EXECUTIVE SUMMARY
Clovis Landscape Maintenance District No. 1 (LMD) is comprised of 50 Benefit Zones that consist of parks, street -side landscaping, neighborhood entry monuments, roundabouts, and lighting that benefit the properties within each of the zones. The properties in each zone are assessed to provide funding for landscape maintenance and the repair and replacement of 848

monuments, lights, irrigation systems, and park amenities. Annually, City staff analyzes the revenues, expenses, and reserves of each Benefit Zone to determine assessment rates.

Pursuant to the Landscaping and Lighting Act of 1972 (Act), City Council must annually conduct a three-step City Council meeting process to approve an Engineer’s Report for the LMD and authorize the levy of assessments for the e nsuing fiscal year. On March 10, 2025, the City Council adopted a resolution initiating the annual process and ordering preparation of the required Engineer’s Report. On April 21, 2025, the City Council adopted a resolution declaring the intention to levy and collect assessments for Fiscal Year 2025/26, preliminarily approve the Engineer’s Report, and set a public hearing for June 16, 2025, as required by the Act.

In addition to the typical annual LMD process, on February 11, 2025, Clovis City Council authorized proceeding with a majority protest assessment election process in accordance with Proposition 218 (Government Code Section 53753) to consider proposed increases to the assessments in both Benefit Zone 4 and Benefit Zone 5 commencing with the Fisca l Year 2025/26 levy. Assessment ballots have been mailed to all affected property owners with instructions that they must be returned by mail by 5:00 PM on June 16, 2025, or in person by the close of the public hearing to be held at the June 16, 2025 City Council meeting. This public hearing is being held to consider all written statements and afford all interested persons the opportunity to hear and be heard concerning the LMD assessments for Fiscal Year 2025/26 and allow for the submittal of any assessmen t ballots up to the close of the public hearing. All submitted ballots will be opened and tabulated in the Police and Fire Headquarters beginning at 8:00 AM on June 17, 2025, and tabulation will be continued on June 18, 2025 if there is a need for an additional day. Any interested parties may attend and observe the tabulation. The results of the election will be reported back to Council at the City Council meeting on July 7, 2025, when the assessments for the LMD will be confirmed for Fiscal Year 2025/26.

Benefit Zone 4 includes parks located within the boundary of Benefit Zone 1 – generally, north of Herndon Avenue to Shepherd Avenue between Willow Avenue and SR-168. A map showing the properties assessed in Benefit Zone 4 is included as Attachment 1. The rates in Benefit Zone 4 have not increased since a Proposition 218 election in 2016. Currently, expenditures are exceeding revenues. It is recommended to increase the existing annual rate by $15.14/year, from $49.86/year to $65.00/year with an annual escalator based on the change in the Consumer Price Index (CPI) not to exceed 3% commencing in Fiscal Year 2026/27.

Benefit Zone 5 includes parks located within the boundary of Benefit Zone 2 – generally, south of Herndon Avenue between Sunnyside Avenue and Lo can Avenue. A map showing the properties assessed in Benefit Zone 5 is included as Attachment 2. The rates in Benefit Zone 5 have not increased since a Proposition 218 election in 2013. In 2016, 2022, and 2023, Proposition 218 elections were conducted but all failed by a very narrow margin. Expenditures are exceeding revenues, and the balance is in a deficit condition. It is recommended to increase the existing annual rate by $14.90/year, from $50.10/year to $65.00/year with an annual escalator based on the change in CPI not to exceed 3% commencing in Fiscal Year 2026/27.

AGENDA ITEM NO. 15.

BACKGROUND
There are currently 50 Benefit Zones within Landscape Maintenance District No.1. These Benefit Zones were established to provide funding for specific landscape and lighting be nefits throughout the City. The properties that receive a specific benefit from those improvements are assessed in proportion to the benefit they receive. The first six Benefit Zones cover the City’s LMD street and LMD park landscaping. Benefit Zones 1, 2, and 3 fund the City’s LMD street - side and street median landscaping. Benefit Zones 4, 5, and 6 fund the City’s LMD parks. Benefit Zones 7 through 50 are neighborhood -specific and include decorative neighborhood entries and/or decorative street lighting, a lso known as enhancement zones. Benefit Zone 11 is no longer used. Benefit Zones Southeast (SE) and Northwest (NW) are unique in that one zone funds all street landscaping, parks, and decorative features benefitting properties within these respective Benef it Zones. Benefit Zone SE is Loma Vista and is located generally south of Bullard Avenue and east of Locan Avenue. Benefit Zone NW is Heritage Grove and is located north of Shepherd Avenue.

The assessments for LMD Benefit Zones 1 through 6 do not have an annual escalation factor because not all of the properties within these zones include an escalation authority in their property covenants. The assessments for LMD Benefit Zones 7 through NW include an annual escalation factor equal to the change in the CPI plus 2%. If assessments need to increase in Benefit Zones 1 through 6, or if they need to increase more than CPI plus 2% in the other zones, it is necessary to hold a Proposition 218 election of the affected property owners. The balloting is conducted per Proposition 218. Election results are determined by a simple majority of returned ballots weighted according to the proportional financial obligation. Benefit Zones are tabulated separately, and each Benefit Zone stands on its own.

FISCAL IMPACT
There is no impact to the General Fund. Costs will be paid by the LMD.

REASON FOR RECOMMENDATION
As required by law, the City Council must conduct a public hearing to allow the public to be heard regarding the LMD assessments and assessment ballots as well as aut horize staff to proceed with the ballot tabulation process.

ACTIONS FOLLOWING APPROVAL
The ballots returned during the election process, including the ballots turned in at this public hearing, will be opened and tabulated on June 17, 2025 (and June 18, 2025, if an additional day is needed) in the Police and Fire Headquarters located at 1233 Fifth Street, Clovis, CA 93612, beginning at 8:00 AM, and the ballot tabulation is open to the public. The results of the ballot tabulation will be presented to City Council on July 7, 2025, and depending on the results, the annual assessment for Benefit Zone 4 and Benefit Zone 5 will be determined at that time with the confirmation of the LMD assessments for Fiscal Year 2025/26.
