ommended Action
Adopt a resolution adopting the plans, specifications and contract documents, authorizing the City Clerk to advertise for bids for the Veterans Memorial Park Project and the Faraday Avenue Improvements Project and appropriating $7,456,704 to the Veterans Memorial Park Project from the Community Facilities District No. 1 Fund.
Executive Summary
On July 26, 2022, the City Council adopted the final Veterans Memorial Park Master Plan, made a finding of compliance with the Growth Management Plan and Citywide Facilities and Improvements Plan Parks Performance Standard and adopted the related California Environmental Quality Act Findings (Exhibit 3). Staff subsequently worked with the design team to develop the plans, specifications and contract documents for the Veterans Memorial Park Project, Capital Improvement Program Project No. 4609. The park consists of a 93.7-acre property, located south of Agua Hedionda Lagoon, with frontage along Faraday Avenue.
The Faraday Avenue Improvements Project, Capital Improvement Program Project No. 6099, will implement modifications to the public right-of-way along Faraday Avenue designed to enhance mobility access to the park.
The Veterans Memorial Park and Faraday Avenue Improvements project have been combined into one public bid process, with an intent to award a single construction contract. The City Council’s adoption of the project plans, specifications and contract documents is required under Carlsbad Municipal Code Section 3.28.080(E), because each of the projects will cost more than $220,000.

(The process for such appropriations is explained in the Fiscal Analysis section below.)
Explanation & Analysis
Veterans Memorial Park Project
The Veterans Memorial Park property is bordered to the southeast by the Macario Canyon and the Veterans Memorial Park Open Space Preserves. Of the 93.7-acre park property, 38.82 acres will be developed, and 54.88 acres will remain designated as hardline habitat preserve areas.1 This park will be the city’s largest
community park, designed as a
welcoming, family-oriented
destination. It will feature a diverse
range of multi-generational and
inclusive amenities thoughtfully
integrated into both active and
passive recreational spaces.
Key elements of the park project
include honoring veterans for
their service, minimizing
environmental impact, and
celebrating the site’s natural beauty and scenic views.
The primary amenities designed are:
• Veterans memorial plaza
• Picnic areas
• Family-oriented bike park
• Concessions/restrooms
• Fitness equipment
• Multi-use trails
V
eterans Memorial Park is a priority project in the 2023-27 Carlsbad Strategic Plan and the 2023-30 Carlsbad Parks & Recreation Department Master Plan and is in alignment with the Carlsbad Community Vision Statement of “Access to recreation and active, healthy lifestyles.” Recent City Council actions related to the planning of Veterans Memorial Park include:
• July 30, 2024: Execution of a professional services agreement to provide design services and pre-engineered building material kits for three buildings within the park (City Council Resolution No. 2024-199).
• June 24, 2025: Execution of a declaration of restrictive covenants for the hardline habitat preserve areas within the park (City Council Resolution No. 2025-151). 1 A "hardline" habitat preserve area is a permanently protected area designated primarily for the conservation and management of biological resources.

Faraday Avenue is classified as an employment/transit connector street in the Mobility Element of the city’s General Plan. Its existing speed limit is posted at 40 mph.
The Veterans Memorial Park traffic study provided recommendations for access to the park along Faraday Avenue. The study proposed two new park access driveways and identified the need for left-turn lanes at each of the driveways to facilitate vehicle access to the park and help reduce delays for drivers traveling along Faraday Avenue.
This project will include the construction of left-turn lanes at each of the park’s two new driveways on Faraday Avenue. New striping will be implemented along Faraday Avenue to accommodate enhanced bike lanes with buffers, and green paint will be used to highlight areas where vehicle and bike traffic may conflict to draw the attention of both cyclists and drivers and enhance bike access to the new park.
Public safety staff from the Fire and Police Departments have reviewed this project’s design with engineering staff from the Transportation Department. Their shared goal was to ensure the project addressed the multiple needs of the community while balancing the priorities associated with engineering, enforcement and emergency response considerations.
Prequalification of contractors
Staff advertised a request for qualifications from contractors to prequalify for the Veterans Memorial Park Project and the Faraday Avenue Improvements Project on June 11, 2025. Eight contractors submitted responses to the request for qualifications by July 22, 2025. Staff subsequently evaluated those responses in accordance with the criteria provided in the request for qualifications and California Public Contract Code Section 20101.
These five contractors were determined to be prequalified and eligible to submit bids on the projects:
• BrightView Landscape Development, Inc.
• Clark Construction Group California, LP
• Edwards Construction Group, Inc.
• Hazard Construction Engineering, LLC
• Los Angeles Engineering, Inc.
All contractors that submitted responses to the request were advised of their eligibility status.
Fiscal Analysis
Veterans Memorial Park Project
The engineer’s estimate for the construction contract for this project, also referred to as the hard cost, is $43,958,454.2 The total estimated construction cost, which includes items such as contingency, administration, inspection, reporting and permitting, for this project is $50,964,008.
2 An engineer’s estimate is an opinion of a project’s probable construction cost given by an experienced and qualified professional engineer generally familiar with the construction industry. The city uses them to obtain an estimate as close to the actual costs as possible.

An additional appropriation of $7,456,704 for this project was forecasted in the Fiscal Year 2025-26 Capital Improvement Program budget, from the Community Facilities District No. 1 Fund. The Capital Improvement Program budget covers a five year period. For projects related to the City Council’s 5-Year Strategic Plan, construction funding is shown as an estimate, i.e., the City Council does not authorize an appropriation when the annual Capital Improvement Program budget is adopted. Instead, staff request an appropriation for the construction when the design is complete, and the project is ready to be bid for construction.
The total funding anticipated in reimbursement grants approved for this project is $8,000,000.
The U.S. Department of Housing and Urban Development issued an agreement providing $3,000,000 through a Community Project Funding Grant. Additionally, the State of California Natural Resources Agency issued an agreement providing $5,000,000 through a Department of Parks & Recreation General Fund Specified Grant.

5. The Agency’s Claims process specified in the Agency Supplement shall not relieve the Contractor of the Contractor’s statutory obligations to present Claims prior to any action under the Government Code.
6. Except for those final payment items disputed in the written statement required in Section 7-3.2 Partial and Final Payment, all Claims of any dollar amount shall be submitted in a written statement by the Contractor no later than the date of receipt of the final payment estimate , or the time specified for such Claim in these specifications, whichever is earlier . Those final payment items disputed in the written statement required in Section 7-3.2 shall be submitted no later than 30 Calendar Days after receipt of the Final Payment estimate. (D) Any payment due on an undisputed portion of the Claim shall be processed and made within 60 days after the public entity issues its written statement. If the public entity fails to issue a written statement, paragraph (3) shall apply.
(2)(A) If the Claimant disputes the public entity's written response, or if the public entity fails to respond to a Claim issued pursuant to this section within the time prescribed, the Claimant may demand in writing an informal conference to meet and confer for settlement of the issues in dispute. Upon receipt of a demand in writing sent by registered mail or certified mail, return receipt requested, the public entity shall schedule a meet and confer conference within 30 days for settlement of the dispute.

(C) For purposes of this section, mediation includes any nonbinding process, including, but not limited to, neutral evaluation or a dispute review board, in which an independent third party or board assists the parties in dispute resolution through negotiation or by issuance of an evaluation. Any mediation utilized shall conform to the timeframes in this section.
(D) Unless otherwise agreed to by the public entity and the Contractor in writing, the mediation conducted pursuant to this section shall excuse any further obligation under Section 20104.4 to mediate after litigation has been commenced.

A Claim that is denied by reason of the public entity's failure to have responded to a Claim, or its failure to otherwise meet the time requirements of this section, shall not constitute an adverse finding with regard to the merits of the Claim or the responsib ility or qualifications of the Claimant.

(5) If a Subcontractor or a lower tier Subcontractor lacks legal standing to assert a Claim against a public entity because privity of Contract does not exist, the Contractor may present to the public entity a Claim on behalf of a Subcontractor or lower ti er Subcontractor. A Subcontractor may request in writing, either on their own behalf or on behalf of a lower tier Subcontractor, that the Contractor present a Claim for work which was performed by the Subcontractor or by a lower tier Subcontractor on behalf of the Subcontractor. The Subcontractor requesting that the Claim be presented to the public entity shall furnish reasonable documentation to support the Claim. Within 45 days of receipt of this written request, the Contractor shall notify the Subcontractor in writing as to whether the Contractor presented the Claim to the public entity and, if the original Contractor did not present the Claim, provide the Subcontractor with a statement of the reasons for not having done so. (e) The text of this section or a summary of it shall be set forth in the Plans or Specifications for any Public Works Project that may give rise to a Claim under this section.
(f) A waiver of the rights granted by this section is void and contrary to public policy, provided, however, that (1) upon receipt of a Claim, the parties may mutually agree to waive, in writing, mediation and proceed directly to the commencement of a civi l action or binding arbitration, as applicable; and (2) a public entity may prescribe reasonable Change Order, Claim, and dispute resolution procedures and requirements in addition to the provisions of this section, so long as the contractual provisions do not conflict with or otherwise impair the timeframes and procedures set forth in this section.
