Sec. 1303
Impasse Resolution Procedures.
(A) All disputes or controversies pertaining to wages, hours, or terms and conditions of employment which remain unresolved after good faith negotiations between the City and a recognized employee organization shall be submitted to a three-member Board of Arbitrators (the “Arbitration Board”) upon the declaration of an impasse by the City or by the recognized employee organization involved in the dispute. The Board shall consist of one representative selected by the City, one representative selected by the recognized employee organization and a third neutral panel member shall be selected by these representatives as set forth below.
(B) The representative designated by the City and the representative of the recognized employee organization involved in the dispute shall each select and appoint one arbitrator to the Arbitration Board within three (3) days after either party has notified the other, in writing, that it desires to proceed to arbitration. The third member of the Arbitration Board shall be selected by agreement between the two representatives appointed by the City and the employee organization and shall serve as the neutral arbitrator and Chairperson of the Board. In the event that the two appo inted representatives cannot agree upon the selection of the third, neutral arbitrator within ten (10) days from the date that either party has declared an impasse, either party may then request the State Mediation and Conciliation Service of the State of California Department of Industrial Relations to provide a list of seven (7) persons who are qualified an d experienced as labor arbitrators. If the two appointed representatives cannot agree within three (3) days after receipt of such list on one of the seven (7) persons to act as the neutral arbitrator, they shall alternately strike names from the list of nominees until one name remains, and that person shall then become the neutral arbitrator and Chai rperson of the Arbitration Board. The representatives shall choose a method for deciding who initiates the first strike. (C) Any arbitration proceeding convened pursuant to this Article shall be conducted in conformance with, subject to, and governed by Ti tle 9 of Part 3 of the California Code of Civil Procedure, as may be amended from time to time. The Arbitration Board shall hold public hearings, receive evidence from the parties, and cause a transcript of the proceedings to be prepared. The Arbitration Board, in the exercise of its discretion, may meet privately with the parties and mediate or med-arb issues in dispute. The Arbitration Board may also adopt such other procedures as are designed to encourage an agreement between the parties, expedite the arbitration hearing process, or reduce the costs of the arbitration process.
(D) In the event no agreement is reached prior to the conclusion of the arbitration hearings, the Arbitration Board shall direct each of the parties to submit, within such time limit as the Arbitration Board may establish, a last o ffer of settlement on each of the remaining issues in dispute. The city council should be ashamed of themselves to want to give themselves a 59% raise and extend their terms without public input. They are trying to be sneaky with our tax money. Honorable Mayor & City Council, July 21, 2026
I am here opposed to placing the measure before the voters which would dramatically increase each council members annual salary from approximately $ 64, 608 to $ 110, 127. That’ s an increase of about $ 45, 500 per year, or roughly 70% while not requiring council members to take on more responsibilities. The measure also extends the maximum amount of time council members can remain in office from eight years to twelve.
Think about what that means!
Instead of asking how City Hall can better serve the people, our city council is asking the people to provide City Hall with higher salaries and longer political careers.
That is the wrong priority.
The Chula Vista City Charter established the office of Councilmember as a part- time position, with much of the City’ s day- to- day administration already handled by the City Manager, City Attorney, and professional staff. Public service should be exactly that— service. It should not become a career built upon a gravy train of overly generous compensation and extended time in office. Serving our community should never be about enriching ourselves.
This measure should be scraped because it combines too many unrelated issues. Voters are being asked to approve a package that includes pay raises, longer term limits, labor negotiation changes, ethics provisions, and other reforms all in one measure, making it difficult to oppose individual items.

July 21, 2026 Post City Council Agenda
This measure is worse then the 2010 Bell City California corruption scandal where seven officials, including the former mayor Oscar Hernandez, former city administrator Robert Rizzo, assistant city administrator, and four city council members were convicted on graft and corruption charges, and were given sentences ranging from probation to twelve years in prison.
Yesterday our very own Ethics commission recommend scraping this measure. What makes the proposed ballot unethical and subject to state and local prosecution are the hidden clauses inserted which contain labor provisions favoring public employee unions. The proposed binding arbitration rules would strengthen unions’ leverage during contract negotiations, therefore increasing future personnel costs in the millions.
Such clauses weakening Chula Vista bargaining position in exchange for council members to achieve a self interest pay raise could be seen as corruption by
The California State Auditor,
The California Attorney General
The County District Attorney, or
The California Fair Political Practice Commission
Our community does not need a corruption scandal which is surely on the horizon if this measure is placed on the ballot. I strongly urge you to kill this proposed ballot measure. Vote for what’ s best for the City as opposed to something which fills your pockets. It’ s gonna make you proud one day. I promise you.
Thank You

City Council Members (with exception of Mayor McCann),
It is we great sadness that I feel compelled to write so critically about the proposal you feel entitled to. I can’t imagine how you can possibly justify the 59-70% increase in your salaries, or adding an additional term. And tossing or hiding it in with some other areas which should submitted for voter consideration like for our Police, is just being deceitful. We don’t need 13 different amendments in one ballot measure. When the city council was voting on this item this past Tuesday, the potential ballot measure hadn’t even gone to the city’s charter committee nor the city’s ethics committee. When asked about this measure last Tuesday the city council members were completely silent. Really disgusting and arrogant.
You no longer represent the people of Chula Vista, but only yourselves. And to not give our MAJOR even one ‘second’ to put this up for a discussion… Ny sincere hope is that you are all surprised when you lose your reelection. You don’t deserve the positon.
With much concern for this council’s ethics,

Good evening, Mayor and Council.
I strongly oppose the proposed 59% salary increase for part-time City Council members. At a time when many Chula Vista residents are struggling with the rising cost of living, asking taxpayers to fund such a significant raise sends the wrong message.
Public service should be about serving the community, not rewarding yourselves with a pay increase that many residents will never see in their own jobs.
Before considering any increase, the Council should demonstrate consistent engagement, transparency, and accountability. As someone who has also observed MTS Board meetings, I’ve been disappointed by Council member Cesar Fernandez’s apparent lack of attention during meetings. Public officials have a responsibility to be present, engaged, and focused on the people they represent. Residents deserve elected leaders who are actively listening, participating, and taking their responsibilities seriously.
This proposal undermines public trust. If Council members believe they deserve a substantial raise, they should first earn the confidence of the community through their performance; not vote to increase their own compensation.
I urge the Council to reject this proposal, and I encourage voters to remember this decision when it’s time to elect representatives who put the public before themselves.
Thank you.

Dear Mayor and Councilmember,
I cannot attend tonights meeting because of my daughters illness but I wanted to strongly object to the very consequential charter changes that are proposed for November’s election .
The strongest objection is failure of these amendments to be vetted by the Charter Review Commission (Mikey you should know better!) and the lack of public outreach and participation.
The second is the outrageous proposal to boost Councilmember’s pay by 59 percent for a part time position. If that was even a legitimate request, why would you not propose a raise for the Mayor as well. Not that I feel that is necessary; the Mayor is very well compensated. To do this at a time when many in our community are struggling to make ends meet is at best tone deaf or at worst arrogance. May I remind you all that you were

elected to serve the public, a responsibility and an honor that should always be in the forefront of your decisions. Its a privilege to serve!
While there is an argument to be made for extending term limits to allow for continuity, that again was not vetted and while lumped in with the pay raise appears to be self serving. In 2000, there was a ballot measure to increase term limits from two to three. The measure had been reviewed and recommended by the Charter Review Commission. It failed by a vote of 17,789 to 25,962.because of our citizens
Binding arbritation is a matter that should be taken up with your own bargaining units and not be influenced by outside union bosses.
In closing, the city is in good financial shape because of our citizens’ trust in the stewardship of our recourses when they overwhelmingly passed Measure P and Measure A. Please don’t abuse that trust by wasting money on sure to fail Charter changes.
Estimated costs for placing the changes on the ballot are estimated to cost between $225K to $480K. Money that could used to hire more park maintenance staff, park rangers or any number of other important positions that truly serve our beloved community.
I wish you the best this evening.

Good Morning,
While I believe everyone deserves to be paid for their work, this pay raise seems extreme. I do not agree that the solution to long projects is to prolong council terms, you need to speed up the projects. Some people just want to stay in positions of power and influence longer and I will not support it.

The Alliance notes that the City's Charter Review Commission, whose primary purpose is to evaluate proposed charter amendments, was not consulted before the proposal advanced. In addition, no community listening sessions were held to solicit public feedback. BOARD/COMMISSION/COMMITTEE RECOMMENDATION
Not applicable.
DISCUSSION
CHANGES TO APPOINTMENT PROCESS AND SEAT QUALIFICATIONS
Ordinance No. 3622 (Attachment 1) revised the appointment process for four seats on the Board of Library Trustees, Charter Review Commission, Sustainability Commission, Traffic Safety Commission, and Veterans Advisory Commission. Each affected commission now has one district-nominated seat for each City Council district, with the remaining seats continuing to be filled through the general appointment process.
For the Traffic Safety Commission only, the district -nominated seats also require the appointed member to reside in the corresponding City Council district.
REASSIGNMENT OF SEATED MEMBERS
Chula Vista Municipal Code (CVMC) section 2.25.035 provides the process for assigning existing members to revised seat designations when seat qualifications or appointment processes are modified. The City Clerk is required to propose revised seat assignments for City Council consideration, with the intent of minimizing disruption to the commission.
Reassigned members retain their existing term expiration dates. Reassignment does not extend or shorten a member’s term and does not allow a member to serve more consecutive terms than otherwise permitted.
If a seated member does not qualify for the newly assigned seat, the member may continue serving the remainder of the current term. A qualified replacement must then be appointed for the succeeding term. This issue applies only to the Traffic Safety Commission because its district -nominated seats require district residency. For the other affected commissions, district residency is not required.
METHODOLOGY FOR PROPOSED SEAT REASSIGNMENTS
To develop the proposed sea t reassignments, the City Clerk reviewed each affected commission’s current membership, including each member’s district of residence, current seat, term expiration date, and whether the seat was vacant or expected to become vacant at the end of the current term.

The analysis focused on assigning the newly district -nominated seats. Seats that remain at -large will continue to be filled through the general appointment process, which was the appointment process applicable to the currently seated members.
For the Board of Library Trustees, Charter Review Commission, Sustainability Commission, and Veterans Advisory Commission, district residency is not required. However, district of residence was considered as an initial, objective factor because it provides a ne utral connection between seated members and the new district-nominated seat structure. Considering residency for this limited purpose does not create a district residency requirement for those commissions.
Vacant seats, and seats expected to become vacant at the end of the current term, were prioritized for assignment to districts not otherwise represented by seated members, where possible. Because seats may have different term expiration dates, random drawing was used when more than one neutral assignment option was available. This avoided assigning a longer or shorter remaining term to any district or member by discretion.
The Traffic Safety Commission used a slightly different approach because its district-nominated seats require district residency. Curre ntly, only Districts 1 and 3 are represented by seated members. To minimize disruption, the proposed District 2 and District 4 assignments are members serving their second terms who are not eligible for reappointment. Where more than one assignment option was available, assignments were determined by random drawing rather than discretion. Those members may continue serving the remainder of their current terms, and their successors must reside in the assigned districts.
On July 1, 2026, the City Clerk conducted a public random drawing to resolve assignments where a neutral selection was needed. Commissioners serving on the affected commissions were invited to observe the drawing.
