TITLE: Downtown Special Event Permit - Chamber Boogie Music Festival 2024 (Resolutions/Roll Call Vote)
RECOMMENDED ACTION
That the City Council (1) adopt a resolution approving a Downtown Special Event Permit for the Campbell Chamber of Commerce (Chamber)’s Boogie Music Festival 2024; and (2) adopt a resolution granting a waiver of City fees related to the Chamber's Boogie Music Festival 2024.
BACKGROUND
Request for Downtown Special Event Permit
In February of 2024, the Campbell Chamber of Commerce (Chamber) submitted to the City of Campbell (City) an application for a Downtown Special Event Permit requesting the City’s Council’s approval for the Chamber to hold its Boogie Music Festival 2024 (Boogie) in the public right of way in D owntown Campbell on Saturday May 18, 2024, from 10:00a.m. to 6:00p.m.; and, on Sunday May 19, 2024, from 10:00a.m. to 5:00p.m.
The Chamber described the event as a celebration of Campbell that has occurred for over 25 years and features the best in food, entertainment, community performers, and local business, and more than 100 fine artists from around the Bay Area. The Chamber also listed the estimated attendance for the event as approximately 50,000.
Request for Downtown Special Event Fee Waiver
The City ’s cost of allowing the Chamber to hold its Boogie event in the public right of way in Downtown Campbell is estimated at approximately $65,000. This amount includes Downtown Special Event Permit application processing fees, as well as the cost for Public Works personnel to prepare the public right of way for the event, and, because public streets will be closed for the event and alcoholic beverages will be sold, the cost for Police Department sworn personnel to staff the event. The Chamber is requesting the City grant a waiver of a portion of these costs so that the Chamber is only required to pay to the City no more than $25,000 for the event.
DISCUSSION
Item: 14
Category: NEW BUSINESS
Meeting Date: May 7, 2024
14 Packet Pg. 291
Downtown Special Event Permit - Chamber Boogie Music Festival 2024 Page 2 of 4 In March of 2024, the City Manager’s Office and the Police Department met with the Chamber to discuss the Chamber’s proposed footprint and security measures for the Boogie event . The parties also discussed th e Chamber’s request for relief from the City’s requirement that the Chamber pay the City’s complete cost of allowing the Chamber to hold the event in Downtown Campbell.
Downtown Special Event Permit
The Downtown Special Event Policy (Permit Policy) provides, in relevant part:
“It is the intent of the City to allow a limited number of outdoor public events for the general economic benefit of the City's business community, cultural enrichment and/or promotion of the City. This policy provides a process for permitting special civic, cultural, and fundraising events using public property including streets, sidewalks, City owned property or other public rights-of-way.” In addition, general guidelines noted in the Permit Policy provide:
• The event must contribute to the economic enhancement, cultural enrichment and/or promotion of the City.
• The event must not severely disrupt normal business and residential traffic patterns.
• The proposed site must be suitable for the event, with consideration given to adequate space, traffic flow, parking, electricity, health and safety requirements, and impact on the site.
• The Organizer must pay for all City services as required by City Council Policy. • The alcohol sales will be by permit only.
The Boogie event has taken place in Campbell for over 25 years and over time has become known as a type of celebration of Campbell. With its offerings of food, community performers, and more than 100 fine artists from around the Bay Area, it provides cultural enrichment, promotes the City, and enhances the City’s economy.
Additionally, through its work with City staff, the Chamber has been able to ensure that the event is held in a suitable location ; does not severely d isrupt normal business or residential traffic ; operates in a manner that avoids health and safety hazard s; and includes s ufficient Police Department personnel to provide proper traffic control, and security, and to ensure the orderly conduct of organizers and visitors alike. Moreover, the event is a highly popular and family -oriented event. For these reasons , staff recommends the City Council approve the Chamber’s request for a Downtown Special Event Permit to hold its Boogie event in the public right of way in Downtown Campbell from Saturday, May 18, 2024 through Sunday, May 19, 2024.
Downtown Special Event Fee Waiver
In certain circumstances, t he City’s Downtown Special Event Fee Waiver Policy (Fee Waiver Policy) allows the City Council to waive 25% of the permit application processing 14 Packet Pg. 292
Downtown Special Event Permit - Chamber Boogie Music Festival 2024 Page 3 of 4 fees and 25% of staffing fees related to the issuance of a Downtown Special Event Permit…if the organizer of the event:
• Provides “an itemized financial statement showing direct costs for event expenses and revenue for which the fee waiver is requested, and a profit or loss sheet for the previous operating year, comparing the projected budget with the actual budget showing the net profit or loss…”
• Has a “proposed budget on file, which projects a break -even or profitable event, when calculated using the fee waiver requested…”
• Provides documentation that the event will “generate less than $100,000 in net revenue (based on financial statements from the prior year’s event)…” and • Has “no outstanding debts payable to the City of Campbell...” In April of 2024, the Chamber shared the following with City staff:
• Profit and loss information for the previous year’s event. • Information supporting projected costs for event expenses and event revenue for which the fee waiver is being requested.
• Information supporting a projected break -even or profitable event, when calculated using the fee waiver requested.
• Information supporting that the event will generate less than $100,000 in net revenue; and
• Information confirming the Chamber had no outstanding debts with the City of Campbell.
Based on the information the Chamber shared, the Chamber has met all the requirements to support a waiver of 25% of the costs associated with the City issuing a Downtown Special Event Permit to the Chamber for the Boogie event. As the total City cost for this year’s Boogie event is estimated at $65,000 , a standard fee waiver of 25% would result in a discount to the Chamber of approximatel y $16,250 in fees, leaving a balance owed to the City of approximately $48,750.
A fee waiver providing that the Chamber would cover no more than $25,000 of the City’s total cost of $65,000 to allow the event to occur in the public right of way would mean a loss to the City of an estimated $40,000 in costs. The City’s Fee Waiver Policy does not contemplate a waiver in excess of 25% of the cost to the City to allow for an event to be held in Downtown Campbell . Therefore, the City Council would need to take action outside of the Fee Waiver Policy to approve this request.
In line with the City’s Fee Waiver Policy, staff recommends that the City Council approve a 25% waiver of fees related to the Boogie event; making the Chamber responsible for covering approximately $48,750 of the approximate $65,000 in cost that will be incurred by the City.
FISCAL IMPACT
14 Packet Pg. 293
Downtown Special Event Permit - Chamber Boogie Music Festival 2024 Page 4 of 4 The total City cost for this year’s upcoming Boogie event is estimated at $65,000. A standard fee waiver of 25% would result in a loss to the City of an estimated $16,250 in fees. A fee waiver with a not to exceed charge of $25,000 would result in a loss to the City of an estimated $40,000 in fees.
