RESPONSES TO PUBLIC COMMENTS
October 2021
The primary objective and purpose of the Initial Study/Mitigated Negative Declaration public review process is to obtain comments on the adequacy of the analysis of environmental impacts, the mitigation measures presented, and other analyses contained in the Initial Study prepared by the City of Colton (City). The California Environmental Quality Act (CEQA) requires that the City decisionmakers consider the comments received during the public review of the Initial Study/Mitigated Negative Declaration prior to carrying out or approving the project (CEQA Guidelines Section 15074[b]). Comments that do not directly relate to the analysis in this document (i.e., are outside the scope of this document) are not given specific responses; however, all comments are included in this section so that the decision-makers may know the opinions of the commenter.

The Barton Road Bridge Removal and Road Construction Project (Project) Initial Study/Mitigated Negative Declaration (IS/MND) was circulated to the public and public agencies for a 30-day public review period from July 19 to August 18, 2021. One comment was received:
• Elsinore Valley Municipal Water District (Matthew Bates, PE) August 18, 2021 Information provided in this this Appendix clarifies, amplifies, or makes minor modifications to the IS/MND. No significant changes have been made to the information contained in the IS/MND as a result of the responses to comments, and no significant new information has been added that would require recirculation of the document.

SUBJECT: BARTON ROAD BRIDGE REMOVAL AND ROAD CONSTRUCTION PROJECT - Notice of Intent to adopt mitigated negative declaration Dear Mr. Ortiz:

The Elsinore Valley Municipal Water District (“District”) received the Notice of Intent to Adopt Mitigated Negative Declaration (“MND”) for the Barton Road Bridge Removal and Reconstruction Project (“Project”). This letter is to express our initial concerns regarding the MND and the Project’s potential impacts to District property and to the environment. The District is the owner of APN: 1167-051-02-0000 (“Property”), located along Barton Road at the intersection of Terrace Avenue. While Figure 3 of the MND purports to depict this property, it does so inaccurately. The District’s Palm Avenue Well (“Well”), which is located on the Property, is utilized for groundwater extraction purposes and is a vital District asset. Additionally, the District’s Well Discharge Line extends from the Property, along Barton Road, to the Riverside Canal. Based on our review of the MND and exhibits provided, the District is providing the following comments.

1. The Project Description is defective. It fails to accurately describe all components of the Project. For example, will the District’s 12-inch Well Discharge Line require relocation? An analysis of impacts of such relocation was completely omitted. What will be the new location and alignment of that line? What impacts will occur as a result of that relocation? What right-of-way will be acquired from the District? While the diagrams appear to suggest that right-of-way is needed on the District’s property, the District’s property is not described on page 5, top paragraph, where the impacted APNs are listed. Also, the MND fails to describe the driveway improvements that will be necessary from the improved roadway to the District’s Property.

2. This Project is clearly part of the roadway improvements needed for the proposed Barton Road Logistics Center. That project is predicated upon the completion of the roadway improvements in this Bridge Removal and Road Construction Project. Yet that project is never mentioned in the MND. The roadway improvements are part and parcel of that Project, and this MND improperly treats them as a separate project rather than mitigation/ improvements for the larger project. This is improper piecemealing.

3. The MND fails to properly identify the Responsible Agencies. For example, while Caltrans is listed as a Project Sponsor, and the Project is identified as being

undertaken in coordination with Caltrans, there is no description of what approvals Caltrans must issue for this project. Moreover, given that significant utility relocation is needed for the Project, including the possible relocation of District’s Well Discharge Line, why are the owners of such lines not identified as Responsible Agencies.

4. The Comment Period is defective. The MND set a 20-day review period. See MND, p. 2. However, given Caltrans’ role in the Project, a minimum of 30 days was required. (Public Res. Code § 21091.)

5. Figure 3 indicates that the City desires to obtain a temporary construction easement (TCE) from the District over the Property. The MND fails to include sufficient detail regarding use of the District’s property. Will the District’s access to its Property be affected for any time? The District has serious concerns over the use of its Property and requests the City contact the District to discuss this matter in more detail.

6. The Project Description states “Construct driveway approaches joining existing driveways to City of Colton and Grand Terrace standards” (Section 2.3, underline added). Proper curb and gutter street improvements do not exists fronting the Property. Therefore, it is unclear if the Project intends to add a driveway to the Property. The District requests a commercial driveway approach be constructed fronting the Property. The lack of such driveway would greatly impact the District’s ability to access its Property.

7. The Project Description states ”Relocate the Riverside Highland Water Company line, City waterline, fiber optic cables, and gas line in the existing bridge and roadway…” (Section 2.3). The District’s Well Discharge Line exists within the entire Project Boundary however, there is no mention of our facility and possible impacts. The City has failed to properly evaluate impacts to District facilities. Moreover, the impacts associated with the relocation of the District’s Well Discharge Line have not been assessed. Will there be any disruption of that line’s operation? What are the impacts of the installation of the line in its new location? Are there biological impacts associated with that relocation? Geological or soil impacts? Archeological Impacts? It is assumed that relocation will be required based on recent relocation efforts conducted as part of the Barton Road Interchange Project. The District requests the City properly evaluate impacts to District facility and determine its relocation is necessary.

8. The MND fails to include sufficient detail within the Project Description or exhibits to fully assess impacts to the District’s Well Discharge Line. The District requests the City pothole the waterline to verify the location (horizontal and vertical) and determine impacts. The District requests that the City submit all design submittals (typically 30, 60, 90 and 100 percent designs) to the District for review.

9. The MND reflects an improper pre-commitment to condemn property. On page 5, the MND simply announces that the necessary property “will be acquired.” This announcement is unlawful. The City has not undertaken the necessary steps to make such a pronouncement. It has not made offers to the property owners for the right-of7.d Packet Pg. 1729 Attachment: Exhibit C_Part2 - Barton Road Bridge Removal ISMND (3479 : CEQA - Barton Road Bridge Removal and Road Construction Mr. Ortiz, City of Colton

way. It has not negotiated with the owners. It has not adopted a resolution of necessity.

10. The MND fails to adequately describe the setting and Surrounding Land Uses. No mention of the District’s property is made, or its existing well or discharge line.

11. The MND fails to identify or assess the Project’s growth inducing effects. The Project Description makes it clear that the existing bridge serves as a serious impediment to high intensity uses in the area that utilize that segment of roadway. The bridge is too narrow and structurally unsound. This project is quite literally “paving the way” for the Barton Road Logistics Center. Yet the growth inducing effect is never mentioned. To the contrary, it is simply concluded that the project “is not growth inducing” without any further explanation. (MND, pages 24, 74.)

12. The MND completely fails to address the potentially significant cumulative effects of the Project when combined with the immediately adjacent Barton Road Logistics Center project. Indeed, the MND simply ignores that project, even though it is very clear that the Logistics Center is necessitating this Project. Page 93 of the MND simply omits any reference to the Logistics Center any the various other projects in the area.

What will be the air quality impacts if the side-by-side projects are constructed at the same time? What will be the traffic impacts? The noise impacts? There is no assessment of these important issues.

The District has serious concerns related to Project impacts and the lack of coordination with the District relating to both this Project and the Logistics Center. Nonetheless, we are committed to working with the City to resolve these concerns and we look forward to meeting with you to discuss them further in the very near future. Please feel free to contact me at [email protected] or 951-674-3146 x8208.

RESPONSE TO LETTER 1: Elsinore Valley Municipal Water District The Elsinore Valley Municipal Water District (EVMWD) owns APN: 1167-051-02-0000 located along Barton Road at the intersection of Terrace Avenue and describes the appropriate boundary of this parcel. Figure 3 (attached) has been revised to reflect this corrected boundary.

The project will not impact the well house; therefore, the map correction does not result not raise a significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact. No recirculation of the IS/MND is warranted.

Response to Comment 1: The assumption that the existing 12” EVMWD line would not be affected by the project was based on the information provided by EVMWD in July of 2019. Further investigations have found that the existing 12” line from the existing well site at South Terrace Drive to the abandoned Railroad tracks is deep enough and is not impacted by the proposed Barton Road reconstruction. However, due to the location of the existing 12” line east of the abandoned tracks, it will be in conflict with the proposed improvements. Based on this assessment, the vertical relocation of approximately 450 feet of the existing waterline is required to maintain the minimum cover with the reconstructed roadway. Barton Road between Grand Terrace Road and South Terrace Drive will be closed to traffic during construction. The EVMWD waterline relocation can be performed prior to the roadway reconstruction. As the project is refined and new information is subsequently made available, the City will coordinate directly with the utility providers to ensure the appropriate relocation of facilities per the applicable provisions of the respective utility. As is typical with this sort of utility effort, it is reasonable to conclude coordination between the City, the roadway design team, and EVMWD engineers will minimize impacts to the 12” line.

This comment does not raise a significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 2 The commenter’s opinion that the roadway improvements are “clearly” required for the Barton Road Logistics Center Project (BRLCP) are erroneous. The Cities of Colton and Grand Terrace have long recognized the needed improvements on Barton Road through the project area. This long established need for a safe and efficient replacement of the current bridge pre-dates the use of the BRLC Project site by its current tenants or the current proponents of the BRLC project1 .

Barton Road Bridge was originally built in 1936 as a two-lane bridge over the UPRR railroad tracks (one lane in each direction). The bridge is structurally unsound and the 25-foot wide bridge deck does not provide adequate pedestrian or bicycle access in accordance with City standards. A review of the existing bridge’s plans shows the design does not account for seismic loading, which is now required in the state of California. The Bridge Inspection Report shows a low sufficiently rating of 58.8 due to low load rating and a roadway geometry that does not meet current American Association of State Highway and Transportation Officials standards. The railroad tracks below the Barton Road Bridge have been abandoned and removed; as such, there is no longer the need to span the railroad tracks 1 see 2019 Federal State Transportation Improvement Program, page SBDS08, “BRIDGE NO. 54C, BARTON RD, OVER UP RR, 0.25 MI W ROUTE 215. Replace 2 lane bridge with new 2 lane Asphalt roadway, Minor seismic contribution. The City of Colton will be the implementing agency for design and construction.”

with a bridge. Because the railroad tracks under the bridge have been removed, there is no need for a bridge crossing at this location. The area under the bridge will be filled, and the existing bridge will be replaced with a two-lane at grade asphalt roadway to connect to the existing roadway to the east and west of the bridge. Continuous pedestrian and bicycle access through the project area will installed through the project area to meet the requirements of both Cities.

The commenter does not identify how the Project is necessary for the proposed BRLCP. The Traffic Study for the BRLCP did not identify the bridge removal/replacement improvements as mitigation for any its project impacts. The commenter does not present evidence that the BRLCP requires the proposed roadway improvements detailed in the IS/MND.

The existing two lane bridge will be replaced with a two lane roadway. The Project does not increase travel lanes through the project area. Due to the long-standing desire to provide roadway improvements through the project area, the Bridge Removal and Road construction project has a purpose and need separate and independent of any existing or planned development project in either City.

This comment does not raise a significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 3: The project has undergone Caltrans review subject to the applicable provisions of its Local Assistance Procedure Manual (LAPM). The National Environmental Policy Act (NEPA) documentation and supporting studies reviewed and approved by Caltrans include:
• Preliminary Environmental Study (approved December 12, 2019); • Traffic Study (approved June 20, 2020);
• Natural Environment Study-Minimal Effects (approved September 23, 2000); • Noise Technical Memorandum (approved February 24, 2021); • Historic Property Survey Report (approved May 24, 2021); • Categorical Exclusion (approved August 18, 2021)
The location of the 12” EVMWD was based on the ATLAS information provided by EVMWD in June 2019. Since information identified this line along the existing right of way, it was concluded to be out of the project impact area and no relocation of the line was anticipated. As the project is refined and new information is subsequently made available, the City will coordinate directly with the utility providers to ensure the appropriate relocation of facilities per the applicable provisions of the respective utility. This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact. No revision or recirculation of the IS/MND is warranted.

Response to Comment 4: The 20-day review period detailed in the IS/MND was a typographical error.

As detailed in the Notice of Intent (NOI), which included an active City maintained weblink hosting the IS/MND and supporting technical studies, “Comments will be received from July 19, 2021 to August 18, 2021 (30-day public review).”

As evidenced by the commenter’s own comment letter, the NOI was distributed per the City’s appropriate agencies for public comment. The minor error recognized by the commenter, did not limit appropriate public comment. The oversight does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

No revision and/or recirculation of the IS/MND is warranted.

Response to Comment 5: The commenter’s concern regarding use of EVMWD property is noted.

There is currently 33 feet of right-of-way centerline of Barton Road and the EVMWD property. At t this time, the project anticipates requesting for a 10-foot wide temporary construction easement along this property. It is reasonable to conclude that the purchase of required right-of-way and/or granting of temporary construction easements will occur between the City and affected parties upon final design prior to construction. As is the typical procedure, terms and conditions of any temporary construction easement would be based on mutually agreed to terms between both parties.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 6: Curbing at the EVMWD parcel occurs only the extreme corner of the property. The Project has been designed to provide appropriate access to the EVMWD property from Barton Road.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 7: Please refer to the Response to Comment 1.

Based on plans provided by EVMWD, the referenced line is located within the project study area. The studies detailed in the Response to Comment 3, as well as other engineering studies, provide an accurate and thorough assessment of the potential environmental effects related to bridge demolition, roadway construction, and other activities in the project area. As EVMWD’s facility is located within the project area, it is reasonable to conclude that impacts associated with necessary utility relocation activities within the study area have been appropriately identified and addressed.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 8: Please refer to the Response to Comment 1. The location of the 12” EVMWD line was based on the ATLAS information provided by EVMWD in June 2019. Since this information identified this line along the existing right of way, it was concluded to be out of the project impact area and thus not potholed. Based on subsequently acquired information, the 12” EVMWD line is not affected by the project west of the existing bridge. As stated in the Response to Comment 1, approximately 450 feet of the existing waterline will need to be vertically relocated to maintain the minimum cover with the reconstructed roadway.

The IS/MND recognizes a requirement to relocate affected utility features to accommodate the proposed roadway improvements. The specifics of utility relocation; including the number, type,

location and nature of feature, is typically refined as the design of a project is advanced. Coordination between the City and affected parties includes the sharing of appropriate information (including asbuilt plans) to identify the specific relocation actions required. It is reasonable to conclude that this coordination will identify relocation criteria sufficient to provide appropriate continuity in service.

The commenter’s concerns will be considered by the City prior to any decision on the project. This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 9: While the acquisition of minor amounts of right-of-way is required for project implementation, this acquisition process cannot be started until after approval of the environmental document. Any acquisition action would be conducted pursuant to applicable Caltrans and City procedures. As adherence to these procedures is mandatory, it is reasonable to conclude the process will be completed in a manner allowing the full construction of the project as detailed in the IS/MND.

The commenter’s statement will be considered by the City prior to any decision on the project. This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 10: Table 2.2.A of the IS/MND has been revised to identify EVMWD facilities in the project area.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact.

Response to Comment 11: Section 2.3 (Project Description) states, “The Project is being proposed to provide a safe connectivity between La Cadena and the Barton Road/Interstate-215 (I-215) interchange and to facilitate efficient access between the Cities of Colton and Grand Terrace.” As stated previously, the existing two lane bridge will be replaced with a two lane roadway. The Project does not increase travel lanes through the project area. Continuous pedestrian and bicycle access through the project area will be installed through the project area to meet the requirements of both Cities. While the project will improve vehicular and pedestrian safety through the project area, as the project replaces a two-lane bridge with a similar size facility, it will not increase total vehicle capacity through the project area. Furthermore, as the replacement roadway will be built at the same location and alignment as the current bridge, the project would not extend roadway infrastructure at a location or in a manner that would induce growth not previously projected by both Cities. Therefore, it is reasonable that it would not induce growth.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact; therefore, no revision or recirculation of the IS/MND is required.

Response to Comment 12: The commenter again fails to acknowledge the long-standing intent of both Cities to replace a structurally deficient bridge with a roadway that provides safe transit through the project area, and incorrectly states the BRLCP is necessitating the Project. As stated previously, the project has a purpose and need separate and independent from any existing or proposed development in the project area.

Potential impacts resulting from the construction of the project have been appropriately identified in the IS/MND. Generally, construction-related impacts are limited in intensity and duration; therefore, the cumulative effects of the project were determined to be less than significant. At this time, it is speculative to determine which development activity in the project area will occur during project construction; therefore, requiring the road improvement project to assess such a cumulative condition is not appropriate.

As required under CEQA, adjacent planned or proposed development will be required to consider their cumulative contribution to local air quality, noise, and traffic impacts. As the project does not include a development component, and replaces an existing structure of similar size, it would not contribute to any cumulatively significant environmental impact identified by nearby planned or proposed developments.

This comment does not raise any significant environmental issue, does not identify a new environmental impact, or increase the significance of a previously identified impact; therefore, no revision or recirculation of the IS/MND is required.

SUBJECT: APPROVE AND ADOPT A RESOLUTION TO APPROVE

AMERICAN RESCUE PLAN ACT (ARPA) ESSENTIAL WORKER

PAY FOR CITY OF COLTON PART-TIME EMPLOYEES,
RESOLUTION NO R-05-22.

RECOMMENDED ACTION
Staff recommends that the City Council take the following action:

Approve and Adopt Resolution No. R-05-22 governing American Rescue Plan Act (ARPA) essential premium pay for non-represented part-time employees who worked during the COVID19 Pandemic period of July 1, 2020 and June 30, 2021.

BACKGROUND
In the past six months the City Council has approved new Memoranda of Understanding with seven employee associations as well as the City’s confidential and executive staff. A feature of these agreements has been a demonstration of the City’s appreciation for staff working during the time period of the COVID-19 pandemic from July 1, 2020 through June 30, 2021. The City of Colton workforce initially went mainly remote between March 2020 and June 2020. As of July 2020, all City offices reopened and the City of Colton employees returned to their offices and duties. This included the part-time employees of the City of Colton who have historically provided crucial and valuable services to the community of Colton as well as the citywide organization.

The purpose of Resolution No. R-05-22 is a recognition of Colton’s part-time employee’s services during the pandemic and an expression of the City’s appreciation by extending to them one-time hazard pay premium afforded by the COVID-19 driven American Recovery Plan Act (ARPA) dispensed by the Federal Department of Treasury. 8 Packet Pg. 1736

Essential Worker Pay (ARPA) - Part-Time Employees
February 1, 2022

Page 2 ends

ISSUES/ANALYSIS
The COVID-19 driven American Rescue Plan Act (ARPA) dispensed by the Federal Department of Treasury, in which the City of Colton was a recipient of approximately $14.8 million dollars, allows for premium pay to essential workers who work during the pandemic, including government workers providing essential municipal services. The City of Colton workforce returned to work in June 2020 and have continually been present back in office since that time providing essential services to city residents. The City currently has dispensed ARPA money to all full-time city employees less one employee association still engaged in negotiations. The following is proposed for the City’s part-time employees:
 Time Period of work performed: 7/1/20 – 6/30/21
 Total Number of Part-Time employees = 55 total P/T employees still active as of 1/7/2022
 $1,000 for employee working more than 500 hours = 40 employees = $40,000  $750 for employees working less than 500 hours = 13 employees = $9,750  $250 for employees working less than 100 hours = 2 employees = $500 Note: There are two part time staff that are CalPERS Retired Annuitants and do not qualify for this payment due to the CalPERS Retired Annuitant provision restrictions.

FISCAL IMPACTS
Approval of Resolution R-05-22 will increase appropriations in the City’s State and Local Fiscal Recovery Fund by $50,880 in account number 219-1000-1000-1010-0000-000, which includes $50,250 for essential worker hazard pay premiums plus the City’s required portion of Medicare tax.

FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION TO AUTHORIZE THE

EXECUTION OF AN AGREEMENT FOR GRANT FUNDING

THROUGH THE CALIFORNIA DEPARTMENT OF AGING,
RESOLUTION NO. R-07-22.

RECOMMENDED ACTION
Staff recommends that the City Council take the following action:

1. Adopt Resolution No. R-7-22 authorizing the execution of an agreement for grant funding through the California Department of Aging.

2. Amend the Fiscal Year 2021-2022 budget to reflect the receipt of an additional $200,000 in State Funding for Senior Center Facility Improvements.

3. Authorize the City Manager to execute all contracts necessary to proceed.

BACKGROUND
The Colton Community Services Department has historically provided a robust program for those ages 50 + through activities held at the Hutton Community Center. These programs included weekday meal service, social connection activities, fitness and special events. With the onset of COVID, the Hutton Community Center programing has been restricted to weekly meal deliveries, limited outdoor activities, and a few drive-thru pick up events. The lack of long-term socialization has heavily impacted the mental health of our senior population.

The Office of Assembly Majority Leader Eloise Gómez Reyes requested new proposals for the upcoming State budget. The Community Services Department requested $150,000 for improvements to the Hutton Community Center’s outdoor patio to expand our ability to provide 9 Packet Pg. 1740

safe activities for those 50 and better. The outdoor patio is located behind the center and is fully fenced with interior and exterior entrances. In its current form, the patio is a very simple, unfinished shade structure, but with additional upgrades, the patio can be used to offer significantly more programing. During the State budget process, Assembly Majority Leader Eloise Gómez Reyes was able to allocate, $200,000 in state funding improve the Hutton Community Center.

ISSUES/ANALYSIS
As we transition to a post COVID world, one of the opportunities to provide safe activities is through the Hutton Community Center’s outdoor patio. In the short term, it will combat the effects of COVID by providing a place for safe socialization as a balm for the depression and loneliness. In the long term, it will improve lives of seniors for a long time to come as a space for outdoor activities and programing such as senior sports, outdoor dances and daily exercise classes. The additional $200,000 in funding will include upgrades such as:
• Level surrounding grass and dirt areas and install artificial turf grass or cement so area can be safely used for activities & programing.
• Installation of an outdoor kitchen and cooking space. • Expansion of patio space to the recreation and dance rooms with exterior access. • Purchase of Patio furnishings and activity equipment.

This resolution authorizes the City Manager to execute this agreement with the state and amend the budget to reflect the grant funding.

FISCAL IMPACTS
The total grant funding equals $200,000 and is reimbursable to the City for allowable expenditures in accordance with the grant documentation and guidelines.

In order to account for this grant funding, to amend the FY 2021-22 budget to increase revenue in Miscellaneous Grants Fund Revenue Account Number 225-5850-022 in the amount of $200,000 and increase appropriations by $200,000 in Miscellaneous Grants Fund Capital Improvement Account Number 225-6200-6233-3890-0000-022.

STAFF REPORT
DATE: FEBRUARY 1, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: ARTHUR MORGAN, ECONOMIC DEVELOPMENT MGR
SUBJECT: SET A PUBLIC HEARING FOR THE CITY COUNCIL MEETING OF FEBRUARY 15, 2022 FOR CDBG 2022 - 2023 PROJECTS.

RECOMMENDED ACTION
Staff recommends that the City Council take the following action:

It is recommended that the City Council set a public hearing date for February 15, 2022 for prioritization of Fiscal Year 2022-2023 Community Development Block Grant Funds

BACKGROUND
Since the Community Development Block Grant (“CDBG”) program’s inception in 1974, it has provided financial assistance to grantees for a variety of community development purposes. The U.S. Department of Housing and Urban Development (“HUD”) uses a formula to calculate the grant amount for each metropolitan city, urban county and state. CDBG funds can be used to benefit low and moderate income residents by: building roads, parks, repairing or rehabilitating housing in target areas, by providing new or increased public services to income-qualifying residents, or by funding initiatives that generate new jobs. The County of San Bernardino’s Community Development and Housing Department (“CDH”) currently provides project oversight for CDBG projects through the Urban County program, in which Colton is a partner and joint recipient.

ISSUES/ANALYSIS
In the fall of 2021, staff was advised by CDH that the submittal deadline for all CDBG proposals for fiscal year 2022-2023 funds was December 14, 2021. Those proposals were analyzed by CDH for eligibility. Eligible project proposals serving Colton residents were forwarded back to the City on January 14, 2022, for further processing. On January 25, 2022, the CDBG Ad Hoc 10 Packet Pg. 1744

Committee met to finalize project recommendations to be presented to the City Council on February 15, 2022. Final funding recommendations are due back to the County by February 28, 2022.

Staff requests Council set a public hearing date for February 15, 2022, to consider and establish their fiscal year 2022-2023 final funding recommendations. Eligible projects recommended for funding will be available for public review beginning February 2, 2022, at the City Clerk’s Office at City Hall, 650 N. La Cadena Drive, in Colton. There is a total of $417,684 in CDBG funds available to Colton for fiscal year 2021-2022.

The County of San Bernardino will then publish all projects countywide, all prioritized and approved projects from its participating cities as required by HUD, prior to adoption of the Consolidated Plan.

FISCAL IMPACTS
CDBG Funded projects completed by the City are 100% reimbursable, up to the approved project limit. Funded capital improvement projects will be included in the 2022-2023 Capital Improvement Program, and will be included in the City’s budget. Funded Public Service Projects will be included in the City’s budget by the Community Services Department.

STAFF REPORT
DATE: FEBRUARY 1, 2022
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: BILL SMITH, CITY MANAGER
SUBJECT: APPROVE TOLLING AGREEMENT EXTENSION BETWEEN CITY

OF COLTON, SUNMEADOWS LLC AND THE COLTON COALITION
(CADENA CREEK MOBILE HOME PARK).

RECOMMENDED ACTION
Staff recommends that the City Council take the following action:

Authorize the City Manager to execute necessary extensions to the existing Tolling Agreement between the City of Colton, Sunmeadows LLC and the Colton Coalition for the Environment, regarding the Roquet Ranch Specific Plan entitlements, to extend the term of the Agreement to February 1, 2022, and also authorize the City Manager to execute extensions for up to six months – to August 3, 2022.

BACKGROUND
On May 15, 2018, the City Council adopted an environmental impact report (EIR), mitigation monitoring and reporting program and general plan amendment for the Roquet Ranch development. Other entitlements (Specific Plan & Zone Change) were adopted at the Council’s next meeting (2d reading of ordinances) (collectively the “Project).

As part of the record of proceedings for the Project, the EIR included letters submitted by interested parties making comments and expressing concerns about the Project and/or its environmental impacts. One such letter was submitted by attorneys representing ownership interests in the Cadena Creek Mobilehome Park and the Colton Coalition for the Environment (“Coalition”). The letter expressed concerns that the EIR did not adequately study hydrology, water and aesthetic impacts on the Cadena Creek Mobilehome Park. Although staff provided responses to each of the concerns and the Project was ultimately approved, the .Coalition threatened to file a lawsuit.

Tolling Agreement Extension - Roque Ranch Entitlements
February 1, 2022

Page 2 ends

Subsequent to Project approval, the Coalition and the developer have expressed an interest in discussing ways to address the concerns of the Coalition without the need for a lawsuit. These discussions have led to the development of a draft settlement agreement that is currently under review by all of the parties. The settlement agreement will contemplate minor project changes to drainage and landscaping improvements. The current tolling agreement expires on January 31, 2022.

ISSUES/ANALYSIS
A tolling agreement is an agreement to waive a right to claim that litigation should be dismissed due to the expiration of a statute of limitations. Its purpose is typically to allow parties additional time to assess and determine the legitimacy and viability of claims without the necessity of filing a lawsuit. The tolling agreement entered into by the City of Colton, the developer (Sunmeadows LLC) and the Colton Coalition for the Environment for the Project is set to expire on January 31, 2022. However, due to recent COVID-19 precautions having made meetings less frequent, authorization for additional extensions is necessary in order to allow the parties to continue to discuss the Project and draft settlement agreement. Therefore, staff is recommending that the City Council authorize a 30-day extension, to March 2 2022, and authorize the City Manager to execute further extensions, for up to six months, to August 3, 2022.

ENVIRONMENTAL REVIEW
Prior environmental impact report certified by City Council.

FISCAL IMPACT
None at this time.
