STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Adopt Resolution No. 4209 Annual Gann Appropriation Limit for FiscalYear 2024-2025
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Mai Vang, Financial Services Director
I. RECOMMENDATION:

Financial Services Director recommends Counciladopt Resolution No. 4209 to establish the Gann Appropriation Limit for the FiscalYear ending June 30, 2025, in the amount of $11,770,242.

II. BACKGROUND:

In 1979, the voters of the State of California approved Proposition 4, commonly known as the (Paul) Gann Initiative. This Proposition created Article XIII B of the State Constitution placing limits on the amount of Tax revenue that can be spent by governmentalentities. Under the current guidelines, our Gann Appropriations Limit grows each year by a formula tied to cost of living factor and population growth provided by Department of Finance on an annual basis.

III. DISCUSSION:

On April 30, 2024, the Department of Finance transmitted an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2024, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2024-25.

State Per Capita Cost of Living Change = 3.62 percent
Coalinga’s Population Change between January 1, 2023 and January 1, 2024 = -0.13 percent Per Capita Cost of Living converted to a ratio: 3.62 + 100 = 1.0362 100
Population converted to a ratio: -0.13 + 100 = 0.9987
100
Calculation of factor for FY 2024-25: 1.0362 x 0.9987 = 1.0349 The City of Coalinga’s FY24/25 Appropriations Limit was calculated at $11,770,242 where $8,248,578 is subject to the Appropriation Limits. This amount is $3,521,664 below the calculated Appropriation Limit.

IV. ALTERNATIVES:

The Gann Appropriations Limit calculation is mandated by California Constitution. There is no alternative.

V. FISCAL IMPACT:

There is no fiscal impact to the City of Coalinga, unless the City exceeds the Appropriation Limit of $11,770,242.

Dear Fiscal Officer:

Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments.

Each local jurisdiction must use their percentage change in population factor for January 1, 2024, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2024-25. Attachment A provides the change in California’s per capita personal income and an example for utilizing the factors to calculate the 2024-25 appropriations limit. Attachment B provides the city and unincorporated county population percentage change. Attachment C provides the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.

Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code section 2228 provides additional information regarding the appropriations limit. Article XIII B, section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.

Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2024. Please note: The prior year’s city population estimates may be revised. The per capita personal income change is based on historical data.

If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2024-25 appropriation limit is:

Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2024-25 3.62
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2024-25 appropriation limit.
2024-25:

Per Capita Cost of Living Change = 3.62 percent
Population Change = 0.17 percent
Per Capita Cost of Living converted to a ratio: 3.62 + 100 = 1.0362 100
Population converted to a ratio: 0.17 + 100 = 1.0017

AUTHORITY
Subject: Authorize Zoning Text Amendment related to Regulations on Gyms/Fitness Centers and Drive Throughs
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:

Councilman Schindler requested as a future agenda item for the Council to authorize the initiation of a zoning text amendment related to regulating gyms/fitness centers and drive through’s.

II. BACKGROUND:

Councilman Schindler would like to update the planning and zoning code to allow gyms and fitness centers by-right in the city’s MBL zoning designations with the condition (additional development regulations) that outdoor activities be limited to the hours of 6am-10pm if adjacent to residentialzoning districts. Currently the zoning code does not allow gyms as a permitted use either by-right or subject to conditional use permit in the industrialzones.

He also would also like to amend the zoning code to eliminate the current restrictions on drive-through’s in the General Commercial (CG) zone. The code currently prohibits drive through’s in the General Commercial (CG) zoning designations.

III. DISCUSSION:

If Councilapproves the initiation of the zoning text amendment, staff will proceed with the appropriate process to update the planning and zoning code.

IV. ALTERNATIVES:

Do not authorize the initiation of a zoning text amendment.

V. FISCAL IMPACT:

None determined at this time.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Approve Purchase of a New Hydraulic Vehicle Lift for the Service Center Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:

Staff is requesting the councilapprove staff to proceed with the purchase of a new Hunter Hydraulic Vehicle Lift for the service center from Cal State Automotive Equipment in the amount not to exceed $41,000.

II. BACKGROUND:

During a recent inspection of the City's only hydraulic vehicle lift last month, it was discovered that there are some safety concerns and recommendations that we stop using the lift until it is replaced. The Lift pillar on left rear side is twisted and bent with no replacement part available. In addition, the safety bars are bent with no replacement available. The hydraulic cylinder has blown seals causing fluid to leak causing no pressure to lift vehicles. Lastly, all four chains are stretched and out of place.

This hydraulic rack no longer has replaceable parts in order to repair. It must be replaced. In addition, the techs will not no longer attempt to repair due to liability concerns since the lift is 24 years old.

III. DISCUSSION:

The City’s service center technician researched new hydraulic lifts to replace the damaged lift at the Service Center. The two lifts that were researched and compared was the Challenger 18K Heavy-Duty 4 post lift and the Hunter 4-Post lift. Both have a capacity of 18,000 Lbs. (with limitations). However, after weighing the pros and cons of each, staff is recommending going with the Hunter product. Below is the analysis of each product:

Challenger 18K Heavy-Duty 4 post lift- Current lead time is 65 days PROS
Chain driven (less maintenance).

Services vehicles up to 18,000LBS.

Fits 194”-236” wheel based vehicles. Wide Deck for duel wheeled vehicles.

Affordable pricing
CONS
Top mounted ram sometimes gets in the way of vehicles doors when opening.

One beam safety lock catch similar to the one already on location, uses tension rods as safety’s.

Scissor lift jacks (loses weight capacity as it is lifted).

Chains are prone to stretch over time and are expensive to replace.

Lift will most likely sway when vehicle is suspended due to only having one lock system.

Single ram system.

Hunter 4 post lift 18k+ Current lead time is 13 days
PROS
Four sectioned ladder locks for extra safety on all four corners.

Provides 18k+LBS lift with dual rams, under rated from the 20klbs its rated for.

Jacks are a triple cylinder lift system, which retains lift power from bottom to top with no loss of lifting power.

Thicker construction for heavier duty applications.

Extra wide 92” runways to accommodate duel wheeled vehicles.

Cable driven which lends to be cheaper when serviced.

Brass pulleys with chrome plated pins. Does not require lubrication.

Attentive service teams with quick response times.

Best in class lift.

Four corner lift sensors to insure even lifting.

Tucked lift ram with no bulky overhead ram.

CONS
Cables need to be changed every five years.

Expensive compared to the challenger.

Takes up a few more feet of shop space.

The Hunter product overall performs better than the Challenger product and the City is looking for a product that willallow staff to service all vehicles in the City’s fleet minus the fire apparatus which is taken to a private company requiring specialized service. The lead time of the hunter product is 13 Days and includes installation and training.

IV. ALTERNATIVES:

None at this time unless Council directs staff to go with an alternative piece of equipment.

V. FISCAL IMPACT:

Since the service center provides services to all departments in the City the following is the cost allocation for this expense:

Water: $6,970 (17%) Major Machinery and Equipment
Sewer:$6,970 (17%) Major Machinery and Equipment
Gas: $6,560(16%) Major Machinery and Equipment
Fire: $4,100 (10%) Major Machinery and Equipment
Police: $6,150 (15%) - COPS Grant
IGT/EMS: $8,200 (20%) Major Machinery and Equipment
Community Development: $820 (2%) Vehicle, Parts, Repairs and Maintenance Administration: $1,230 (3%) Vehicle, Parts, Repairs and Maintenance This would be an unbudgeted items, however, due to the recently discovered safety concerns, staff feels that this purchase should be undertaken as soon as possible to ensure services continue at the service center and safety of staff.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Approve Beer and Wine Off-Sale Business License, through the Department of Alcoholic Beverage Control (ABC) within Census Tract 80 in the City of Coalinga for the Coalinga Family Market at 210 E. Elm Ave
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:

Staff recommends consideration and approval of a request for a Beer, Wine and Distilled Sprits License at the Existing Coalinga Family Market located at 210 E. ElmAve. Further, authorizing the Assistant City Manager, as the designated subordinate officer, to issue a letter to the State Department of Alcoholic Beverage Control (ABC) in accordance with Part 3 of the ABC application.

II. BACKGROUND:

The owner of the Coalinga Family Market at 210 E. ElmAve applied for a Type 20-off sale (Beer and Wine) license through the State Department of Alcoholic Beverage Control.

The City of Coalinga requires a Conditional Use Permit for these establishments unless exempt as prescribed in the Planning and Zoning Code. The Applicant submitted their CUP application to Community Development Department and received approval by the Planning Commission on December 12, 2023.

Link to Planning Commission Agenda and Application: CLICK HERE III. DISCUSSION:

Section 23958.4 of the Business and Professions Code limits the number of licenses allowed within any given census tract and if exceeded, the local governing body shall determine whether public convenience or necessity would be served by the issuance of an additional permit.

According to the attached application, there are currently four (4) off-sale licenses within Census Tract

80. According to ABC, the maximum number of allowed licenses under the Business and Professions Code Section 23958.4 is four (4). All licenses beyond four (4) are required to be approved by the governing body.

Planning Staff spoke with the Police Department and there was no concern related to the issuance of the additional license in the City.

The Community Development Department recommends that the Council authorize the Assistant City Manager, as the designated subordinate officer, to issue a letter to be attached to the application indicating public convenience or necessity would be served by the issuance of a license.

IV. ALTERNATIVES:

Do not make the finding of public convenience and necessity - not recommended.

V. FISCAL IMPACT:

Approval of the license would have a sale tax and business license tax benefit to the City. The revenue would benefit the General Fund.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize City Manager to Sign and Submit Local Transportation Development Funds for FiscalYear 2024-2025
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Mai Vang, Financial Services Director
I. RECOMMENDATION:

Financial Services Director recommends City Councilauthorize the City Manager to sign and submit the Transportation Funding Claim to the Council of Fresno County Governments (COG) to facilitate the collection of City’s share of the Local Transportation Development Act and State Transit Assistance Funds (Articles 3 & 8 and Transit monies) for FY 2024-2025.

II. BACKGROUND:

The Council of Fresno County Governments has determined the apportionment of Local Transportation Funds and State Transit Assistance Funds for FY 2024-2025.

To facilitate distribution of the funds allocated to the City of Coalinga, a Transportation Funding Claim form (see attachment) must be submitted to COG. City Counciladopted Resolution No. 3629 on November 7, 2013 as a “continuing resolution” so that future action by City Council only requires authorization for the City Manager to sign and submit the Claim Form documents attached. These funds are used for transit operations and street maintenance. The following is a breakdown of this year’s claim.

FY2025
Bicycle & Pedestrian (Art. 3) 19,774
Regional Transportation Planning 27,615
Streets & Roads (Art. 8.a) 583,577
FCRTA (Transit Operations) 237,996
Community Transit Service (CTSA). Art. 4.5 49,101
County MOU Pleasant Valley 309,299
Funds Pending Further Claiming 38,643
TOTAL 1,266,005
III. DISCUSSION:

There is $1,266,005 in Local Transportation and State Transit Assistance revenues designated for Coalinga in FY 2024-2025.

A previously signed Memorandum of Understanding (MOU) with Fresno County on March 25, 2008 regarding Tax Sharing Agreement requires the City remit a portion of the transportation revenues to the County, which was amended and signed on April 26, 2023. Under Article VIII section 8.2B, with the annexation of the non-contiguous Pleasant Valley State Prison and Mental Health Treatment Facility, this specific impact led to an increase in City share of certain population based revenues such as the Transportation Development Act Funds (TDA), and Measure C Program Funds. The MOU allows the City to remit to the County of Fresno their apportionment share of TDA and Measure C funds to be claimed out of the City of Coalinga TDA revenues. Based on population data received from the State Department of Finance, the calculation for FY 2024-2025 shows the City needs to reimburse the County $309,299 from TDA funds.

IV. ALTERNATIVES:

No alternatives recommended. This annualclaim ensures City receives its proportionate share of this transportation funding.

V. FISCAL IMPACT:

There is $1,266,005 in Local Transportation and State Transit Assistance revenues designated for Coalinga in FY 24-25, of which $603,351 willcome directly to the City for use.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize City Manager to Execute an Agreement with Central Valley Environmental
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manger
Prepared by: Mercedes Garcia, Senior Administrative Analyst I. RECOMMENDATION:

Authorize City Manager to Execute an Agreement with Central Valley Environmental to Abate Finance Storage Area and Evidence Storage Room Located at 160 W Elm.

II. BACKGROUND:

The City has an off-site storage area used by the Finance Department and Police Department. While documents were being organized for destruction it was noted the storage area had mold in it. Staff reached out to California Intergovernmental Risk Authority (CIRA) our risk pool for guidance on the property loss.

CIRA recommended a preferred vendor Sierra Pacific Loss Management.to potentially assist with identifying the scope of the mold issue. Sierra Pacific Loss Management contacted Central Valley Environmental to identify the scope for abatement of the mold issue.

III. DISCUSSION:

The City received the attached proposal for abatement of the mold issue in the amount of $11,275. The proposal includes abatement of both areas along with some add-on for additional testing of asbestos and lead due to the age of the building. The additional testing is estimated to cost about $3,800. Staff request a contingency of $1,500 should additional project monitoring be needed to complete the project.

IV. ALTERNATIVES:

Do not authorize the City Manager to execute the agreement with Central Valley Environmental - staff does not recommend as the abatement of the area is needed and timely completion is needed to prevent further mold growth.

V. FISCAL IMPACT:

The cost of the remediation of the two areas is $11, 275 with additionalconsultant fees for testing in the amount of $3,800 and a $1,500 contingency for a total of $16,575.00. This is an unbudgeted General Fund expense that will be funded by California Intergovernmental Risk Authority (CIRA) grant funds.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Authorize and Approve Contracts for CY 2023 Intergovernmental Transfer Program Participation
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Greg DuPuis, Fire Chief
I. RECOMMENDATION:

The Fire Chief and City Manager recommend authorizing the Fire Chief to sign Letter of Interests for participation in the CY 2023 Intergovernmental Transfer Programs. The Health Plan Provider Agreements for Anthem Blue Cross and CalViva Health will be sent to the City once the CY 2023 VRRP IGT Agreement is approved by Counciland signed by the City.

1. Letter of Interest between the City of Coalinga and Anthem Blue Cross.

2. Letter of Interest between the City of Coalinga and CalViva Health.

II. BACKGROUND:

Since 2006 the California Department of Health Care Services (DHCS) has offered local governments that provide health care the opportunity to secure additional Medi-Cal revenues by participating in a voluntary Intergovernmental Transfer (IGT) Program with their local Medi-Cal managed care plans. In Fresno County the two managed care plans are Anthem Blue Cross and CalViva. The Coalinga Fire Department provides EMS ambulance transport, a Medi-Calcovered service to Medi-Cal plan members, therefore is eligible to participate in the IGT program. In summary, the IGT process will result in the two Medi-Cal Managed Care Plans paying governmental providers of health care services additonal Medi-Cal revenues to offset previously unreimbursed charges for serving Medi-Cal plan members. The payment amounts are determined by the provider's unreimbursed charges, the number of other local government providers participating in the IGT's in the county or region, the Plan's recommendations, and the State's formulas. The Fire Department has participated in the Rate Range IGT's since 2015.

III. DISCUSSION:

A rate range IGT is implemented through three contracts: One with each of the two plans and one with the DHCS for the transfer of public funds. The contract templates have been approved by the State and Federal governments and have been accepted by many counties and large public health care systems. These documents spell out each entity's obligations regarding transfer of local funds, the use of the funds by the State to increase Plan rates, the payment from the Plan to the provider, and the treatment of the IGT-funded payments by the provider. Before any funds are transferred to the State by a local government, allcontracts are signed by the participants. Each IGT, including the contributing governmentalentity and the level the Plan rates are increased, are approved in advance by the Federal government. Because our city will do one IGT with Blue Cross and one with CalViva, we will have two sets of documents.

The contracts this year willencompass one fullcalendar year. Since our participation is based on unreimbursed charges from the Managed Care Medi-Cal plans, our participation will be slightly more since adding a third ambulance for part of this calendar year. Participation in this program has allowed us to create our Non-safety EMS division of the Fire Department.

We will be using proceeds from the previous year’s participation to fund this contribution.

IV. ALTERNATIVES:

1. Do not participate in the VRRP IGT program. (Not recommended) V. FISCAL IMPACT:

Our total to be transferred to DHCS for CY 2023 will be approximately $1,119,631 and will occur 1 st quarter
2025. The minimum we will be reimbursed will be $2,801,980 which will result in net new funds of approximately $1,682,349 to be spent on healthcare services.

STAFF REPORT - CITY COUNCIL/SUCCESSOR AGENCY/PUBLIC FINANCE

AUTHORITY
Subject: Consideration of Bid Award for WTP Upgrades – Chlorine Room Improvement Project
Meeting Date: Thursday, June 13, 2024
From: Marissa Trejo, City Manager
Prepared by: Sean Brewer, Assistant City Manager
I. RECOMMENDATION:

It is recommended that the Coalinga City Council reject all bids due to the bids received exceeding the project budget for the Chlorine Room Improvements Project. The apparent lowest bidder is recommended to be deemed nonresponsive due to not including the required signed addendum. The second apparent lowest responsive bidder exceeded the budget by $301,580. The project is recommended to rebid at a later date.

II. BACKGROUND:

The City hired MKN & Associates to assist the City in cost estimating, design engineering and bid support for all the water bond projects and various other water and wastewater projects the City has. Since this project required some additionalarchitectural, structuraland mechanical support MKN requested sub-contracting Teter, Inc to complement the scope of the project.

In May 2023, the Coalinga City Council directed MKN & Associates to prepare engineering plans and specifications and authorized a call for bids for the WTP Upgrades – Chlorine Room Improvement Project.

The primary scope of work, is mobilization/demobilization, perform demolition and disposal, furnish and install exhaust fans, furnish and install ductwork, grilles and supports, furnish and install new exterior doors and door hardware, rotate orientation of chlorine cylinders and piping, furnish and install electrical and instrumentation improvements.

III. DISCUSSION:

City Staff received and opened two bids for this project on June 4, 2024, at 2:00 p.m.

MKN reviewed and recommended GSE Construction Company, Inc. as the apparent low bidder with a total bid proposal of $427,200.00:

Strategic Mechanical is recommended to be deemed nonresponsive due to the following:
3 Addendums were issued for this project requiring a signed acknowledgement back from the contractors. Strategic Mechanical failed to provide a signed acknowledgement for Addendum No. 3, an important Division 09 Finishes document that may have affected their bid total, if it was not included in their proposed itemized amount.

The city recently created an ordinance that allows them to officially disqualify contractors (in its sole discretion) during the bid review (Ordinance Related to Disqualification of Contractors for Public Works Projects in Division 0, Section 00010 – Notice to Contractors, 14 th paragraph). After
discussions with City staff, the City would like to use their discretion to disqualify Strategic.

The Engineer’s Estimate was $125,620.00. Staff recommends to reject all bids, revisit the scope of work and re-bid the project due to the extreme over budget total.

IV. ALTERNATIVES:

To award the project to GSE Construction (Staff does not recommend). The bid summary is included as Attachment “A”. GSE Construction Co., Inc., has furnished the required bid bond. If the City Council decides to award the project to GSE Construction Co., Inc., and the “Notice to Proceed” is issued, the contractor will have 90 working days to complete the work. The following is a tentative schedule:

Award of Contract: June 13, 2024
Start of Construction: July 9, 2024
Completion of Construction: December 6, 2024
V. FISCAL IMPACT:

Total authorization request for this contract is $427,200.00 with an additional 10% contingency of $42,720.00 for a total of $469,920.00. This project is funded from a combination of bond funding and the professional services fund of the water treatment plant.

If all bids are rejected there will be no fiscal impact to the General Fund.

V. FISCAL IMPACT:

The fiscal impact to the City's General Fund to place the item on the ballot for November is estimated not to exceed $35,000 in combination with the other election items (City Council District 1, 2 and 4 seats). This expense is budgeted.
