STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Adopt Resolution No. 4162 Annual Gann Appropriation Limit for FiscalYear 2023-2024
Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Mai Vang, Financial Services Director
I. RECOMMENDATION:
Financial Services Director recommends Counciladopt Resolution No.4162 to establish the Gann Appropriation Limit for the FiscalYear ending June 30, 2024, in the amount of $11,388,636.
II. BACKGROUND:
In 1979, the voters of the State of California approved Proposition 4, commonly known as the (Paul) Gann Initiative. This Proposition created Article XIII B of the State Constitution placing limits on the amount of Tax revenue that can be spent by governmentalentities. Under the current guidelines, our Gann Appropriations Limit grows each year by a formula tied to cost of living factor and population growth provided by Department of Finance on an annual basis.
III. DISCUSSION:
For FiscalYear 2023-2024, the state cost of living factor of 4.44% was used to compute the appropriation limit. The population growth in Fresno County was 0.15% while growth in City of Coalinga was -0.54% as provided by Department of Finance for May 2023. The City has the option of which population factor to use in the Limit calculation. Generally, the larger population factor is used to provide the maximum Limit allowable.
The City of Coalinga Tax revenues are $3,323,882 below the calculated Appropriation Limit meaning there is no impact to the City.
IV. ALTERNATIVES:
The Gann Appropriations Limit calculation is mandated by California Constitution. There is no alternative.
V. FISCAL IMPACT:
Based on the calculation, there is no fiscal impact to the City of Coalinga.

The Road Repair and Accountability Act and Further Authorizing a Budget Expense in the Amount of $446,621.00 to Execute the List of Projects Funded by SB 1 in the 2023/2024 FiscalYear
Meeting Date: Thursday, May 19, 2022
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
City CouncilApprove Resolution No. 4159 Approving a List of Projects to be Funded by SB 1: The Road Repair and Accountability Act and Further Authorizing a Budget Expense in the Amount of $446,621.00 to Execute the List of Projects Funded by SB 1 in the 2023/2024 FiscalYear II. BACKGROUND:
Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 in order to address the significant multi-modal transportation funding shortfalls statewide. The new transportation bill will generate $54 billion over the next decade, split between state and local agencies.
III. DISCUSSION:
SB 1 includes accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year. The City must include a list of all projects proposed to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, in the City budget, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement.
The City is expected to receive $446,621 in RMRA funding in Fiscal Year 2023/2024 from SB 1 and is recommending using the funds and future funds for the City's annual road repair and maintenance efforts through completing the following project:
Cherry Lane – Elm to Falcon Lane
This project has been under design for the past 6 months and proceeding to construction in summer of 2023 and since this has overlapped SB1 implementation periods, staff would like to use SB1 funds for the entire project and reserve the local funds for other projects in the pipeline.
IV. ALTERNATIVES:
None - this action is required under SB 1 in order to utilize the finding allocated to the City of Coalinga.
V. FISCAL IMPACT:
The City is expected to receive an estimated $446,621 from the Road Maintenance And Rehabilitation Account funds to support the City's annual road and rehabilitation efforts. This new funding must be used on street related project implementation.

II. BACKGROUND:
This was requested as a future agenda item by Councilman Vosburg to amend the design guidelines for the City of Coalinga to require city review and approval of such improvements on undeveloped sites or for the expansion of a site and/or use.

Such new improvements could include, but not be limited to, grading, paving and fencing. Other improvements would be a the discretion of the City as to constituting "site improvements"
IV. ALTERNATIVES:
Do not adopt Resolution No. 4163 - staff does not recommend.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Waive Second Reading and Adopt Ordinance No. 860 related to Distance Requirements for Smoke Shops from Sensitive Uses
Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
City CouncilApproval of a Zoning Text Amendment (ZTA 23-02) Amending the Planning and Zoning Code Related to Smoke Shops and Waiving the Second Reading and Adoption of Ordinance No. 860 II. BACKGROUND:
The City Council directed staff to work with the Planning Commission to establish distance requirements for smoke shops and hotels/motels from sensitive receptors such as schools, parks, and residential uses. The Planning Commission conducted two meetings to discuss establishing a definition for smoke shops in addition to establishing a distance requirement from sensitive uses.
On May 9, 2023, the Planning Commission conducted a noticed public hearing to consider zoning text amendment ZTA 23-02 and adopted resolution 023P-005 recommending approval of Ordinance No. 860 by the City Council.
On May 18, 2023, the City Council held a public hearing, introduced and waived the first reading of Ordinance No. 860.
III. DISCUSSION:
Staff prepared an ordinance that establishes a definition for smoke shops and distance requirements from sensitive uses. The definition and distance requirements have been formulated to be similar to how the City regulates establishments that sellalcohol such as liquor stores and bars.
Definition: Smoke Shops. An establishment selling smoking, and/or traditional or electronic tobacco paraphernalia or products where 25 percent (25%) or more of the total floor or shelf area is devoted to selling tobacco products. Limited sales of tobacco products that commonly occur within convenience stores or service stations are not included in this definition. Smoking shall be prohibited within all smoke shops, unless the establishment has been formally permitted to operate as a tobacco bar under applicable state and local laws.

Environmental Review: Staff finds and determines that there is no possibility the adoption of Ordinance No. 860 will have a significant effect on the environment as it will be establishing distance requirements from sensitive receptors further reducing impacts to surrounding properties. Accordingly, under the provisions of § 15061 (b)(3) and § 15378(b)(5) of Division 6 of Title 14 of the California Code of Regulations, the CEQA Guidelines, the adoption of this ordinance is not subject to the requirements of the California Environmental Quality Act.
The following standard findings must be made for each Zoning Ordinance amendment:
The proposed Zoning Ordinance amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City.
The proposed Zoning Ordinance amendment is consistent and compatible with the goals, policies, and actions of the General Plan, and the other applicable provisions of the Zoning Ordinance.
If applicable, the site is physically suitable (including, but not limited to access, provision of utilities, compatibility with adjoining land uses, and absence of physicalconstraints) for the requested zoning designations and anticipated land uses/developments.
The proposed Zoning Ordinance amendment has been processed in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Authorize City Manager to Execute a Contract with Superior Court of California, Fresno County, to provide Available Court Connection and Electronic Support Services (ACCESS) in the City of Coalinga
Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Mercedes Garcia, Senior Administrative Analyst I. RECOMMENDATION:
City Manager recommends the approval of a contract with Superior Court of California, Fresno County, to provide Available Court Connection and Electronic Support Services (ACCESS) in the City of Coalinga.
II. BACKGROUND:
In early 2013 the Superior Court of California, Fresno County selected the City of Coalinga as a Remote Video Proceedings (“RVP”) location. The program was developed as a way to help service Fresno County residents living outside Fresno City limits. As part of the RVP project, the City was responsible for providing the location, physical materials and electronic equipment needed to conduct remote video proceedings for traffic court. The court provided a court staff person to coordinate the proceedings, operate the Remote Video Proceedings equipment, and perform basic courtroom activities. The court also covered the monthly cost of the Court Call video teleconferencing service.
On March 3, 2021 Council approved entering into a three year contract. The RVP program has worked well and the City renewed the contract each time it has been up for renewal.
III. DISCUSSION:
After six years of successful RVP operations in Coalinga, Fresno Superior Court would like to expand services provided through RVP in Coalinga. In addition to remote hearings, the court will be providing selfhelp services for traffic questions through video conferencing. Residents of Coalinga and surrounding communities will be able to submit forms, ask questions, and appear for a traffic trial from the comfort of the Coalinga City Hall.
Through the new partnership, the City would need to hire a part-time Office Assistant to staff the site for four hours per week on Wednesdays, and court staff will remain in Fresno. The Court would include financial support of $100 per week for ACCESS which would cover the cost to the City.
IV. ALTERNATIVES:
Do not authorize the City Manager to execute a 5-year Agreement Available Court Connection and Electronic Support Services (ACCESS) - Not recommended
V. FISCAL IMPACT:
The Superior Court of California, Fresno County would pay $100 per week for services provided to ACCESS for a maximum amount of $5,000 per year which is expected to cover the City's costs.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Authorize Assistant City Manager to Enter into a Construction and Reimbursement Agreement with Coalinga Huron Unified School District related to the Cherry Lane Reconstruction Project
Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
Staff is requesting Councilauthorization to allow the Assistant City Manager to enter into a construction and reimbursement agreement with the Coalinga-Huron Unified School District related to work that will be performed on CHUSD property as part of the Cherry Lane Reconstruction Project.
II. BACKGROUND:
The City is currently in design for the Cherry Lane improvements between Elm Ave and Falcon Lane and expected to go out to construction this summer. During the course of design staff felt that it would be beneficial to incorporate the area of asphalt west of Cherry Lane that is located on CHUSD property which has deteriorated to a state of disrepair similar to that of the rest of Cherry Lane. Staff spoke with the school district about incorporating some additional work within their property and they expressed interest in partnering with the City on their portion (approximately $60K - see attached estimate with exhibit).
III. DISCUSSION:
In order to accomplish the work and ensure reimbursement from the CHUSD for their portion of the project, the City Attorney drafted a construction and reimbursement agreement that will need to be executed between the School District and the City. STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Consideration of Bid Award for the Pleasant Avenue Water Main Replacement Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
It is recommended that the Coalinga City Council waive the first three pages of the Project Specifications Section 00410 Bid Proposal is required for the award of the bid proposal of this project for all bidders, and the Coalinga City Council approves that the Addendum No. 6 (total of one page) supersedes the Project Specifications Section 00410 Bid Proposal (total of three pages), as stated on Addendum No. 6, and follow procedures to award the apparent lowest bidder.
It is also recommended that the Coalinga City Council award a Contract in the amount of $662,041.00 to DG Construction, Inc., 1576 Menlo, Clovis, CA 93613 for the Pleasant Avenue Water Main Replacement Project.
It is also recommended that a contingency of 10% ($66,204.10) be included in the Council action to cover any unforeseen incidentals for a total authorization amount of $728,245.10.
II. BACKGROUND:
In May 2022, the Coalinga City Council directed staff to prepare engineering plans and specifications and authorized a call for bids for the Pleasant Avenue Water Main Replacement Project. The primary scope of work, BASE BID is to reconstruct approximately 2,631 linear feet of a City Water Main on Pleasant Avenue located between Louisiana Street and South Hachman Street in Coalinga, CA. The work consists of, but is not limited to: saw cutting, abandoning of existing 4” main and service laterals, removal and replacing of fire hydrant assemblies, construction of new 8” water main, 1” service laterals, and all associated connections and appurtenances, restoration of AC pavement, curb and gutter, and sidewalk, and water main disinfection and pressure testing.
III. DISCUSSION:
City Staff received and opened six bids for this project on May 16, 2023, at 2:00 p.m. DG Construction, Inc., was the apparent low bidder with a total bid proposal of $662,041.00. The Engineer’s Estimate was $669,448.25. The entire bid summary is included as Attachment “A”. DG Construction, Inc., has furnished the required bid bond.
City Staff received one bid protest from JT2 Inc. dba Todd Companies (Todd) on the basis that DG Construction submitted incomplete bid documents. However, as stated on the latest addendum, Addendum No. 6 (total of one page) supersedes the Project Specifications Section 00410 Bid Proposal (total of three pages). DG Construction submitted Addendum No. 6 (total of one page) and did submit a complete bid document.
If the City Council decides to award the project to DG Construction, Inc., and the “Notice to Proceed” is issued, the contractor will have 30 working days to complete the work. The following is a tentative schedule:
Award of Contract: June 1, 2023
Start of Construction: June 26, 2023
Completion of Construction: August 1, 2023
IV. ALTERNATIVES:
The alternative to this councilaction would be to reject all bids. If all bids are rejected, the City would have to re-advertise or cancel the project. Staff believes that re-advertising the project will not result in lower bids.
V. FISCAL IMPACT:
Total authorization request for this contract is $662,041.00 with an additional 10% contingency of $66,204.10 for a total of $728,245.10. This project is funded by 2020 bond proceeds. There will be no fiscal impact to the General Fund.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE
AUTHORITY
Subject: Presentation and Discussion related to the Draft Cycle 6 Multi-Jurisdictional Housing Element
Meeting Date: Thursday, June 1, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:
Receive presentation from the City of Coalinga's consulting team of the public review draft MultiJurisdictional Housing Element and Receive input from the Planning Commission prior to submittal to the State Department of Housing and Community Development (HCD).
II. BACKGROUND:
The Housing Element is a state required element of the General Plan and is required by law to be completed every 8 years. There are defiantly benefits to making sure the housing element is completed each cycle and intime such as eligibility for grant funding. Unfortunately, the consequences for inaction reach far and the state has issued specific guidance to Cities on the consequences of falling short in adopting or otherwise complying with housing elements. This ranges from legal suits, loss of permitting authority, financial penalties and court receivership.
In April 2022, the City Council authorized staff to participate in the Fresno County Multi-Jurisdictional Housing Element similar to the approach taken in the 5th planning cycle of housing elements.
III. DISCUSSION:
Placeworks has been retained by the participating jurisdictions to complete the 6th cycle housing element.
They will be providing a presentation of the draft element to the Planning Commission and anyone in attendance to gather feedback and input prior to submitting the draft to HCD for review.
A copy of the draft Housing Element was circulated for public review on May 10, 2023. A copy of the notice availability has been attached to this report with the locations where a physicalcopy may be accessed or a link to the electronic version.
