SECTION 1. The foregoing recitals are true and correct and are incorporated herein by this reference.
SECTION 2. The City Council hereby authorizes the City Manager to implement the direction provided by the City Council regarding the automatic renewal provisions contained in Section 2.4 of the Second Amendment to the Amended and Restated Agreement for Solid Waste and Recyclable Materials Handling Services with Consolidated Disposal Service, LLC dba Republic Services.
SECTION 3. If the City Council elects to allow the Agreement to automatically renew, no further action shall be required and the Agreement shall continue in accordance with its terms.
SECTION 4. If the City Council elects to exercise the contractual opt-out provision, the City Manager, or designee, is authorized to prepare and transmit the written notice required under Section 2.4 of the Agreement and take all administrative actions necessary to implement the City Council's direction, including returning to the City Council with recommendations regarding future solid waste collection services, if appropriate.
SECTION 5. If any section, subsection, sentence, clause, or phrase of this Resolution is held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Resolution.
SECTION 6. This Resolution shall take effect immediately upon its adoption.
