3. USBR Water Supply. This Agreement is for both contracted long-term USBR Water Supply (Contracted Water) available to City and Section 215 or other discounted USBR water (Discounted Water). Contracted or Discounted Water may be made available to Farmers to the extent it is made available to City by USBR, and after a full supply has been provided to City’s treated water customers, Water available to Farmers may also be reduced by allocations to other wholesale customers. When the supply of Discounted Water is terminated by the USBR, City’s Contract water may be available to Farmers on an as-available basis as determined month-to-month by City. In the event USBR determines Discounted Water supply has ended, with or without timely notice from USBR, and Farmers continues to take water under this Agreement, Farmers agree to pay the higher Contract price shown below for excess water beyond the Discounted Water supply, provided City is billed the higher price from USBR. City shall use its best effort to notify Farmers as soon as City is notified by USBR of Discounted Water ending.
4. Price for Purchase Water. The price for standard contract water shall be based on the City’s cost plus $25 per acre-foot (AF). The following calculation shows March 2023 as an example. The actual price shall be updated as any of the cost components change, or any cost components are added to the City’s cost.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Adopt Resolution No. 4152 Authorizing Mayor to Execute a Temporary Water Service Contract (Section 215) with the United States Bureau of Reclamation.
Meeting Date: Thursday, April 6, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
City Council is hereby recommended to authorize the Mayor to execute an agreement with the USBR to purchase discounted water supply in the event such water becomes available.
II. BACKGROUND:
The wet winter has resulted in discounted water likely being available from the USBR in lieu of long-term contracted water. This water is called “Section 215” water. The following is the explanation of Section 215 water from the USBR.
Section 215 of the Reclamation Reform Act, Public Law 97-293 authorizes the Bureau of Reclamation (Reclamation) to provide temporary water service contracts (215 contracts) for unstorable flood flows (Section 215 water) as a result of (1) an unusually large water supply not otherwise storable for Project purposes; or (2) infrequent and otherwise unmanaged flood flows of short duration.
III. DISCUSSION:
This will be a relatively short-term opportunity with no downside to the City, except that a contract must be signed to obtain the water. This water can also be used for sale to Harris Feed Lot and Pleasant Valley Water Conveyance Partners. Section 215 water is expected to flow from April to June or until the time the USBR shuts off flows. These flows are considered extra water in addition to our contracted water we typically get any given year.
IV. ALTERNATIVES:
The alternative is to continue purchases under the standard rates on the existing agreement.
V. FISCAL IMPACT:
Based on an analysis of totalcosts for standard contract water versus totalcosts for Section 215 water, the cost reduction for Section 215 water is approximately $26 per acre foot (AF). Assuming projected purchases of 1,000 acre-feet during availability of the water, the cost savings to the city would be $26,000, making the effort to execute worthwhile.

Staff prepared an ordinance for the Planning Commission where a public hearing was conducted on March 14, 2023 and the planning commission considered the draft ordinance and adopted resolution no. 023P-002 recommending approval by the
The City Council at their March 16, 2023 meeting, introduced and waived the first reading of ordinance no. 858. .
III. DISCUSSION:
Section 9-5.126 of the Coalinga Planning and Zoning Code regulates temporary uses such as carnivals, fairs and festival events within the City. Currently the City permits carnivals, fairs and festival events that are in connection with an existing commercial uses or in conjunction with an activity of a civic organization, church, lodge, public or private school, or other such group or organization with established standards such as hours of operation, location, time limits, parking, and duration.
The proposed changes requested by the City Council was to amend the temporary use activities to be permitted in residentially zoned districts on parcels no smaller than 20 acres. Included in the ordinance are additional regulations related to hours of operation and parking.
A copy of Ordinance No. 858 is attached to this report.
Also, provided is a link to the City’s existing temporary use regulations. https://library.municode.com/ca/coalinga/codes/code_of_ordinances? nodeId=CD_ORD_TIT9PLZO_CH5STSPUSAC_ART1STSPUSAC_S9-5.126TEUS General Plan/Zoning Consistency: The proposed zoning text amendment is consistent with the general plan policies and implementation measures including zoning consistency for temporary uses when appropriate measures are taken through the application review process to protect the publics health, safety and welfare.
Environmental Determination: This text amendment has been reviewed in accordance with CEQA and staff has determined that this ordinance change would not have a detrimentaleffect on the health, safety and welfare of the community and fall under Section 15304(e) - Minor alternations to land since there will be operational regulations established and included to reduce potential impacts. Since the uses are temporary in nature and limited to four (4) occurrences per year, this would not have a permanent impact on the environment or the surrounding neighborhoods. Typically temporary uses require minor alternations of the land where no substantial permanent facilities are provided.
The following standard findings must be made for each Zoning Ordinance amendment:
The proposed Zoning Ordinance amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City.
The proposed Zoning Ordinance amendment is consistent and compatible with the goals, policies, and actions of the General Plan, and the other applicable provisions of the Zoning Ordinance.
If applicable, the site is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physicalconstraints) for the requested zoning designations and anticipated land uses/developments.
The proposed Zoning Ordinance amendment has been processed in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act.
IV. ALTERNATIVES:
Do not adopt Ordinance No. 858.
V. FISCAL IMPACT:
There may be a fiscal impact to the general fund as it relates to expanding temporary uses through the collection of additional sales tax revenue.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Discussion, Direction and PotentialAction regarding Posing to the Voters the Question of Whether the Mayor's Position should be Elected At-Large and Placing the Item on the November 2024 Election Ballot
Meeting Date: Thursday, April 6, 2023
From: Marissa Trejo, City Manager
Prepared by: Marissa Trejo, City Manager
I. RECOMMENDATION:
There is no staff recommendation. This was a Future Agenda Item requested by Councilman Adkisson.
II. BACKGROUND:
This was initially requested as a Future Agenda by Councilman Adkisson at the May 6, 2021 City Council Meeting.
At the June 3, 2021, City Council meeting, the vote was split 2-2 with the Mayor being absent.
The item then came back to Councilat the July 1, 2021, City Council meeting with a 3-2 vote to place this item on the ballot for the special recallelection scheduled for September 14, 2021.
On July 6, 2021, the City was informed its Resolution to place this item on the ballot was rejected by the County of Fresno Registrar of Voters.
Under guidance issued by the Secretary of State on July 2, 2021, after the Council voted to place this item on the ballot, the provisions of Elections Code 10406 do not apply because this gubernatorial recallelection was not called by the Governor and there is not a statute calling for a statewide specialelection.
The election was called by Lieutenant Governor Eleni Kounalakis, therefore, Elections Code 10406 does not apply and the City is prevented from consolidating the at-large Mayor election with the recall of Governor Newsom.
In August of 2021, this item then went back to the Council to ask if this item should be placed on the ballot of the November 2022 election and the item did not pass.
Councilman Adkisson has since requested this item come back to Councilas a future agenda item.
III. DISCUSSION:
Councilman Adkisson has requested this item to be placed on the agenda to discuss the at-large Mayor item being placed on the November 2024 election ballot.
IV. ALTERNATIVES:
Do not place it on the November 2024 ballot
V. FISCAL IMPACT:
Fresno County Registrar of Voters did not prepare a cost estimate since this item would be over a year away, but staff's best estimate, based on actual past election costs when Measure J was placed on the ballot during a regular election year, is $4,000 to the City's General Fund. There would also be a cost of approximately $20,000 to hire a demographer to redo the City Council District Maps as the Council would consist of 4 districts with 1 at-large Mayor.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Discussion, Direction and PotentialAction regarding Filling an Anticipated City Council Vacancy for District One (1)
Meeting Date: Thursday, April 6, 2023
From: Marissa Trejo, City Manager
Prepared by: Marissa Trejo, City Manager
I. RECOMMENDATION:
Councilman Adkisson requested a future agenda item to discuss filling his District One (1) City Council seat upon his anticipated resignation.
The staff recommendation is for the Council to appoint someone into the position rather than holding a costly specialelection.
II. BACKGROUND:
Councilman Adkisson shared that he intends to resign from Coalinga City Council in, or around, mid-June 2023.
III. DISCUSSION:
This item on the agenda allows Council to discuss plans to fill the anticipated vacancy on the City Council, provide direction and/or take potentialaction.
Council may:
1. Hold a specialelection (not recommended);
2. Appoint a community member who meets the requirements for living in District One (1).
Should Councilchoose to appoint a community member, Council may choose to:
1. Advertise for a set period of time and consider any memos of interest submitted;
2. Make nominations;
3. Ask any interested person to attend a Council meeting and publicly state their interest;
4. Any combination of the above.
IV. ALTERNATIVES:
There really is no alternative. The Council seat will need to be filled if vacated. This item simply allows Council to discuss, direct and take potentialaction on filling the vacancy once it arises.
V. FISCAL IMPACT:
Depends on how the Councilchooses to fill the seat.
