Title: Concord Logo/Caltrans Stormwater Green Infrastructure Manager: Bruce Davis
Proposed By: CDD - Engineering
Classification: CIP-Drainage and Stormwater
Location: Market St and Clayton Rd by Hwy 242
Begin Date: 7/1/2023
Completion Date: 7/1/2025
Related Projects:
Description: This will be a Cooperative project with Caltrans for storm water green infrastructure at the Market St and Clayton Rd Intersection. A combination of up to 15,000 square feet of bioretention area and full trash capture devices will divert runoff from 17 acres of public right-of-way (66-acre total watershed) prior to discharge into Pine Creek. This project involves storm drain system reconfiguration, low flow pump for diverting treatment flows to new bioretention area within City right-of-way, and full trash capture devices.
Pertinent
Issues:
Per Regional Board permitting requirements, the City of Concord has to install both full trash capture devices and storm water green infrastructure facilities. The initial funding for construction to be provided by an outside agency, in this case Caltrans. The siting and modification of existing City storm drain systems is critical to study and plan so that the benefits to the City can be maximized, since the long term costs of maintenance will be borne by City forces (Public Works). Additional opportunities for treatment of Caltrans right-of-way storm water runoff.

Title: La Vista Avenue/Joan Avenue Improvements
Manager: Aldrich Bautista
Proposed By: CDD - Engineering
Classification: TIP-Local Streets and Roads
Location: La Vista Ave/Joan Ave
Begin Date: 7/1/2027
Completion Date: 12/29/2028
Related Projects:
Description: This project will design and construct storm drain system at the intersection of La Vista Ave and Joan Ave to mitigate localized flooding at the intersection. Project scope of work includes roadway pavement widening to install concrete curb, gutter, sidewalk (on the east side), curb ramps, installation of drainage improvements, traffic signage and striping.
Pertinent
Issues:
Residents near the Joan Ave/La Vista Ave intersection have expressed concern about poor drainage and localized flooding within the project area. The existing drainage ditch and driveway culvert system located on the south side of Joan Ave has inadequate capacity to convey the 10- year storm event from the watershed. Right-of-Way acquisition may be required to construct the proposed improvements.

Title: Centre Concord Replacement Audio/Visual System
Manager: Greg Taylor
Proposed By: Information Technology
Classification: ITP-Information Technology
Location: Centre Concord
Begin Date: 1/4/2023
Completion Date: 12/27/2024
Related Projects:
Description: This project will upgrade current Audio and Video System at Centre Concord. The system is not fully operational and lacks the items renters and City meetings/events require. Replacing and upgrading the current system with modern technology will not only meet renters needs, but potentially increase revenue by attracting renters seeking cutting edge technology for their event. Add a paging system and hearing loop system to address Americans with Disability Act (ADA) compliance and general safety and communication within the building.
Pertinent
Issues:
The audio/visual system in ballroom has not worked properly in several years. The amplifiers in 2 of the 3 ballrooms are no longer working and a portable sound system must be set up for all users requiring sound. Renters requiring sophisticated audio/visual set-ups must contract with a DJ or sound vendor to meet their needs, which discourages some potential renters and a loss of rental revenue.
Due to facility reservations already booked through December 2022, the full project (replacement) would be best scheduled for December 2024. If only replacing stand-alone components, can be completed at any time.

Proposed By: Public Works - Facilities Maintenance
Classification: CIP-Parks and Recreation
Location: Concord Community Park
Begin Date: 10/3/2022
Completion Date: 2/1/2023
Related Projects:
Description: This project will improve restroom facilities at Concord Community Pool to include a family/inclusionary bath/changing room for pool users.
Pertinent
Issues:
Original construction of Concord Community Pool was completed in 1967 with a building that housed restrooms, changing areas and shower areas designated for Men and Women. The pool received a major renovation in 2003/2004 which updated many of the fixtures in the restroom rooms, changing areas and shower area but did not alter the configuration or add to them.
In an effort to create and promote an inclusive, equitable and welcoming environment for all swimmers who wish to utilize the pool, having rooms designated as men’s and women’s no longer meets the needs of the community.

Begin Date: 1/2/2023
Completion Date: 3/1/2023
Related Projects:
Description: This project will revitalize and modernize the interior of the Willow Pass Community Center, revitalize and repair men's and women's restroom walls, fixtures and flooring, replace fixtures, cabinets, counter tops, flooring, doors, door frames and window coverings in the main hall, lobby, kitchen, Arts & Crafts room and the Classroom, paint the entire interior, including offices, and add built-in projector screens and other AV equipment to bring the facility beyond 19th century technology.
Pertinent
Issues:
Significant lead time will be required to block out the facility from rentals and classes to perform the actual work.
A newer, more aesthetically pleasing interior is needed to maintain the building as an asset. The building's interior is 40+ years old and in extremely poor condition.

Proposed By: Public Works - Facilities Maintenance
Classification: CIP-Parks and Recreation
Location: Concord Community Park
Begin Date: 9/1/2022

Related Projects:
Description: This project will purchase and install permanent shade structures on the North and East side of the swimming pool. Material for shade structures are designed to allow for shade and UV protection while allowing wind and water to pass through them.
Pertinent
Issues:
Concord Community Pool has been one of the premier swimming locations in Contra Costa since its opening in 1967, the facility went through massive renovation in 2003/04. A recurring issue, which was unable to be addressed during the 2003/04 renovation, is the lack of shade to provide any level of protection from the harmful UV rays of the sun around the pool deck for parents, pool users, swim teams, spectators and staff.

Title: Centre Concord - Replacement Carpet and Tile
Manager: Robert Hardie
Proposed By: Public Works - Facilities Maintenance
Classification: CIP-Building and Grounds
Location: Centre Concord
Begin Date: 10/2/2023
Completion Date: 12/1/2023
Related Projects:
Description: Centre Concord is rented to the community for wedding receptions, reunions and other functions. As such, it provides a source of income to the City. This project will replace the tile in the lobby, and carpet in the ballroom and adjoining hallway at Centre Concord.
Pertinent
Issues:
Centre Concord hosts wedding receptions and higher-end social event rental business and the current carpet and tile are not to the appropriate standard. Over time, carpeting in any facility deteriorates and needs replacement. Providing a facility that is in first class condition is essential for the generation of rental income. The ballroom carpet was last replaced in January 2008. The lobby tile has not been replaced since 1993.
Delay or postponement of replacing the tile and carpet may result in a reduction in the number of rental events, and programs suitable to conduct at the Centre Concord Facility.
Due to the facility already being rented through December 2022, this project is expected to take place in October-December 2023.

Title: Concord Community Pool Bulkhead
Manager: Bernard Enrile
Proposed By: CDD - Engineering
Classification: CIP-Parks and Recreation
Location: Concord Community Pool
Begin Date: 11/13/2023
Completion Date: 1/15/2024
Related Projects:
Description: Installation of a new bulkhead at Concord Community Pool. The pool, when originally built in the 1960's, had a bulkhead separating the short and long courses of the pool. The bulkhead came to the end of it's useful life when it cracked, sank and had to be removed in the late 1980's.
Pertinent
Issues:
Adding back a bulkhead would help generate additional revenue to the City. With the expansion of teams, and the number of requests to use the pool, the current configuration doesn't allow staff to support as many programs to meet the demand. In addition, lack of a bulkhead prevents staff from accommodating the growing needs of existing user groups such as the Terrapin Swim Team.
Current configuration of the pool only allows for nine short course lanes in deep end area and six short course lanes in shallow area, a total of 15 short course lanes. With installation of bulkhead, total available short course lanes would be 25, adding 10 programmable lanes. This would allow for maximum usage of pool space and the ability to generate additional revenue.

Proposed By: Public Works - Transportation
Classification: TIP-Traffic Signals
Location: Citywide
Begin Date: 7/1/2022
Completion Date: 6/30/2027
Related Projects: Arterial/Collector LED Streetlight Retrofit - 2566 Description: Of the total 8,271 streetlights, about 1,000 are being replaced with an additional 500-800 being replaced as part of routine maintenance. The remaining ~6,500 streetlights still need to be upgraded to LED lights ahead of them failing.
Pertinent
Issues:
High rate of failure of existing induction streetlights. This is causing a strain on existing staff resources by not being able to keep up with the failing streetlights as well as not being able to procure material in time due to supply chain issues. A maintenance plan needs to transition into a citywide upgrade project to get ahead of these failures.

Title: Arnold Industrial Place/Peralta Road Traffic Signal Installation Manager: Abhishek Parikh
Proposed By: Public Works - Transportation
Classification: TIP-Traffic Signals
Location: Arnold Industrial Pl and Peralta Rd
Begin Date: 7/1/2025
Completion Date: 12/31/2026
Related Projects:
Description: This project will design and construct a new traffic signal plus geometric improvements at the intersection of Arnold Industrial Pl and Peralta Rd.
Pertinent
Issues:
Under existing conditions, this intersection does not meet the peak hour traffic signal warrant. Under future (2030) conditions with build out development, the intersection meets the peak hour traffic signal warrant during the AM and PM peak hours. Only the Peak Hour Warrant was analyzed and there is a possibility that this intersection could meet other warrants as well. Therefore, the project costs are 100 percent OSIP eligible to unfunded component costs.

Report in Brief
The Fiscal Years (FY) 2021-22 and 2022-23 Biennial Budget was approved by Council on June 8, 2021. Significant adjustments to the FYs 2021-22 and 2022-23 budgets were approved by Council at the Mid-Year Budget Update on March 8, 2022. Therefore, this Mid-Cycle Update will focus on a few minor adjustments proposed for FY 2022-23. The recommended modification to the General Fund budget incorporates an increase of $145,000 in one-time expenditures, which equates to 0.1% of the City’s operating budget. This modification has no material impact on the City’s projected General Fund reserve at the end of the FY 2022-23 budget year of just over 30%.
The body of this report covers the following topics:
Presentation of the Council’s Tier 1 and Tier 2 Priorities for the fiscal year; Fiscal Year 2022-23 General Fund Recommended Adjustments; Fiscal Year 2022-23 Measure V Fund Recommended Adjustments, this includes information on both contracts being recommended for funding; Fiscal Year 2022-23 Other Fund Recommended Adjustments; Measure V Oversight Committee Findings;
Information on the City’s Salary Schedule; and

Background
On June 8, 2021, the City Council adopted the City’s biennial operating budget covering FYs 2021-22 and 2022-23. Biennial budgeting refers to the practice of developing a budget every two years. Under biennial budgeting, the public and City Council receive annual mid-fiscal year updates in February/March as well as a mid-cycle review approximately 12 months after the initial adoption of the biennial budget. A biennial operating budget is a best practice because it requires more forward planning from the City and it allows limited staff resources to re-focus every other year from the operating budget to the City’s capital investment plan (CIP).
Prior to the preparation of the City’s current Biennial Budget, significant reductions were made to the City’s revenues and expenditures in response to the anticipated economic effects of the COVID-19 pandemic including the elimination of 36 full-time equivalents (FTE) staff positions at the Mid-Cycle Budget Update on June 9, 2020. At the time the Biennial Budget was prepared in June 2021, the pandemic’s effects on revenues were not fully known and the City appropriately budgeted revenues in a conservative manner.
In the months since the Biennial Budget was approved, revenues came in higher than budgeted. Therefore, significant adjustments were approved by Council at the Mid-Year Budget Update on March 8, 2022 for FYs 2021-22 and 2022-23, including restoring 17 full-time positions. The restored positions were determined to be critical to the organization’s success maintaining essential city services for the community.
This Mid-Cycle Update provides recommendations for adjustments to the operating budget covering FY 2022-23.

Analysis
The report is divided as follows for ease of reading.
Part I: Presentation of the City Council’s Priorities for the Fiscal Year Part II: FY 2022-23 General Fund Recommended Adjustments Part III: FY 2022-23 Measure V Fund Recommended Adjustments (including information on the two agreements being recommended for approval) Part IV: FY 2022-23 Other Fund Recommended Adjustments
Part V: Measure V Oversight Committee Findings
Part VI: City’s Salary Schedule
Part VII: City’s Annual Appropriations Limit
Part I: Presentation of the City Council’s Priorities for the Fiscal Year At Council’s annual priority setting workshop held in April 2022, Council determined its main priorities through FY 2022-23. Council reaffirmed the organization’s focus on the ongoing priorities (in no stated order) of fiscal stability, economic development, quality of life, public safety, roadway maintenance, customer service and being a desirable workplace.
Further, the Council established four Tier 1 priorities and one Tier 2 priority1 through FY 2022-23 as follows:
Tier 1
Staffing – Fill vacant positions in order to continue to provide essential services to the community.
Homelessness – Adopt a strategic plan to address the homelessness crisis using part of the $2.4 million one-time funds Council set aside the Mid-Year Budget Update in March 2022.
Development of the former Concord Naval Weapons Station – Work with Concord First Partners team on next set of approvals: Terms sheet, specific plan, disposition and development agreement, and Environmental Impact Report. Objective Design Standards – Create objective design standards for multifamily residential development, through a public process, to support Concord’s tradition of high-quality design, in response to recent State legislation intended to stimulate housing production.
1 Tier 1 priorities are to be the focus of the organization for the year, beyond day-to-day regular services and priorities. Tier 2 priorities reflect projects or programs Council has identified as important to accomplish during the fiscal year if staff resources allow for it.
City Council Agenda Report
Agenda Item No. x
June 28, 2022
Tier 2
License Plate Reader (LPR) Camera Deployment – Purchase and deployment of LPR cameras throughout the City to assist in identifying vehicles of interest in support of solving crimes more efficiently and assist our police department with public safety.
The City Council further agreed that if new items were added as priorities, or items were re-prioritized, then existing priorities would need to be moved to another tier or deferred until time and resources became available.
Part II: FY 2022-23 General Fund Recommended Adjustments The FY 2022-23 projected General Fund revenues are $116.1 million and projected General Fund expenditures are $116.1 million, which includes a proposed expenditure adjustment of $145,000, which equates to 0.1% of the operating budget.
General Fund Expenditure Recommended Adjustments
(1) City Manager/City Council –$145,000 Election Costs (one-time) Based on a current registered voter population of 72,524 and an estimated cost of $2-$3 per registered voter, the estimated cost of the election is approximately $145,048 to $217,572.
Final costs will be determined by the Contra Costa County Elections Division following the election and varies depending upon the number of agencies that consolidate and share in the election costs. Due to the increased cost of $2-$3 per registered voter from $1.25 - $1.75 per registered voter in the 2020 election, the City Council is being requested to approve a budget amendment to increase the Election budget by $145,000 for a total amount of $225,000. As this expenditure adjustment represents only 0.1% of the City’s operating budget, it will not have a material effect on the City’s reserves.
(2) City Manager/City Council – 1.0 FTE Video Services Coordinator – Transfer $60,000 from the Information Technology Operating Fund to the General Fund (no additional funding necessary)
The City Manager’s Office is requesting one FTE Video Services Coordinator to replace a previously defunded Video Services Coordinator position. The full-time Video Services Coordinator was converted to part-time during the Great Recession as result of the fiscal emergency. Adding back the position is necessary to ensure continuity of services.
The requested FTE will have a net-zero impact on the General Fund operating budget. Funding is proposed to be borne by the existing Community Relations budget for part-time video services, supplemented by the Information Technology
City Council Agenda Report
Agenda Item No. x

Department, which created budgetary savings through reduced printing and equipment costs. No additional appropriations are required.
The primary role of the Video Services Coordinator involves the recording and broadcasting of public meetings and maintaining the City’s government access cable channel. Secondarily, the City prioritizes the recording and broadcasting of community events such as the Music & Market concert series, the 4th of July parade, the Mayor’s holiday sing-a-long and tree-lighting event, and Mt. Diablo Unified School District high school graduations.
Video production has become a highly skilled profession through advancements in technology. Few candidates are willing to commit themselves to the long hours and late nights as part-time staffers. Consequently, recruitment and retention of skilled personnel has become an increasing challenge. Given the criticality of the role, staff recommends adding back a full-time professional to establish continuity. Doing so will also increase capacity to generate more content for Concord TV, website and social media platforms, thereby creating more opportunities to inform the community about important issues.
(3) Parks and Recreation – 1.0 FTE Recreation Program Aide - No additional funding necessary
The Parks and Recreation Department is requesting an additional FTE in the form of a Recreation Program Aide position in FY 2022-23. At the Mid-Year Operating Budget Update on March 8, 2022, a Program Manager was approved with an associated budget of $200,000. After receiving approval of the new position, the Department re-evaluated its needs and determined that two less skilled positions would support the Departments efforts providing recreational programming more effectively, and would require the same budget allocation. Consequently, the Department has under filled the authorized manager position with an aide position and is requesting the ability to add a second Recreation Program Aide position to their staffing. One of the more significant challenges facing this Department is hiring part-time staff, this aide position will relieve some of that pressure and is anticipated to be easier to fill. Additionally, it offers an entry level opportunity to the Department, supporting the Department’s succession planning efforts. This request would have no impact on the general fund or adopted budget as the cost of two Recreation Program Aides, with benefits, is equivalent to the cost of the Program Manager position approved at Mid-Year.
General Fund Reserves
The General Fund is projected to end FY 2022-23 with slightly over a 30% fund balance reserve. This includes holding $1 million in reserves for unforeseen economic uncertainties such as the ongoing COVID-19 pandemic.
City Council Agenda Report
Agenda Item No. x
June 28, 2022
Part III: FY 2022-23 Measure V Fund Recommended Adjustments (4) Measure V Sales Tax - $700,000 (ongoing)
Measure V revenues have been coming in higher than anticipated. This adjustment is based on actual results as of April 2022 and projections by the City’s sales tax consultant.
(5) Transfer to Police Department – $660,000 Contracts Professional (ongoing) In response to the “Community Conversation on Homelessness and Mental Health” meeting on August 12, 2020 and subsequent Council meetings on September 8 and 22, 2022, Council directed City staff to pilot two programs. The first program being expansion from a half-time CORE team to a full-time team and establishment of a Concord Mental Health Evaluation Team (MHET) to provide County services in Concord. City staff, after the initial pilot programs, and updates to Council on September 28, 2021 for CORE and January 10, 2022 for MHET, have determined the programs are successful and provide support to the unhoused and those who suffer from mental illness. Staff recommends continuing these programs on a fulltime basis for FY 2022-23 with an option for the City Manager to extend either or both agreements for up to two additional one year terms.
Use of these existing County programs continues to be an efficient way to enhance services within the City of Concord. If approved, the programs would continue to be funded primarily through Measure V revenue for FY 2022-23, consistent with the priorities Council shared with voters for the investment of Measure V revenue. The CORE Masters Level Social Worker will be funded by PLHA grant funds.
The projected estimated cost for a full-time CORE Team with the Masters Level Social Worker for one year (July 1, 2022 to June 30, 2023) is approximately $383,000. PLHA grant funds have been approved to fund the cost of the social worker and the remaining cost of the full-time CORE Team will be funded from Measure V. The requested not to exceed amount of $400,000 allows operational flexibility and contingency funds for City staff to address unanticipated program costs or potential cost increases.
The projected estimated cost for Concord MHET for one year (July 1, 2022 to June 30, 2023) is approximately $241,000. The requested not to exceed amount of $260,000 allows operational flexibility and contingency funds for City staff to address unanticipated program costs or potential cost increases. The fully loaded cost of the Concord Police Officer position re-assigned to the Concord MHET team is approximately $175,000; this cost would be carried in the Department’s operating budget.
Future funding options for each of the two additional one year option terms will be incorporated into the next Biennial Operating Budget.
(6) Capital Improvement Program (CIP) - 1 FTE Associate Civil Engineer (Limited Duration) - $194,000 annually for four years (no additional funding)
City Council Agenda Report
Agenda Item No. x
June 28, 2022
The Community Development Department, as part of managing the enhanced Capital Improvement Program (CIP) Two-Year CIP Budget that Council considered on the same night as this mid-cycle budget update, needs to add one limited duration position: Associate Civil Engineer. This position will be funded through the CIP budget and does not affect the operating budget. However, Council is required to authorize this position. The new position will bill directly to the Measure V funded Capital Projects in the adopted CIP; therefore the new position will have no impact on the General Fund.
In order to demonstrate to the voters of Concord who supported Measure V that the City is actively investing the sales tax revenue into our roadways, the Two-Year CIP is greatly accelerating the Five-Year Pavement Expenditure Plan and initiating design on all planned residential and arterial paving projects in the first year of the CIP, requiring immediate staffing support to deliver these critical projects on-time and on-budget. This position is needed as the volume of proposed new and continuing CIP projects exceeds the sustainable workload for the current CIP staffing levels.
Part IV: FY 2022-23 Other Fund Recommended Adjustments
(7) Sewer Fund – $98,500 Salaries and Benefits (ongoing) The Public Works department requests an appropriation of $98,500 from the Sewer Enterprise fund. The budget request is to support the exchange of one Heavy Equipment Operator and eight Maintenance Workers with five Maintenance Collection System Workers and four Lead Maintenance Collection System Workers.
The new classifications and proposed position exchanges were presented to and approved at the City Council meeting on March 1, 2022. Recruiting and retaining qualified employees within the Sewer Division has become increasingly difficult due to other agencies providing premium pay for their knowledge, skills and abilities. By creating the Maintenance Collection System Worker classification and the Lead Maintenance Collection System Worker classification, the City will have a competitive advantage when it comes to recruiting and retaining its qualified staff. (8) American Rescue Plan Act (ARPA) Fund – transfer to Project #2597 COVID-19 Testing Program (no additional funding)
On August 24, 2021, Council approved weekly COVID-19 testing/verification of City employees for one year, up to $350,000. These funds were budgeted for FY 2021- 22 only. Due to the ongoing pandemic, staff is requesting to reallocate the remaining funds as of June 30, 2022, up to $250,000, into a project account to be used through December 31, 2024 or whenever the funds are depleted, whichever comes first.
City Council Agenda Report
Agenda Item No. x
June 28, 2022
(9) Information Technology Operating Fund – transfer $60,000 to the General Fund As noted above, the City Manager’s Office is requesting one FTE Video Services Coordinator that will be funded through existing Community Relations budget for part-time video services and supplemented by the Information Technology Department, which created budgetary savings through reduced printing and equipment costs.
Part V: Measure V Oversight Committee Findings
The Measure V Oversight Committee reviewed the FY 2020-21 Annual Comprehensive Financial Statement (ACFR), which includes the annual audit; the proposed FYs 2022- 23 and 2023-24 capital budget; and the use of the previously approved Measure V Revenues in the General Fund Operating Budget for FYs 2021-22 and 2022-23 approved during the Mid-Year Budget Update held March 8, 2022. There are no further changes proposed to the use of Measure V Revenues in the General Fund Operating Budget.
After completing its review, the Committee found that it is consistent with the principles adopted with the ballot measures approved by Concord citizens in 2010, 2014, and 2020. The Oversight Committee found that:
The FY 2020-21 Annual Audit reflects that Measure Q/V funds were collected and appropriately spent, consistent with the ballot measure language. The City’s proposed use of Measure V revenues in the Biennial Capital Improvement Budget for FYs 2022-23 and 2023-24 addresses the City’s infrastructure backlog.
The Committee encourages Council to continue analyzing spending priorities to ensure that they meet the most pressing needs and concerns of all Concord residents. Additionally, the Committee commends the Council for partnering with the Concord community to address areas of community concerns and encourages further collaboration with residents and community members to achieve those goals.
A copy of the Measure V Oversight Committee report to the City Council is attached (Attachment 4).
Part VI: City of Concord’s Salary Schedule
In order to confirm that the California Public Employees’ Retirement System (CalPERS) will appropriately consider the City of Concord’s employee compensation earnable when calculating retirement benefits, the City of Concord’s Salary Schedule is required to be formally adopted by the City Council in a public meeting structured by Public Employees’ Retirement Law Government Code Sections 20636 and 20636.1.
City Council Agenda Report
Agenda Item No. x
June 28, 2022
The Public Employees’ Retirement Law Government Code Sections 20636 and 20636.1 define compensation earnable for State, School, and Public Agency members.
In order to meet the definition of compensation earnable, an amount of pay must constitute either pay rate or special compensation as defined in the statutes. Section 20636(d) further requires that pay rate and special compensation schedules, ordinances, or similar documents be public records available for public scrutiny.
Section 20636(b)(1) (applicable to Public Agency members) and 20636.1(b)(1) (applicable to School members) require pay amounts to be paid pursuant to publicly available pay schedules.
A cost of living adjustment was adopted by City Council for Confidential, Executive Contract, Executive Management, Management, Police Management Association, Concord Police Association, Professionals, and Teamsters employee groups effective July 11, 2022.
As a result of the Letter of Agreement between the City of Concord and the Concord Police Association, dated June 22, 2022, a one-time non-precedent setting market equity adjustment of five (5) percent to the base salary to the classification of Police Officer and Police Sergeant will be considered by City Council on June 28, 2022 to aid in recruiting and retaining qualified staff, effective July 11, 2022. The wages for these classifications have been adjusted to reflect these increases.
To be in compliance with CalPERS, Council must adopt the revised City’s Salary Schedule incorporating these adjustments. See Attachment 5.
Part VII: The City’s Annual Appropriation Limit
In November 1979, the voters of the State of California approved Proposition 4, which created limits on the amount of revenue that can be spent by most entities of government, including local governments. The method of calculating these limits was modified with the passage of Proposition 111 in June 1990. The City is in compliance with these requirements, and the City’s applicable proposed Municipal Budget appropriation subject to the limit (approximately $94 million) remains well below the $223 million appropriation allowed the City of Concord for FY 2022-23. A resolution setting the limit is required; Attachment 6, fulfills this requirement.
Environmental Review
None of the activities addressed herein constitute a “project” within the meaning of Public Resources Code Section 21065, 14 Cal Code Regs. Sections 15060(c)(2), 15060(c)(3), or 15378 because none of the activities has the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment; even if any activity was a project under CEQA, each is exempt under 14 Cal. Code Regs. Sections 15061(b)(2), 15061(b)(3) and 15378(b)(4).
City Council Agenda Report
Agenda Item No. x
June 28, 2022
Financial Impact
The proposed actions have no significant fiscal impact. The increase in spending of $145,000 to support the increased cost of this November’s municipal elections represents 0.1% of the operating budget.

TO: Honorable Mayor and Councilmembers
FROM: Citizen Measure V Oversight Committee - Brian Beckon, Chair; Michelle Lane, Vice Chair; Diane Sprouse, Greg Grassi, & Brandy Leidgen SUBJECT: Measure V Oversight Committee’s Review of the FY 2020-21 Annual Comprehensive Financial Report and Evaluation and Report on the City’s Proposed Use of Measure V Revenues in the Proposed Biennial Capital Budget for FY 2022-23 and FY 2023-24
The Measure V Oversight Committee (Committee) met on April 25, 2022 to review the Fiscal Year (FY) 2020-21 Annual Comprehensive Financial Statement (ACFR), which includes the annual audit.
At its March 24, 2022 meeting, the Committee heard a presentation from staff on the City’s preliminary Biennial FY 2022-23 and FY 2023-24 Capital Budget. At this same meeting, the Committee also received an update on the use of Measure V revenues in the City’s adopted Biennial Operating FY 2021-22 and FY 2022-23 General Fund Operating Budget. During its FY 2021-22 Mid-Year Review, City Council approved amending the Measure V budget to include a $2.6 million increase to the sales tax revenue in FY 2021-22 and FY 2022-23 based on strong economic recovery in sales tax post-pandemic, which is also supported by updated sales tax consultant estimates.
Additionally, new expenditure adjustments totaling $3.8 million (includes $1.2 million of one-time funds) in FY 2021-22 and $2.45 million in FY 2022-23 were approved to address infrastructure maintenance projects for pavement and roadways, building maintenance, and parks and medians maintenance. One-time funds were specifically used to prioritize the City Council’s goal of addressing infrastructure maintenance. The City Council also directed staff to reserve $2.4 million of one-time funds in FY 2021-22 for the needs of the unhoused and Council will provide direction on how to use these funds at a future date. Council also directed staff to appropriate $150,000 in FY 2022-23 to fund one Code Enforcement Officer position on an ongoing basis. The Committee supports these changes to the Measure V budget.
The purpose of the Capital Budget presentation was to obtain an understanding of how Measure V revenue is proposed for use in the Capital Budget in order to advise the Council. Measure V was passed to: protect core services, maintain the City’s reserves, address the City’s infrastructure backlog, and address areas of community priority.

Measure V Committee’s Finding Memo
June 28, 2022
The Committee has made the following findings with regard to its charge in oversight of the tax:
1. Does the FY 2020-21 Annual Audit reflect that the Measure Q/V tax was collected and appropriately spent?
On April 25, 2022, the Committee reviewed the FY 2020-21 Annual Comprehensive Financial Statement (ACFR) and determined that the presentation of the Measure Q/V Transactions and Use Tax in the financial statements (pages xiv, 13, 24-25, and 32) reflect the collection of the tax appropriately.
The Committee finds that usage of Measure Q/ V tax revenue ($18.5 million) was identified clearly in the annual audit (pages xiv, 30, 32 of the ACFR). Further, the Committee finds that $14.3 million of Measure Q/V tax revenue went to maintain City services, which allowed the City to avoid cuts to core City services, and the remaining $4.2 million was used consistent with the City’s Fiscal Sustainability Ordinance to support reserves and infrastructure investment. Consequently, the Measure V Committee concludes that the tax was collected and appropriately utilized.
2. Does the City’s proposed Biennial Capital Budget for FY 2022-23 and 2023- 24 address the City’s infrastructure backlog?
On March 24, 2022, the Committee reviewed the Proposed FY 2022-23 and FY 2023-24 Biennial Capital Budget and concluded that the presentation on the use of Measure V revenue to fund capital projects addresses the City’s infrastructure backlog. Specifically, the revenues are being allocated to support existing infrastructure and address areas of community and Council priority. Safe and usable infrastructure is a City Council priority.
The City borrowed $114 million to accelerate infrastructure projects, leveraging Measure V funds. Over the next two fiscal years, $79.2 million in Measure V revenue and funding from debt issuances for which Measure V funds are allocated for debt service are planned for various street improvement projects, parks facilities improvements, building maintenance, citywide accessibility enhancements, and improving efficiencies through information technology.
Measure V revenue comprises 14% and debt issuance funding comprises 55% of the proposed Biennial Capital Budget for FY 2022-23 and FY 2023-24, at approximately $16.1 million and $63.1 million respectively. The proposed capital projects do not create new, ongoing expenditures. The Biennial Capital Budget addresses the infrastructure backlog and allocates payments for debt service for infrastructure improvements.
Measure V Committee’s Finding Memo
June 28, 2022
Committee Summary and Recommendation
Measure V has proven to be a vital revenue source allowing the City to protect core services, safeguard reserves, address critical infrastructure backlogs, and focus efforts toward areas of community priority.
