Camarillo Springs Road, a larger Single 12.5’x6.5’ bypass box culvert, new Double 12.5’x6.5 box conduits bypassing the “Lake”, and a breach-resistant floodwall or levee embankment which is proposed to completely separate the upstream runoff, preventing it from entering the “Lake”.

The updated drainage plan results in a 100-year flood elevation of 112 ft. for existing homes adjacent to the “Lake”, six (6) feet lower than the current FEMA BFE, elevation of 118 ft. As a result, some 154 parcels would be removed from the 100-year flood plain and no longer have

Page 2 of 9 ends

the mandatory flood insurance requirement. However, if a parcel has even a small area at the 112 ft. elevation, lenders and insurance companies may still require flood insurance.

Note, as outlined in City staff’s April 13, 2022 presentation to City Council, the changes to the drainage plan “will result in significant new information that under CEQA, require updates to the Draft EIR … FEMA and the Ventura County Watershed Protection District would also need to review the significant new information.”

We are of the opinion that the proposed drainage system will function during a 100-year flood as intended if there are no drainage feature failures such as blocked pipes or culverts, a breach in the levee embankment or floodwall, or malfunctioning mechanical devices. However, the proposed development includes an artificial “Lake” fill embankment with new houses on top which are higher than the existing houses adjacent to the “Lake”. This is not a standard design, therefore there are some inherent risks associated with the drainage design concept.

The artificial fill embankment will double as a dam embankment and a levee embankment, yet it is unclear if it will be designed and engineered as such. A “Lake” area is formed behind the proposed fill embankment located perpendicular to the current Camarillo Springs Creek center line through the golf course. At the same time, a levee embankment is being created parallel to the Conejo Creek center line with houses behind it.

The National Flood Insurance Program (NFIP) defines a levee in Title 44, Chapter 1, Section

59.1 of the Code of Federal Regulations (44 CFR 59.1) as “a man-made structure, usually an earthen embankment, designed and constructed in accordance with sound engineering practices to contain, control, or divert the flow of water so as to reduce risk from temporary flooding.” Therefore, as part of the required revised CLOMR to FEMA, the fill embankment should be included as a levee since it is being used to remove existing homes from the 100- year Special Flood Hazard Area (SFHA).

Because of its location and the proximity to Conejo Creek, the fill embankment creates a “levee condition” along Conejo Creek as there are many existing homes adjacent to the “Lake”, which are several feet below the existing 100-year Base Flood Elevation (BFE) in Conejo Creek.

Due to the significant flood level differential between the Conejo Creek and the area adjacent to the “Lake”, the development as proposed is unable to provide an unobstructed emergency overflow spillway in compliance with City requirements to allow stormwater to escape from the “Lake” under any rainfall conditions before it reaches the elevation of any existing and proposed homes.

Other residential development projects in the City, such as Pitts Ranch, have historically included an unobstructed emergency overflow spillway constructed lower than the adjacent home pad elevations, and higher than the downstream flood elevations in the receiving streams allowing stormwater to escape before it reaches the elevation of any homes. Emergency overflow spillways are typically designed to handle the unreduced incoming 100-year flood peak flows without the use of mechanical backflow prevention devices.

Instead of providing an unobstructed emergency spillway as prescribed above, the project is proposing a redundant 4 ft. diameter overflow pipe from the “Lake” with a weir opening on top set at the 112 ft. 100-year flood elevation of the “Lake.” This proposed overflow pipe and weir is not designed for the unreduced incoming 100-year flood peak flow. The other main 4 ft.

Page 3 of 9 ends

diameter operating outlet pipe and this redundant overflow pipe both require mechanical backflow prevention devices at their outlets such as flap gates to prevent flood water from backflowing from Conejo Creek into the “Lake.” Manually operated gate valves are being proposed as a backup prevention measure in the event the mechanical flap gates fail. These mechanical devices and the drainage pipes and culverts will require implementation of a maintenance plan to ensure their proper operation to prevent flooding in perpetuity. The proposed drainage plan does not meet the City’s requirements of an unobstructed emergency overflow spillway as previously described.

In our opinion, the project does not meet the City’s requirements due to the outlined issues described above. These include lack of an acceptable unobstructed emergency spillway; lack of a properly designed overflow system and drainage path; absence of information on whether the fill embankment between Conejo Creek and the “Lake” will be designed to the FEMA/USACE levee design standards, and reliance on mechanical flood protection devices that require intensive maintenance in perpetuity.

Meeting the City’s requirements is technically infeasible by this project with the proposed fill embankment and drainage design concept.

This, combined with the significant historical events in Camarillo Springs including brush fires, intense rain storms and destructive mud and debris flows, may result in potential significant flooding risks to the existing and proposed development.

PROPOSED PROJECT BACKGROUND
New Urban West Inc. (NUWI) is proposing to redevelop the current Camarillo Springs Golf Course into an active adult lifestyle and golf community consisting of 200+ single family homes and amenities for those aged 55+. The site is currently located at the confluence of the local Camarillo Springs Creek Watershed (CSCW) with the regional Conejo Creek, which is a Ventura County Watershed Protection District (VCWPD) jurisdictional redline channel.

HISTORICAL NATURAL HAZARDS
Historically, this area has experienced numerous natural hazard events including fires, local (CSCW) and regional (Conejo Creek) flooding, hillside instability, and debris flow. In May 2013, the Springs Fire burned through and eliminated much of the vegetation along the eastern and southern sides of CSCW, increasing the likelihood of hillside instability. Heavy and intense rainfall events swept through the area in November and December of 2014 creating substantial public safety hazard events that resulted in significant residential and general infrastructure damage due to mud and debris flows. As a result, the City of Camarillo invested significant capital in the installation of numerous debris flow control systems.

Due to the recorded local drainage related issues and history of fire in the watershed, the City required NUWI and its consultants (PACE, ECG) use previously accepted runoff methodology estimates. The City also required multiple drainage infrastructure “failure” alternatives and mitigation strategies be evaluated that are in addition to the typical design standards required for most developments.

3RD PARTY REVIEW PROCESS
Several 3rd party conceptual drainage design reviews were completed by Kasraie Consulting (KC) to determine if the proposed conceptual design met City standards as well as requirements necessary due to the specific site conditions. The following provides dates of these reviews and a brief synopsis of key findings or requirements:

A. July 23, 2021 Submittal #1 Review Key Comments
o Revise hydrology method and procedures.
o FEMA may consider the Lake fill embankment a levee or creating a “Levee Condition”. o Expand 2D flood modeling to include CSCW.
o Map flood hazards due to historical fire/flood events & potential blockage or system failures.
o Perform several what-if failure analyses.
o Potential for Division of Safety of Dams (DSOD) jurisdiction. o Update debris production analysis.
o Require Unobstructed Emergency Spillway & Flow Path.

B. August 12, 2021 (Draft 2009 Hydrology for CSCW)
o As requested by the developer, KC provided Legacy Hydrology models from the City’s Draft 2009 Master Plan of Drainage for reference.

C. October 11, 2021 Submittal #2 Review Key Comments
o Update hydrology with recommended revisions.
o Provide Tc Calculations.
o Adjust and correct subarea boundaries.
o Include hydrograph volume adjustment.

D. March 2, 2022 Submittal #3 Review Key Comments
o Submittal #3 generally followed 3rd Party Review recommendations. o Developer updated hydrology using Legacy Methods as recommended by KC. o KC independently modeled and evaluated the existing and proposed drainage systems. o Based on our findings, the proposed drainage system will function as intended during the 100-year flood. However, certain corrections, design changes and recommendations are provided.
o Discharges and velocities to the channel west of Margarita Avenue increase due to the added conveyance caused by the triple box culverts, the Ridge View Street storm drain, and the 2-48-inch “Lake” drain pipes.
o With additional outlet erosion mitigation measures as well as the fact that peak flows on Conejo Creek will not be impacted, this increase is unlikely to have adverse effects in Conejo Creek.
o Margarita Avenue culvert crossing needs to be redesigned to incorporate an energy dissipator structure that will include the outlets of the triple box culverts, 48-inch storm drain along Ridge View Street, and 2-48-inch “Lake” drain pipes. o Design calculations need to support a meaningful reduction in flow velocities leaving the energy dissipator from 9 fps to 3 fps. Please note basic rock riprap will not be adequate.
o Lake outlet pipes will require mechanical flap gates to prevent backflow into the Lake from Conejo Creek. Operation & Maintenance Manual is required. o The “Lake” fill embankment needs an unobstructed emergency spillway and flow path per City requirements.

Page 5 of 9 ends

o VCWPD watercourse permit and/or concurrence is required due to the fill embankment, outlet works, and energy dissipator being within the Conejo Creek floodplain and floodway.
o The Lake will hold the 100-year 24-hour storm volume; however, a multi-day (4 day) flood analysis is required.
o A breach-resistant floodwall or levee is required to separate the West Basin from the Lake. A larger area will be inundated (up to elevation 119.3) if the floodwall/levee were to beach. Include a 100-year and 500-year breach analysis in the Master Plan report.
o Document each failure analysis and results in the Master Plan Report, and include the multi-day 100-year analysis.
o Provide a combined 500-year storm analysis for Conejo Creek and CSCW.

E. April 13, 2022 City Council Presentation by Hassan Kasraie o Video of City Council meeting is online at the City’s Website.

F. October 14, 2022 3rd Party Drainage Review – Final Observations (this document)

SUBMITTAL #4 REVIEW COMMMENTS & FINAL OBSERVATIONS
In response to KC’s 3/2/2022 technical comments, the applicant has adequately addressed review items (a), (c), (f), (i), (k), (l), and (n). The other technical comments were also responded to for our review, and we provide the following final observations:

Item (b) Hydrology

The percent impervious value for subarea WS35 was not revised.

Items (d) & (e) Downstream Energy Dissipator and Margarita Avenue Culvert Improvements

The overall conceptual drainage system outlet at Margarita Avenue is proposed to consist of three 12.5’ wide x 6.5’ high Reinforced Concrete Box (RCB) conduits, two “Lake” 48” Reinforced Concrete Pipes (RCP) with mechanical closure devices, as well as one 48” RCP along Ridge View Street that will all drain to an energy dissipator structure.

A complete energy dissipator and outlet structure design at Margarita Avenue was not provided.

Design calculations and analysis to support a reduction in flow velocities from 9 fps to 3 fps was not provided.

The April 2022 Master Drainage Plan and Floodplain Analysis (MDPFA) report indicates that this will be provided at final design, therefore a reduction in flow velocities cannot be verified at this time. Based on a 3/29/22 project meeting, PACE stated that the final design will not adversely impact the adjacent properties as required by California Drainage Law.

Item (g) Unobstructed Emergency Spillway

Page 6 of 9 ends

An unobstructed emergency spillway and flow path were not provided as required by the City.

A redundant 48” RCP outlet pipe and weir structure are proposed in addition to the single “Lake” 48” RCP operating outlet pipe. Preventing backflow from Conejo Creek through the “Lake” outlet is dependent on a mechanical system, such as the proposed mechanical Tideflex Duckbill Check Valves (TDCV) on the outlets of both 48-inch RCP pipes and the additional manual gate valve on each 48-inch RCP. NUWI and PACE acknowledge that an operations and maintenance plan is necessary for the mechanical system.

Item (h) VCWPD Concurrence

During the 3/29/22 meeting, City staff reiterated that the applicant must get concurrence from VCWPD on the new and updated drainage design concept before the EIR is recirculated. PACE agreed and indicated they would reach out to VCWPD.

As part of the EIR and FEMA Conditional Letter of Map Revision, the developer provided a submittal package to VCWPD addressing the regional impact of the initially proposed conceptual design on Conejo Creek.

Since the conceptual design has been updated and is proposed to include outlet structures and potential impacts to adjacent properties within the Special Flood Hazard Area (SFHA) of a jurisdictional channel, documentation verifying VCWPD permitting requirements and subsequent concurrence is required.

At the time of this review, such documentation or concurrence have not been provided.

Item (j) Separation Floodwall-Levee Embankment

The embankment or floodwall between the West Basin and the “Lake” is proposed to separate the upstream Camarillo Springs Creek flows and the local flows adjacent to the lake.

A full design of the embankment or floodwall, including soils or geotechnical engineering analysis, was not provided, therefore the separation cannot be verified at this time. PACE has indicated that this information will be provided at the time of final design.

Item (m) Additional Information or Data
iv. There was no Breach Analysis provided for the embankment between the “Lake” and the West Basin therefore breach resistance cannot be verified at this time. PACE has indicated that they will consult with a geotechnical engineer to ensure the separation floodwall and levee embankment will be designed to prevent breaching.

New Item (o) 1,000-year Flood Protection
PACE’s April 21, 2022 cover letter states among other things:

Page 7 of 9 ends

“The Legacy rainfall represents volumes in excess of a 1,000-year storm event according to the latest county and NOAA data. Thus, the system is now designed to greater than 1,000-year event even though 100-year event protection is the published design standard accepted by the county and by FEMA.” In our opinion, the above statement is false. The drainage system is designed for a 100- year storm return period as the Rational Method only includes a runoff coefficient “C”, 100-year rainfall intensity “I” in inches per hour, and the drainage area “A” in acres.

There are no other rainfall depth or volume values included in the basic Q=CIA formula.

For reservoir routing and dynamic flood routing purposes, the hydrograph volume is adjusted with the SCS-based “fattening” method. As can be seen in PACE’s hydrology calculations below, only a weighted-average 24-hour rainfall total of 6.5 inches is applied, not the theoretical K Zone total rain amount of 10.6 inches (B98). The total 100-year flood hydrograph is 304.55 acre-feet based on the Legacy Method.

In comparison, as shown below, the 2017 Hydrology Manual analysis performed by JDS yields a total volume of 258.07 acre-feet.

Even though, the peak 100-year flow nearly doubled (from 1,151 cfs to 2,250 cfs), the hydrograph volume only increased 18% (from 258.07 acre-feet to 304.55 acre-feet).

Therefore, we disagree with PACE’s assertion that they are providing 1,000-year level of flood protection.

Revised “Legacy Method” VCRAT Hydrology by PACE 4/21/2022

Original “2017 Hydrology Manual” VCRAT Hydrology by JDS 10/31/2018

New Item (p) On-site Drainage Design based on “Legacy Hydrology Methods”

Page 8 of 9 ends

The ECG on-site drainage design hydrology was not updated to match the Legacy Method procedures. ECG’s “Preliminary Drainage Study for Camarillo Springs Golf Course for Tentative Tract Map No. 6016” dated June 24, 2021 is partly based on the Legacy Method Time of Concentration methodology, and the hydrology is based on the 2017 Hydrology Manual methods.

To be consistent with the remainder of the project, the on-site hydrology must adopt the Legacy Methods as well.

New Item (q) Comments on Revised TTM
Manual gate valves are inadvertently shown on the Double 12.5x6.5 RCB conduits instead of the 4 ft. diameter “Lake” outlet pipes. The various 100-year inundation areas were not updated to be clearly shown on the TTM within the “Lake”, West Basin, East Basin, including the Conejo Creek floodplain and floodway lines.

Subject: Camarillo Springs Summary of Project Activities (TT-6016/RPD-204); Triennial Review Update

Dear Ms. Lee:

Thank you for the opportunity to present this status update on the Camarillo Springs project.

Since our last update, we have worked hard to further define our project, talk to the community, and expand on our vision for a project that not only adds much needed senior housing and a golf course, but also fits the character and spirit of Camarillo Springs, a community we’ve come to know and respect over the past several years.

As you know, the project will provide 248 age-restricted homes for seniors alongside a new locally owned golf course and clubhouse. We believe that our golf course concept is part of a new national trend for 12 holes that allows the passionate golfer to scale up to 18, while also welcoming new and more causal golfers to the course. The approach has proven to invigorate communities across the country and has earned acclaim from famous golfers both locally and nationally. From Jack Nicklaus’ Red Ledges in Utah to Las Vegas, Florida, and all over Europe, 12-hole courses are a big part of the future of golf.

Notably, our project also includes a robust trail network and publicly accessible open space. As a matter of fact, open space, parks, and golf account for 83% of the project.

We continue to work with the community to protect and rebrand the golf course while also providing opportunities for outdoor activities for seniors and other community members. It’s imperative that seniors can welcome their children and grandchildren to a community that has amenities for all ages. Trails, parks, dog parks, and tot lots are all part of the new, fresh approach to the Greens at Camarillo Springs.

Approximately 17% of the property will be redeveloped with single-family detached housing. We have heard feedback that many seniors would like to move into smaller homes that are more manageable. Our project does that and frees up valuable larger homes for families in the area. The need for senior housing is at an all time high throughout our state. Camarillo is no different. This article from the VC Star

2001 Wilshire Blvd, Ste 401
Santa Monica, CA 90403

2 highlights the dire need for seniors to find affordable housing and the lack thereof. https://www.vcstar.com/story/news/2022/04/05/senior-advocate-older-adults- pushed-out-housing/9472635002/. The Greens and Camarillo Springs will provide much needed senior housing for the region and allow seniors to live with dignity and security.

Street improvements to Ridge View Street will add additional travel lanes, construct a sidewalk, and enhance safety for all residents. The project includes over $15,000,000 in privately funded infrastructure improvements that will substantially reduce flooding risks for all 156 existing residents living in the FEMA flood hazard zone. As a result of ongoing collaboration with the City of Camarillo and your 3rd party hydrology consultant, the drainage system is designed to handle extremely large and rare rainfall events, including a100-year storm, 500-year storm, multi-day storm, and features multiple redundant safety features that work to prevent failures. A comprehensive maintenance manual for the proposed drainage system has been developed alongside a budget detailing ongoing operating cost.

Since our last triennial review update, project activities have been largely related to completion of a 3rd party hydrology review and associated modifications to the master drainage plan, finalization of analysis required to produce the economic impact studies requested by the City, ongoing engagement with the Camarillo Springs community, and responding to the City in connection with preparation of revised Draft EIR sections for recirculation.

Since the approval of the General Plan Amendment Referral in September 2017, our project team has spent more than 5,400 hours preparing plans, designing a brand-new golf course, responding to City feedback, addressing comments from FEMA and Ventura County Watershed Protection District (“Watershed”), and engaging with area residents and stakeholders. As of the date of this letter, both Watershed and FEMA have concluded their review of the project.

To date, in total, we have completed 28 submissions to the City of Camarillo, FEMA, and Watershed in support of the project with total costs exceeding $4,000,000.

A summary of recent project activities is provided directly below. A detailed chronology of project plan submissions to the City, FEMA, and Watershed is attached as Exhibit A.

I. Flood Safety and Hydrology

A key objective of the project is to significantly reduce flooding hazards for the 156 existing residents that currently live within a mapped FEMA flood zone. The proposed project, as revised in collaboration with the City’s 3rd party consulting team, represents an unprecedented private investment in flood safety after 40 years of unabated flooding risks.

3 At the request of the City and in response to public comments on the draft environmental impact report (“EIR”), an independent 3rd party review of the proposed master drainage plan (“MDP”) has been performed by Mr. Hassan Kasraie. Mr.

Kasraie has reviewed the MDP three times, beginning in June of 2021 and concluding in March of 2022. Our team worked diligently to respond to all comments provided by Mr. Kasraie and make changes to the plan and project accordingly.

After 10 months of review and input from the City’s team, the proposed MDP has been finalized to add additional safety features which will provide protection to existing and future homeowners in the event of a 100-year storm event, 500-year storm event, and multi-day storm event.

The MDP was revised to conservatively utilize legacy rainfall data, an approach that provides an even greater factor of safety by designing a system that can accommodate extremely large volumes of water and addresses multi-day rainfall events. The revised MDP has been reviewed by County Watershed and the application has been deemed complete by Watershed staff. Additional coordination with Watershed will occur during final design and construction.

Since the approval of the GPA referral in 2017, our engineering team at PACE has performed over 5,300 hours of work in support of the MDP and associated review by FEMA, Watershed, and City of Camarillo. This includes 32 months of plan preparation and coordination with Watershed and 18 months of plan preparation and coordination with FEMA staff.

II. Completion of Drainage Maintenance Manual and Economic Impact Analysis

As part of the 2017 referral, the City requested a comprehensive maintenance manual, including allocation and accounting of costs for future HOA and golf course improvements. This information is a component of an economic impact study also requested by the City.

The requested maintenance manual has been provided to the City. It includes details on the operation, inspection, and maintenance of each component of the master drainage system, including total costs to complete these activities. A schedule of inspections, debris removal guidelines, and sediment removal best practices are also provided. Finally, a maintenance checklist has been created for ease of use by future residents to ensure all maintenance activities are performed properly and in a timely manner.

Furthermore, we have completed a full analysis of annual maintenance costs associated with the new golf course facility and HOA operated amenities including the proposed parks, trails, clubhouse, streets, and common landscaping. A complete HOA maintenance budget was created to estimate the ongoing HOA costs. This budget was completed in accordance with California Department of Real Estate (DRE) requirements and regulations.

4 Maintenance costs associated with the golf course were also estimated and included in the manual provided to the City. The golf course analysis derived maintenance costs by comparing other public and private courses in the area and accounts for costs unique to the Camarillo Springs drainage system.

These analyses confirmed our belief that the proposed project represents a financially sustainable master planned development that will deliver significant flood safety improvements, recreational amenities, and sustainable golf amenity with a diversified revenue stream to ensure long term viability. The senior housing will provide a financial base of support for the ongoing operation and maintenance of the amenities.

III. Revision of Tentative Tract Map

In accordance with the changes made to the MDP as a result of the City’s 3rd party review, our engineering team has updated the tentative tract map and submitted these plans for City review and comment on August 18, 2022. As of the date of this letter, we have not received any additional comments on the revised tract map.

IV. Community Engagement

Since approval of the GPA referral, we have remained committed to ongoing engagement with the Camarillo Springs community. We have held over 60 meetings with area residents, the Camarillo Springs Advisory committee, and other stakeholders. Outreach has included 13 workshops regarding flood safety, environmental review process, and golf course design.

We have held 7 meetings with the Advisory Committee sub-committees on golf course design, food and beverage service, and parks and open space.

In total, more than 300 hours have been spent engaging with the community and holding workshops. Over 1000 residents have participated in these meetings, workshops, and sub-committee meetings. The project design and amenities reflect the time spent listening to our neighbors. All proposed new homes will be age restricted to those 55+ years and older, ensuring consistency with the primary demographic of the existing community. The proposed new homes have been located in an area of the property that is farthest away form existing residences in an effort to minimize impacts to views and traffic patterns. The amenities included in the project are a direct result of the feedback we received from residents related to the importance of golf, new dining options, parks, and open space.

V. Conclusion

Again, thank you for this opportunity to provide a summary of project activities completed in support of our applications for the Camarillo Springs project.

5 We look forward to our continued work with staff to finalize the project EIR and begin the public hearing process.

Sincerely,

Jonathan Frankel
Project Manager

Comments Dear City Council,
By voting yes you are saving golf at Camarillo Springs. A "no" vote will place our entire neighborhood in jeopardy. From what I've read in the documents many things can be built where the course is now. Why let that happen. Please, think of all of us senior residents as you vote.

Comments I am hoping & praying the City Council will vote in favor of the development of the Camarillo Springs Golf Course. I am a resident of this community & I live on the golf course & the water... I am aware that the owners are not golf course investors & trying to keep this old & dilapidated course going.... The course is in terrible shape & is only going to get worse if this development is not allowed to go forward. AND it will be an eyesore & a terrible symbol for the entire community of Camarillo. If it is not approved, you will be responsible, along with the people who oppose it, of
contributing to this awful mess.. You have an opportunity to have this entire area repaired & made into a place of beauty for Camarillo... Please take advantage of it so we, the taxpayer, will not have to bear the burden..

Sincerely

Comments Dear Camarillo City Council Members,
I am writing to express my strong support for the proposed development of Camarillo Springs Golf Course. I believe that this project will bring numerous benefits to our community and enhance the quality of life for residents in Camarillo. As a longtime resident and avid golfer, I see this development as an opportunity for positive change.

The Camarillo Springs Golf Course development project
promises several significant advantages for our city:

Economic Growth: The redevelopment of the golf course will attract visitors and tourists, thereby boosting the local economy. New businesses and job opportunities will emerge, contributing to the overall economic well-being of our
community.

Recreational Opportunities: Camarillo Springs Golf Course has long been a cherished recreational space for residents. By modernizing the facility, we can continue to offer recreational opportunities for golfers of all levels. Additionally, with well- designed facilities, it could become a hub for community events, outdoor activities, and family gatherings.
1 Preservation of Open Space: The proposed development
ensures that a substantial portion of the property remains open space, preserving the natural beauty of Camarillo
Springs. This demonstrates a commitment to the
environment and the conservation of green spaces in our city.

Increased Property Values: The improvement and
modernization of the golf course will likely have a positive effect on property values in the surrounding neighborhoods, which is an appealing prospect for homeowners and
investors.

Community Engagement: I appreciate that the developers
have actively engaged with the community to gather input and address concerns. This collaborative approach demonstrates their commitment to creating a project that aligns with our community's needs.

I understand that there may be concerns and reservations about this development, and I respect the need for a
comprehensive review of its impact on the environment,
traffic, and local infrastructure. However, I believe that with careful planning and responsible development, these issues can be mitigated.

In conclusion, I urge the Camarillo City Council to support the Camarillo Springs Golf Course development project. I believe this is a fantastic opportunity to revitalize our community and provide valuable amenities for residents. Please consider the long-term benefits and positive impact this project can have on Camarillo and its residents.

Thank you for your time and dedication to our city's well- being. I look forward to seeing this project move forward and contribute to the continued growth and prosperity of
Camarillo.

Thank you, Alan Ching

Comments I OPPOSE cutting up the golf course to build 258 new homes.

The noise from the building the traffic will be horrendous it's already too crowded here. New urban west in the Beverly Hills lawyer Ron Richards should not threaten to let the course go follow if he can't build 258 homes and make tons of money.

The advisory committee does not represent us it represents GH group who they belong to and will make money T the
expense of our lifestyle. PLEASE KILL THIS PROJECT . Thank you.

Comments Camarillo Springs was once an asset to our community but has recently fallen into extreme disrepair. What was once a beautiful beacon is now an embarrassment. Through years of deferred maintenance, the course is falling apart and needs drastic action. While I would love to keep it an 18 hole course, the proposed changes solve the needs of the course and keep it viable while also helping the surrounding community with flood mitigation. Camarillo Springs is a special place for me because it’s where I take my small children to learn the game I love. It’s how we bond over shared time together. If the course goes away, we will lose that opportunity. I strongly support their proposed improvements and urge you to vote yes on their plans.

Camarillo Springs GPA 2017‐2 overview    ‐ Part 3
by Mike Mishler (M.S. Geology in Ground Water)
Update from Previous Mishler Comments
Volcanic Bedrock Issue Update
 The Preliminary Final EIR (PFEIR) reported that additional geotechnical study had been done on the volcanic bedrock.
a. Geotechnical firm Geolabs – Westlake Village completed the study. b. This additional study reported that the volcanic bedrock should be rippable. c. This study was only mentioned in res ponse  to my question in the PFEIR. d. Sidenote: I believe this additional geotechnical study should have been included in the DEIR appendices.

Developer use of ‘Tideflex Valves’ flap gates
 The developer (via PACE) showed pictures of the new flap gates in the PFEIR (page 2‐900). a. Flap gates are in Huntington Beach, Orange Cou nty.
b. Flap gates are used for a flood control channel.
c. Notice that the flood control channel has concrete and riprap with little loose soil or vegetation. This is the ideal environment for flap gate use. d. But this is the opposite from the proposed project flap gate use environ ment. The adjacent landowner’s farm field drainage ditch consists of just dirt and has plenty of vegetation/debris that lies outside of any HOA control. Also note that the proposed project’s flap gates will be down at the same elevation as the dirt drainage ditch.

Page 2 of 5 ends

California Jurisdictional Sized Dam
 As reported in my Part 2 presentation, the California Department of Water Resources uses only two inputs (variables) to determine if a dam is under their regulatory control. a. The first input (variable) is the height of dam.
i. Defined as vertical distance (in feet) measured fr om  the lowest point at the downstream toe of the dam to its maximum storage elevation (which is typically the spillway crest).
b. The second input (variable) is amount of possible/potential water storage capacity (in acre‐feet).
c. Any artificial barrier that has a height of six feet or more and could impound water with storage capacity of 50 acre‐feet or more is defined as a California Jurisdictional Size Dam.  Note that the following factors/conditions do not matter. a. The horizontal distance from downstream dam toe to the crest does not matter. b. The probability of water reaching the maximum water storage area does not matter.  Kasraie Consulting report ‘3rd Party Drainage Review – Final Observations’ dated October 14, 2022, stated on page 2:
a. “The artificial fill embankment will double as a dam embankment and a levee embankment, yet it is unclear if it will be designed and engineered as such.”  Note that April 13, 2022, City Council presentation by Hassan Kasraie of Kasraie Consulting reporting to city council for their 3rd party review stated:
a. Hassan Kasraie stated the artificial fill embankment (housing pad) should be checked to see if it is a California Jurisdictional Sized dam.
 I did not see any reference in the PFEIR that addresses this issue.  Based on my geotechnical background and knowledge the proposed artificial fill embankment (housing pad) is clearly a California Jurisdictional Sized Dam, with over six feet of height and over 50 acre‐feet of impound water storage capacity.
 See figure 2 to see how I determined the dam height.
a. Figure 2 shows one area from RDEIR page 4‐14, ‘FIGURE 4‐5 – PROPOSED TRACT NO 6016‐ SHEET 2’.
b. The blue arrow line indicates how I would determine the dam height of some 14 feet. i. The downstream dam toe would be at elevati
on of some 108 feet located where
the drains enter the drainage ditch. All material from this point to the dam crest is continuous artificial fill and considered part of the dam. ii. The crest of the dam for the blue line is at Pad #3 with an elev ation of 122.4 feet. iii. Note that the dam crest at Pad #3 is some 12 feet higher than the existing/current elevation for that location.
c. The orange arrow line is just another option to determine dam height (some 10 feet height in this example).
i. The downstream dam toe in this example would be existing road embankment, with elevation of around 112 feet and continuous artificial fill to the crest. d. No matter ho w you look at this embankment the dam height is well over six feet.  The impound water storage capacity of just the top six feet (116 to 122 feet elevation) is well over 50 acre‐feet.

Part 3 – The Proposed Project is a Flawed Concept
 No emergency overflow spillway.
o As stated in the EIR “In summary, staff concludes that the proposed drainage plan does not meet the City’s requirements of an unobstructed emergency overflow spillway, which are required to guarantee that the proposed development would not increase flooding hazards. Meeting the City’s requirements is no t  possible by this project with the proposed fill embankment and drainage design concept.”
o “…  may result in potential significant flooding risks to the existing homes and the proposed development.”
 Project relies on flap gates to protect the new housing units. o As stated in the EIR “…  the project is proposed to provide a series of pipes and mechanical devices and the proposed drainage pipes and culverts would require implementation of a maintenance plan to ensure their proper operation to prevent flood ing in perpetuity. There can be no guaranteed assurance of the proper implementation of the maintenance plan into perpetuity and, therefore, no guarantee of compliance with CMC Chapter

16.34 – Flood Damage Protection.”
o “Revised Draft EIR identified significant and unavoidable impacts with respect to Hydrology and Water Quality.”
 “Meeting the City’s requirements is technically infeasible by this project with the proposed fill embankment and drainage design concept.” As reported by Kasraie Consulting report dated October 14, 2022.
 Proposed project water outflows still impact the adjacent landowner.  Proposed project does NOT benefit our community.
o Proposed project removes 31 acres from existing city open space. o Proposed project does NOT provide flooding protection to existing homes.  As stated in PFEIR page 2‐877 “Specifically, failure of the mechanical devices and /or development pad / levee could cause floodwater from Conejo Creek to inundate the homes removed from the floodplain by the CLOMR and resulting Letter of Map Revision (L OMR). The extent of the flooding in this instance would be the same as if the project did not occur.”
 Proposed project is technically very complex, with many technical issues still unresolved.
o Examples of some still missing technical requirements.

Page 5 of 5 ends

 As reported by PFEIR page 2‐879, the separation floodwall‐levee embankment technical design between the West Basin and the Lake is still lacking.
 As reported by PFEIR page 2‐879, the breach analysis for embankment between the lake and West Basin is still lacking.
 As reported by PFEIR page 2‐888, the proposed Maintena nce Manual is inadequate.
 As reported by RDEIR page 1‐3. The Ridge View Street storm drains are still lacking the design for complete energy dissipator design to reduce flow velocities from 9 feet per second (fps) to 3 fps.
 Realistically there is no way the proposed HOA can handle all the technical complex operational and maintenance aspects of this proposed project.  To make matters even worse, in my opinion the proposed project is really a California Jurisdictional Dam with housing built on top of the dam. o This means the proposed dam is under the control of the California Department of Water Resources and not the city.
o This makes the existing very technical proposed project even more complex. In my opinion there is NO chance the state would allow this proposed project to be built.
 As stated before, I am not against new developments. I have supported other developments which made sense and added clear benefits to our community. But this proposed project is a flawed concept with NO added community benefits.

The city has many other options to add new housing units that make sense and are safe.

Public Comments October 11, 2023
Camarillo Springs GPA 2017‐2 overview    ‐ Part 2
by Mike Mishler (M.S. Geology in Ground Water)
Review of Part 1 Mishler Comments from September 27, 2023 Mistakes of Original Draft EIR (ODEIR) identified by Mishler

1. Oil seeps were natural oil seeps – not abandoned oil well leaks a. ODEIR never did any investigative geologic field work to back up claim. b. Natural oil seeps will never stop – new oil migrating up every day. c. Apparently new plan is to fill in the pond with dirt to try and hide the oil seeps.

2. ODEIR ‘forgot’ to mention the dangerous use flap gates, especially when used for housing pad. a. Follow up hydrology study confirmed dangerous use of flap gates. b. Hydrologist stated that no California housing pad has ever used flap gates. c. Revised DEIR (RDEIR) is still planning to use flap gates.

3. ODEIR upper reservoir (at Camarillo Springs Road) emergency spillway design was incorrect. a. RDEIR corrected ODEIR plan error.

4. ODEIR upper reservoir was not built to be a reservoir and could be breached. a. RDEIR states project applicant will follow up with geotechnical review/study.

5. ODEIR ‘forgot’ to mention the serious water flow impact on the adjoining northern property from project’s drainage system.
a. RDEIR states that this is still a potential problem. b. Per RDEIR (page 5.9‐18)
i. “A complete energy dissipator and outlet structure design at Margarita Avenue to support a reduction in flow velocities from 9 feet per sec (FPS) to 3 fps has not been provided in the Master Drainage Plan. Ther efore, the City is presently unable to confirm that the project would not cause substantial erosion within the Conejo Creek. This is a potentially significant impact.”

6. ODEIR ‘forgot’ to mention that lower/main reservoir had no emergency overflow spillway. a. Even Camarillo’s  detention ponds have emergency overflow spillways. b. Without emergency overflow spillway proposed new homes could be flooded or washed away.
c. RDEIR still does not include an emergency overflow spillway as required by city code. d. Per RDEIR (page 5.9‐47)
i. “…  the proposed drainage plan does not meet the City’s requirements of an unobstructed emergency overflow spillway to guarantee that the proposed development would not increase flooding hazards.”
ii. “…  may resu lt in potential significant flooding risks to the existing homes and proposed development. In addition, several issues identified during the City’s third party review of the Master Drainage Plan and Floodplain Analysis for the

Page 2 of 9 ends

project have not been resolved and, as a result, the proposed project is unable to guarantee that there would be no increase flooding hazards. Therefore, the impact of the project on flooding onsite or offsite would be significant and unavoidable.”

7. ODEIR and RDEIR treated volcanic bedrock the same as sand sediment. ODEIR, without any apparent field geologic investigation, assumed 100% of the volcanic bedrock can be excavated and used like the sediment formations (Las Posas Sand, Saugus Formation and surficial sediments) that comprise the Camarillo Hills and Las Posas Hills. EIR cann ot  default and assume that any volcanic bedrock can be excavated with normal excavation equipment and be used in the building pad. Without a detailed field geologic investigation of the volcanic bedrock the EIR must default to the worst case and assume that all or most of the volcanic bedrock mu st  be blasted and unusable for any building pad. a. Per ODEIR Appendix L – Geotechnical Hazards Evaluation, dated April 6, 2020 i. This geotechnical evaluation did not include any onsite geologic investigation.

1. Study based on published and unpublished information. ii. Geotechnical study reported that the south‐west excavation site (‘south basin / golf area’) co
nsists of alluvial deposits and bedrock.

1. “Alluvial Deposits     These sediments generally consist of admixtures of sand and silt with occasional horizons of sandy clay. These deposits are characteristically in a moderately compact condition, but become more compact with depth. These earth materials will be satisfactory for the support of the proposed project provided the Geotechnical Engineer’s recommendations are followed.”

2. “Bedrock     Bedrock will likely be encountered in the Borrow Site portion of the project. It will consist of basalt and basaltic agglomerate assigned to the Miocene‐age Conejo Volcanics. These deposits are commonly dense to hard and well‐fractured.”
iii. Note that the Geotechnical report did NOT state that the volcanic bedrock was satisfactory for the proposed project.
iv. No work was done to determine the percentage of volcanic bedrock to sediment deposits within the excavation site.
b. It is likely that the volcanic bedrock will require blasting (drilling and explosives) to be removed.
i. Supported by Geotechnical study.
ii. The same volcanic bedrock is located at the Hill Canyon Road cut. The Hill Canyon Road volcanic bedrock required blasting to create the road cut. See figure 1 for example of volcanic bedrock that was blasted to create the Hill Canyon Road.
iii. Note that resulting blasted rock cannot be used in construction of the building pad. Solid rocks cannot be compacted while trying to construct a building pad. c. The ODEIR and RDEIR state the building pad material and the excavation material will balance. So that no earth material will be exported or imported from the project site. i. Per RDEIR (page 4‐11)

Page 3 of 9 ends

1. “…  there would not be any import or export of soil to or from the property. Earthwork is intended to balance onsite.”
ii. But with blasting of the volcanic bedrock the earth material onsite balance is no longer true.

1. Blasted rock will be exported from the project site.

2. Sediment material will be imported to the project site to make up for the lost blasted volcanic bedrock material.

Figure 1   Hill Canyon Ro ad cut‐ arrows indicate blasting drill hole locations. d. Any volcanic bedrock blasting will invalidate many EIR calculations. i. Blasting will create dust and vibrations.
ii. All EIR air emission, energy, equipment calculations are invalid. e. RDEIR never commented or responded to my ODEIR volcanic bedrock blasting issues. f. Note that while working for Woodward & Clyde Engineering Consultants (Geotechnical Company in San Diego County) I conducted all geologic ‘hard rock’ excavation feasibility field studies.

Page 4 of 9 ends

g. Note that I am not stating that the volcanic bedrock will require blasting, but based on my geologic experience there is a very good chance. Without any geologic field studies of the volcanic bedrock the EIR calculations must default to blasting. h. Sidenote: This is a geologic issue and not an engineering issue.

Part 2  Additional Missing Issues from DEIR      ‐ Mishler October 11, 2023 Comments

1. Missing Issue #1: Excavation of main lake area below 107 feet elevation a. RDEIR plans show that the main lake will be at 107 feet elevation. b. RDEIR plans show that the main lake bottom will be at 100 feet elevation.
c. RDEIR uses a groundwater elevation of about 107 feet. i. This is based on groundwater statement from the Appendix L – Geotechnical Hazards Evaluation report.
ii. Per Geotechnical Hazards Evaluation report (page 3)

1. “Groundwater was encountered in our previous, adjacent geotechnical investigation at an elevation of about 107 feet (GWV, 2019).” d. A large ar
ea of the proposed main lake is currently above the planned lake bottom at 100 feet elevation and will require excavation. e. RDEIR does not address how excavation of the lake bottom to 100 feet elevation is to be done below the groundwater level of 107 feet elevation.
i. Is the site going to be tempora
rily dewatered (pumping
groundwater out) during excavation of the lake bottom?
ii. RDEIR does not address the potential temporary dewatering issues of lowering the local groundwater level below 100 feet during construction of the lake.

Page 5 of 9 ends

2. Missing Issue #2: Building pad is a California Jurisdictional Sized Dam a. California Department of Water Resources reference:
(below and page 6 are images from the California Department of Water Resources web site)

Page 6 of 9 ends
Page 7 of 9 ends

b. The downstream toe of dam has an elevation of 108 feet. c. The dam crest (housing pad because has no spillway) has an elevation of some 120 feet.
d. Therefore, the jurisdictional height of the dam is about 12 feet (120‐108 feet).
i. This is my opinion based on my geologic exper ience and my graduate course ‘dam design’.
e. Per RDEIR page 4‐4, water storage of main lake from 108 to 112 feet elevation is 56 acre‐feet. Water storage from 112 feet to 120 feet elevation is currently uncalculated but is at least twice the volume from 108 to 112 feet. Th erefore, the total water storage volume is at least 150 additional acre‐feet (from 108 to 120 feet).
f. Therefore, with dam height of some 12 feet and water storage capacity of over 150 acre‐feet the ‘building pad’ is a California Jurisdictional Dam (with housing units located on the dam).
i. Note that the EIR must now follow the California requirements for earth dams.
ii. Note that California has the highest safety dam requirements in the world.

1. Note that California will never allow a dam to be built without an emergency spillway.

2. Ther e  are many geotechnical studies that will now be required.
iii. This is going to require an entire team of geotechnical dam experts, including engineers and geologists to design and review the dam design and all related aspects of the dam, before the next EIR can be conducted.
iv. California also has very strict conditions for the maintenance and oversight of dams.
v. How will the HOA oversee, operate, maintain, and update the dam with future California dam requirements?

Page 8 of 9 ends

Summary and Main Goal:

This presentation’s main goal is to provide some technical education to the City Council members.

1. Note that the developer portrays this proposal as just about adding more housing units. The developer does not want the City Council to think about anything else, like all the technical mistakes and problems.

2. But as shown above this proposal contains many dangerous technical problems.
a. Some existing problems.
i. Project water flow impact on adjacent property.
ii. Use of flap gates for a housing project.
iii. No emergency spillway.

3. Note that the history of this project has many technical mistakes. a. Some examples of technical errors.
i. Natural oil seeps, design plan errors like the upper reservoir spillway.

4. EIR’s have contain many technical errors.
a. Forgetting to mention dangerous use of flap gates, not having an emergency spillway, drainage water impacts on adjacent property. b. Making false geologic assumptions.
i. Assuming that volcanic bedrock can be treated as sediment for excavation and use in pad.
ii. Assuming that no dewatering will be required for the main lake excavation.

5. Developer not knowing that the ‘building pad’ is really a California Jurisdictional Size dam.

The bottom line is that this proposal is technically very complex. Project history has proven that the proposal is beyond the technical capability of the developer.  I believe this proposal could be the most complex technical proposal the city has ever seen.
 This proposal is outside the ‘wheelhouse’ of our local knowledge base. a. This proposal has ‘too many moving parts’.
b. Why does a local retired geologist have to point out these issues?

Page 9 of 9 ends

 Any attempt to move forward with this proposal would first require a complete geotechnical onsite study focusing on all the dam issues. a. After a complete geotechnical study then new EIR could be completed based on proper and complete input and design.
b. Note that designing, planning, building, operating, and maint aining  a dam would be very expensive.
 This proposal is very dangerous and does not provide any benefit for our community.
a. No HOA could ever handle all the problems and cost of overseeing a dam.
b. There are many other city sites that can be used for development.

The city has already provided two attempts for the developer. It is time to realize that it is time to stop wasting staff and citizen’s time and kill this project.

City Council meeting
October 25, 2023
Greeting City Council members.

I am John Gardner and I live on the golf course at Camarillo Springs.

I wish to express my disappointment and concern regarding the seemingly unreasonable amount of time and changing
requirements this city review has taking pretty much at every point of the process.

Finally, we are privy to the long over-due EIR report which states clearly that except for the most outrageous demand of meeting a one in a 1,000 year flood mitigation standard, the proposed project provides successful flood mitigation in multiple flood scenarios that includes a 500 year flood which is 5 times greater than typical 100 year flood requirements of the city and of FEMA.

Hindsight is a wonderful thing and I’m sure the developer regrets their original good intention to help protect existing homes from flood exposure by offering to address the flood 1 mitigation issues as part of this project. It would have been much easier to propose new homes with subsidy to rebuild the golf course than get entangled in this very complex but now proven strategy to make existing residents safer in all scenarios.

There is no project that would be risk-free and I contend that it is totally unreasonable to expect any developer to mitigate a one in a thousand chance event. If we held all development to those standards there would be no development at all, and I suspect no repair / maintenance of existing buildings.

In addition, I was please to see that the economic and golf study clearly supports that the new project would increase property values and a denied project would negatively impact property values. I was pleased to see that the national golf foundation study clearly states that the proposed use of the property was in accordance with the available land and in sync with national trends for golf course use and sustainability.

I won’t repeat all of the other known benefits of the project, but I strongly encourage the council to consider the multiple favorable and study supported elements of this project and the fact that all of the reports and studies are favorable except for the one statement of inevitable and significant flooding based on a specious and unrealistic 1,000 year flood standard.

I can't imagine any thoughtful response in view of these facts other than full council support.

Of course I am biased due to living on the golf course, but I believe this is a wonderful project for our city and a wide range of our citizens.

Thank you for your consideration and blessings for making a wise decision regarding this project.

Comments Dear Mayor and Council Members:

I have written several times in the past in support of the proposed New Urban West development at Camarillo Springs.

I've lived in the mobile home park, by the 18th tee, for 18 years; and while I'd prefer to have the present golf course renovated and in operation, I support the development as a viable alternative, one that's better than other available possibilities. I want to maintain my property value, continue to have golf in our community, have the ponds restored and improved, and enjoy the additional amenities included in the proposal.

My present concern is the misinformation - according to my understanding - that is being disseminated by the "opposed group." At the meeting on October 25, would you please clarify once and for all, and in no uncertain terms, the following points:
1) Will there be lifting of FEMA flood control insurance for any of the homes? I understood that there would be. The
opposition states there will not - and that there never was going to be such relief.
2) Will the proposed plan include a 12-hole golf course, for sure? The opposition states there will not be - and that the supposed golf course plan was a sham.
1 I urge you to put forward the TRUTH, loud and clear. NUW and the Council itself have been accused of lying to and
misleading the public. It's critical for you to be clear and definitive on the above issues. Thank you.

Re: 10/25/23 Agenda Item P: Triennial Review of Referral for NUWI Camarillo, LLC
Dear Mayor Santangelo and the City Council of the City of Camarillo:

This law firm represents NUWI Camarillo, LLC (“NUWI” or “Applicant”). On behalf of NUWI, we are writing to confer our serious concerns about the Agenda Report prepared by staff in regard to the Triennial Review of the Referral for General Plan Amendment (“GPA”) 2017-2, in relation to the Camarillo Springs Project.

A
s you know, the Camarillo Springs Project has been pending before the City since 2017.

It proposes to change the General Plan land use designation on 31 acres of the existing Camarillo Springs Golf Course from Quasi-Public to Low-Medium Density Residential. On September 27, 2017, the City Council voted to process the Referral for GPA 2017-2, and again on September 23, 2020, the City Council voted to continue processing the Referral. Like the item before the Council now, on September 23, 2020, the Referral was before the Council at a Triennial Review.

A
t no time during the September 2017 or September 2020 reviews did staff raise concerns about the consistency of the proposed Project with the General Plan. However, now, six years into the processing of the project, staff alleges GPA 2017-2 may result in “General Plan impacts,” and “negative impact[s] on the welfare of the community.” (Agenda Report, pp. 6-10.) Not only are these allegations completely unsupported by any evidence in the Agenda Report, they are flatly inconsistent with the fact-based analyses presented in the project’s Environmental Impact Report (“EIR”). Unfortunately, this eleventh hour sandbagging hints of post-hoc rationalization and an attempt to provide the City Council some ground for rescinding the Referral for GPA 2017-2 without holding a proper hearing on the merits of the project, as due City Council, City of Camarillo
October 24, 2023

Page 2 ends

process requires. For the Council to rescind the GPA 2017-2 Referral on October 25, 2023, would raise several legal issues.

First, as a threshold matter, should the City Council choose to use the Triennial Review process as premature way to kill the Camarillo Springs project, this would be a clear misapplication of City Council Policy 7.01, which, on its face, is designed to coordinate the processing and timing of amendments to mandatory general plan elements, which are limited by state law to no more than four per year, and ensure internal consistency within the General Plan as a whole, another state law requirements. (Policy 7.01, §§ A(1), (2).) The General Plan amendment referral process was clearly not enacted to provide for ad hoc approval or disapproval of a project based on the merits of the project, or a balance of a project’s benefits against its environmental impacts. Policy 7.01 makes clear amendment referrals are not equivalent to project approval: “Fulfillment of the general criteria for amendment consideration does not, however, assure or even imply the ultimate approval or disapproval of a General Plan amendment by the City Council. That is, decisions on the contents of the General Plan are by law based solely on the best judgment and discretion of the City Council, made after due process and deliberation.” (Policy 7.01, § A(3), emphasis added.) City Council Policy 7.01 does not imbue the Council with authority to consider and deliberate on the merits of the project.

It directs the Council only to consider whether, under the five “Review Criteria” identified under Section B of the policy, to continue processing GPA 2017-2. Notably, nothing about the project has changed in regard to the five “Review Criteria” since either 2017, when the Council first voted to study the Referral, or 2020, when the Council again voted to continue processing the Referral. No change in the project’s consistency with the General Plan has occurred since the inception of the project.

Second, it is wholly unclear from the description presented in the October 25, 2023 meeting agenda what action the City Council is actually considering. The description for Agenda Item P reads: “Staff recommends that the City Council conduct the Triennial Review and provide direction to staff on any actions it deems proper regarding the General Plan Referral request of NUWI Camarillo, LLC.” However, stating in an agenda description that the City Council may take “any actions it deems proper” is not consistent with the City’s duties under the Ralph M. Brown Act (Govt. Code, § 54950 et seq.) (“Brown Act”). The Brown Act unequivocally requires that local public agencies provide at least 72 hours’ notice of the action it will be considering at a public meeting. (Govt. Code, § 54954.2.) The agenda description must identify “each item of business to be transacted” at the meeting. (Govt. Code, § 54954.2(a)(1).) If an agenda could satisfy this requirement by only stating that the agency might take “any action it deems proper” such a loophole would obviously swallow the rule, and render the Brown Act’s sacrosanct agenda notice requirement meaningless. (See, e.g., Olson v. Hornbrook Community Services District (2019) 33 Cal.App.4th 501, 519, citing San Diegans for Open Govt. v. City of Oceanside (2016) 4 Cal.App.5th 637, 643 [“agenda drafters must give the public . . . more than City Council, City of Camarillo
October 24, 2023

Page 3 ends

mere clues from which they must then guess or surmise the essential nature of the business to be considered”].)
Third, the Agenda Report’s allegations that GPA 17-2 would result in “General Plan impacts” is unfounded and blatantly at odds with the City’s own administrative record and factual determinations. In short, the EIR already concluded that this project is consistent with the City’s General Plan. The Agenda Report’s attempt to fashion heretofore unmentioned inconsistencies is inappropriate, violates due process, and is not only unsupported, but wholly contradicted, by the evidence in the administrative record. The Agenda Report’s brand new claims of General Plan inconsistency were never raised at the 2020 Triennial Review. This, coupled with the fact that the City’s own EIR came to the opposite conclusion leaves the impression that staff is contorting itself to provide some ground upon which the Council can point to for rescinding the Referral. But the law does not permit public agencies to randomly assert conclusions—instead, the law mandates that public agencies “set forth findings to bridge the analytic gap between the raw evidence and ultimate decision or order.” (Topanga Association for a Scenic Community v. County of Los Angeles (1974) 11 Cal.3d 506, 515; see also 516 [“a findings requirement serves to conduce the administrative body to draw legally relevant subconclusions supportive of its ultimate decision; the intended effect is to facilitate orderly analysis and minimize the likelihood that the agency will randomly leap from evidence to conclusions”].)
Y
et, here, the Agenda Report does “randomly leap” to conclusions that are directly counter to the evidence presented in the City’s own environmental impact report. The Agenda Report states that because GPA 2017-2 will redesignate a portion of a failing 18-hole golf course to Low-Medium Residential and reconfigure the rest of the course to a more viable 12-hole course, the “change to the General Plan to remove open space and replace it with residential uses may have a negative impact on the welfare of the community given all of the important benefits open space provides.” (Agenda Report, p. 8.) Yet, there is absolutely no “bridge” provided between this actual proposed project and the Agenda Report’s conclusion. This project will redevelop a failing golf course, replace it with not just housing but myriad recreational amenities, and reconfigure the remaining portion of the course to not just a more viable model, but a model that is necessary to ensure the course’s continued survival. These are not just the assertions of the applicant, but the findings of the City’s own Business Analysis of the Camarillo Springs Golf Course Report, which concludes that the project is necessary to the continued viability of the golf course.
1 Worse yet, the unsupported conclusion in the Agenda Report is directly at odds with the 1 See, e.g., Business Analysis of the Camarillo Springs Golf Course, prepared by NGF Consulting on behalf of the City of Camarillo, p. 2 (The course’s “current (2023) condition is poor and the property is at risk of failure” ), (“The observed financial condition of CSGC in 2023 is not sustainable and will eventually lead to total system failure and the facility’s inability to earn enough revenue to cover basic expenses”); (“The CSGC property is set up well to accommodate some form of facility alteration that would involve a reduction in the number of golf holes and new property available for alternate development”); (“If undertaken, altering CSGC to a high- quality golf course (9 City Council, City of Camarillo

conclusions of the EIR, which determines that the project was consistent with the General Plan. (EIR, pp. 5.10-6, 5.10-7 et seq. [Table 5.10-2].) How the City’s EIR can conclude one thing, and the Agenda Report the exact opposite, is in no way clear.

S
imilarly, the Agenda Report claims that the removal of golf course acreage will somehow result in a parkland deficiency. The Agenda Report reads, “As the City is already deficient in the amount of parkland, a loss of golf course open space may have a further negative impact on the welfare of the community.” (Agenda Report, p. 8.) This post-hoc rationalization is directly contradicted by the City’s own EIR, which analyzed the impacts of the project on the provision of parkland, and specifically concluded that the parkland provided by the project “would exceed the VPRPD and the City overall standard of 5 acres of parkland per 1,000 residents.” (EIR, p. 5.13-4.) Further, and as noted in the EIR and wholly ignored by the Agenda Report, “the project applicant has agreed to provide a fee to the PVRPD to help develop or expand public park facilities within Camarillo.” (EIR, p. 5.13-4.) The EIR concludes that both cumulative and direct impacts to parkland, recreation, and other public facilities would be less than significant. (EIR, pp. 5.13-4 through 5.13-6.) The Agenda Report’s conclusion otherwise is not based on fact.

T
he Agenda Report also alleges that “[a] change in the land use designation to allow for residential development on a 31-acre portion of the golf course would substantially affect [the] current views” of adjacent mobile home residents, implying that this is somehow inconsistent with the General Plan. However, it is unclear how many residents (the closest of which are approximately 250 feet away) would actually be allegedly affected, and, notably, the City’s EIR concluded otherwise. The EIR considered whether the project would “conflict with applicable zoning or other regulations governing scenic quality” and determined that it would not. As part of this analysis, the EIR specifically considered whether the project would be consistent with the City’s General Plan Community Design Element, and determined that the project was consistent. (EIR, pp. 5.1-11 and -12.)
I
n regard to wildfire, the Agenda Report claims, vaguely, that “[a] change in land use on a portion of the golf course to allow for residential development, should consider whether to avoid placement of such uses in areas subject to high or extreme wildfire threats that could place future development at risk.” (Agenda Report, p. 10.) But the EIR already considered whether or 12 holes) that will be more desirable than a poor-quality 18-hole golf course will be beneficial to CGC and the City of Camarillo”); p. 6 (“Camarillo Springs GC is an aging golf facility that had been experiencing declining participation but gained a significant boost with a surge in golf interest in the last 203 years, although this too may be waning. Despite the increase in activity and revenue in 2020-2022 the facility still has an urgent need for new capital investment to enhance the golf course and clubhouse. Without this new investment, it is not likely that the CSGC facility can earn the revenue it needs to sustain itself for the longer term, and thus the NGF does not see this as a viable golf facility business enterprise in its current condition”). As determined by the City’s study, the course requires at least $6.8 million of new capital, currently loses money every year, and the County of Ventura has reduced the property’s valuation by 50%.

City Council, City of Camarillo
October 24, 2023

Page 5 ends

the proposed project would result in wildfire risks, and it determined that it would not.

Specifically, the EIR includes a fact-based analysis that determines the project would not substantially impact emergency response or evacuation, the project would not exacerbate wildfire risk, the project would not require the installation or maintenance of associated infrastructure that might exacerbate wildfire risks, and would not expose people or structures to significant risks as a result of post-wildfire flooding, landslides, runoff, post-fire slope instability, or drainage changes. (EIR, pp. 5.16-6 through 5.16-10 [Revised DEIR].) 2 Finally, it is becoming increasingly clear that the City is intent on denying any fair use of the existing, but failing, Camarillo Springs Golf Course. If the City wishes to ensure the use of the golf course, in a configuration that the City’s own financial and business consultants have determined infeasible over the long term, that loses money every year, and that requires, per the City’s own consultant, at least $6.8 million of new capital, this constitutes a taking of private property, without just compensation.
**************
I
n conclusion, we urge the Council to refrain from taking any action on October 25, 2023, that would result in a misuse and misapplication of City Council Policy 7.1, that would violate the Brown Act’s noticing requirements, that would violate the City’s duty to only take action based on adequately supported findings of fact, and that could constitute a taking of private property without just compensation.

Sincerely,
J
ennifer J. Lynch
2 In addition to the unsupported claims in the Agenda Report that GPA 2017- 2 will result in “General Plan impacts” associated with open space, parkland, views, and wildfire—again, in direct contradiction to the City’s conclusions in the EIR and in past Referral reviews—the Agenda Report also alleges that the issues raised in the October 14, 2022 3rd Party Drainage Review “have not been resolved.” But NUWI and its technical consultants provided a detail ed, point-by-point response to each of the issues raised in this 3rd Party Review. This response letter and technical memorandum were submitted to the City during the public review and comment period on the Revised DEIR.

While we understand that the Triennial Review is not the forum for addressing the adequacy of the CEQA document, or for balancing the benefits of the project against its environmental impacts, the fact that the Agenda Report does not even acknowledge the existence of the Applicant’s response to the 3rd Party Drainage Review is misleading and further speaks to our concern that the Agenda Report does not provide an objective analysis of the project.

Hello Veronica, I wanted to follow up with you on my letter I sent about the Camarillo springs golf course project to the mayor. I have worked for the company western golf since 2019 I’ve seen many dishonest business practices with the current owner telling us not to make any improvements to the course, lying about our pump station being broken so we couldn’t water (right before Covid)basically running the course into the ground so it was so deplorable trying to force the city and residents to go with his plan or else shut the course down. There was a drainage line just installed recently they hit another oil cap oil started leaking out their idea of a fix was put a board and rocks over it let the next guy deal with it:/

Comments We live on Irena Avenue facing the golf course and would love to see the golf course restored. Our community is a gem, but we could use a lot of renovations, that the developer is proposing. The improvements would increase home values, and tax revenue for the city of Camarillo. It would also improve the quality of life for the surrounding citizens.

Comments I strongly support the new development of the Camarillo Springs Golf Course. Camarillo Springs in a very unique area of the City of Camarillo. It is the first exit for Camarillo as you come down the grade heading North and represents an inviting community and place to live with unique features that the rest of Camarillo does not have such as Conejo Mountain, rolling green hills, an abundance of nature and wildlife. Most of the residents are homeowners, not renters, and we take great pride in our community. We want to feel safe and secure in our homes. If the golf course is taken away, I'm concerned the golf course will look like it did during the first days of Covid, with weeds waist high, what will happen to our property values when this happens? I strongly believe our property values will decrease significantly and our entire lifestyle will be downgraded. Who will be responsible for the maintenance of this property? What will it be in the years to come? From what I can see, the opposition does not have a plan for the future of the land. They say the wildlife will be affected. The wildlife is not going to go away. It will still be here for us to enjoy even if we only have a 12 hole golf course. Yes, the views of a few of the mobile homes on the golf course will be affected, but they will still have a pleasant view, which will not be weeds and fences. Most importantly, the NUW plans removes approximately 156 homes from a
flood zone!! How can this be bad?? The amenities will be 1 enhanced and increase the value of our homes tremendously and enhance our lifestyle, not take away from it. There will be a new club house, pool area, dog park, etc. The opposition seems to think that all of the NUW development is a lie. How can they really believe that??
Of course we all wish everything could remain the same, but reality is that after 50 years the course needs to be taken care of and we have a review our best options.

We, the homeowners, have been under stress for the past seven years not knowing what will happen to our property values, our lifestyle and our unique area. I ask the City Council to please approve the NUW plan. Our homes and
lifestyle mean a lot to us. Please do not take this away from us.

Agency City Council
Item Type Agenda Item
Item Number or Subject Q - Camarillo Golf Course Redevelopment Position Support
Comments I'm commenting to support the redevelopment of the CAMARILLO Springs golf course. I feel concerns of many of the residents of Camarillo Springs have been listened to and changes were made in the initial planning. I also feel that many things are being addressed in the plan to make it a better place than it is now. I'm not hearing anyone else or any group of people commenting on improving the current
situation, other then to just say leave it as is.

Item Number or Subject NUWI Housing Project
Position Support
Comments Dear City Council,
I'll be the first one to say that you have an extremely hard job.

Balancing the need for more housing while weighing all the nuances that come with it. Not easy and sometimes not fair.

I've actually been able to review this project thoroughly and I think it is very well done and needed in this community.

In short, I'd love to share my support for this project and look forward to your vote.

Agency City Council
Item Type Agenda Item
Item Number or Subject Q: Triennial Review of Referral for NUWI Camarillo, LLC Position Not Applicable
Comments Honorable Major Santangelo and City Council, I come to you asking for your full support for a project on your agenda tonight, the continuation of a single family housing
development in Camarillo Springs. As you may know, Haas Automation manufactures machine tools locally with
operations and land holdings in both Oxnard and Camarillo.

The attached letter outlines our position when it comes to housing in the region. We simply don't have enough housing to meet the needs of our future workforce. Failure to approve responsible-minded project like this one will only result in companies like Haas expanding or relocating into other
regions.

Please take the responsible action and vote to allow this project to continue. The future of manufacturers like Haas are at stake.

Thank you,
Peter Zierhut
Vice President, Outside Operations, Haas Automation

Item Number or Subject The Greens at Camarillo Springs
Position Support
Comments Dear City Council Members,
I appreciate our city's leadership taking a flexible and open- minded approach to new housing opportunities such as The Greens at Camarillo Springs.

I think the developer has shown great consideration to our city's unique needs with its technical
research/implementation (flood planning) and its integration of community input into the design/concept.

However, a protracted approval process, which has at times characterized this development, can inhibit thoughtful
investments into our community and increase housing costs.

Above all, I thank you very much for your time and all the work you do for this community.

Thank you,
Brando Pozzi

Second Triennial Review
NUWI Camarillo, LLC
Camarillo Springs
October 25, 2023

Background
City Council Policy 7.01 - General Plan Amendments (Non-City Initiated) • Provides guidelines for considering proposed amendments to the Camarillo General Plan by an applicant other than the City.
• A Referral application is submitted and presented to the City Council for their initial consideration. The City Council, at its discretion, may order further processing or may terminate application proceedings at that point. • A Triennial Review is conducted every three years after the Referral application was referred to staff for study. At the conclusion of the Triennial Review, the City Council will either continue to study the Referral or rescind the Referral.

Background
NUWI Camarillo LLC Referral
• On September 27, 2017, the City Council was presented with a Referral application and after reviewing the request, the Council ordered further processing of the Referral application.
• The Referral contemplates redesignating 31 acres from the current Quasi- Public designation to Low-Medium Density Residential (10 dwelling units per acre maximum), over a portion of the existing Camarillo Springs Golf Course.
• On September 20, 2020, City Council conducted the first triennial review of the Referral and voted 3-2 to allow the referral to remain in place and for staff to continue to study the Referral.
4 Referral of 31 acres from Quasi-Public to
Low-Medium Density Residential
Ridge View St.

Camarillo Springs Rd.

U.S. 101
Background
• City Council authorized the processing of the Referral subject to the preparation of the following studies:
• Fiscal Impact Analysis
• Property Value Analysis
• Hydrology and Hydraulic Study
• California Environmental Quality Act (CEQA) Review
Current Status of Referral
• Property Value Analysis
• Proposed project is not likely to result in significant negative property value impacts within the Camarillo Springs Golf Course community. • Value appreciation could lag if golf course closes and improvements are considerably delayed.
• Fiscal Impact Analysis
• Estimated revenues and maintenance cost appear to be reasonable however, proposed maintenance budget is subject to caveats.
• At least $6.8 million renovation needed for golf course. • Hydrology and Hydraulic Study
• Extensive analysis of the proposed project drainage plan concluded that the potential risk of flooding can not be eliminated.

Current Status of Referral
• California Environmental Quality Act (CEQA) Review
• Policy 7.01 provides guidelines for considering proposed amendments to the General Plan, including that all proposed amendments should be evaluated with consideration for environmental impact.
• In accordance with this Policy, the City Council included its 2017 Referral for staff to conduct CEQA review.
• In 2020, a Draft EIR was circulated for a 45-day public review. Based on revisions by the applicant to the Master Drainage Plan and Floodplain Analysis, and Tentative Tract Map, certain sections of the Draft EIR were recirculated for a 45-day public review from June 24, 2023 to August 8, 2023.
• The Revised Draft EIR identified significant and unavoidable impacts with respect to Hydrology and Water Quality.

Current Status of Referral
Camarillo General Plan Land Use Element:
• “Adequate recreational facilities and space to satisfy a community‑wide need should be considered and include a diverse recreational program for both passive and active recreation.”
• “Open space within Camarillo is found in the form of parks, agricultural lands, hillside areas, golf courses and waterways.”
Current Status of Referral
Camarillo General Plan Recreation Element
• “The Camarillo Springs Golf Course located on the easterly side of the City of Camarillo is an 18 hole public golf course with clubhouse, pro shop and restaurant. This facility provides a significant amount of open space and should be continued as a satisfying part of the regional needs for recreation.”
Current Status of Referral
Camarillo General Plan Open Space and Conservation Element • Open space land is a limited and valuable resource which must be conserved wherever possible.
• The General Plan acknowledges parks, parkways, reservoirs, playgrounds, and golf courses make up part of the open space within the city. • SB 1425 requires every city and county to review and update its local open space plan by January 1, 2026 and must include action plan for climate resilience, co- benefits of open space, and rewilding opportunities.

Current Status of Referral
2021-2029 Housing Element
• California Department of Housing and Community Development certified the City’s Housing Element on April 14, 2023.
• City was allocated a Regional Housing Needs Allocation (RHNA) of 1,376 for the period between 2021 – 2029.
• City’s land inventory has sufficient capacity to exceed the 1,376 RHNA housing units; additional units are not needed to satisfy RHNA.

Current Status of Referral
Camarillo General Plan Community Design Element
• “The four golf courses found within the community serve as important visual, recreational and cultural amenities. These facilities should continue to be operated and maintained with a goal of maximizing available resources while providing the highest quality visual and landscape elements.” • Highway 101 is designated a scenic corridor.
• “Enhance existing view corridors along scenic corridors. Maintain the visual quality and scenic views along designated corridors.”
Current Status of Referral
Camarillo General Plan Safety Element
• City is currently in the process of updating the Safety Element to address specific wildfire hazard planning requirements for all jurisdictions with lands in the Very High Fire Hazard Severity Zones (VHFHSZ). • The entire Camarillo Springs area,
including the project site is within
a VHFHSZ.
