ITEM FOR COUNCIL CONSIDERATION
Report on Winter Protection Berm Assessment District No. 5 for Fiscal Year 2024-25.

STAFF RECOMMENDATION
Adopt Resolution No. 6314, acting to accept the mandatory Annual Report and Budget and to set the matter of the continuation of Assessment District No. 5 for Fiscal Year 2024-25 for public hearing at the regular City Council Meeting of May 28,2024.

Sample Motion: I move to adopt Resolution No. 6314, as read by title only

BACKGROUND
The Assessment District No. 5 (District) for the Winter Protection Berm Program was formed by Resolution No. 3061 , dated December 14, 1992, in order to fund a sand berm facility as a measure of shoreline protection for Carpinteria City Beach and immediately adjacent properties. Each year, it is necessary to hold a public hearing to receive public input including any protests prior to consideration of setting the annual assessment charged to properties within the District's boundaries.

This matter would allow the City Council, if determined appropriate, to accept the Annual Report and Budget and to set a public hearing date for its consideration of continuing the District.

DISCUSSION
The adoption of Resolution No. 6314, as shown as Attachment A, is the next step of the benefit assessment district process. Resolution No. 6314 sets the date of the public hearing for May 28,2024, when final action on the setting of the annual assessment for the District may be taken pursuant to Government Code Section 54954.6, which pertains to notice of assessments.

Report on \Mnter Protection Berm Assessment District No. 5 for Fiscalyear ZO24-25 April22,2024
Page2
ln accordance with the City Council's Resolution lnitiating Proceedings, the City Engineer filed a report with the City Clerk as required by the Municipil lmprovement Act of 1913. The report contains the following parts:

A. Plans and specifications of winter protection Berm project. B. Estimate of Project Cost. C. Assessment Role of Parcels of Land within Assessment District. D. Method of Apportionment of Assessment. E. Assessment Role of the Owners of Parcels of Land within Assessment District. F. Assessment Diagram. G. Collection Statement. H. Unpaid Assessment Statement.

A copy of the Report of the City Eng ineer is shown as Attachment B.

The City utilizes the revenue from the District to partially pay for the Winter protection Berm Program. Should the District not collect the funds as programmed, the City would need to find an alternative source of funds or discontinue the District.

POLICY CONSISTENCY
The recommendation can be found consistent with policies of the City's General plan and Local Coastal Plan, as described below.

Safety Element Objective S-4: Minimize the potentiat risks and reduce fhe /oss of life, propefty and the economic and social distocations resulting from flooding. lmplementation Measure No. 13 The City shatt support and facititate the current Army Corps of Engineers (ACOE) feasibitity study and'otherwise pursue long-term solutions for beach nourishment and establishment of a vegetated dune system at City Beach. As an interim measure, and with permission from the Coastal Commission and US Army Corps of Engineers, the City may construct a sand berm on the City Beach parallelto the homes fronting on the beach.

LEGAL AND RISK MANAGEMENT CONSIDERATIONS
The protection provided by the Winter Protection Berm Program is not intended to serve as a substitute for any flood protection improvements or flood insurance. The Winter Protection Berm Program is not impervious to being destroyed itself. Even with the Report on \Mnter Protection Berm Assessment District No. 5 for FiscalYear 2024-25 April22,2024

Page 3 ends

Winter Protection Berm Program in place, the possibility of damage to public and private improvements by winter storms still exists.

OPTIONS

1. Adopt Resolution No. 6314, acting to accept the mandatory Annual Report and Budget and to set the matter of the continuation of Assessment District No. 5 for Fiscal Year 2024-25 for public hearing at the regular City Council Meeting of May 28,2024.

2. The City Council, at its discretion, may modify the findings of the Report in any respect (Streets and Highway Code Section 10300) and the modified Report will stand as the Report for all subsequent proceedings except that the City Council may not change the boundaries of the District to include any territory that will not, in its judgment, be benefitted by the improvement.

3. The City Council could choose not to accept the mandatory Annual Report and/or not set the matter of continuing Assessment District No. 5 for public hearing; however, by omitting this step, the District would not be continued for Fiscal Year 2024-25.

Estimate of Project Cost
Engineer's Report
Estimate of Project Cost
Carpinteria Gity Beach Winter Protection Berm
FiscalYear 2024-2025
The following estimate of project cost for the Carpinteria City Beach Winter protection Berm is prepared in order to determine the anticipated cost of installing, maintaining, and removing the annual project. Variables that exist in this estimation include not knowing what beach conditions will be for the berm installation in the fall, what level of maintenance will be necessary to keep the berm intact during the winter and how much machine time will be needed to remove the berm in the springtime. Other components of the cost estimate are more reliable. These components include the cost of biological reporting and project administration.

The installationoJthe winter protection berm is accomplished by a negotiated contract pursuant to 22032(a) of the California Public Contract Code. This code states that public projects of forty-five thousand dollars ($45,000) or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order.

For Fiscal Year 2024-2025, the cost is estimated to be $3S,S00. This amount is based upon the following breakdown:

Machine time: $12,000.00
The quantity of maintenance needed throughout the winter storm season is based upon the severity of weather encountered during the time the berm is in place. Some winters require no maintenance while others can require a significant maintenance effort. An amount should be contributed each year in an effort to anticipate some level of maintenance. Based upon empiricai data, a contribution of five thousand dollars per year should, on average, be adequate.
$5,000.00
Removal of the berm in order to return the berm material to the upper tidal zone and to reconfigure the beach to a natural spring profile also varies for several reasons. Should the winter be exceptionally mild, and the berm remains one hundred percent intact, a greater amount of time will be required to remove it. After some winter seasons, a significant portion of the berm is eroded away, reducing berm removal costs. Removal costs can thereby vary significantly from year to year.

An estimated cost for this procedure equals: $12,000.00 Biological monitoring is a requirement of the Army Corps of Engineers and California Coastal Commission who grants authority to the City to do this project. Under the monitoring plan, the California grunion and snowy plover bird must be studied each season in order to ensure mechanical beach sand movement does not interfere with the spawning or nesting grounds. This procedure is performed by City statf with consultation being performed by a qualified biologist.

The cost of this operation equals: $ 2,000.00
The general administration of the berm project overall includes the coordination for construction of the berm, supervision of the construction, any general or related tasks associated with berm management, monitoring of the berm in the winter to watch for berm erosion, preparation of the reports that must be submitted to the Army Corps of Engineers and the California Coastal Commission, berm assessment accounting and management.

The cost of this operation equals: $4,500.00
Based, therefore, on the above anticipated cost of the project, the estimated cost in the fiscal year 2024-2025 would be thirty-five thousand five-hundred dollars ($35,500).

The Assessment District No. 5 total assessment was set in January 1997 by a mail ballot. ln that process, the total District fees were set at Twenty thousand two hundred twe nty-eig ht an d 34 I 1 00 d o I I a rs ($20,228.34) .

The City of Carpinteria may not raise that assessment without an affirmative vote of the affected property owners. As such, in2024-25 the City will contribute to the District an amount of fifteen thousand two-hundred seventy-one dollars and 66/100 dollars ($15,271.66). Therefore, the net amount assessable on land within the district is Twenty thousand two hundred twenty-eight dollars and 341100 dollars ($20,228.34).

Method of Apportionment of Assessment
Garpinteria City Beach Winter Protection Berm
FiscalYear 2024-25
The Carpinteria City Beach Winter Protection Berm Project is constructed along the Carpinteria City Beach bordered on the east by Linden Avenue and to the west by Ash Avenue. The berm is constructed each fall in order to provide a measure of protection to public and private improvements from severe winter storms and wave action. ln order to fairly assess the ocean front properties that directly benefit from the berm protection, a formula was developed which reflects the benefit each parcel of land receives.

First, the cost of providing the service is divided into fixed and variable costs. Fixed costs are those that are required regardless of the amount of sand actually moved.

These include the permit compliance, biological monitoring and administration of the berm project. The fixed costs are apportioned equally to all properties within the boundaries of the assessment district. The contribution toward the maintenance fund is also included among the fixed costs. Variable costs include the cost of the actual machine time required to move the sand. Since properties in the District receive varying levels of benefit depending upon the property's length of beach frontage, variable cost is assigned to each property based upon its actual length of beach frontage.

Condominium or apartment properties'beach frontage was determined by dividing the number of units in each complex by the length of the property's beach frontage. These variable and fixed costs were apportioned to each property and an assessment assigned as part of a Proposition 218 vote and the assessments have not been altered in subsequent years.

A City owned parcelwithin the District's boundaries is assessed in the same fashion as all other parcels within the District's boundaries in order to comply with Article Xlll D of the California Constitution.

COUNCIL AGENDA STAFF REPORT
April 22, 2024

ITEM FOR COUNCIL CONSIDERATION
Amendment No. 1 to Agreement with Showscapes Inc. (dba Treescapes) for a One-Year Term Extension and Related Costs to Provide Landscape Maintenance Services.

STAFF RECOMMENDATION
Authorize the City Manager to execute Amendment No. 1 to the Maintenance Agreement with Showscapes Inc. (dba Treescapes) for a one-year term extension to provide landscape maintenance services in an amount not-to-exceed $267,600 for a total amended agreement amount of $961,410.

Sample Motion: I move to authorize the City Manager to execute Amendment No. 1 to the Maintenance Agreement with Showscapes Inc. (dba Treescapes) for a one-year term extension to provide landscape maintenance services in an amount not-to-exceed $267,600 for a total amended agreement amount of $961,410. (The motion requires a roll call vote.)

BACKGROUND
On April 12, 2021, the City Council authorized the City Manager execute a Maintenance Agreement with Showscapes, Inc. for a three-year term to provide landscape maintenance services. Pursuant to the Maintenance Agreement, landscape maintenance includes the grounds of City bike paths/trails, facilities, parks/open spaces, parking lots, and right-ofway (parkways and medians, not including street trees). The Maintenance Agreement sets term limits at an initial three years with two, 1-year extensions if mutually agreed upon in writing for a possible contract total term of five years. The current Maintenance Agreement is in its third year of the three-year term and is set to expire on April 30, 2024.

The purpose of this agenda matter is to authorize the City Manager to execute Amendment No. 1 to the Maintenance Agreement with Showscapes Inc. (dba Treescapes) for a one-year term extension to provide landscape maintenance services in an amount not-to-exceed $267,600 for a total amended agreement amount of $961,410.

Amendment No. 1 to Maintenance Agreement with Showscapes, Inc. (dba Treescapes) April 22, 2024

DISCUSSION
Since the execution of the original Maintenance Agreement, three new City assets were gained, namely Carpinteria Skate Park, Coastal Vista Trail- Interim Linden Avenue to Holly Avenue Spur, and Via Real right-of-way (Northbound Highway 101 On- and Off-ramps at Casitas Pass Road pursuant to the Freeway Maintenance Agreement between the City and California Department of Transportation
1 ). Said City assets are currently not in the
original landscape maintenance scope of work. The proposed Amendment No. 1, as shown as Attachment A, adds these new City assets to the landscape maintenance list of parks/open spaces and right-of-way, respectively. As shown in Attachment A, cost associated with additional services include $1,200, $690, and $1,200 per month, respectively, that total a monthly increase of $3,090. This would translate to $37,080 per year.

As also a part of the proposed Amendment No. 1, Showscapes, Inc. requests for a 3.3- percent increase of unit prices to be applied for the one-year extension. Staff evaluated the proposed unit prices, and staff found it to be consistent with the changes in the price level of the Los Angeles-Long Beach-Anaheim Consumer Price Index (CPI). (The CPI is a nationally accepted measure of the average change over time in the prices paid by urban consumers for a market basket of consumer goods and services.). If applied, the proposed fee change (i.e. 3.3-percent) would translate to an annual increase of $8,520 (or $710 per month) for a new annual cost of $267,600 (or $22,300 per month).

Staff evaluated the performance of Showscapes, Inc. through vendor reporting, site visits, and daily observations, and staff determined it to be satisfactory to merit another year of providing landscape maintenance services.

COUNCIL AGENDA STAFF REPORT
April 22, 2024

ITEM FOR COUNCIL CONSIDERATION
Second Amendment to Santa Barbara County Association of Governments Joint Powers Agreement.

STAFF RECOMMENDATION
Authorize the Mayor to execute a Second Amendment to the Santa Barbara County Association of Governments Joint Powers Agreement.

Sample Motion: I move to authorize the Mayor to execute a Second Amendment to the Santa Barbara County Association of Governments Joint Powers Agreement.

BACKGROUND
Consistent with federal, state, and local public health recommendations for curbing the spread of the COVID-19 virus in 2020, many people relied on broadband services in order to telework, participate in school, and socialize with friends and family while remaining socially distant. The COVID-19 pandemic made the digital divide in unserved and underserved communities more apparent as work, commerce, health, and other services moved online. Those in unserved and underserved communities were struggling to participate in the digital landscape as broadband services were unavailable to them due to lack of affordability or infrastructure. Further, the state identified a need for improving broadband infrastructure in order to:

1. Encourage new broadband service providers to enter the marketplace in order to improve competition

2. Build redundancy of connection for improved resiliency and disaster recovery

3. Increase overall capacity for local broadband service in support of economic development and enhanced telework infrastructure.

In order to address these needs, a broadband infrastructure was identified as an essential service. In July 2021, the Santa Barbara County Association of Governments (SBCAG) formed the Broadband Ad-hoc Committee, which comprises of SBCAG board members Nelson and Hartman (County of Santa Barbara), Osborne (City of Lompoc), Patino (City of Santa Maria) and Perotte (City of Goleta). The Broadband Ad-hoc Committee formed the basis of SBCAG Board of Directors' support and encouragement Second Amendment to Santa Barbara County Association of Governments Joint Powers Agreement April 22, 2024

to formalize a collaborative, regional approach to developing a broadband strategic plan between SBCAG, County of Santa Barbara, and the eight incorporated cities.

On October 21, 2021, the SBCAG Board of Directors authorized its Executive Director to request for participation from the eight cities, including the City of Carpinteria, in the preparation of the Santa Barbara County Regional Broadband Strategic Plan. In October 2021, the County of Santa Barbara Board of Supervisors also committed $200,000 from the County of Santa Barbara's share of the American Rescue Plan Act.

The SBCAG Board of Directors proposed dividing the remaining cost among the eight cities based on the 2021 California Department of Finance population estimate to the cities' collective population of 307,821. See Table 1 below for the jurisdiction contributions based on population.

with the MOU, conducted a public outreach campaign among the individual communities regionwide, including with the Carpinteria community. For the Carpinteria community, a public forum was held in the auditorium of Carpinteria Children's Project on June 1, 2022. The public forum was moderated by Supervisor Das Williams, and the panelists were from Carpinteria Children's Project, Carpinteria Unified School District (CUSD), and The Zumaya Group. The following table is a summary of the public forum.

Carpinteria Children's Project Public Forum Summary (June 1, 2022) Challenges ► High cost of service ► Lack of awareness of affordability programs ► Multi-family homes: inability to access service per individual or family
► Inadequate training resources/lack of awareness of training resources
► Gap is caused by lack of access to modern technology
► Need training
► 65% of students qualify for reduced/free lunches
Opportunities ► CUSD installed Wi-Fi on school busses/vans ► Partnerships with providers (Connect to Compete)
► Digital Navigators and workshops
► Outreach opportunities
► Promotoras Network and digital navigators
Barriers ► Disproportionately impacts low-income neighborhoods ► Everything relies on the internet; Connectivity is required for quality of life
Based on input from the individual communities as well as the local agencies, a draft of the Santa Barbara County Regional Broadband Strategic Plan was prepared by Broadband Consortium Pacific Coast. In the draft Santa Barbara County Regional Broadband Strategic Plan, affordability and access were noted as the most significant barriers to broadband adoption in the Carpinteria community. The following recommendations were presented as strategies to overcome said identified barriers:

1. Access (Capacity and Connectivity)
a. Continue development and availability of community Wi-Fi maintained by the City or in partnership with education and community centers. b. Seek grant funding to increase staffing capacity within City departments to work on broadband priorities.

2. Affordability and Adoption
a. A community Wi-Fi system would benefit those unable to connect due to cost.

Grant Account of the California Advanced Services Fund, a program administered by the California Public Utilities Commission.

b. Support partnerships with the Digital Equity Coalition to expand awareness of the Affordable Connectivity Program.

3. Requirements for Redundancy and Resiliency
a. Continue to partner with SBCAG in regional coordination of the Golden State Connect Network and last-mile planning and implementation. b. Consolidate and create a complete asset inventory that could be utilized for broadband infrastructure deployment.
c. Prioritize smart city planning in the General Plan and develop necessary and corresponding policies.

On November 9, 2022, Broadband Consortium Pacific Coast presented the draft Santa Barbara County Regional Broadband Strategic Plan to the Utilities Committee (Members Nomura and Lee). The Utilities Committee recommended for the City Council to accept the Santa Barbara County Regional Broadband Strategic Plan. On November 14, 2022, the City Council accepted the Santa Barbara County Regional Broadband Strategic Plan. In December 2022, the SBCAG Board of Directors approved the final Santa Barbara County Regional Broadband Strategic Plan.

In May 2023, the California Public Utilities Commission approved a Local Agency Technical Assistance (LATA) Grant in the amount of $1 M to the joint grantees of the County of Santa Barbara and SBCAG for implementing the Santa Barbara County Regional Broadband Strategic Plan on behalf of the MOU partners. The implementation includes preliminary broadband network design, a programmatic environmental impact report, and a joint powers authority establishment.

The purpose of this agenda matter is for the City Council to authorize the Mayor to execute a Second Amendment to the Santa Barbara County Association of Governments Joint Powers Agreement in order to fulfill the LATA Grant requirement of establishing a joint powers authority.

DISCUSSION
On October 19, 2023, the SBCAG Board of Directors approved SBCAG staff's recommendation of a Second Amendment to the SBCAG Joint Powers Agreement (JPA), expanding the JPA's scope for broadband services to the MOU partners. The proposed Second Amendment is shown as Attachment A. All MOU partners are required to have their respective governing board execute the Second Amendment in order to fulfill the LATA Grant requirement of establishing a joint powers authority.

POLICY CONSISTENCY
The proposed City Council actions in support of a Santa Barbara County Regional Broadband Strategic Plan can be found consistent with policies of the City's General Plan and Sustainable Community Policy, as described below.

ITEM FOR COUNCIL CONSIDERATION
Closeout of City Hall Campus lmprovements Project- Sewer Replacement.

STAFF RECOMMENDATION
Authorize the Mayor to sign the Closeout Agreement and Release of Claims for the City Hall Campus lmprovements Projecl Sewer Replacement with Toro Enterprises lnc.

Sample Motion: I move to authorize the Mayor to sign the Closeout Agreement and Release of Claims for the City Hall Campus lmprovements Project- Sewer Replacement with Toro Enterprises lnc. (This motion requires a roll callvote.)

BACKGROUND
ln June 2022, a sanitary sewer pipeline assessment was conducted by the Carpinteria Sanitary District as a part of its routine cleaning maintenance for the City Hall campus' sanitary sewer lateral. The sanitary sewer lateral runs underground that is parallel to the south property line of City Hall and connects with a Carpinteria Sanitary District mainline in Dump Road. The Carpinteria Sanitary District discovered the sanitary sewer lateral to be structurally deficient and advised the City to remove and replace it as soon as possible.

On January 8,2024, the City Council awarded the construction contract to Toro Enterprises, lnc. in the Total Base Bid amount of $285,609. On January 9,2024, the Notice of Award was issued to Toro Enterprises, lnc. in order to begin the process of executing the construction contract including furnishing the required performance bond, payment bond, and certificates of insurance and insurance endorsements. Staff confirmed the construction contract was fully executed and issued the Notice to Proceed to Toro Enterprises, lnc. for starting construction on February 12,2024.

The purpose of this agenda matter is for the City Council to authorize the Mayor to sign the Closeout Agreement and Release of Claims for the City Hall Campus lmprovements Project- Sewer Replacement with Toro Enterprises, lnc.

DISCUSSION
The general scope of work of the City Hall Campus tmprovements project- Sewer Replacement consisted of abandonment of a structuraily-deficient sewer line and installation of its replacement. The rocation map is shown as Attachment A.

During the course of construction, the following contract change order was directed by the Public Works Director:

The Balancing Contract Change Order accounts for any increases and decreases in quantity of bid items for the final amount of work. The Eialancing Contract Change Order also accounts for extra work and eliminated work.

The following tables summarize the original revenue and expense budgets, respectively:
_.1Qhange Order Number Brief Desc n Cost
1 Balancing Contract Change Order $5,471.73
The following table summarizes the actual costs of the construction contract with Toro Enterprises, lnc.:

Construction management and inspection were performed by Public Works Department Engineering Division staff, and no consulting services were utilized.

The Public Works Director finds the work as being in conformance with the contract documents and determined the construction wasiompleted on Februa ry 29,2024.

Therefore, staff recommends for the City Council to authorize the Vlayoi to sign the closeout Agreement and Release of claims as shown as Attachmeni g.

COUNCIL AGENDA STAFF REPORT
April 22, 2024

ITEM FOR COUNCIL CONSIDERATION
Annual Review of the City's Master Fee Schedule.

STAFF RECOMMENDATION
Approve and adopt Resolution No. 6316, updating the City's Master Fee Schedule.

Sample Motion: I move to Adopt Resolution No. 6316, approving the City's Master Fee Schedule.

BACKGROUND
At the Council Meeting of October 9, 2023, the City completed a Cost of Service Study (Study) designed to determine the level of fees necessary to ensure the City recovers the full cost of providing the various services it makes available to the public.

At the Special City Council meeting on October 30, 2023, the City Council reviewed and filed the Study. The City Council provided direction to staff and continued the meeting to November 13, 2023. City staff, requiring additional time, requested the City Council continue the matter to the meeting of November 27, 2023.

At the Council Meeting of November 27, 2023, the City Council approved the first reading of Ordinance No. 774 and the adoption of Resolution No. 6282, updating the City's Master Fee Schedule with an effective date of January 29, 2024. The second reading of the ordinance was held on December 11, 2023
The purpose of this agenda item is for the City Council to consider and approve the revised Master Fee Schedule (see Exhibit 1) that includes an inflation factor of 1.5% based on the Consumer Price Index (CPI) of the Los Angeles-Long Beach-Anaheim for the month of December. City staff are recommending half of the CPI of 3% since the rates were increased on January 29, 2024.

Annual Review of Master Fee Schedule

DISCUSSION
Ensuring City costs are fully recovered for consumer or fee-based services is a critical element in fiscal stabilization for the City. While having an understanding of the minimum fee/charge necessary for cost recovery is essential in both local government and private business, unlike private business, which may set fees/charges to make a profit, California cities are limited by state law to recovering only up to actual costs of service. Conversely when fees/charges are not adjusted regularly, costs may exceed fees/charges resulting in a subsidy.

As the City's costs to provide these types of services change over time, the City's fees and service charges should also change accordingly. Included in this report is a summary of changes (see attachment A) that provides a listing of all the proposed changes to the Master Fee Schedule, as well as the variance (increase/decrease).

There are also corrections to some of the fees. For example, the Home Occupancy Permit is now incorporated into the Business License Review fee since the process to aquire a business license is the same for either city or home business application.

Moving forward, City staff will revise the Master Fee Schedule on an annual basis (January/February) and present to City Council for consideration. The effective date of the City's Master Fee Schedule, if approved by the City Council is July 1, 2024.

Government Code Section 66017 states adoption of certain fees or charges shall be effective no sooner than 60 days following the final adoption of the fee or charge or increase in the fee or charge.

POLICY CONSISTENCY
While most of the cost recovery targets are 100%, some are less. Electing to collect fees that recover less than 100% of the City's costs for providing a service is a policy choice. Ensuring City costs are fully recovered for the provision of consumer or feebased services is a critical element in fiscal stabilization for the City.

FINANCIAL CONSIDERATIONS
City Council approval of this action would establish a revised Master Fee Schedule effective July 1
st of Fiscal Year 2024-25. The additional revenue would offset the corresponding increase in costs necessary to provide the services.

LEGAL AND RISK MANAGEMENT CONSIDERATIONS
The City Attorney has reviewed this Agenda item and will be available to answer questions at the meeting.

PRINCIPAL PARTIES EXPECTED AT MEETING
None.
