RIVERSIDE COUNTY TRANSPORTATION COMMISSION
TRANSPORTATION DEVELOPMENT ACT ARTICLE 3 BICYCLE

AND PEDESTRIAN FACILITIES PROGRAM ADOPTED POLICIES
Transportation Development Act Policies

1. Up to 5% of Article 3 apportionment can be used to supplement other funding sources used for bicycle and safety education programs; the allocation cannot be used to fully fund the salary of a person working on these programs.

2. Article 3 money shall be allocated for the construction, including related engineering expenses, of the facilities, or for bicycle safety education programs.

3. Money may be allocated for the maintenance of bicycling trails, which are closed to motorized traffic.

4. Facilities provided for the use of bicycles may include projects that serve the needs of commuting bicyclists, including, but not limited to, new trails serving major transportation corridors, secure bicycle parking at employment centers, park and ride lots, and transit terminals where other funds are available.

5. Within 30 days after receiving a request for a review from any city or county, the transportation-planning agency shall review its allocations.

6. Up to 20 percent of the amount available each year to a city or county may be allocated to restripe Class II bicycle lanes.

7. A portion of each city’s allocation may also be used to develop comprehensive bicycle and pedestrian plans. Plans must emphasize bike/pedestrian facilities that support utilitarian bike/pedestrian travel rather than solely recreational activities; a maximum of one entire allocation per five years may be used for plan development.

8. Allowable maintenance activities for the local funds are limited to maintenance and repairs of Class I off-street bicycle facilities only.

RCTC Policies

1. The SB 821 Call for Projects will occur on a biennial basis, with a release date of the first Monday of every other February and a close date of the last Thursday of every other April, beginning in 2015.

2. If a project cannot be fully funded, RCTC may recommend partial funding for award. To handle tiebreakers, RCTC will use, in terms of priority, the safety question first then construction readiness.

3. Agencies awarded funds will not be reimbursed for any project cost overruns.

4. Agencies being awarded an allocation will be reimbursed in arrears only upon submitting adequate proof of satisfactory project completion. Claims need to 17336.00005\43911910
Attachment 2
include: the claim form, copies of paid invoices, a copy of the Notice of Completion (NOC), and photographs of the completed project.

5. The allocated amount represents the maximum amount eligible for reimbursement.

For projects completed under the allocated amount, the agency will be reimbursed at the matching ratio as presented in the application.

6. An agency will have thirty-six (36) months from the time of the allocation to complete the project. There will be no time extensions granted unless the reason for the delay can be demonstrated. Where substantial progress or a compelling reason for delay can be shown, the agency may be granted administrative extensions in twelve-month increments at the discretion of the Executive Director.

7. Any programmed and unused Article 3 Program funds will be forfeited unless that agency can a) utilize the unused funds to complete projects that are the same or similar in scope and/or are contiguous to the approved project or b) apply the funds to a project previously submitted under an Article 3 call for projects and approved by the Commission, subject to Executive Director approval.

8. Design and construction of facilities must conform to the general design criteria for non-motorized facilities as outlined in the Caltrans Highway Design Manual.

9. Temporary facilities, projects in the bid process, or projects that are under construction will not be funded.

10. The SB 821 evaluation committee will be comprised of a minimum of five evaluators representing a wide range of interests; such as: accessibility, bicycling, Coachella Valley, public transit, and the region. Staff, consultants, and other representatives from agencies submitting project proposals will not be eligible to participate on the evaluation committee that year.

11. Following each call, staff will monitor the equity of allocations to Coachella Valley versus Western Riverside County; the allocation should be relative to what the Coachella Valley’s share would have been if distributed on a per capita basis (the percentage of funds applied for should also be taken into consideration). If the allocation is often found to be inequitable to the Coachella Valley, staff will recommend adoption of a new policy to correct the imbalance.

12. Certain costs at times associated with bicycle/pedestrian projects are not eligible when the benefit provided is not the exclusive use of bicyclists/pedestrians, such as: curb and gutter as part of roadway drainage system, driveway ramps installed across sidewalks, and where roadway design standards require a roadway shoulder width that is at least as wide as a standard bike lane.

13. For each Call for Projects, a city is eligible to submit up to three (3) applications, and the County of Riverside is eligible to submit up to two (2) applications per Supervisorial District.

14. Each application is limited to a maximum request of 10% of the current Call for Projects programming capacity.

15. Total award to one jurisdiction is limited to 20% of current Call for Project’s programming capacity.

16. Awarded agencies can commence reimbursable project activities on July 1 of the Call 17336.00005\43911910
Attachment 2
for Project fiscal year cycle. E.g.: for FY 25/26 Call for Projects, reimbursable work starts on July 1, 2025.

17. Awarded agencies have until October 1 of the Call for Project fiscal year cycle to execute the Memorandum of Understanding (MOU) with RCTC. E.g.: for FY 25/26 Call for Projects, MOUs must be executed by October 1, 2025 17336.00005\43911910

• Award a construction contract to Union Pavement Services, Inc. in the amount of $249,590 for the SB 821 Bicycle and Pedestrian Facilities program (SB 821) for Perez Road Class IV Separated Bikeway project (C08673) and authorize a twenty-five percent (25%) contingency in the amount of $62,410.00 for unforeseeable construction costs.
o Authorize the City Manager to execute the required contract documents. o Authorize the City Engineer to request bonds and insurance for the project and issue the notice to proceed.
• Authorize the City Engineer to execute a purchase order and all necessary documents, in the amount of $67,250.68, for the procurement of three hundred thirty (330) K71 bollards to be used as the physical separation for the Perez Road Class IV Separated Bikeway project.

BACKGROUND:

On February 8, 2023, the City Council formally accepted the Cathedral City Active Transportation Plan (ATP), developed with funding support from the Southern California Association of Governments’ (SCAG) sustainability program. The ATP is intended to help cities across Southern California implement actionable strategies to enhance mobility options of all users, particularly pedestrians, bicyclists, and transit riders. The plan establishes a citywide pedestrian and bicycle network, outlines safe connections between key destinations, and identifies specific infrastructure improvements to support alternative transportation modes.

On February 6, 2023, the Riverside County Transportation Commission (RCTC) issued a call for projects under the FY 2023-2024 SB 821 program. In response, engineering staff identified two projects from the ATP that would significantly improve safety for both bicyclists and pedestrians, and which met the program’s eligibility criteria. The selected projects were:
• Perez Road from Cathedral Canyon Drive to Date Palm Drive (Class IV Separated Bikeway)
• Whispering Palms Trail from 30th Avenue to Dinah Shore Drive (Class III Bike Route) In April 2023, the city submitted individual funding applications for each of the identified projects, both of which were approved by RCTC in July 2023. Following the approvals, the City Council, in August 2023, authorized funding agreements for both projects under the FY 2023-2024 SB 821 program. These agreements formalized the commitments and financials responsibilities of both RCTC and the city, based on the total estimated project costs outlined in the grant applications.

For the Perez Road Class IV Separated Bikeway Project, the total estimated project cost was $680,000. Of this amount, the city was awarded $510,000 (75%) in SB 821 grant funding, with the remaining $170,000 (25%) to be provided through a required local match.

The eligible reimbursable expenses under the SB 821 program include project administration, design, environmental review and construction.

On December 11, 2024, the City Council awarded a contract in the amount of $35,000 to STC Traffic, Inc. (STC) for engineering professional services related to the design of the Perez Road Class IV Separated Bikeway Project. STC completed the plans, specifications and estimates (PS&E) for the project on July 18, 2025.

The Perez Road Class IV Separated Bikeway project proposes an on-street bicycle facility with physical separation. The project spans approximately 0.6 miles along Perez Road from Cathedral Canyon Drive to Date Palm Drive. Planned improvements include an east-west bicycle facility that will provide a connection to major local roadways, transit, and adjacent key community destinations. The Class IV separated bikeways will include a 7-foot bike lane adjacent to the existing curb, a 4-foot horizontal buffer zone with vertical K71 flexible post delineators, spaced approximately 10 feet apart. The project also includes the application of Rubberized Emulsion Aggregate Slurry (REAS) to rehabilitate the pavement in the project area.

During the design phase, city staff, in collaboration with the STC, explored various alternatives to physically separate the bike lanes from vehicular traffic lanes to enhance cyclists’ safety and comfort. As part of this evaluation process, staff reached out to several municipalities across Southern California and within the Coachella Valley that had already implemented Class IV separated bike lanes. In addition to gathering insights from other cities, city staff also met with multiple vendors to review available products and technologies that could meet local needs.

Based on the findings from consultations and product evaluations, the decision was made to install K71 bollards as physical separators to clearly define bike lanes and enhance overall roadway safety. With the estimated cost being within the City’s informal bidding process, staff obtained three quotes for the selected bollards. This approach allows the city to secure the lowest available price and identify a separate line item for the bollard installation as part of the overall project construction.

On June 18, 2025, a community meeting was held at Meester Zebra’s, a local restaurant on Perez Road, to present the project's objectives, scope, and expected impacts. The meeting also provided an opportunity for the public to share feedback, suggestions, and concerns.

The event was well attended, with participants expressing unanimous support for the project.

Attendees offered constructive input, which was considered as the project moved into the construction bidding phase.

DISCUSSION:

Construction Bid Process
On July 20, 2025, the city advertised the invitation to bid, requesting qualified contractors to perform the scope of work described in Bid No. B24-99E, which includes the PS&E for this project.

The bid solicitation was made available to contractors for twenty-five (25) calendar days and advertised in the following locations:
• Desert Sun – published on July 20, 2025, and July 27, 2025 • PlanIt Print Works – from July 20, 2025, until August 12, 2025 • City’s Website – from July 20, 2025, until August 12, 2025 On August 12, 2025, the city received three (3) bid proposals for this project. The following table ranks each qualified bidder by the total base bid amount.

RANK CONTRACTOR AMOUNT
1 Union Pavement Services, Inc. $249,590
2 All American Asphalt $275,500
3 Pavement Coatings Company $337,350
The bid tabulation prepared by the Engineering Division is attached to this report for reference.

On August 15, 2025, All American Asphalt, the second-lowest bidder, submitted a formal protest challenging the bid submitted by Union Pavement Services Inc. (Union), the apparent low bidder. After a thorough review of the bid documents and the protest, the City Engineer determined that the protest lacked merit. As a result, the protest did not meet the threshold for reconsideration or reversal of the bid solicitation outcome.

Based on the bids received, the lowest responsive and responsible bidder who yields the lowest contract price is Union Pavement Services, Inc. from Jurupa Valley, CA.

Informal Bid Process
On July 11, 2025, city staff contacted vendors to provide quotes to purchase 330 units of K71 bollards through the informal bid process according to the city’s procurement policy.

Staff received three (3) quotes for the procurement of this product. The following table ranks each supplier by the total quote:

RANK CONTRACTOR AMOUNT
1 Zumar $67,250.68
2 SimiFast $71,542.43
3 Endoto Corp $79,175.47
Based on the quotes received, the lowest priced quote was submitted by Zumar from Tacoma, WA.

City staff recommend the City Council to authorize a total construction budget of $379,250.58, comprised of:
• Award a construction contract to Union Pavement Services, Inc. in the amount of $249,590 for the SB 821 Bicycle and Pedestrian Facilities program (SB 821) for Perez Road Class IV Separated Bikeway project (C08673) and approve a twenty-five percent (25%) contingency in the amount of $62,410.00 for unforeseeable construction costs.
o Authorize the City Manager to execute the required contract documents. o Authorize the City Engineer to request bonds and insurance for the project and issue the notice to proceed.
• Authorize the City Engineer to execute a purchase order and all necessary documents, in the amount of $67,250.68, for the procurement of three hundred thirty (330) K71 bollards to be used as the physical separation for the Perez Road Class IV Separated Bikeway project.

All work will be performed within the existing city right-of-way. Construction is expected to start in November 2025 and is estimated to be completed by January 2026.

ENVIRONMENTAL ANALYSIS:

These projects are categorically excluded under the National Environmental Policy Act (NEPA) process for federally funded projects per 24CFR58.35 (a)(1) and categorically exempt under the California Environmental Quality Act (CEQA), Section 15301 for existing facilities.
