SUBJECT: TRUCK/VAN STORAGE AD-HOC COMMITTEE
PAGE 2
BACKGROUND
Included in the City Council and City Manager goals is for City staff to evaluate sites for truck/van parking as well as its potential revenue. Staff has looked at alternatives ranging from developing a City-owned site to entering into a development/re venue sharing agreement with a separate entity.
City staff would like to keep the City Council updated on potential options. However, to allow the potential third-party entities time to review proposals internally without making commitments to the City, staff would like to request that the City Council form an ad -hoc committee to consider all options and present a recommendation to the City Council.
ISSUES/ANALYSIS
Beginning at California Government Code Section 54950, the Ralph M. Brown Act (“Brown Act”) requires that local government legislative bodies conduct government business in an open and duly noticed public meeting. However, there are specific exemptions when the Brown Act is not applicable. One of those exceptions includes ad-hoc committees.
Ad-Hoc committees have no more than two City Council members (i.e., less than a quorum), they do not have a fixed meeting schedule, they do not have continuing subject matter jurisdiction, and they are limited to a single purpose. The last feature also means that once a task is complete, the respective ad-hoc committee will dissolve.
As written above, staff is exploring options for the City Council and public to consider as truck/van storage sites. The development/revenue sharing option appears to be a viable alternative. However, to be considerate of the internal review process that organizations need to take, City staff wants to provide updates to the Council while respecting the deliberative process for other organizations.
Therefore, at the request of the City Manager, it is requested that the City Council form a Truck/Van Storage Ad-Hoc Committee. This committee will review prospective options, provide feedback to City staff, and ultimately bring back a recommendation to the City Council at a future City Council workshop (with all other options available for review). Once a recommendation is issued by the Truck/Van Storage Ad -Hoc Committee at a public workshop, then the committee will dissolve.
Therefore, to facilitate feedback and open discussion with se lected members of the City Council, it is requested that 1) the ad -hoc committee be formed and 2) that the City Council appoint two members to serve on the ad-hoc committee.
