EMSL maintains liability limited to cost of analysis. Interpretation and use of test results are the responsibility of the client. This report relates only to the samples reported above, and may not be reproduced, except in full, without written approval by EMSL. EMSL bears no responsibility for sample collection activities or analytical method limitations. The report reflects the samples as received.
Results are generated from the field sampling data (sampling volumes and areas, locations, etc.) provided by the client on the Chain of Custody. Samples are within quality control criteria and met method specifications unless otherwise noted. The above analyses were performed in general compliance with Appendix E to Subpart E of 40 CFR (previously EPA 600/M4-82-020 “Interim Method”) but augmented with procedures outlined in the 1993 (”final”) version of the method. This report must not be used by the client to claim product certification, approval, or endorsement by NVLAP, NIST or any agency of the federal government. Non-friable organically bound materials present a problem matrix and therefore EMSL recommends gravimetric reduction prior to analysis. Unless requested by the client, building materials manufactured with multiple layers (i.e. linoleum, wallboard, etc.) are reported as a single sample. Estimation of uncertainty is available on request.

Asbestos Hazard Emergency Response Act (AHERA) – 40 CFR 763.86 Applies to public school districts and non-profit schools, including charter schools and schools affiliated with religious institutions. Since 1986, schools have been required to inspect for asbestos-containing building material(s) and prepare management plans and/or take action to prevent or reduce asbestos hazards. Personnel working on asbestos activities in schools must be trained and accredited in accordance with the Asbestos Model Accreditation Plan (MAP).
These legal requirements are founded on the principle of "in-place" management of asbestos-containing material(s). Removal of these materials is not usually necessary unless the material is severely damaged or will be disturbed by a building demolition or renovation project.
Asbestos School Hazard Abatement Reauthorization Act (ASHARA)
This law, enacted in 1990, extended funding for the asbestos abatement loan and grant program for schools. ASHARA also directed EPA to increase the number of training hours required for the training disciplines under the MAP and to expand the accreditation requirements to cover asbestos abatement projects in all public and commercial buildings in addition to schools.
Asbestos NESHAP – 40 CFR 61, Subpart M
Applies to certain demolition and renovation projects in facilities containing ACM and/or assumed ACM. The NESHAP rule usually requires that all friable ACM and some categories of non-friable ACM be removed before a building is demolished, and may require localized removal before or as part of a renovation. For renovation projects where friable ACM will be disturbed, the Asbestos NESHAP rule may require appropriate work practices or procedures for the control of emissions. The following Asbestos NESHAP definitions of ACM are important in interpreting which NESHAP requirements may apply to your building:
Friable asbestos-containing material: any material containing more than one % asbestos that when dry, can be crumbled, pulverized, or reduced to powder by hand pressure.
Category I non-friable asbestos-containing material: asbestos-containing packings, gaskets, resilient floor covering, and asphalt roofing products containing more than one % asbestos that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure.
Category II non-friable asbestos-containing material: any material excluding Category I non-friable ACM, containing more than one % asbestos that, when dry, cannot be crumbled, pulverized, or reduced to powder by hand pressure.
Regulated asbestos-containing material (RACM): (1) friable ACM, (2) Category I non-friable ACM that has become friable (3) Category I non-friable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or (4) Category II non-friable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the materials in the course of demolition or renovation operations regulated by NESHAP.
Asbestos NESHAP also requires that the EPA or the state (if the state has been delegated authority under NESHAP) be notified before certain renovations impacting RACM begin. When ACM is removed or disturbed during renovation, Cal/OSHA regulations may apply.
State and Local Regulations
Specific asbestos requirements are contained in Title 8 of the CCR as well as in the California Health and Safety Code. The removal or disturbance of 100 square feet or more of ACCM must be performed by a contractor certified by the California Contractor's State License Board (CSLB) to conduct asbestos-related work and/or an employer/contractor registered with DOSH to perform asbestos-related work. Less than 100 square feet of ACCM does not require DOSH registration; however, an employer performing such work must send a "report of use" to Cal/OSHA. All other occupational health and safety work rule(s) requirements also apply; particularly those from Title 8 CCR Section 1529.
DOSH asbestos standards are contained in Title 8 CCR Sections 1529 and 5208. The asbestos standard in Section 1529 applies to asbestos-related construction work, such as routine building maintenance, asbestos removal, renovation, demolition, excavation which may involve exposure to asbestos as a natural constituent, and asbestos spill/emergency cleanup. The asbestos standard in Section 5208 applies to general industry. These standards mandate an eight-hour time-weighted average (TWA) permissible LPA Project No. - 4742

exposure limit (PEL) of one-tenth (0.1) fibers per cubic centimeter (f/cc) of air, and a thirty (30)-minute excursion limit of one f/cc.
Employers conducting any operation involving the disturbance of materials containing asbestos and/or which may reasonably be expected to result in employee exposure above the PEL and/or excursion limit must register with DOSH using the "Carcinogen Report of Use Form." This is a one-time registration; however, the employer must update the report and provide it to DOSH when there are any changes in report information.
The following are select Cal/OSHA definitions regarding asbestos work:
Class I asbestos work means activities involving the removal of TSI and surfacing ACM and presumed ACM (PACM).
Class II asbestos work means activities involving the removal of ACM which is not thermal system insulation or surfacing material.
This includes, but is not limited to, the removal of asbestos-containing wallboard, floor tile and sheeting, roofing and siding shingles, and construction mastics.
Class III asbestos work means repair and maintenance operations, where ACM, including TSI and surfacing ACM and PACM, is likely to be disturbed.
Class IV asbestos work means maintenance and custodial activities during which employees contact but do not disturb ACM or PACM and activities to clean up dust, waste and debris resulting from Class I, II, and III activities.
Intact means that the ACM has not crumbled, been pulverized, or otherwise deteriorated so that asbestos is no longer likely to be bound with its matrix.
On January 1, 1989, Assembly Bill 3713 mandated the addition to the California Health and Safety Code of Chapter 10.4, which affects owners of buildings constructed prior to 1979. The regulation details notification requirements for owners of buildings with known ACMs and/or ACCMs. The bill requires owners to provide written notices to employees, contractors, and lessees concerning matters related to ACM and ACCM. The notice must include (1) existence of, conclusion from, and contents of asbestos building surveys, (2) specific locations of ACM and ACCM, (3) general procedures and handling restrictions to minimize asbestos disturbance, (4) results of any bulk analysis or air monitoring conducted, and (5) potential health risks associated with asbestos exposure.
For non-friable materials (i.e., material in which asbestos fibers are completely encapsulated), such as asbestos-containing resilient floor covering, notice must include (1) information described in Items 1 and 2 in the preceding paragraph, and (2) warning that activities such as removing, sanding, scraping, etc. are restricted and should not be performed by unqualified employees.
Notice in writing to each individual employee must be provided within 15 days of the receipt of information identifying the presence or location of ACM and ACCM within the building; annual notification is required thereafter. The regulation also requires the posting of warning notices in building areas where construction, maintenance, or remodeling may create a release or disturbance of ACM and ACCM.
Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986 took effect February 27, 1987, and is contained in the Health and Welfare Agency Regulations, Title 22 CCR Division 21.5. This act prohibits all building owners and private businesses with 10 or more employees from "knowingly" or "intentionally" exposing any individual to a listed hazardous substance without first providing a "clear and reasonable warning" of such exposure.
For asbestos, the level at which warning requirements are exempted, or the "no significant risk level" (NSRL), is 100 fibers inhaled per day, or 140 million fibers ingested per day. The 100 fiber NSRL equates to an airborne fiber concentration of 0.00001 f/cc based on the inhalation of 10 cubic meters of air during an eight-hour work day. There is currently no validated sampling and analytical methods capable of detecting airborne fibers at this low level. For practical purposes, the Health and Welfare Agency has indicated that warnings must be posted when indoor airborne asbestos concentrations are significantly higher than ambient (outdoor) levels.
Materials containing more than one % asbestos are also subject to San Diego County Air Pollution Control District (APCD) Rule 1206 (adopted and effective 11/15/2017). Regulated ACM (friable ACM and non-friable ACM that will become friable during demolition operations) must be removed from a facility prior to demolition. Notification to that effect must be submitted to the San Diego APCD no later than ten (10) working days prior to any demolition, other than that performed on an emergency basis.

A facility includes commercial, public, industrial, or residential structures (including any structure, installation, or building containing condominiums or individual dwelling units operated as a residential cooperative, but excluding residential buildings having four or fewer dwelling units), any ship, and any active or inactive waste disposal site. Note: in Los Angeles, Orange, Riverside, and San Bernardino Counties, the South Coast Air Quality Management District (SCAQMD) has included “residential structure” in its defining of a facility, meaning that such dwellings must also be assessed for and removed of any asbestos prior to a renovation/demolition. Additionally, under SCAQMD Rule 1403, a Procedure 5 (Approved Alternative) work plan is required where significantly disturbed ACM is identified. Please contact your county, city, and/or local air pollution control district (APCD) or air quality management district (AQMD) for any additional, location-specific requirements.
In California, friable asbestos-containing waste containing more than one % asbestos must be handled, transported, and disposed of as hazardous waste in accordance with the California Environmental Protection Agency regulations contained in Title 22 CCR.
ACCM containing one % or less asbestos can be disposed as non-hazardous waste. However, the waste disposal facility must be notified of %s of asbestos in the waste. Cal/OSHA worker protection regulations for asbestos would still apply during handling of the waste.
EPA Regulations
40 CFR Part 745 (Final Rule): The EPA has mandated that every state adopt abatement protocols and institute a training and certification program for inspectors, workers, supervisors, etc. This certification went into effect in August 1998, and beginning in August 1999 EPA's abatement work practices had to be must be followed. If a state has not implemented State Lead Regulations, the EPA's program will be in effect. The EPA Final Rule certification and work practice requirements apply to lead abatement in child-occupied facilities, with minimal direct impact on commercial property operations.
Public Law 102-550: Title X of the Housing & Community Development Act of 1992:
Deals with training requirements for managing and procedures for evaluating the risks of identified LBP.
Resource Conservation & Recovery Act (RCRA): Deals with the waste and disposal requirements associated with LBP materials.
The Safe Drinking Water Act (SDWA) of 1974, amended in 1986, 1988, and 1989 : Set drinking water standards to protect the publi c health. Major amendments ban the use of lead materials in new plumbing and in plumbing repairs and require water suppliers to notify the public about lead in drinking water. The EPA action level for lead in drinking water is 15 parts per billion (ppb).
Lead-Based Paint: Department of Housing and Urban Development Guidelines for Hazard Identification & Abatement in Public Housing (HUD; 1995, 2012): Deals with requirements for testing and managing the potential for LBP exposure in public housing primarily focused on the safety of children.
EPA's 2010 Lead Renovation, Repair and Painting Rule (RRP Rule) requires that firms performing renovation, repair, and painting projects that disturb LBP in homes, child care facilities, and preschools built before 1978 have their firm certified by EPA (or an EPA authorized state), use certified renovators who are trained by EPA-approved training providers, and follow lead-safe work practices when disturbing more than six square feet per room or 20 square feet outside.
Local and State Regulations
DOSH lead standards are contained in Title 8, CCR, Section 1532.1 Lead, Subchapter 4, Construction Safety Orders, Article 4.
Dusts, Fumes, Mists, Vapors, and Gases. DOSH lead regulations apply to all construction work where an employee may be occupationally exposed to lead. Construction work is defined as work for construction, alteration and/or repair, including painting and decorating. It includes but is not limited to the following:
(1) Demolition or salvage of structures where lead or materials containing lead are present; (2) Removal or encapsulation of materials containing lead; (3) New construction, alteration, repair, or renovation of structures, substrates, or portions thereof, that contain lead, or materials containing lead;
(4) Installation of products containing lead;
(5) Lead contamination/emergency cleanup;
(6) Transportation, disposal, storage, or containment of lead or materials containing lead on the site or location at which construction activities are performed; and
(7) Maintenance operations associated with the construction activities.

Title 17, CCR, 35001 California Department of Public Health defines LBP as paint or other surface coatings that contain an amount of lead equal to, or in excess of one milligram per square centimeter (1.0 mg/cm2) or more than one half % (0.5 %) by weight and presumed-LBP as paint or surface coating affixed to a component in or on a structure, excluding paint or surface coating affixed to a component in or on a residential dwelling constructed on or after January 1, 1979, or a school constructed on or after January 1, 1993. If a lead sampling is performed on a building, notification should be submitted to the CDPH on Form CDPH 8552 by the accredited inspector.
The Los Angeles County Code of Ordinances, Title 11 Health and Safety, Division 1 Health Code, Chapter 11.28 Lead Hazards defines “Dangerous levels of lead-bearing substances” as paint, varnish, lacquer, putty, plaster, and similar coatings or materials that contains lead in excess of seven-tenths of one milligram per square centimeter (0.7 mg/cm2) as determined by a lead- detecting instrument.
The City of San Diego Municipal Code (4-2008) Chapter 5, Article 4, Division 10: Lead Hazard Prevention and Control Ordinance includes five key elements to prevent lead poisoning:
(1) A visual inspection to verify the absence of visible dust or debris must be performed upon the completion of all activities which disturb or remove paint -
(A) Where the paint is presumed LBP covering a surface area and/or (B) Where LBP testing performed on the paint revealed lead levels greater than 1000 ppm or 0.5 mg/cm2.
A renovator shall record the results of the visual inspection on the form provided by the City of San Diego, shall maintain that form for a minimum of three years, and shall make all such forms available to the City of San Diego upon request. (2) A clearance inspection must be performed upon the completion of all activities which disturb or remove paint and after visual inspection -
(A) Where the paint is presumed lead-based paint covering a surface area and/or (B) Where lead-based paint testing performed on the paint revealed lead levels greater than 5000 ppm or 1.0 mg/cm2. (3) The lead-safe work practice clearance inspection standards shall be performed only by a Certified Lead-Related Construction Inspector/Assessor or Project Monitor.
(4) All clearance inspection procedures shall be in compliance with 40 CFR part 745.227 and title 17 of the CCR clearance guidelines.
Please contact your county, city, and/or local air pollution control district (APCD), air quality management district (AQMD), or CDPH for any additional, location-specific requirements.
Note that waste characterization testing and appropriate disposal are governed by Title 22, CCR, Chapter 11 as well as the RCRA.
In brief, a combination of testing beginning with Total Threshold Limit Concentration (TTLC) followed by Soluble Threshold Limit Concentration (STLC or W.E.T. test) analyses must be performed. The waste must pass both tests to be considered non- hazardous in California. A third test, known as the Toxicity Characteristic Leaching Procedure (TCLP), must also be completed for waste that is determined to be hazardous assessing whether or not treatment of the actual waste is required.

If such cost is not contained or specified in the Bid Form, the Contractor shall include the costs in the other Bid items on the Bid Form.
31. BASIS OF AWARD; BALANCED BID.
The Agency shall award the Contract to the lowest responsible Bidder submitting a responsive Bid. The lowest Bid will be determined on the basis of the total B id price. In the event of any discrepancies, written numbers (e.g., fifty, hundred) will govern over numerical numbers (e.g., 50, 100) on the Price Proposal Form. Also, the sum of all lump sum line items will govern over the “Total Proposed Lump Sum Price” line item.
The Agency may reject any Bid which, in its opinion when compared to other Bids received or to the Agency’s internal estimates, does not accurately reflect the cost to perform the Work. The Agency may reject as non-responsive any Bid which unevenly weights or allocates costs, including but not limited to overhead and profit to 1 or more particular Bid items or otherwise violates Public Contract Code Section 9203.
32. AWARD PROCESS.
Once all Bids are opened and reviewed to determine the lowest responsive and responsible Bidder, the Board may award the Contract. Once notified by Agency staff, the apparent successful Bidder should begin to prepare the following documents: (1) the Labor and Materials Bond; (2) the Performance and Warranty Bond; and (3) the required insurance certificates and endorsements. Once the Agency notifies the Bidder of the award, the Bidder will have 10 Working Days from the date of this notification to execute the Contract and supply the Agency with all of the required documents and certifications or the Bidder may forfeit the Bid security and the Agency may pursue award of the Contract to the next lowest, responsive, responsible Bidder.
Once the Agency receives all properly drafted and executed documents and certifications from the Bidder, the Agency shall issue a Notice to Proceed to that Bidder.
33. EXECUTION OF CONTRACT.
As required in these Instructions to Bidders, the Bidder to whom an award is made shall execute the Contract in the amount determined by the Contract Documents. The Agency may require appropriate evidence that the persons executing the Contract are duly empowered to do so. The Contract and bond forms to be executed by the successful Bidder are included within these Specifications and shall not be detached.
