STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Approve Comprehensive Fee Schedule for the Consumer Price Index (CPI) Update effective January 1, 2024
Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Mai Vang, Financial Services Director
I. RECOMMENDATION:

Financial Services Director and City Manager recommend the approval of the Comprehensive Fee Schedule for the annualconsumer price index (CPI) update effective January 1, 2024 as approved by Resolution No. 3789 on January 4, 2018 for development and other miscellaneous services.

II. BACKGROUND:

A fee is a charge imposed on an individual or business for a service that the individual or business chooses to receive. A fee may not exceed the estimated reasonable cost of providing the particular service or facility for which the fee is charged, plus overhead. Examples of fees included building permits, copy charges, and fire plan check fees.

Proposition 4, 13, 26, and 218 have placed both substantive and procedural limits on cities' ability to impose fees and charges. Collectively these constitutionalamendments provide safeguards against taxes being imposed with a vote of the people.

Proposition 26 contains a more generalarticulation of the cost of service principle which includes a requirement that the local government bear the burden of proof that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to recover the reasonable costs of the government activity, and that the manner in which those costs are allocated to a customer bear a fair or reasonable relationship to the customer's burden on, or benefits received from, the governmentalactivity.

In 2017, a service cost study was performed by Willdan. The intent of the study was to determine the following in regard to those services:

1. What does it cost the City to provide these services?

2. What fee changes are necessary to achieve the City's policies on cost recovery? The primary purpose of this review was to fairly and equitably set fees for the costs of providing such essential services to the individuals or organizations operating within the city proper. The goal is to neither make a profit on nay service, nor unintentionally subsidize any fee-oriented area. The fee only applies to the individuals or organizations who requested for the service, as opposed to the public at large. It is generally accepted that recovery of costs should be in directly proportion to the individual/specific gain for services received. For example, private development activity that benefits specific individuals generally is expected to pay fees that reflect 100% cost recovery. There are circumstances and programs which typically justify a subsidy such as youth, senior, and library services. The cost of these services is subsidized while the user receives benefits for which he or she does not fully pay.

Willdan developed a cost model based on "fullcost," which includes direct and indirect costs, including support costs from other departments. Direct costs include salaries and benefits attributed to each service.

Indirect costs are not readily identifiable with a direct operating program but rather, are incurred for a joint purpose that benefits more than one cost objective. Indirect costs include accounting, legal services, human resources and building maintenance.

III. DISCUSSION:

Resolution No. 3789 passed on January 4, 2018 provided authorization to the City to adjust the fees based on the San Francisco area annualconsumer price index (CPI) annually every January 1st. The Fresno area annual CPI is 3.3%, which is .5% higher than the recommended rate.

Due to timing and availability of the CPI factor, staff is requesting to use the annualized CPI factor between the months of October to October to become effective every January 1st. The CPI factor used for the 2024 Fee update is 2.8% increase over October 2022 to October 2023.

IV. ALTERNATIVES:

Not approve the fee schedule and keep current fees in place.

V. FISCAL IMPACT:

Revenues generated from the proposed fees are unable to be determine at this time due to the unknown variable of the volume of these services to be provided in the current fiscal year and upcoming years.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Approve Purchase of a New Ambulance from Emergency Vehicle Group (EVG) Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Greg DuPuis, Fire Chief
I. RECOMMENDATION:

Fire Chief recommends approving the attached purchase order from Emergency Vehicle Group (EVG) for one (1) new Wheeled Coach Medium-Duty Type I Freightliner M2 Ambulance.

II. BACKGROUND:

We currently have (6) Wheeled Coach light-duty ambulances that make up the bulk of our fleet. Except for the one ambulance purchased in 2023, by the City of Huron, four (4) ambulances have excessively high mileage and continue developing increasing mechanical problems. Due to such a significant contrast between light-duty ambulance call reliability and high maintenance/repair costs of the higher mileage ambulances, in the past we have rendered older light-duty ambulances surplus and dispose of them at 300,000 miles.

1. 2019 Ford F450 – 216,195 miles

2. 2019 Ford F450 – 226,394 miles

3. 2016 Ford F450 – 323,670 miles

4. 2016 Ford F450 – 320,463 miles

5. 2022 Ford E350 – 29,785 miles

6. 2023 Ford F450 – 1,500 miles
With the addition of a per-diem ambulance, we now have all 4 ambulances being staffed daily (3 Coalinga, 1 Huron). This provides us with unreliable back-up units, should any mechanical issues cause an ambulance to be out of service. By purchasing this ambulance, we will maintain our current level of service, which includes the need for a back-up unit with no loss in maintaining our daily staffing. Additionally increasing to a medium-duty chassis willextend overall the in-service life expectancy of the ambulance by two to three times over the current light-duty chassis. The maintenance service intervals are also increased by three times (from 5,000 miles to 15,000 miles) which decreases our maintenance costs and out of service times.

III. DISCUSSION:

EVG has been a supplier of ambulances to Coalinga Fire for the last four purchases and have met or exceeded our expectations. We would like to continue to use EVG as our sole source provider of emergency equipment. EVG has informed us that as of November 1, 2023, the lead time for an ambulance build has increased from 12-18 months to 24 months, minimum. This is due to decreased chassis availability as wellas parts and components delays, resulting from the continued nationwide back log caused from COVID19, shipping restrictions and auto/industry labor relation conflicts. EVG has NO ambulances available for immediate purchase and continually receives requests for future ambulance build reservations. In addition, the cost of a new ambulance and equipment is expected to increase an additional 10% on January of 2024. By not approving this purchase we may have to wait two (2) years or more to replace a 2016 ambulance and pay an exponentially increasing amount of funds.

The previous bid in 2022 included new gurneys and loading mechanisms, which meet DOT recommendations for rollover safety. Radio communication equipment will be included in this request, as the previous did not, eliminating the need for additional purchases and lead times.

IV. ALTERNATIVES:

1. Do not replace one of the current 2016 ambulances.

2. Purchase F450 ambulance for $414,202.31 (not recommended).

V. FISCAL IMPACT:

The cost of purchasing the new ambulance, including the gurney, loading mechanism and radio communication equipment is $468,463.14 and can be purchased from IGT funds we will have available from the FY 2025/2026 budget. The purchase will have no impact on the current adopted budget or the General Fund.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize Police Department to Purchase 5 APX Next Handheld Radios Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Young, Police Commander
I. RECOMMENDATION:

Police Chief is recommending and seeking authorization to purchase 5 more APX Next handheld radios using the Police Departments COPS Grant funding.

II. BACKGROUND:

The Police Department currently has 20 APX Next radios for its officers. With the additions of 2 full time positions, 2 full time positions from the recent BCSS Grant, and a non-paid reserve position, the department will not have enough radios to issue that will work with the upgraded radio system.

III. DISCUSSION:

Staff has been working with its radio vendor, J's Communication in Fresno, to obtain a quote from Motorola to purchase the additional radios. Motorola has provided a quote for $34,706.72 for 5 APX Next radios.

This is a heavily discounted price that Motorola provided to help put the department in a position to be able to afford this needed equipment. There is an annual program subscription fee of $223.55 for years 2 and 3.

After that the programming fee will be reassessed.

The Police Departments COPS Grant willcover the one time cost for the radios and related programming subscription costs so it will not effect the general fund.

IV. ALTERNATIVES:

Councilcan deny this purchase but that will leave any officers in excess of 20 without a compatible radio.

V. FISCAL IMPACT:

The totalcost to purchase the 5 APX Next radios is $34,706.72. The second and third years following the purchase there will be an annual program subscription fee of $223.55. These costs will be paid using the Police Departments COPS Grant fund so there will be zero impact on the general fund.

APX NEXT RADIO SOLUTIONS
Overview
APX NEXT is Motorola Solutions’ next-generation P25 platform purpose-built for first responders to access and act on information while maintaining focus in critical situations. Across all aspects of the radio experience—deployment, operation, maintenance, and evolution—APX NEXT brings critical advancements to usability and performance. Equipped with broadband, LTE, Wi-Fi, Bluetooth 5.0, and GPS capabilities, APX NEXT extends future-ready performance, applications, and full interoperability to the field and control room to transform accurate data into smarter action.

Key benefits of the APX NEXT include the following:
• SmartTouch Experience – Easier operation centered around a redefined 3.6” impact resistant touch display and shallow menu hierarchy. This cleaner and more intuitive visual layout increases the usability of the APX NEXT radio and helps users find the information they need without pause or distraction.
• Ruggedized, Ergonomic Design – Increased personnel safety and efficiency with an improved T-Grip ergonomic design, full-color top display, and tactile knobs for efficient use in emergency situations.

Patented touch technology enables for reliable gloved use, while also making the screen immune to false actuations from water, snow, ice, or debris. The APX Next device meets the same MIL standards for ruggedization achieved by Motorola Solutions’ APX platform radios. • Easy Fleet Management – Easier and quicker radio provisioning, remote software updates, and streamlined management reduce downtime and support control center staff. Motorola Solutions’ Device Management Services (DMS) maximize the effectiveness of APX NEXT, reducing maintenance risk, workload, and total cost of ownership. DMS brings RadioCentral (RC) programming to APX NEXT, as well, supporting faster provisioning and deployment to get devices in the hands of responders and out into the field.
• Secure Communications – Hardened End-to-End security allows only authorized units in the system to listen to transmissions. Real-time security provides seamless protection from the device and data in transit to the cloud and the LMR system
Evolving with Applications Services
APX NEXT Application Services enhance device capabilities and improve user experience. These applications are subscription-based offerings for easier optimization and scaling to meet evolving needs.

SmartConnect
First responders need to know that they are covered and supported with critical intelligence no matter where the mission takes them. The SmartConnect application keeps users connected and maintains critical LMR features through a broadband connection by extending Land Mobile Radio (LMR) networks for voice and data coverage outside normal LMR service areas. By seamlessly switching between P25 LMR and LTE cellular networks, SmartConnect extends reliable PTT communications as radio users roam onto supported broadband networks. Authentication, status, talkgroups, and encryption are all preserved automatically, without interruptions or resets to ensure that end users continue to have access to the critical features they need in emergency situations.

network and CommandCentral Aware integration, SmartLocate can quickly send GPS coordinate updates and location information from the field to dispatchers to create a more effective operating picture of any situation. This gives dispatchers a greater ability to manage incidents and efficiently dispatch available units with confidence that resources are allocated where necessary. Access to CommandCentral Aware is not included with a SmartLocate subscription.

SmartProgramming
Leveraging DMS and RadioCentral provisioning capabilities, the SmartProgramming application allows APX NEXT radios to be updated anywhere within an agency’s local LTE network coverage area. APX NEXT devices no longer need to be tied to a computer via USB cable, limited to WiFi network coverage, or gated by Land Mobile Radio (LMR) bandwidth. SmartProgramming allows the APX NEXT device to take advantage of LTE broadband data speeds to pull programming jobs from RadioCentral devices in minutes.

SmartMapping
The SmartMapping application provides precise and accessible location information for field users on APX NEXT’s modernized map interface, improving situational awareness and informing response. Users can see their own location and the location/status of other officers at a glance and immediately tap to communicate with these personnel. SmartMapping streamlines engagement by providing access to the application directly from the APX NEXT radio’s home screen to best support users wherever the mission takes them.

Re: Addendum 5 to the Municipal Advisory Agreement dated June 1, 2020 by and between the City of Coalinga (“City”) and Wulff, Hansen & Co. (“Municipal Advisor”) Dear Ms. Trejo:

The purpose of this Amendment Letter #5 (the “Letter”) is to set forth and document changes to Addendum 5 to the Municipal Advisory Agreement with the City dated June 1, 2020. In the Municipal Advisory Agreement referenced above, the City agreed to retain Wulff, Hansen & Co. to provide certain financial advisory services for the City. The services to be provided by the Municipal Advisor for each financing or other advisory project contemplated were to be provided pursuant to an Addendum describing the specific scope of services, the fee to be charged, and the date upon which the Addendum would terminate.

In order to allow Municipal Advisor to continue providing services under Addendum 5 to the Municipal Advisory Agreement after December 31, 2023, Municipal Advisor and the City, by this Amendment Letter #5, wish to extend the termination date of Addendum 5 to the Municipal Advisory Agreement to December 31, 2024.

Addendum 5 was entered into as a replacement for previous Addenda 1 and 3, whose scope of work included extra services relating to the solar project (review of JCI savings assumptions, etc.) payable upon signing of the Project Development Agreement with the City’s preferred vendor. However, the City had executed the vendor contract without requesting or receiving any of the services it had contracted to receive from us prior to execution. Therefore, when Addendum 5 replaced Addenda 1 and 3 it removed those services and reduced our fee commensurately, a reduction of $7,000.

Recently, the City has requested that we deliver a similar set of contract-related services (review and negotiation of savings assumptions, structure, etc.) in connection with the vendor contract it has already executed. Therefore, both parties now wish to amend the Addendum to reflect the fact that the City has added back to the scope of work many of the services previously removed. Consequently, in order to allow Municipal Advisor to be fairly compensated for its additional work and time, this Amendment Letter #5 shall increase Municipal Advisor’s contingent fee from $57,500 to $62,500, an increase of $5,000.

All other terms of the original Addendum 5 shall remain unchanged and in full force and effect until the new termination date of December 31, 2024.

A copy of the Municipal Advisory Agreement, and Addendum 5 thereto are also attached to this Letter for your reference. Please sign a copy of this Letter agreeing to the terms of this change to the termination date of the Municipal Advisory Agreement.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize Police Department to Enter into a Contract with Permitium, LLC For It's CCW and Livescan Services
Meeting Date: Thursday, October 5, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Young, Police Commander
I. RECOMMENDATION:

Police Chief and Commander are requesting authorization to enter into a contract with Permitium, LLC to assist with the payments and issuance of Concealed Carry Weapons (CCW) licenses and payments and appointments for Livescan fingerprinting by using their Permit Director Program.

II. BACKGROUND:

Currently, the Police Department is only making appointments for both CCW applicants and Livescans via telephone. Payments for both must be made by cash or check, as the Police Department is not set up to take credit card payments. CCW permits are currently completed manually via typewriter and if a mistake is made, a new one must be started. CCW applications either need to be picked up in the lobby of the Police Department and filled out by hand or printed off the City’s website and filled out by hand.

III. DISCUSSION:

Permitium, LLC offers a program that will allow several improvements to our current process for both CCW’s and Livescans. It will allow appointments to be made online with are then followed up with reminder emails / texts for the appointment sent from the program. It will allow for online tracking of an appointment and allow a person to follow the process, whether it’s up to their appointment or throughout the CCW process. The Program Director program will allow CCW applications to be completed and submitted online through their secure system.

Permit Director will then allow the Police Department to print the CCW permits, as well as a new CCW ID card, which will include a photo of the licensee. Many other departments are using this program, including the Fresno County Sheriff's Office, Fresno Police Department, Sacramento County Sheriff’s Office, Santa Clara County Sheriff's Office, and the San Joaquin County Sheriff’s Office.

The program will increase the cost of the process for those applying and using it. There will be the normal City fee for the service, plus a service fee of $5 and if a credit card is used, a standard credit card fee of $0.30 plus 3.3%. These costs will be paid by the person needing the service and not the City. The service fee will be used to offset the monthly cost of the program.

IV. ALTERNATIVES:

Do Not Authorize Police Department to Enter into a Contract with Permitium, LLC For It's CCW and Livescan Services
V. FISCAL IMPACT:

The cost of the Permitium Permit Director program is $250 per month, or $3,000 annually. With the $5 service charge for each use, the Police Department will need to conduct about 600 applications, either CCW or Livescan, in which a credit card is used, to pay for the program and make it a zero-cost item to the general fund.

Currently the Police Department charges about $29 for rolling fees for Livescan, meaning the department would need to do about 104 Livescans annually to pay for the program. Currently between Livescans and CCW applications, the department surpasses that number so if the $5 service fee from Permitium does not cover the cost, the rest can be paid using the service fee the City charges, for a minimalcost to the General Fund.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize Police Department to Purchase Two New Patrol Vehicles Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Sean Young, Police Commander
I. RECOMMENDATION:

Police Chief and Police Commander recommend the purchase of 2 new patrol vehicles using COPS Grant funding.

II. BACKGROUND:

The police department is in need of purchasing new vehicles to supplement its existing fleet. The current fleet consists mainly of Dodge Chargers for patrol officers, the newest one being a 2015. The current fleet is in current need of repair due to the age of the vehicles.

III. DISCUSSION:

With recent times being what they are with the equipment needs of agencies, finding police vehicles has been difficult and our normal vendor, Wondries Fleet Group, has been unable to find vehicles, and Enterprise Fleet Management has been unable to fulfill vehicle orders properly and has not been able to secure any police interceptor models. Finding equipment for the up-fitting of the vehicles is just as difficult and there is, on average, a 6-month wait to get the equipment in.

Staff has found companies with vehicles in stock that willalso up-fit them and ship them to the police department. One of the three fleet sales companies staff reached out to is located in Texas, Cameron Country Dodge. They have Dodge Charger Pursuit models in stock and will provide the up-fitting. The cost of the vehicles is $40,500 each, with an additional $20,833 for the up-fitting. There is a delivery charge of $4,812 since the vehicles will be shipped from Texas. For both vehicles, up-fitted, shipped with all fees included, the cost will be $136,290.

This can be financed for either 3, 5, or 7-years. The interest rates vary with each option, but the 3-year financing option is the best for cost savings. The total to finance for 3-years at 6.49% interest will be $154,917.24, or $51,639.08 per year. The financing would be handled by Government Capital Corporation.

The cost can be covered by the COPS Grant which the police department is awarded every year.

IV. ALTERNATIVES:

Councilcan deny this request and the police department willcontinue with its existing fleet.

V. FISCAL IMPACT:

The totalcost for the purchase of the two vehicles will be $154,917.24, financed over a 3-year period for an annualcost of $51,639.08. The purchase of these vehicles and up-fitting equipment will be done through the police departments COPS Grant and have zero impact on the general fund.

From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:

It is recommended that the Coalinga City Council:

A. Accept the project as complete.

B. Authorize the City Engineer to file the Notice of Completion for the project with the County Recorder and notify surety to exonerate contract bonds.

C. Authorize the Finance Department to release the 5% construction retention payment to DG Construction 35 days after recordation of the Notice of Completion by the Fresno County Registrar-Recorder’s Office, contingent upon no claims being filed on the project.

II. BACKGROUND:

On June 1, 2023, the City Council awarded a construction contract to DG Construction in an amount of $662,041.00, with an additional contingency of $66,204.10 set aside for any unforeseen incidentals for a total authorization amount of $728,245.10.

The primary scope of work, base bid, was to reconstruct approximately 2,631 linear feet of a City Water Main on Pleasant Avenue located between Louisiana Street and South Hachman Street in Coalinga, CA. The work consists of, but is not limited to: saw cutting, abandoning of existing 4” main and service laterals, removal and replacing of fire hydrant assemblies, construction of new 8” water main, 1” service laterals, and all associated connections and appurtenances, restoration of AC pavement, curb and gutter, and sidewalk, and water main disinfection and pressure testing.

A notice to Proceed was issued to DG Construction providing 30 working days to complete construction.

III. DISCUSSION:

The project which was originally scheduled for completion on August 28, 2023 was ultimately completed on November 16, 2023. Unforeseen clay material sewer laterals crossing at the new water main alignment caused extensive hand labor at each crossing by the contractor and extended the completion date.

The project saw increases due to unforeseen sewer lateral repairs. An increase to the project contingency of $78,545.00 to cover these additional project costs was approved at the August 3, 2023 regular City Council Meeting. The finalcontract amount is $751,370.51 which includes $23,125.41 of the $78,545.00 approved by City Council on August 3, 2023.

A final inspection of the project was performed September 22, 2023, which included preparation of a final punch list of items. The punch list items were completed on November 16, 2023. The notice of completion, when filed, begins a time period for which mechanics liens, liens against the contractor, and stop payment notices can be filed against a public construction project. It is a protection for the City during a construction project. Staff is not aware of any issues related to this project.

IV. ALTERNATIVES:

V. FISCAL IMPACT:

The project was fully funded by 2021 bond proceeds and sewer funds for the sewer laterals that needed to be repaired.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Discussion, Direction and PotentialAction regarding Animal Shelter Services Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Marissa Trejo, City Manager
I. RECOMMENDATION:

City Manager recommends Council hear the staff report and review supporting material.

II. BACKGROUND:

Since July 1, 2019, the City of Coalinga has been contracting with Gimme Love, a local non-profit organization, to provide shelter services at the City's animal shelter located at 150 W. Elm Street, Coalinga, CA 93210.

III. DISCUSSION:

The current contract expires on January 5, 2024.

On Monday, November 20, 2023, the City (consisting of Mayor Horn, Councilman Hedgecock and Chief Garza) met with Gimme Love (consisting of Loriand George Anderson) to present a new contract between the City and Gimme Love for animal shelter services which would begin on January 6, 2024, and remain in effect for a period of three (3) years, or until the new animal shelter is completed, whichever comes first.

The new contract consisted of the following summarized changes:

Specifying that the shelter hours of operation would be a minimum of 20 hours per week which would be posted and publicly available.

Adding additional language as to what Gimme Love already does, which is not a change to their current operations.

Adding more specific language on expectations.

Adding language to help address and control the rodent problem.

Adding language to help comply with health and safety requirements.

Adding language to specify the number of adoption events Gimme Love will host annually.

Adding language to allow Gimme Love to set, collect and retain adoption fees.

Changes in the payment structure as follows: Rather than a $10,000 payment on or around each July 1, the City would issue an $11,000 payment with $5,000 going toward general shelter operations and $6,000 going toward spay and neuter, adding that the City will pay for telephone and internet services at the shelter and increasing the annual utility payment cap from $2,500 to $3,000, and, rather than paying a flat monthly fee of $2,400, the City would pay a pro-rated amount per animal per month as reflected in the attached proposed contract.

These changes were requested to attempt to address the rodent issue, building and fire code requirements, overcrowding concerns and opportunities for Gimme Love to increase their revenue while also decreasing their expenses.

During the November 20, 2023, meeting between the City and Gimme Love, Gimme Love communicated to the City that they were not interested in the new contract and would cease shelter services at the end of the current contract.

On November 21, 2023, Gimme Love submitted formal written notice to the City that they would be discontinuing shelter services effective January 6, 2024 (attached).

Since then, City Manager Trejo and Gimme Love have communicated via email in regard to the contract (attached).

On November 28, 2023, City Manager Trejo met with Gimme Love (consisting of Loriand George Anderson) and reviewed the contract explaining the reasoning behind each change.

Gimme Love, collectively Loriand George Anderson, were agreeable to some aspects of the contract, but not the contract in its entirety.

Council was briefed on these negotiations in closed session.

Council may now elect to:

1. Allow the current contract with Gimme Love to expire on January 5, 2024, and A. direct the City Manager to work with the City Attorney to form a non-profit for the animal shelter; and B. authorize a full-time Animal Control Officer position in addition to the existing part-time animalcontrol position; and
C. have the City assume animal shelter services effective January 6, 2024; OR

2. Extend the current contract with Gimme Love for thirty (30) days, until February 6, 2024, and direct the City Manager to continue to attempt to negotiate a new contract, understanding that, if no agreement can be reached, option 1, as referenced above, would occur.

IV. ALTERNATIVES:

Explained in Discussion portion of staff report.

V. FISCAL IMPACT:

The current annualcontract cost to the General Fund is $41,800.

If the Council decides to allow the current contract with Gimme Love to end on January 5, 2024, direct the City Manager to work with the City Attorney to form a non-profit, authorize a full-time Animal Control Officer position, and have the City assume animal shelter services effective January 6, 2024, the fiscal impact ongoing increase to the General Fund is approximately $70,000, however, any adoption fees (to be set) collected, which would likely be minimal, would be revenue to the City which would minimally lower the recurring fiscal impact.

Lori,
We followed up from with the owner of Bug Me Pest Control after he was out at the shelter last week.

He is confident he can resolve the mouse/rat problem, but said he would only do so under the following conditions:

1. A food storage containers with holes or without proper airtight seals must first be discarded;

2. All other pest control service must be stopped;

3. All other mouse traps, bait stations, etc, must be removed;

4. PW will need to go out to cover holes along building vents.

Mountain Valley should be out today for regular service and will assess the situation.

Please let me know if you would like us to proceed with Bug Me or see how Mountain Valley does.

Marissa

Good morning, Lori.

Shannon is going to be reaching out to our pest control company this morning to service the animal shelter so I just wanted to give you a heads up so you aren’t caught by surprise when they show up over there.

Their services will be billed to the City.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Discussion, Direction and PotentialAction regarding Entering into a Maintenance Agreement for the Management of Medians in the Warthan Estates and Posa Chanet Subdivisions
Meeting Date: Thursday, December 7, 2023
From: Marissa Trejo, City Manager
Prepared by: Larry Miller, Public Works and Utilities Coordinator I. RECOMMENDATION:

Staff is looking for direction from the City Council regarding whether or not they would like for staff to negotiate and bring back a long-term maintenance agreement with CHRPD to maintain various landscape medians in the Warthan Estates and Posa Chanet Subdivisions. Further, authorize the Assistant City Manager to have the City Attorney prepare a maintenance agreement to bring back to the City Council in January/February 2024 for consideration.

II. BACKGROUND:

Staff members have been talking with CHRPD about the possibility of taking over the maintenance of the medians in the Warthan Estates and Posa Chanet Subdivisions. CHRPD has conveyed their interest in relinquishing management responsibilities for these medians, citing challenges in cost-effective grounds maintenance.

III. DISCUSSION:

Presently, CHRPD controls and has a duty to maintain the landscaped areas of Warthan Estates and some of the landscaped areas in the Posa Chanet subdivisions.

Warthan Estates that are controlled by CHRPD can be described as:

Approximately 68,287 square feet (1.56 acres)
Medians and landscape features along Merced Ave from Jayne Avenue to Lucille Avenue Medians and landscape features along Chardonay Lane from Merced Avenue to Merlot Way Medians and landscape features along Lucille Avenue from Merced Avenue to Bordeaux Way Medians and landscape features along Bordeaux Way
Landscaped Areas in Posa Chanet that are controlled by CHRPD can be described as:

Approximately 39,710 square feet (.91 acres)
Medians and landscape features along El Rancho Boulevard from San Pablo Drive to Highway 198/33 Landscape features along El Rancho that protrude into San Pablo Drive, Posa Chanet Boulevard, and Hacienda Drive
Medians and landscape features on Posa Chanet Boulevard from the El Rancho Boulevard to the end of the Centennial Park lot line
Funds to maintain these areas are based on a tax assessment through each respective lighting and landscape district. The sum of these assessments is approximately $64,000 annually. CHRPD does not have adequate staff to manage the grounds themselves, so they have sought contractual services from vendors. The sum of their water utility and contract expenses exceeds the assessment, leaving CHRPD in a deficit.

Preliminary discussions have taken place between CHRPD and the City of Coalinga to explore the feasibility of utilizing assessed funds. The objective of this report is to assess the potential for entering into a maintenance agreement, whereby CHRPD would transfer autonomy and responsibility for maintaining the lighting and landscape districts (LLMD’s) to the City of Coalinga in exchange for the total tax assessment.

Herein are the details of that feasibility study.

Currently, the described Warthan Estate landscaped areas are metered by two 1.5” meters and the described Posa Chanet landscape areas are metered by three 2” meters. Combined their water usage during peak water use years was 2.28 million gallons. The subsequent annual water-use and meter charge fees were $6,294.42 and $21,265.92 respectively.

In its present condition, due to the presence of leaks and oversized meters, staff feels that significant savings could be achieved almost immediately. While it is unknown to the extent that correcting leaks within the area willcontribute to the water-use savings, some amount of savings will be achieved here. In regard to the meter sizing, there is a potential savings of $13,206.32 annually. In the unlikely event that no efficiencies are found in water use, the estimated annual water utility expenses would be $14,254.02.

Due to its recently bolstered groundskeeping staff, the city will not need to utilize contract services to maintain the grounds. The grounds in their present condition may take some additional man hours to establish the landscape areas, e.g., replace meters, remove dead vegetation, and correct irrigation leaks or inefficiencies. Staff anticipates that dedicating 3 hours per week with a team of 4 employees willadequately maintain the landscaped areas in Warthan Estates, while 3 hours per week with a team of 2 employees will suffice for the specified Posa Chanet landscape areas. This equates to a total of 936 man hours annually at a cost of $36,026.64.

Given utilities costs of $14,254.02, staffing costs of $36,026.64, and an approximate tax assessment value of $64,000, a total of $13,719.34 would be available to cover parts and supplies as wellas additional operational expenses incurred due to an expanded territory.

In light of this information, it is clear that it is not only feasible to enter into a maintenance agreement, but it can also offer other interesting opportunities. Notably, we would have autonomy to make improvements as we saw fit. Staff would recommend improvements similar to what we have completed in Monterey and Washington. This would improve the aesthetic, water use characteristics, and man hour requirements.

Herein are the details of how that would affect the feasibility.

Given a rough calculation of square feet of 107,997 in the described landscape areas, it is presumed that a landscape project similar to that of Washington and Monterey would cost approximately $250,000. While the initial investment is significant, it provides both an aesthetic improvement as wellas significant water savings and man hour cost reductions.

During the 2022 calendar year, the water requirements for the Monterey medians was 552,000 gallons for an entire year. Given that the square footage for the area is 33,896, it can be presumed that it required 16.29 gallons per square foot of landscaping. Variation in this metric is nearly a certainty if applied to other areas due to plant material density, but it is the nearest nexus we are capable of making. Applying this water use requirement to both Warthan Estates and Posa Chanet would yield an estimated water savings of 529,000 gallons of water per year. Reducing its annual water cost to $12,797.56.

Man hours related to the updated landscaping are estimated to be reduced from 936 to 624 annually. This reduces the man hour costs from $36,026.64 to $24,017.76, representing a cost savings of $12,008.88.

Given the approximate tax assessment of $64,000 and an operational budget of $36,815.32, a total of $27,184.68 would remain to cover any remaining miscellaneous operationalexpenses and updates to the medians over time. This amount also serves as an offset to capitalexpenditures incurred by the landscape improvements, leading to a return on investment (ROI) of approximately 10 years.

Supporting documentation has been attached to this report.

IV. ALTERNATIVES:

None
V. FISCAL IMPACT:

The tax assessment of the lighting and landscaping district is approximately $64,000. In the scenario that no improvements, outside of meter size reductions, there will be an approximate $13,719.34 surplus year over year available to cover miscellaneous expenses and future improvement projects. Should the improvements be made, this surplus will increase to approximately $27,184.68 annually. With an assumed cost of $250,000, the ROI would be approximately 10 years.
