CITY CLERK OF THE CITY OF COMPTON
JULY 7, 2026
TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS
FROM: JEROME GROOMES

ACTING CITY MANAGER
SUBJECT: CONSIDERATION OF A BALLOT MEASURE FOR THE NOVEMBER 2026

GENERAL ELECTION TO PROHIBIT THE SALE, POSSESSION, AND USE

OF FIREWORKS IN THE CITY OF COMPTON

SUMMARY
On June 9, 2026 staff received direction from Council to authorize preparation of a ballot measure for placement on the November 2026 General Election ballot proposing a citywide ban on all fireworks. The propose ballot consideration references Resolution No. 26,228, which previously outlined the City Council’s intent to evaluate and pursue measures enhancing public safety related to fireworks.

BACKGROUND
Fireworks activity in the City of Compton continues to pose significant public safety risks and quality-of-life impacts. Despite existing prohibitions on illegal fireworks and enforcement efforts by the Fire Department, Sheriff’s Department, and Code Enforcement, the community continues to experience:
 Large-scale use of illegal aerial fireworks
 Neighborhood disturbances throughout the summer months  Fire hazards to residential and commercial structures  Injuries to residents and visitors
 Distress to seniors, individuals with PTSD, children, and pets  Elevated noise and air quality complaints
In Resolution No. 26,228, adopted by the City Council, the Council expressed its commitment to exploring additional regulatory and enforcement options to improve community safety and reduce fireworks-related impacts. The Resolution further directed staff to evaluate legal mechanisms available for implementing a comprehensive fireworks ban, including voter-approved measures.

Staff has determined that a complete prohibition on the sale, possession, and use of fireworks in Compton— including currently permitted “safe and sane” fireworks— requires approval by the electorate, as authorized by the Compton City Charter.

21.21.21.21.21.21.21.21. STAFF REPORT – CONSIDERATION OF FIREWORKS BALLOT MEASURE FOR THE NOVEMBER 2026 JULY 7, 2026
PAGE 2

ANALYSIS
The placement of a ballot measure on the November 2026 ballot would allow Compton voters to decide whether to adopt a citywide fireworks ban. Key components of the proposed measure would include:

1.Prohibiting all fireworks within City limits, regardless of classification.

2.Authorizing the City Council to adopt supplemental regulations and fines.

3.Aligning Compton with regional jurisdictions that have adopted similar bans.

4.Strengthening enforcement authority, particularly during high-risk holiday periods.

Placing the measure on the November 2026 General Election ballot will ensure maximum voter turnout and reduce election-related costs through consolidation with the Los Angeles County elections process.

If the City Council directs staff to move forward, staff will collaborate with the Legal Division to draft ballot language, an impartial analysis, and the required resolutions calling the election and consolidating with Los Angeles County.

FISCAL IMPACT
Costs associated with placing the measure on the November 2026 ballot will depend on Los Angeles County Registrar-Recorder/County Clerk charges. Estimated costs will be presented to the Council upon receipt of the County’s final consolidated election fee schedule. Funding will be drawn from the General Fund’s elections budget.

ALTERNATIVES
The City Council may:
Direct staff to prepare the ballot measure for the November 2026 ballot; Modify the scope or timing of the proposed ballot measure; Decline to pursue placement of a fireworks ban on the ballot.

RECOMMENDATION
Staff recommends that the City Council:

Provide direction to staff to prepare all necessary documents for placing a fireworks ban measure on the November 2026 General Election ballot, consistent with the intent expressed in Resolution No. 26,228.

THE EXISTING PROFESSIONAL SERVICES AGREEMENT WITH MIG,
INC. TO INCLUDE THE DEPARTMENT OF HOUSING AND

COMMUNITY DEVELOPMENT (HCD) MANDATED REZONING/ZONING
CODE REVISIONS FOR AN ADDITIONAL COST OF $137,170.00 AND ESTABLISHING A PURCHASE ORDER FOR MIG, INC. FOR THE
ESTIMATED REMAINING CONTRACT BALANCE OF $76,520.05 TO
COMPLETE THE COMPREHENSIVE CITYWIDE GENERAL PLAN 2045

UPDATE, ASSOCIATED ENVIRONMENTAL IMPACT REPORT AND

AUTHORIZING THE CITY MANAGER TO AMEND THE COMMUNITY
DEVELOPMENT DEPARTMENT FISCAL YEAR 2026-2027 BUDGET TO

REALLOCATE REMAINING PURCHASE ORDER BALANCES TO THE
NEW MIG, INC. PURCHASE ORDER.

SUMMARY
Adoption of the attached Resolution will rescind Resolution Nos. 25,817 and 26,214 and replace them with a single consolidated resolution that ratifies the existing Professional Services Agreement with MIG, Inc., including an amendment in the amount of $137,170.00 for the HCD-mandated Rezoning/Zoning Code revisions, authorizes a purchase order in the amount of $76,520.05 for the remaining contract balance, and authorizes the use of budgeted funds to complete the project.

BACKGROUND
Government Code Section 65300 requires cities to maintain a General Plan that serves as the City's long-range policy framework for growth, development, housing, infrastructure, public services, and environmental stewardship. The City’s existing General Plan document was adopted in 1991 and no longer reflects current planning practices, development trends, housing requirements, or State laws. As a result, the Community Development Department released a Request for Proposals in February 2021 seeking qualified firms to prepare a comprehensive General Plan 2045 Update and associated Environmental Impact Report (EIR). Following a competitive selection process, MIG, Inc. was selected as the most qualified firm, and on April 19, 2022, the City Council authorized the City Manager to enter into a Professional Services Agreement with MIG, Inc. for the preparation of the General Plan 2045 Update and EIR.

July 7, 2026, Page 2
During preparation of the General Plan Update, the Housing Element was submitted to the California Department of Housing and Community Development (HCD) for review.

HCD subsequently required the City to complete the rezoning of impacted properties and revise portions of the City's Zoning Code to ensure consistency among the Housing Element, the General Plan, and zoning regulations. Because MIG, Inc. has served as the lead consultant throughout the planning process and possesses extensive familiarity with the City's land use framework, community outreach efforts, and environmental analysis, staff determined it was in the City's best interest to amend the existing agreement and retain MIG, Inc. to complete the HCD-mandated Rezoning and Zoning Code revisions for an additional cost of $137,170.00.

Resolution Nos. 25,817 and 26,214 were subsequently adopted by the City Council to authorize contract amendments, funding allocations, and purchase orders associated with the General Plan 2045 Update, Environmental Impact Report, and HCD-mandated Rezoning/Zoning Code revisions. To provide additional clarity regarding the purpose and funding of the previously approved actions, staff recommends adopting a single consolidated resolution that ratifies the amended agreement, authorizes the remaining purchase order needed to complete the project, and reallocates the remaining project funds to a new purchase order for project completion.

STATEMENT OF ISSUE
Staff is seeking City Council approval of the attached Resolution to ratify the amended Professional Services Agreement with MIG, Inc., rescind and consolidate previous Council actions related to the project, authorize a purchase order in the amount of $76,520.05 for the remaining contract balance, and reallocate the remaining project funds necessary to complete the General Plan 2045 Update, Environmental Impact Report (EIR), and HCD-mandated Rezoning/Zoning Code revisions.

FISCAL IMPACT
The total cost for the professional services agreement with MIG, Inc is $76,520.05. Funds have been allocated in the General Fund Fiscal Year 2026-2027 budget in Account No. 1001-780-000-4266. There is no additional impact to the General Fund. Funds for the remaining years of the agreement will be allocated in future City budgets Account No. Description Amount

Authorize issuance of a purchase order to MIG, Inc. in the amount of $76,520.05 from Account No. 1001-780-000-4266 (Contract Services). The funds shall remain available until all contracted services have been rendered and the agreement has been fully completed.

WHEREAS, the City's existing General Plan was adopted in 1991 and no longer provides up-to-date policy guidance necessary to address current planning, housing, environmental, and economic development issues; and
WHEREAS, on February 18, 2021, the Community Development Department released a Request for Proposals seeking qualified planning firms to prepare a comprehensive General Plan 2045 Update and associated Environmental Impact Report (EIR); and
