STAFF REPORT
DATE: APRIL 15, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: CHARLES BERRY, ELECTRIC UTILITY DIRECTOR
SUBJECT: CONFIRM ONGOING EMERGENCY CONDITION AT AGUA
MANSA POWER PLANT.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Confirm ongoing emergency conditions at Agua Mansa Power Plant and authorize the City Manager or designee to execute all necessary agreements to complete repairs to the power plant and simultaneously execute all necessary agreements with all vendors as required as provisioned in Colton Municipal Code § 3.08.130 (A).
BACKGROUND
On Friday, February 14, 2025, Ag ua Mansa Power Plant (AMPP) experienced a fault condition on the medium -voltage bus work interconnecting the generator switchgear to the step -up transformer. Upon investigation, the bus work is determined to be non -serviceable due to the extensive damage caused by multiple faults. Due to this non -serviceable status, the bus work, which is a proprietary product, must be replaced, resulting in AMPP being out of market until all repairs are completed.
The emergency conditions were affirmed by the City Council at its regular meeting on March 18, 2025. Pursuant to the Colton Municipal Code 3.08.130 (A), a report on the emergency and work performed shall be provided at the next regular meeting of the City Council, and then at every meeting thereafter.

Staff Report to the Mayor and City Council
Emergency Condition - Agua Mansa Power Plant
April 15, 2025
With AMPP out of the market, the power plant remains unavailable to be called upon to support the City’s energy needs in addition to the broader California Independent System Operator (CAISO) controlled SP 15 market. Based upon staff analysis of replacement energy and energy related products, the immediate cost exposure is $6,300,000 in addition to the replacement costs for the bus work, which is estimated at $1,100,000 for a total unplanned forced outage cost of $7,400,000. This analysis to market exposure assumes the repairs can be made and AMPP is placed back into market on, or before July 31, 2025.
Should repairs extend beyond July 31, 2025 , and AMPP remain s out of market, the financial liability to the Electric Utility will grow exponentially , not only in energy and related products, but also in potential fines levied by the CAISO due to an unplanned forced outage condition.
Conversely, if staff can complete repairs and return AMPP to market ahead of the July 31, 2025 date, the Electric Utility will realize the benefits of market cost avoidance.
Given the significant financial exposure to the City , the City Manager’s Office has issued an emergency declaration and directed staff to effectuate repairs in the most responsible and economic manner possible. To accomplish this, the City has invoked Colton Municipal Code
3.08.130 (A), dispatching with the formal budding requirements and executing all necessary agreements to complete repairs and restore AMPP to dispatchable status.
FISCAL IMPACTS
Sufficient appropriations are available in Fiscal Year 2024 -2025 adopted budget in Electric Utility Fund Agua Mansa Power Plant Capital Account Number 520-8000-8009-4930-0107-000.

TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: CHARLES BERRY, ELECTRIC UTILITY DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION TO APPROVE THE THIRD
AMENDMENT TO GRANT AWARD FOR THE EQUITABLE
COMMUNITY REVITALIZATION (ECRG) AGREEMENT,
RESOLUTION R-15-25.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve Resolution No. R -15-25 to authorize the acceptance of a grant award from the Department of Toxic Substances Control; and
2. Amend the FY 2024-25 budget to increase revenues and appropriations by $272,000; and
3. Authorize the City Manager or his designee to execute in the name of the City of Colton all grant documents, including but not limited to, applications, agreements, amendments, and requests for payment necessary for this grant project.
BACKGROUND
The City of Colton applied for funding to mitigate a land use covenant on City-owned property, Assessor Parcel Number (APN) 163-041-38, located at 160 S. 10th Street, in the City’s corporate yard. On July 1, 2022, the Department of Toxic Substances Control (DTSC) notified the City that it had been selected as the inaugural grantee for the Equitable Community Revitalization Grant (ECRG) in the amount of $280,000. On September 6, 2022, the City Council approved Resolution No. R-98-22, authorizing acceptance of the grant.
A first amendment to the agreement was executed on June 11, 2024, extending the agreement term to March 12, 2025. A second amendment followed on January 6, 2024, further extending 14 Packet Pg. 367

the term to February 26, 2026. To address data gaps related to historical site uses and PAH - impacted soil, a Supplemental Site Investigation (SSI), including soil and soil vapor sampling, was conducted by Ninyo and Moore in August 2023.
The SSI Report, issued on March 4, 2024, evaluated the risk posed to on -site commercial workers and the environment by contamination in the soil and soil vapor. Based on the findings, DTSC conditionally approved the SSI Addendum Report on August 2, 2024, but requested additional delineation of tetrachloroethylene (PCE)-impacted soil vapor and PAH-impacted soil.
The initial grant funds have been exhausted, leaving no remaining resources to complete the additional site investigation. On February 13, 2025, City staff submitted a request for a third amendment to the ECRG agreement, seeking an additional $272,000 to complete the additional work requested by DTSC.
ISSUES/ANALYSIS
The City of Colton is currently in the preconstruction design phase for a Zero Net Energy (ZNE) Public Works and Utilities building located at 160 S. 10th Street. During the initial Geotechnical Request for Proposals (RFP), a land covenant/deed restriction was identified on Assessor Parcel Number 163-041-38, situated within the City’s corporate yard.
A Phase I Environmental Site Assessment (ESA) has already been completed for the property.
The grant funding received will support the completion of the Phase II Environmental Site Assessment. Upon its completion, the City will be positioned to apply for future Environmental Cleanup grants, if needed, based on the results of the Phase II investigation. These results will determine whether the land covenant can be removed or if mitigation measures are required to enable the development of green space as the project progresses.
In response to these findings, the Department of Toxic Substances Control (DTSC) has requested additional soil testing and the creation of a cleanup plan. The City has submitted a request for further funding from DTSC to cover these additional tasks. On March 6, 2025, the City was notified that its ECRG Third Amendment Additional Funding Request, related to the original ECRG Agreement (ECRG-2021-00784), was approved, with an award of $272,000 in additional funding.
The breakdown of the award is outlined below:

DATE: APRIL 15, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: ANTHONY VEGA, POLICE CHIEF
SUBJECT: ACCEPT FY2024 JUSTICE ASSISTANCE GRANT (JAG) AWARD
AND APPROVE AND ADOPT A RESOLUTION APPROVING THE
BUDGET AMENDMENT TO REFLECT PURCHASE OF GLOCK
HANDGUNS, RIFLE CASES, PLATE CARRIERS AND RELATED
EQUIPMENT, RESOLUTION NO. R-16-25.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1. Approve and adopt Resolution No. R-16-25, authorizing the acceptance of the 2024 Justice Assistance Grant Award (JAG) in the amount of $14,391 and amending the FY2024/2025 Miscellaneous Grant Fund budget to accept the award.
2. Approval to purchase 9 Glock handguns, 70 Rifle cases and 10 Plate Carriers with the JAG 2024 funds.
BACKGROUND
The Justice Assistance Grant (JAG) is the provider of federal criminal justice funding to state and local jurisdictions. The formula for the distribution of funds is based on each city’s population, their part one crimes and direct allocations to state and local governments. The City of Colton’s allocation has been determined to be $14,391. These grant funds must be expended for law enforcement purposes only.
ISSUES/ANALYSIS
The Colton Police Department is currently allotted 6 3 sworn personnel. This is an increase of approximately 12 officer positions in the last 5 years. This has put a strain on our duty weapon 15 Packet Pg. 372

inventory. As a result, we are in fear of reaching capacity with all firearms being issued and having no available duty weapons in reserve. It is good practice to keep available reserve duty weapons should the need arise to replace due to over use or damage. For this reason, the department is wanting to purchase (9) Glock 47 semi -automatic handguns along with additional accessories, with a total cost of approximately $7,191. Staff has researched Glock 47 handguns and Gun Gallery was the lowest cost.
With the rise in violent crime to include active shooter type incidents it has become essential officers have access to the most effective weapons systems to keep the community safe. One of these weapons systems is AR -15 semi-automatic rifle platform. A necessity for the proper care and storage of the rifle is a padded storage bag specifically designed for the storage of this weapons system. The department has agreed to purchase (70) Tactical Rifle cases along with additional accessories with a total cost of approximately $2,000. Staff have researched rifle cases and MidwayUSA Heavy Duty Tactical Rifle cases were selected. MidwayUSA Rifle cases were the lowest cost, currently in stock and available to be purchased in the State of California.
The Colton Police Department deploys, on a collateral basis, 10 Special Weapons and Tactics (8 Officers, 2 Sergeants) operators. Each operator is equipped with a vest carrier system that houses the National Institute of Justice (NIJ) compliant soft ballistic armor and NIJ compliant ballistic plates. The NIJ sets the only nationally accepted standard for body armor worn by law enforcement officers. SWAT personnel are expected to be deployable at a moment’s notice and with reasonable response times. For this reason, all SWAT personnel maintain accessibility of their gear, which means the gear is handled daily. In addition, training is held twice a month, putting much stress and ware on the carrier system. The current carrier systems have become disheveled and outdated, and the fear is that they will soon be unable to be effective. To solve this issue, the department wants to purchase (10) plate carriers and pouches along with additional accessories with a total cost of approximately $5,200. Staff has researched plate carriers and the multicam black Agilite K -Zero plate carriers by Lionheart Alliance were selected as they were the lowest cost, currently in stock and available to be purchased in the State of California.
FISCAL IMPACT

ITEM NO. 16
STAFF REPORT
DATE: APRIL 15, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: DEB FARRAR, COMMUNITY SERVICES DIRECTOR
SUBJECT: APPROVE AND ADOPT A RESOLUTION TO AMEND THE FY 2024- 2025 BUDGET AND ACCEPT HOMELESS HOUSING, ASSISTANCE
AND PREVENTION PROGRAM (HHAP-4) GRANT FUNDS,
RESOLUTION NO. R-02-25.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
1) Adopt Resolution R -02-25 authorizing the execution of an agreement for grant funding through the County of San Bernardino Homeless Housing, Assistance and Prevention Program Round 4 (HHAP 4),
2) Amend the Fiscal Year 20 24-2025 budget to reflect the receipt of $ 345,580 in funding and allocate as detailed in this report,
3) Authorize the City Manager to execute all contracts necessary to proceed.
BACKGROUND
The San Bernardino City and County Continuum of Care (SBC CoC) has been allocated funds by the State of California Homeless Coordinating and Financing Council in the Business, Consumer and Housing Agency, under the Homeless Housing, Assistance and Prevention Program Round 4 (HHAP -4). HHAP is authorized by Assembly Bill (AB) 140, which was signed into law by Governor Gavin Newsom on July 19, 2021. HHAP makes available grant allocations to cities, counties, and continuums of care with flexible funding to prevent and end homelessness in their regions. The San Bernardino County Office of Homeless Services (OHS) is the Administrative Entity authorized to act on behalf of the county to administer HHAP -4 as designated by the SBC CoC.
16 Packet Pg. 391
Staff Report to the Mayor and City Council
Grant Award - Homeless Housing Assistance & Prevention Program (HHAP-4) April 15, 2025
ISSUES/ANALYSIS
The City of Colton applied for $346,000 in HHAP funding in Spring 2024, to sustain staff support for community members through Rental Assistance and Rapid Rehousing initiatives. On September 10, 2024, a letter from the County of San Bernardino Office of Homeless Services stated that the City of Colton had been recommended to receive $345,580 contingent upon final approval by the County Board of Supervisors. The official contract was received on December 13, 2024 for the amount above to be expended from December 3, 2024 – June 30, 2027.
The City of Colton has a goal of providing a direct response to the current global issue of homelessness through a Housing First approach, with past services and resources provided through the previous HHAP grants. This funding will provide the City of Colton with resources to continue to provide services directly and through collaborations with other agencies for the City’s target population of families and individuals that are at imminent risk of homelessness or are already homeless, including prevention services, navigation services, and rental assistance and Subsidies.
The program will be coordinated through the Community Services Department, with the aid of a new part time position of Case Manager, who will provide a centralized point of access for at - need individual, families or individuals who are recently homeless or homelessness is imminent.
This Case Manager will also continue to collaborate with local community organizations, faith - based groups, and government organizations to provide information on local services for the homeless community. This grant will fund the position from July 2025 through June 30, 2027, and the extension of the position will be determined by the success of the program and the ability to apply for other grants or alternative funding to extend the program and services.
Overall, this grant is expected to assist at least 44 households with eviction prevention or rapid rehousing, along with support services to even more community members. Staff recommends that City Council approve the acceptance of the HHAP grant funding in the amount of $345,580, authorize the addition of a part -time Case Manager position to support program implementation, and direct staff to proceed with the execution of the grant agreement and related program activities. This funding will enable the City of Colton to sustain and expand critical services that directly address the needs of individuals and families experiencing or at risk of homelessness, furthering the City's commitment to reducing homelessness and enhancing the quality of life for its residents.
FISCAL IMPACTS
The $345,580 in grant funding is reimbursable to the City for allowable expenditures in accordance with the HHAP Grant documentation and guidelines.

PROJECT DESCRIPTION
1. Project Description.
The City of Colton (City) has applied for and has been awarded funding from the Homeless Housing Assistance and Prevention Program, Cycle 1 in 2020, and the 2019 Homeless Emergency Aid Program (HEAP) to directly respond to the current global issue of homelessness through a Housing First approach. In order to continue to respond to the already prevalent need for housing assistance and the repercussions of the rising inflation rate, the City of Colton will need to continue expanding its programming. According to the 2023 Point-in-Time Count (PITC), Colton has 150 unsheltered individuals (one of the four highest counts in the County). It is imperative that the City continue to provide services to the homeless and at-risk of homeless (including the elderly and youth). As a disadvantaged City, funds can be constrained, and therefore outside funding sources need to be obtained. The proposed Homeless Housing Assistance and Prevention Program (HHAP) would provide the City the ability to continue supporting this vulnerable population with 1) Rental Assistance, 2) Rapid Re-Housing, and 3) Hiring a new Case Manager to manage intake. The City’s Homeless Assistance Program can only succeed by providing the homeless with services where they are, with funding from HHAP. The Community Services Department is equipped, experienced, and supported by the City, the community and the homeless population.
The City of Colton's Homeless Assistance program was created when awarded funding from the Homeless Emergency Aid Program (HEAP) grant program in 2019 with continued services from funding from the Homeless Housing Assistance and Prevention Program (HHAP) grant in 2020. The HEAP grant provided funding through May 2021. The HHAP-Cycle 1 funding completed in 2023. The Luque Community Center (Center) is the homeless prevention and resource center for the City of Colton. The Center provides direct services through the past funding sources (listed above). In addition to the homeless assistance, the Center houses the Colton Community Closet, providing a food pantry, gently used clothing and shoes, hygiene items, and limited medical supplies. This service is provided by appointment only. Twice a month, the Center is also the location for monthly emergency food giveaways in partnership with the Community Action Partnership of San Bernardino and the American Rescue Plan Act (ARPA). The Center was recently awarded $1 million from the State of California Budget to facilitate a renovation of the Center into a Homeless Resource and Prevention Center, which will further expand the City's serviceability.
With this renovation in mind, the City is poised to expand services to include a ¾ time Case Manager for 24 months to provide ongoing wrap-around services for those currently unsheltered or at risk of being unsheltered. The added Case Manager would allow the Department to track clients more efficiently, understand where they need more support, and make improvements based on outcomes.
2. Measurable Outcomes.
The project indicators are expected to reflect success in resolving homelessness. Each indicator represents data that the Case Manager will track from the beginning and throughout the entire project period. Logs will contain intake data and historical housing information, with first contact dates and any additional contact thereafter. Tracking will consist of coordination with the Colton Unified School District

to assist in identifying students who may be at risk of homelessness, utilizing existing databases from local hospitals and Continuum of Care. The Case Manager will be responsible for identifying the best strategies for addressing, tracking, and completing these goals. These goals include:
a. The projected number of homeless or at imminent-risk homeless families/individuals to be served by program funds is 40-44 families or 160-176 individuals. b. The projected number of homeless or at imminent risk of homeless families/individuals who will receive Rental Assistance will be 25-30 families or 100-120 individuals c. The projected number of homeless or at imminent risk of homeless families/individuals who will receive Rapid Re-Housing will be 10-15 families or 40-60 individuals. d. The projected number of homeless or imminent homeless individuals who receive rental assistance or subsidies and remain in their homes six months after their initial contact is at least 80%.
e. The projected number of literally homeless or chronically homeless to be contacted in unsheltered locations and be connected to wrap-around services is 10-15 individuals.
3. Administrative Capacity.
The City of Colton is a disadvantaged city of 54,285 (2021 U.S. Census Bureau). Our goal is to provide relevant services with strong leadership, while developing long-lasting strategies that improve our community members' lives. The City has the administrative capacity and staff support to ensure City programming succeeds but is reliant on external funding for priority programs that are not covered by our City funds. The Colton Homeless Assistance Program is a much-needed, proven successful program that requires funding to continue services such as rental assistance and rapid rehousing services, and having a Case Manager dedicated to this project.
The Community Services Department, with support from the City Manager, City Council, and all City Departments, supports the goals of the program and provides proactive assistance to ensure its success. Our Community Services Department consists of three divisions: Library Services, Recreation Services, and Early Childhood Education. Among these departments is a team of 75 employees, with identified responsibilities to collaborate, coordinate, and provide services to our underrepresented residents. Our comprehensive variety of City programs gives us the experience to understand and assist our community where they live. The goal of the Colton Homeless Assistance Program is to provide emergency services to our at-risk homeless population (including the elderly and youth) and current homeless persons. With past funding from the HHAP Cycle 1 in 2020 and the HEAP in 2018, the City has been able to provide much-needed resources to the homeless and at-risk community.
4. Project Sustainability.
Throughout the grant term, the Case Manager will continue to work to establish sustainable procedures and policies for the Homeless Assistance Program. The Case Manager will establish or expand on procedures and secure approval for the City’s HHAP policies during the first six months of hiring. As the project is publicized, the City anticipates the number of residents facing a housing crisis or homelessness, who receive assistance will increase. As Colton increases services through HHAP funding, the at-risk and current homeless population will have access to broader services. As needs are being met, we will see a reduction in those needing supportive services. Our project model is designed to assist at-risk individuals in a way that will increase their knowledge and experience in identifying and accessing resources. This experience will also increase their resilience. As their

resilience increases, they are able to support others in the community facing a potential housing crisis.
This is the very core of our current Neighbor Helping Neighbor program at the Center. The City will continue to publicize its project to our community, increasing our reach within the community to be able to provide well-rounded services. As we see the communities’ needs being met, we will continue fostering their resilience and connecting them to available services within the County of San Bernardino. During the course of the Homeless Housing Assistance and Prevention Program, the Case Manager will actively seek additional funding sources, including grants, corporate sponsorships, and community partners who may adopt our future endeavors. Further, the City Council has identified a portion of CDBG funding toward homeless services since 2019 and will continue to do so. These one-time funds will allow the City to continue providing a program to the community that is recognized as being a vital and valuable resource.
5. Long Term Results.
The City will continue to further its services currently provided. The City will continue with its established system for assisting residents who are at risk of imminent homelessness and are currently homeless by
connecting them to services needed to stabilize them. The long-term result will be that 75% of all clients entered into the City’s program for services will remain in their housing for at least six months after their initial contact with the City’s Homeless Assistance Program and preferably a year after our services have commenced.
6. Collaboration.
The City coordinates with the San Bernardino County Office of Homeless Partnership (SBCHP), the Family Services Association, the Central Valley Regional Steering Committee, and the Continuum of Care (COC) to obtain and stay up to date on the resources available for the City's Homeless Assistance Program’s target population. The City of Colton also collaborates with the Colton Joint Unified School District (CJUSD) to identify families in need and collaborate on what resources can be provided. The City connects with local churches and non-profit groups to explore existing services that connect residents to services. The City works with local public safety departments to identify unsheltered chronically homeless within the City in order to offer supportive services and community resources.
The San Bernardino County of Homelessness Partnership was developed to promote a strong collaboration between agencies to direct the planning, development, and implementation of the County’s 10-year strategy to end chronic homelessness. The SBCHP will assist in facilitating better communication, planning, coordination, and cooperation among the City and other service providers. The Family Services Association (FSA) is one of the largest, multi-service, non-profits in the Inland Empire.
FSA provides early education, trauma-informed mental health services, obtainable senior housing, support for home-bound individuals and more, serving over 13,000 community members each year. The Central Valley Steering Committee provides a regional response to the COC’s request for input and decision making from stakeholders in this area.

25. RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve the attached four side letters, associated market salary adjustments and resolution for the Colton Police Civilian Employees Association (CPCEA), Teamsters Local 1932 - General Employees Unit (General Unit), Teamsters Local 1932 – Mid-Manager Employee Unit (MM) and International Brotherhood of Electrical Workers Local 47, Water/Wastewater Division (IBEW, Water/Wastewater), to be implemented following the first full payroll cycle May 1, 2025 following Council approval.
BACKGROUND
The City of Colton has been experiencing a recruitment and retention crisis for the past 3 -4 years, facing significant challenges in recruiting, attracting, and retaining qualified personnel across all departments and levels of City employment. The City Council and the City Manager's office initiated a Labor Plan effort to increase Colton's salary structure to the mid -market range of comparable regional agencies. To date, the Labor Plan has been implemented for four employee Associations: the Colton Police Officers Association, the Colton Police Management Association, the Colton Dispatchers Association, and the Colton Fire Fighters Association. Labor Plan Compensation Adjustments
April 15, 2025
City is currently in negotiations with a successor Memorandum of Understanding agreement with the IBEW Electric Unit, and the Labor Plan will be reflected in their first year of the new contract.
This staff report addresses a market adjustment to the remaining four City employee associations: The Colton Police Civilian Employee Association, IBEW Water/Wastewater Association, Teamsters General Unit , and Teamsters Mid -Management Unit, to bring their classifications into the regional area labor mid-market range.
Approval of the attached Side Letters for each group and Resolution R -21-25 will finalize the City Labor Plan , bringing City of Colton employees up to mid -level market compensation compared to our regional neighboring agencies, as the City of Colton competes with these agencies for talent.
ISSUES/ANALYSIS
The City of Colton is below market for compensation across all departments, resulting in difficulty filling positions due to high levels of vacancies and unsuccessful recruitments, as well as retention issues. This turnover creates inefficiencies and incurs additional costs for all departments as they continually retrain and evaluate new employees. While this has been prevalent within our Safety Departments, it is also applicable to a significant extent among various classifications of the City’s miscellaneous employees, whom these four employee associations represent.
The City and the four-employee associations agree as follows:
The City and the Teamsters General Unit (General) agree: In May 2025, association classifications will receive mid-level market salary compensation adjustments, averaging
11.12%, as specified in General Side Letter #4, Attachment One. All other contract provisions remain the same and in effect.
The City and the Teamsters Mid -Manager Unit (MM) agree: In May 2025, association classifications will receive mid-level market salary compensation adjustments, averaging
14.65%, as specified in MM Side Letter #3, Attachment Two. All other contract provisions remain the same and in effect.
The City and the Colton Police Civilian Employees Association (CPCEA) agree: In May 2025, association classifications will receive 1) Animal Services Officer – 22.87% increase, 2) Code Compliance Officer – 11.04% increase, 3) Community Service Officer – 24.06% increase, 4) Lead Code Compliance Officer – 15.49% increase, 5) Police Services Clerk I – 16.43% increase, and 6) Police Services Clerk II – 26.35% increase. All other contract provisions remain the same and in effect. See CPCEA attachment Three, Side Letter #3.

Labor Plan Compensation Adjustments
April 15, 2025
The City and the IBEW - Water/Wastewater agree: In May 2025, association classifications will receive 1) Collection System Maintenance Technician I – 5.02% increase, 2) Public Works & Utility Inspector - .74% increase, 3) Senior Water Distribution Operator – 7.84% increase, 4) Senior Water Production Operator – 12.13% increase, 5) Wastewater Treatment Plant Mechanic I – 8.81% increase, 6) Water Distribution Foreperson – 3% increase, 6) Water Distribution Operator I – 9.28% increase, 7) Water Distribution Operator II – 11.98% increase, 8) Water Production Operator I – 20.51% increase, 9) Water Production Operator II – 19.73% increase, 10) Water Production Operator III – 22.19% increase. All other contract provisions remain the same and in effect. See IBEW – W/W attachment Four, Side Letter #3.
FISCAL IMPACTS
These Labor Plan salary range adjustments will cost approximately $2.14 million annually and $356,828 for the final two months of the 2024-25 fiscal year, identified as follows:
Bargaining Unit Total Annual Estimated
Impact
Total Estimated FY2024-
25 Impact
CPCEA $248,259 $41,385
IBEW W/WW $280,719 $46,796
Teamsters Mid
Managers
$992,293 $165,415
Teamsters General $619,271 $103,232
TOTAL $2,140,532 $356,828
These figures take into account the impact on other percentage -based premium pays, cash-out benefits, overtime, employer contributions to CalPERS, and the City’s portion of Medicare expenses.
As these changes were not previously factored into the FY2024-25 mid-year budget revision, budget resolution R-21-25 increases appropriations from reserve balance in various Funds’ Salaries Accounts for differences over $20,000 to effectuate these changes through the end of the current fiscal year in the following accounts and amounts:

Right of Way - Iowa Avenue
April 15, 2025
Condition of approval No. 51 of the Development Services Director’s Administrative Review Action Form requires right-of-way dedication fronting the site along Iowa Avenue in accordance with the Mobility Element of the General Plan. Iowa is designated as a Secondary Arterial Street in the Mobility Element of the General Plan. It is standard to condition new development projects to dedicate to ultimate right -of-way as a means to construct public improvements fronting the site in accordance with City Standards.
Section 66440 of the Subdivision Map Act (SMA) requires the legislative body to accept, on behalf of the public, any real property, including easements, offered for dedication for public use in conformity with the terms of the offer of dedication.
The developer has agreed to dedicate the easement and has prepared the legal description and plat plan included as Exhibit “A” and Exhibit “B” to the attached Grant of Right -of-Way Easement.
FISCAL IMPACTS
There is no additional financial impact for this action. The funding for the design, plan checking, construction, and inspection of proposed public improvements due to required right - of-way easement dedication including recordation filing fees are at the complete expense of the developer. The maintenance of the public improvements post -construction is added to the City’s street maintenance budget.

ITEM NO. 19
STAFF REPORT
DATE: APRIL 15, 2025
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: BILL SMITH, CITY MANAGER
PREPARED BY: ANTHONY VEGA, POLICE CHIEF
SUBJECT: APPROVE INSTALLATION OF "SAY NO TO PANHANDLING" SIGNS.
RECOMMENDED ACTION
Staff recommends that the City Council take the following action:
Approve the installation of “Say No to Panhandling” signs in strategically identified public locations and direct staff to work with local organizations to include information on giving alternatives.
BACKGROUND
The City has experienced a noticeable increase in panhandling activity, particularly in high - traffic public spaces such as shopping centers, freeway off -ramps, and intersections. Aggressive solicitation and the safety concerns associated with individuals stepping into traffic or approaching residents have prompted community complaints.
ISSUES/ANALYSIS
With the increase in panhandling, installing “Say No to Panhandling” signs serves several purposes:
• Public Education: The signs inform community members that it is illegal to panhandle:
o Penal Code Section 647c: Every person who willfully and maliciously obstructs the free movement of an person on any street, sidewalk, or other public place or on or in any place open to the public is guilty of a misdemeanor. Nothing in this section affects the power of a county or a city to regulate conduct upon a street, sidewalk, or other public place or on or in a place open to the public. 19 Packet Pg. 492
Staff Report to the Mayor and City Council
Signage - Panhandling
April 15, 2025
o California Vehicle Code 22520.5:
▪ (a) No person shall solicit, display, sell, offer for sale, or otherwise vend or attempt to vend any merchandise or service while being wholly or partly within any of the following:
▪ (1) The right -of-way of any freeway, including any on ramp, off ramp, or roadway shoulder which lies within the right -of-way of the freeway.
▪ (2) Any roadway or adjacent shoulder within 500 feet of a freeway off ramp or on ramp.
▪ (3) Any sidewalk within 500 feet of a freeway off ramp or on ramp, when vending or attempting to vend to vehicular traffic. ▪ (b) Subdivision (a) does not apply to a roadside rest area or vista point located within a freeway right-of-way which is subject to Section 22520.6, to a tow truck or service vehicle rendering assistance to a disabled vehicle, or to a person issued a permit to vend upon the freeway pursuant to Section 670 of the Streets and Highways Code.
▪ (c) A violation of this section is an infraction. A second or subsequent conviction of a violation of this section is a misdemeanor.
• Encouragement of Alternatives: The signage provides a telephone number for assistance and resources that provide long-term support.
• Improved Public Safety: Signs discourage solicitation in busy areas, reducing the risk of traffic-related incidents and confrontations between panhandlers and the public. • Community Standards: Posting these signs demonstrates the City’s commitment to a clean, safe, and welcoming environment for all.
The signs are not intended to criminalize or target any group, but rather to encourage responsible giving and promote engagement with the City’s social service partners.
FISCAL IMPACTS
Costs will be minimal and limited to sign production and installation. Sufficient appropriations are available in the General Fund Police Department supplies and equipment account number 100-6070-6071-2301-0000-000. The department is also seeking potential grant funding for this public safety initiative.
