City Council

Item No. 6.A

Meeting Date: March 22, 2023
From: Ryan Hunt, Communications and Events Manager
Title: SUP #23-002: Maya La Feria International De Cultura

City Council

RECOMMENDATION:

To approve Special Use Permit #23-002 and allow the Maya La Feria International De Cultura event to utilize the Community Amphitheater on Sept. 30-Oct. 1, 2023.

BACKGROUND:

Maya La Feria International De Cultura is scheduled for Sept. 30 – Oct. 1, 2023, and is requesting use of the Cathedral City Community Amphitheater . This was presented briefly to the Council at the Feb. 15, 2023, meeting. The idea was first presented to city staff during a presentation hosted by the Cathedral City Chamber of Commerce.

DISCUSSION:

Maya La Feria Internat ional De Cultura projects a strong local and regional audience and would represent another local event dedicated to celebrating the culture and history of Latino countries/heritage. The event, which is a proposed partnership between the Cathedral City Cham ber of Commerce and Camara de Comercio Guatemala USA, features folklorico performances, live entertainment and cultural cuisine/presentations representing Mexico, Central & South America.

FISCAL IMPACT:

As a third -party event, the applicant must submit a ll necessary payments and documentation to the City prior to the event.

Since this would be a new event in Cathedral City, the economic impact is unknown.

However, Communications & Events sees this as an opportunity to draw more foot traffic downtown, to provide affordable entertainment to residents and visitors and to increase customers frequenting our restaurants and small businesses in the downtown area.

Proposal to Cathedral City Public Arts Commission
"Yve Evans Presents" 2023 Blues/Jazz Concert Series
December 28, 2022

"I would teach children music, physics, and philosophy , but most importantly music, for the patterns in music and all the arts are the keys to learning." Plato

Cathedral City Senior Center proposes a new city-wide performing arts series. The Blues/Jazz concert series, free to the public of all ages, will be an introduction to some and a time to reminisce for others. Yve Evans is a local icon who, besides performing, speaks to the audience about the importance of the songs she sings and the music she plays.

At this point in the Coachella Valley, there isn't a free daytime concert series year-round for all to enjoy. The Cathedral City Senior City Center CCSC) is offering a five-concert series for 2023 to help fill that gap.

T
he second concert in the series (March 25) is a special one that will be videotaped for International Jazz Day, a partnership between the Herbie Hancock Foundation and UNESCO. In 2021, Yve and Sue Townsley put Coachella Valley on the UN Jazz map by submitting a concert with five musicians, choreographed by Yve. The Coachella Valley had never participated before, but this time, CCSC would like to concentrate on Cathedral City, especially because the city recently became an International City of Peace. The session will be shown around the world on April 30.

International Jazz Day is the world's largest celebration of jazz as a force for peace, intercultural dialogue, and international cooperation.

Each year on April 30, people from over 190 countries worldwide come together to recognize jazz for promoting respect for human rights and human dignity, eradicating discrimination, bolstering freedom of expression, fostering gender equality, and reinforcing the role of youth in enacting social change.

The concerts will be held in the main room at the Senior Center. We have scheduled three dates through Spring and will select the fall dates after Yve knows her performing calendar on cruise ships.

Attachment: 2022-12-28 CCSC Jazz Series Proposal to CCPAC (3659 : Public Arts Commission Arts Education Funding Request: Senior Center

January 21, March 25, June 17, and two in the Fall, dates TBD.

All on Saturdays, all 3:00-5:00 pm.

CCSC is asking the Public Arts Commission (PAC) for $2,000 to cover the costs of the musicians for 2023. A banner will list all contributors.

Yve is approaching other sponsors for assistance with issues that may arise, i.e., instrument replacement. The concerts are free to the public, and CCSC will accept donations to cover refreshments. CCSC will match a potential public arts commission grant with an additional $2,000 for staffing, facility use, refreshments, cleanup, displaced rental income, and advertising.

A series of this nature will be positive for the city and the senior center.

If PAC chooses to participate, it will be good advertising seen around the world. The senior center is honored to serve the community and further the public arts commission's commitment to utilizing arts to foster creativity, empathy, and beauty and strengthen our communities socially, educationally, and economically

Thank you for your consideration.

Staff Report

City Council

Item No. 6.C

Meeting Date: March 22, 2023
From: George Crum, Police Chief
Title: Request 4 -year Lease Agreement with Enterprise Fleet Management

City Council

RECOMMENDATION:

To authorize, effective with fiscal year (FY 2023/2024), a lease agreement with Enterprise Fleet Management for (8) eight Police Department vehicles at an annual cost of $93,572.50 with an optional maintenance program of $5,432.04 for a total cost of $99,004.40 annually. Additionally, to authorize the installation of emergency lighting and equipment for $45,687, including tax.

BACKGROUND:

Certain law enforcement operations conducted by different units within the Police Department require the use of various makes and models of unmarked vehicles. The City has historically purchased and owned all fleet vehicles and equipment. Over the years, the Department has purchased vehicles, generally in batches, with the same manufacturer, make, and model. With an aging fleet, routine maintenance and repairs have become more frequent to keep vehicles safe and operational.

The Police Department has identified nine vehicles currently in need of replacement, with five being over ten years old. The other four vehicles are nine years old. This aging fleet has bro ught on the challenge of maintenance with the rising costs of parts and labor. For example, the current price for an oil and filter service is $116. To maintain the fleet, staff has utilized three different vendors for services. Over the last three years, the vehicle repairs and routine service cost for these nine vehicles was $34,454. An internal usage review has determined one of the nine vehicles is no longer needed and it will not be replaced, thus generating a cost savings. However, the remaining eight vehicles will need to be replaced so the Department has studied the best way to do that and achieve the best overall value.

With the price of replacement vehicles increasing yearly, staff has been reviewing avenues of cost savings and an easier procurem ent process for vehicles of various makes and models. An annual master lease agreement with Enterprise Fleet Management can be an efficient and cost -effective way to accomplish this goal.

6.C
Packet Pg. 179

Cathedral City Page 2 of 6 Printed on 3/22/2023
Enterprise works with government organizations in developing a plan for fleet operations. They identify a plan with the lowest total ownership cost through open - ended master lease agreements averaging 3-5 years.

Enterprise Fleet Management works with nearly every vehicle manufacturer to receive the lowest cost, often s ignificantly cheaper than that available to the general public.

Enterprise Fleet Management continually monitors the used car market, maximizing the resale value at the end of the leasing term.

Enterprise Fleet Management offers a low -cost maintenance option, so the overall cost of ownership is less than purchasing a vehicle outright when measuring the savings from maintenance costs. Currently, Enterprise Fleet Management provides a monthly maintenance plan costing between $55-$59 per month (depending on the vehicle).

This plan would equal a total monthly cost of $453, for an annual fee of about $5,432, for the eight proposed vehicles; significantly less than current maintenance costs. Since staff has moved from using mileage alone as a basis for determining when a vehicle needs routine service to utilizing an hours -operated model accounting for the significant time police vehicles are routinely left to idle, we can expect these vehicles will come due for service even more frequently than in the past. This is significant with the cost of one oil change being more than two times the cost of the monthly maintenance plan for any one vehicle.

Enterprise Fleet Management's maintenance plan utilizes a variety of available vendors where cars can be serviced and repaired. Currently, every major auto dealership in Cathedral City is on the preferred -vendor list for maintenance. This would allow the vehicles to be serviced in the City, reducing downtime for staff transporting cars for service.

Enterprise Fleet Ma nagement offers three options through this program at the end of the 4-year lease:
(1) The leased vehicle can be sold with the proceeds applied toward the lease of a different vehicle; or the City can elect to receive the funds back from Enterprise via check;
(2) The City can pay the remaining book value for the vehicle and own it outright; (3) The City can extend the lease and continue to make payments, eventually paying the vehicle off and taking ownership.

Notwithstanding option three, the master equity lease program is not meant to be used as a means of purchasing vehicles outright except for under unusual circumstances.

The program focuses on the leasing of cars during the agreed -upon period, which are then resold and new vehicles acquired. This is why Enterprise continually monitors the used car market, as previously mentioned, which maximizes the resale amount during the lease agreement term. This process reduces the overall cost of ownership based on vehicle value, cost of maintenance, and increas ed fuel savings with more fuel -efficient vehicles, and eventually alternative fuel vehicles being added. However, after the end of the lease, if it is determined the vehicle should be purchased that can occur . Also, leased vehicles can be bought outright at any given time without penalty under this plan.

The master equity lease program is an "open -ended" lease structure, allowing the City to replace more vehicles with less upfront capital. Below are highlights of the program:

· No mileage restrictions, no abnormal wear and tear fees, and no early termination penalties.

· The City has all rights of ownership and can equip the vehicles with aftermarket parts as necessary (for example, emergency lighting equipment).

· The scheduled rotation reduces ov erall vehicle-related costs with the ability to expeditiously phase in a more modern, fuel -efficient fleet while reducing maintenance costs.

· Leasing provides the opportunity to minimize the amount of significant capital outlays necessary for purchasin g vehicles while still being able to capitalize the lease cost

· The City would establish a more proactive fleet replacement plan to acquire vehicles more consistently.

Vehicles take up significant staff time to order, register, upfit, and eventually sell/auction. There are cost savings and efficiencies attained from having Enterprise perform those services. With the buying and selling powers of a larger fleet -specific organization such as Enterprise, it is expected the equity returned to the City from the sale would be substantially more than received by the City in typical auction sales.

Staff has researched using an equity lease agreement to evaluate its usefulness as an economical acquisition method. Staff found several similar agencies have partne red with Enterprise Fleet Management to implement fleet replacement programs with positive feedback and results. Enterprise was awarded a fleet management contract with Sourcewell, which provides government, education and nonprofit organizations with a coo perative purchasing program by managing solicitation requirements through a competitive process and offering a network of awarded contracts. The City of Cathedral City is currently a member of Sourcewell and receives the benefits of being a member.

Currently, the following organizations utilize the Enterprise Fleet Management program:

· City of Santa Ana (70+ administration, detectives, and support vehicles) · City of Westminster (90+ vehicles for all city operations) · City of Azusa (15+ vehicles for Police Department)
· City of Rialto (20+ vehicles, both marked and unmarked) · City of Barstow (various city and police vehicles)
· City of Pasadena, City of Corona, City of La Quinta, City of Downey, City of Laguna Nigel, City of Redlands, and many others.

The Po lice Department seeks to build a long -term relationship with Enterprise Fleet Management. The services supplied by Enterprise Fleet Management meet the requirements of the Police Department and will substantially reduce staff time in procuring vehicles.

DISCUSSION:

Staff is seeking authorization to enter into an agreement with Enterprise Fleet Management for a 4-year lease agreement.

Staff is requesting approval of the optional maintenance agreement in the amount of $5,432 annually (monthly estimated c ost of $453 ), which will cover all routine maintenance except for brakes and tires.

To demonstrate just one routine maintenance cost, following is a breakdown of the cost of oil changes currently charged and the breakdown if paid outright:

· Four oil changes per year x $116 = $464 per car
· Eight cars x $464 per year = $3,712 per year
· $3,712 x Four years = $14,848

Staff is requesting funds for the installation of emergency lighting/radio equipment in the amount of $45,687, including sales tax, to be installed by Dana Safety Supply.

The following yearly costs are shown below:

The annual cost per year without the maintenance plan is as follows for FY 2023/2024 through FY 2026/2027:

· Year 1 - $139,259 W/O Maintenance plan and one-time upfitting cost. · Year 2 – $ 93,572 W/O Maintenance plan.
· Year 3 – $ 93,572 W/O Maintenance plan.
· Year 4 – $ 93,572 W/O Maintenance plan
· Total $419,975 4-year cost W/O maintenance and one-time upfitting costs.

The estimated profit from the sale of the vehicles at the end of the lease is about $84,126, reducing the overall cost to $335,849.

The annual cost per year with the maintenance plan is as follows for FY 2023/2024 through FY 2026/2027:

· Year 1 - $144,691 Including Maintenance plan and one-time upfitting cost. · Year 2 - $ 99,004 Including Maintenance plan.
· Year 3 - $ 99,004 Including Maintenance plan.
· Year 4 - $ 99,004 Including Maintenance plan.
· Total $441,705 4-year cost with maintenance and one-time upfitting costs.

The estimated profit if these eight vehic les were sold at the end of the lease is about $84,126, which would reduce the overall cost to $357,579.

As an alternative, Staff also considered purchasing the listed vehicles using funds from the Equipment Replacement Fund with an estimated cost of $356,000 (not including title and registration fees). The total cost to purchase would be estimated at $402,000, including upfitting costs but not accounting for expenses incurred for maintenance during the same four-year period.

An agreement through Enterpris e Fleet Management would reduce the upfront funding needed. It is estimated that with the inclusion of the maintenance plan, the cost savings realized could be up to $102,000 through the end of the lease.

Staff has selected a variety of vehicles from dom estic automakers, to avoid the purchase of the same make and model vehicle. Vehicle manufacture rs have moved away from producing sedan style vehicles meeting the needs of law enforcement. For example, Ford only makes the Ford Mustang sedan and this year is the last year Dodge will make the Charger. This is why staff has decided for (2) two Chargers, since this was a police fleet type vehicle and emergency equipment is readily available.

Two F150 XL’s will be assigned to our Community Service Officers and assist when loading or transporting bikes and other large items. While staff has identified (9) vehicles to be removed, one vehicle is over 20 years old (2003 CNG Ford F150) and will be sent to auction due to age of the vehicle and not handled through Ent erprise.

Based upon the needs of the department, staff has determined eight vehicles for lease to best serve the department’s need, which will reduce the fleet by one.

Enterprise Fleet Management works with nearly every vehicle manufacturer to receive the lowest cost, significantly cheaper than is available to the general public. The partnership with the various manufacturers allows the city to explore Electric Vehicle options in the future. Enterprise has recently supplied the City of South Pasadena with ten Telsa Electronic Vehicles (EV’s). In 2035 state legislation requires all new vehicles being sold to be electric. The exact impact to public safety is unknown, however, the quick acquisition and forecasting of vehicle needs can be handled with Enterpri se Fleet Management.

The City’s goal is to institute a plan to acquire, maintain and efficiently replace vehicles on a regular schedule. This plan provides a finite working timeline for Department vehicles, allowing for quick sale, at the best time, and timely acquisition of new vehicles.

It is believed the long -term savings will be more significant as the program continues in the future.

FISCAL IMPACT:

With this being a lease, funding for this program will come from the General Fund’s operating budget and added as a line item to the Police Department's operating budget.

Based upon the various fiscal models shown, the current recommendation is the 4 -year lease term with the optional maintenance plan at a four-year cost of $441,705.

With each vehicle b eing its own contract, payment will not actually start for each vehicle until it is delivered. This eliminates any payment for a vehicle before the City has the ability to use it.

Since the cost would be fixed for four years, any future amount needed to c ontinue the lease program beyond that will be brought forward during future budget considerations.

6.C
Packet Pg. 183

Cathedral City Page 6 of 6 Printed on 3/22/2023
The lease term will allow staff to evaluate the program and, if proven successful, look to subsequent budget cycles for further replacement of vehicles.

With the sale of the eight existing vehicles, Enterprise Fleet Management has estimated proceeds totaling $24,000 will be reimbursed to the City and these funds will be deposited into the Equipment Replacement Fund.

EFFECTIVE MONTHLY PAYMENT ADJUSTED W ITH EQUITY: Monthly Payment Adjusted with Equity is the estimated equity at term calculated back into the payment divided by the term to show the true cost of each vehicle after resale.

ESTIMATED MONTHLY PAYMENT PER VEHICLE wTAX: Monthly Payment includes Depreciation, Interest, Management Fee, Tax, and $125 Delivery Fee which includes moving to AME vendors FULL MAINTENANCE PROGRAM (OPTIONAL): The Full Maintenance Program is a fixed and guaranteed monthly cost, which includes all preventative, unscheduled, and uncommon repairs (oil changes, engines, transmissions, alternators, etc.) and 24-hour Roadside Assistance with Towing. Brakes & Tires are NOT included.

PHYSICAL DAMAGE PROGRAM (OPTIONAL): Enterprise can provide Physical Damage Coverage. Requires an appication to quote and certain restrictions apply.

ESTIMATED EQUITY @ TERM: The estimated Equity is the Estimated Resale Value minus Reduced Book Value and $400 Service Charge. The Customer can choose to roll that equity as the down payment on the new vehicle, or Enterprise can cut a check back to the Customer.

ESTIMATED RESALE VALUE @ TERM: is a conservative commercial wholesale value. This value is based on estimates from Enterprise's Remarketing Dept and third party Automotive Leasing Guide. At term the City has the option to have Enterprise sell the vehicle through our channels to maximize the resale return. The Resale Value less the Reduced Book Value and the $400 Serviec Charge goes back to the City.

REDUCED BOOK VALUE @ TERM: Reduced Book Value is the amount that is left on the books at lease term. At this point, the customer has three options: 1) replace existing vehicle with new vehicle, 2) pay RBV plus tax and own the vehicle, and 3) continue making payments and extend the lease; eventually paying off the vehicle and taking ownership. *All leases are Open-Ended Equity Municipal Leases. Service Charge of $400 per unit is due at lease termination (netted out of the proceeds on the sale of vehicle). Detailed Vehicle Specs will be reviewed and finalized and the City can add additional aftermarket equipment if necessary (Truck **DOWN PAYMENT ON AFTERMARKET EQUIPMENT IF APPLICABLE: Aftermarket equipment, such as light bars, truck bodies, ladder racks, etc can be added into the lease/loan. Staff Report

City Council

Item No. 6.D

Meeting Date: March 22, 2023
From: John Corella, Director of Engineering/Public Works Title: Consulting Agreement with HR Green for Land Development Engineering Support

City Council

RECOMMENDATION:

To appr ove a Professional Services Agreement with HR Green, Inc. to provide Land Development Engineering Support Consulting Services and Electronic Plan Check Services for the amount of $64,000 and $30,000, respectively for not to exceed total of $94,000; and, authorize the City Manager to execute the Agreement.

BACKGROUND:

Cathedral City is still experiencing growth with new developments continually being submitted to the Development Services Department. These Projects are in the queue and moving through the planning stages. Once again, this year’s development expansion provides increased opportunities for the City.

Even though these new development projects are submitted through the City’s Development Services Department, the City’s Engineering Division is significantly involved in the pre -submittal process, submittal process, the entitlement process (Planning Commission) ; and after entitlement, the actual plan preparation, process, permitting process and construction process. Evidence of these efforts are seen on the projects that have been constructed and issued certificates of occupancy.

At this time, the Engineering Division’s support for development is being managed and performed by the Director of Engineering/Public Works (Director) and contracted pl an checkers. Recognizing that development is critical to the City , and that it does take significant hourly resources to manage and process the Engineering Division’s portion of the process, in September 2022, the City Council approved a full time Land Development Engineer into the Budget moving forward from that date.

DISCUSSION:

Since that approval date, there have been significant resources provided by the Human Resources Division to recruit for the Land Development Engineer position. A successful

6.D
Packet Pg. 217

candidate with the right qualifications has not emerged to date.

Engineering Staff has reviewed the current Development Services queue and what will be necessary to complete the current workload, as well as the volume of anticipated development projects p rojected to be submitted. It has been determined that, even if the Land Development Engineer position is filled within the next few months, there will a training period to get this new employee up to speed. This still leaves a significant gap to effectively manage and process the development projects that are either pre or post entitlement.

Proactively, Engineering reached out to HR Green, Inc. (HR Green) to see if they have a person(s) with the skill set that could provide engineering development suppor t. HR Green responded they do have a n Assistant Engineer (EIT) available for this service and can be available working minimally onsite and majority electronically offsite for up to 8 hours each week. This person is providing assistance to another local C ity at this time with minimal supervision.

Additionally, Staff asked HR Green if Tim Jonasson, PE was also available for up to 4 hours a week to provide additional support on development engineering as well . (As a reminder, Mr. Jonasson assisted the Engineering Division with CIP Management support prior to the hiring our new City Engineer and stayed on a few months to assist in the transition. That contract recently expired).

Providing more background on HR Green, HR Green specializes in supporting municipalities in situations we are experiencing , which is expansion with limited resources to adequately address the required needs. This development engineering support will be provided mainly through their Palm Desert office. HR Green’s consultant supporting the Assistant Engineer is Tim Jonasson, PE, who once was the tenured Director of Engineering/Public Works for the City of La Quinta. With HR Green, Mr.

Jonasson as a Principal Engineer, has worked with other cities in Southern California to support similar situations we are experiencing.

HR Green’s experienced personnel will allow the Director to be able to begin moving the Engineering Division’s development workload back into a more predicable process in the interim period prior to hiring a full t ime Land Development Engineer. This assistance will allow the Director to work with the developers and their respective consultants at a management level and pass this work t o HR Green , including development of a workable conditions of approval template.

HR Green is proposed to work with the Director one (1) day a week (12 consulting hours comprised of 8 hours for the Associate and 4 hours for the Principal, respectively with work to occur minimally onsite and a majority offsite. This may increase and /or decrease depending on certain milestones in various development projects being completed and others being initiated. The estimate for these services is $ 64,000 and will be paid at the hourly rates in the proposal.

Please note that Staff has asked for more available consulting hours from HR Green, in which HR Green stated they currently are not able to provide for the level of personnel needed for this service. Engineering, in lieu of having a full time Land Development

6.D
Packet Pg. 218

Cathedral City Page 3 of 4 Printed on 3/22/2023
Engineer on Staff, will continue to seek additional consulting services for this specialty.

In addition to the above, Staff is again asking HR Green to provide plan check services.

Currently, all the developer submitted plans and studies are outsourced to plan check firms supporting C ity Staff. Staff is requesting HR Green be added to the list of available consultants and bolster our existing contracted development plan check services. The estimate for these services is $ 30,000 and will be paid according to the services provided. No te: The newly adopted fee structure includes internal or external plan and study review services collected in advance of the post entitlement development process.

HR Green has submitted a proposal, which has been reviewed and is in line with current su pport services provided by similar consultants. Staff is recommending a Consulting Services Agreement be authorized for a period of six (6) months not to exceed $94,000, comprised of $64,000 for Engineering Development Support Services and $30,000 for Ele ctronic Plan and Study Review Services. The Agreement will also provide for a six (6) month extension , at an additional cost of $94,000) . Once a land development engineer is hired to the Cathedral City staff, there will be a six (6) month training/transition period in the amount of $94,000.

FISCAL IMPACT:

The FY 2022/2023 has available salary and benefit funding for the estimated $30,000 portion of the Agreement amount will be incurred during the remainder of this fiscal year. It is proposed this cost be funded from the salary savings from the unfilled Land Development Engineer position. Since the City will not incur staff labor costs, there will not be a budget adjustment for these contracted services.

For FY 202 3/2024, t o fund the engineering deve lopment support services in the pre - entitlement phase, HR Green ’s services, directly related to a development project, will be reimbursed directly by the developer from the Development Services Department’s application deposit. This is consistent with how outside services are currently paid for in this pre-entitlement phase. As a result, there will not be a budget adjustment.

After entitlement (the post entitlement process ), the 202 1 adopted plan check fees provide funding for these services. As cited i n the past, when these fees are collected, they are recognized as revenue in the General Fund. The past FY 2022/ 2023 budget did not account for paying for these services out of the General Fund Engineering Professional and Technical Services account fund, 100-156-8601. (Note: These post entitlement services are now accounted for in the upcoming proposed FY 2023/ 2024 and 2024/2025 funding for these services in the General Fund Engineering Professional and Technical Services account, 100-156-8601.)

Once the land development engineer is hired (planned for FY 2023/2024) , a budget adjustment in the amount of $94,000 will be required for the training/transition period.

Staff Report

City Council

Item No. 6.E

Meeting Date: March 22, 2023
From: John Corella, Director of Engineering/Public Works Title: 2023 SB 821 Bicycle and Pedestrian Facilities Program Funding Application

City Council

RECOMMENDATION:

To authorize the submittal of a 2023 SB 821, Bicycle and Pedestrian Facilities Program funding application for two (2) potential bike lane improvement Projects; authorize the Director of Engineering/Public Works to authorize a Task Order under the Annual Contract for Traffic Engineering Services with STC Traffic Inc., to provide engineering assistance and complete the Application(s) for the 2023 SB 821, Bicycle and Pedestrian Facilities Program funding program; and, authorize the City Manager to sign all applications/letters for the Funding Program.

BACKGROUND:

SB 821 is a discretionary program administered by the Riverside County Transportation Commission (RCTC) to fund local bicycle and pedestrian projects. The program is provided through the Transportation Deve lopment Act (TDA) and funded through the Local Transportation Fund (LTF), a ¼ percent of the state sales tax. Each year, 2 percent of the LTF revenue is made available for use on bicycle and pedestrian facility projects through the SB 821 program. On every odd-numbered year, the Commission conducts a competitive Call for Projects in which all local agencies within the County can submit applications. Eligible projects include construction of bicycle lanes, sidewalks, and Americans with Disabilities Act curb ramps, and the development of bicycle and pedestrian master plans.

The programming capacity for this cycle is $6,901,202. As such, the maximum funding request per application is $690,120 and maximum funding for each jurisdiction is $1,380,240.

This year’s Call for Projects was released on February 6, 2023, and will remain open until April 27, 2023.

The program guidelines are summarized as follows:

6.E
Packet Pg. 250

Cathedral City Page 2 of 5 Printed on 3/22/2023

• 36 months to complete a project.
• Limit 3 applications per city. For Riverside County, limit 2 application s per Supervisorial District.
• Maximum request for each application is 10 percent of current Call for Projects programming capacity.
• Total award to one jurisdiction is limited to 20 percent of current Call for Projects programming capacity.
• Project can start on July 1 of the Call for Projects Fiscal Year Cycle. e.g.:
for FY 2023/24 Call for Projects, awarded projects can start on July 1, 2023.
• Use safety question and construction readiness to settle tiebreakers.

The evaluation criteria consist of:

• Destinations Served – 14 points max, 2 points for each destination served. • Safety - 15 points max, safety enhancement features included in the project.
• Multi-Modal Access – 6 points max, added “bicycle lanes, sidewalks, and crosswalks” as eligible multi-modal elements for consideration. • Matching Funds – 10 points max, 1 point for each 5% of match provided by the local agency.
• Population Equity – 5 points max, calculated by RCTC Staff, Cathedral City receives 2 points in this evaluation criteria.

The City has had recent success with this Grant Program. The City completed the 2019 SB 821 Gerald Ford Drive Bike Lanes Striping Project with 80% participatory funding from this Program and will also be leveraging its 80% award of funds for the Cathedral Canyon Drive Side walk Gap Closures Project toward the Cathedral Canyon Drive Sidewalks and Multiuse Trail Project, one of three (3) Projects within the City/CVAG Active Transportation Program Cycle 5.

DISCUSSION:

For this 2023 SB 821 Call for Projects, City Staff has ide ntified improvements based on the prioritized strategies from the recently accepted Cathedral City Active Transportation Plan (ATP) that was funded by the Southern California Association of Governments’ (SCAG) Sustainability Program to assist Southern Cali fornia Cities in developing tangible strategies to improve mobility conditions for all people who walk, bike, and take transit. The ATP provides the framework to support safe connections between key destinations within the City, including schools, transit facilities, employment centers, parks, residential neighborhoods, and more.

City Staff has identified locations within the City that roadway safety for bicyclists and pedestrians can be improved with the assistance of outside funding. Staff has identifie d two (2) Projects to submit for funding:

1. Whispering Palms Trail from 30Th Avenue to Dinah Shore Drive.

6.E
Packet Pg. 251

Cathedral City Page 3 of 5 Printed on 3/22/2023

2. Perez Road from Cathedral Canyon Drive to Date Palm Drive.

The proposed improvements on Whispering Palms Trail, as identified in the Cathedral City AT P, is a Class III Bike Boulevard (bike route) that provides a right of way designated by signs , pavement markings and traffic calming features for shared use of the street with pedestrian and vehicles from 30 th Avenue to Dinah Shore Drive. Speed surveys, crash data, field evaluations and proximity to schools, parks, and medical facilities data are critical information for the grant application compilation. The goal is to put together a Project within the grant funding limits. This Project would add approximately two (2) miles of bike route and would require the installation of a yellow broken centerline, shared roadway bicycle markings on the pavement, additional signage and traffic calming features . Exhibit 1 attached to this report shows the extent of the proposed bike route.

The Cathedral City ATP recommends a Class IV Protected Bike Lane on Perez Road from Cathedral Canyon Drive to Date Palm Drive. This Project would add approximately 3,000 linear feet of on -street bicycle facility physically separated from vehicular traffic along each side of Perez Road. Again, the grant application would involve collecting and evaluating speed surveys, crash data, field evaluations and proximity to school or park data as critical information for the grant application compilation.

The segment of Perez Road between Cathedral Canyon Drive and Date Palm Drive does not allow on -street parking in its majority. All industrial and commercial buildings within this road segment have access or walkways provided from their own parking lots.

Installing a Class IV Protected Bike Lane on both side of Perez Road and maintaining four (4) lanes of travel (two (2) lanes in each direction) with a center turn lane, would eliminate 1,200 linear foot of existing on-street parking which represents 20% percent of the total length of curb on this road segment of Perez Road. Exhibits 2A and 2B are attached to this report and show the existing locations for on -street parking and no - parking designated areas along Perez Road.

The submittal proc ess for the SB 821 Call for Project has become more sophisticated and is typically best done by consultants having success within these programs. This, in addition to the short time window RCTC is giving in which to propose, evaluate and complete the Applications (with required data attachments) for each Project, these types of Grant applications are best left to specialists. In order to complete the scoring, estimating and overall Grant application to meet RCTC's requirements and deadlines, Staff has soli cited a task order proposal from STC Traffic Inc., to assist Staff and prepare the two 2023 SB 821 Grant applications for a not to exceed cost of $20,000.

STC Traffic Inc., is the City’s contracted on call Traffic Engineer and has a proven track record wi th over $40 million in successful projects valuation on the past Calls for Projects considering different federal and state programs. STC Traffic expertise will provide the City the best opportunity for success on these Applications.

The proposed cost wi ll include STC Traffic guiding the initial evaluation of Projects and compiling the necessary data on each Project. When all the information is collected, STC Traffic will assist the City on the submittal of the formal Project Application(s).

6.E
Packet Pg. 252

Cathedral City Page 4 of 5 Printed on 3/22/2023
This grant r equests the City declare a local match percentage that the City will commit to in conjunction with the submittal of the 2023 SB 821 grant package. One point will be awarded for each 5% match provided by the local agency, for a maximum of 10 points at a 50% match with supporting documentation of the proposed match to be included in the application.

The total cost and benefit of the proposed Projects have not been completely analyzed at this time, and a firm budgeted percentage participation amount has not been determined. Based on past grant awards, and the estimated rough order of magnitude (ROM) provided by the Cathedral City ATP, Staff is recommending, for budgeting purposes, the following City participation amounts if the Projects are awarded:

1. Whispering Palms Trail Class III Bike Route Project: The total estimated Project cost is $595,700 based on the estimated unit cost per mile provided in the Cathedral City ATP for a Class III bike route. If the Project is awarded , Staff is recommending a participation amount of up to twenty percent ( 20%) which equates to approximately $119,000 from the City’s available Traffic Safety Fund (233).

2. Perez Road Class IV Protected Bike Lane Project – from Cathedral Canyon Drive to Date Palm Drive: The total estimated Project cost is $542,210 based on the estimated unit cost per mile provided in the Cathedral City ATP for a Class IV protected bike lane. if the Project is awarded, Staff is recommending a participation amount of twenty percent ( 20%) which equates to appr oximately $110,000 of the estimated cost which would come from the City’s available Traffic Safety Fund (233).

Staff is requesting City Council authorize the submittal of 2023 SB 821 Bicycle and Pedestrian Facilities Program funding Application for the t wo (2) sidewalk and bike lanes Projects, respectively ; authorize the Director of Engineering/Public Works to authorize a Task Order under the On Call Contract for Traffic Engineering Services with STC Traffic Inc., to provide engineering assistance and com plete the Application for this 2023 SB 821 Call for Projects Funding Program; and, to authorize the City Manager to execute all required applications/letters for the 2023 SB 821 grant package.

FISCAL IMPACT:
$20,000 for STC Traffic services will be funded from the FY 2022/1023 Engineering Department Professional Services budget 100-156-8601.

Staff is recommending a City participation amount of twenty percent (20%) for budgeting purposes for each Project. The City participation amounts if the Projects are awarded are as follows:

1. Whispering Palms Trail Class III Bike Route Project: The estimated participation amount of $119,000 will be funded from City Traffic Safety Fund (233).

2. Perez Road Class IV Protected Bike Lane Project – from Cathedral Canyon Drive to Date Palm Drive: The estimated participation amount of $110,000 which would come from the City Traffic Safety Fund (233).

6.E
Packet Pg. 253

Cathedral City Page 5 of 5 Printed on 3/22/2023
The above-mentioned City participation amounts will be adjusted by the Consultant as the engineering estimates are developed for the grants.
