Report in Brief
The Monument Boulevard Class 1 Path (Project No. 2455) is constructing a shared-use path along the east side of Monument Boulevard between Cowell Road/Oakmead Drive and Systron Drive/Walters Way, intersection improvements at Monument Blvd/Cowell Rd, Monument Blvd/Systron Dr, along with bio-retention and landscaping improvements within the project limits. See attached location map (Attachment 1). The Federal project number is CML-5135(059).
The construction contract was awarded on May 24, 2022, and construction began in July 2022. Due to long material lead times for traffic signal poles and street light poles, the project is being constructed as a two-season project. However, due to the nature of

the increased duration of construction, the cost for construction management, inspection, and materials testing services will need to be increased.
Recommended Action
Approve an amendment to a Professional Services Agreement in the amount of $30,065.40 with Park Engineering for the Monument Boulevard Class 1 Path (Project No. 2455) on Monument Boulevard from Systron Drive to Cowell Road; authorize the City Manager to execute the agreement in a form acceptable to the City Attorney; and make the CEQA determinations as provided in this staff report.
Background
The City was awarded federal One Bay Area Grant (OBAG 2) funding for the project in 2017, with funds unavailable for use until 2020. Caltrans approved the use of funding for design in May 2020 and design began later in 2020. Design was completed at the end of 2021 and Caltrans approved the use of funding for construction and construction engineering in February 2022. The project was advertised for construction bids in March 2022 and the construction contract and construction management agreement with Park Engineering was awarded in May 2022. The assumption at time of award was one construction season with ninety (90) working days. The contractor subsequently notified the City that there were eight to ten month material lead times for traffic signal and street light poles. The City and contractor, Redgwick Construction, agreed to proceed with construction on the project with the assumption of a two construction season project. For the City, the decision was based upon the fact that the project was federally funded and there are grant funding requirements that require work on the project to be invoiced every six months to Caltrans. Had the City delayed the project for eight to ten months, the federal funding would have been in jeopardy. Construction activities began in July 2022 and the first construction season concluded in November 2022. The second construction season began in January 2023 and project completion in the field is anticipated for end of June 2023.
The original amount ($258,424) for the professional services agreement with Park Engineering was agreed upon with the assumption of a one construction season project of ninety working days. This amendment adds a second construction season. City staff worked with Park Engineering to agree on an amount for additional cost for the additional 90-days of work, in the amount of $30,065.40. This will result in a new total of $288,489.40 for the agreement.
Financial Impact
The total budget for this project is $5,629,000 and is funded by federal One Bay Area Grant (OBAG 2) funds (Fund 402), Measure J Local funds (Fund 475), and Measure V funds (Fund 401 and 490). There are sufficient funds in the project budget for the amendment of the agreement.

Dear Tianjun,
As previously discussed, Park Engineering CM & Inspection Services original budget for the City’s Monument Blvd. Class 1 Path Project (Federal Project CML-5153(059)) will not be sufficient for completion of the project work.
Our original construction management, inspection and materials testing budget was based on information provided by the City for a 95 working day duration, with a small allowance of overtime. Due to the lengthy duration for procurement of the new signal and streetlight poles to be installed on the project, the start of the project’s working days were delayed until the construction efforts began for work specific to the intersection improvements related to the new traffic signal poles – Monument Blvd at Systron/Walters and Cowell/Oakmead, the controlling operation for the project. This start of intersection work was sequenced to be coordinated with the arrival of the new signal poles and recently began in mid-January 2023.
However, work was allowed to commence on the efforts to construct the non- controlling items of work on the project specific to the new path along Monument Blvd.
Activities to construct the new trail included demolition and grading, concrete improvements, HMA plug paving & digout work, retaining wall construction, pervious concrete installation for the path, new path lighting conduit, box & foundation work, fencing, irrigation and planting activities.
This significant amount of work required nearly full-time inspection efforts as well as significant materials testing to ensure quality of work and materials placed. This preliminary trail construction work started in mid-July 2022 and has used approximately 75% of the $235,000 budget through January 2023, with field work likely to continue into May 2023 for completion.
As the “split start” of the project work without contract time starting was not anticipated in the original cost estimate from Park Engineering based on contract documents available, please find an additional budget estimate of $30,000 to be added to our original budget amount for continued services to ensure the project’s contract compliance, with consideration the original contract allotment had a 10% contingency for a $258,424 total. This estimate includes field time for the remaining concrete, electrical, paving & resurfacing, striping & signing work, planting and irrigation work estimated to complete in May 2023, as well as hours to complete final payment to the Contractor and overall project files / documentation. There is also an allowance for any remaining materials testing to be performed – both concrete and HMA work.

Report in Brief
The City of Concord has been selected to receive an amount of $7,026,000 in federal and regional grant funding from the Metropolitan Transportation Commission (MTC) to fund two transportation Capital Improvement Program (CIP) projects within the City limits under the Cycle 3 One Bay Area Grant (OBAG 3) and the Cycle 6 Regional Active Transportation Program (ATP) funding programs. These projects and respective grant amounts are: (1) Galindo Street Multimodal Corridor Project with project limits between Salvio Street and Clayton Road and Clayton Road between Galindo Street and Grant Street (OBAG 3 - $3,361,000); and (2) Willow Pass Road Bikeway Connection Project (OBAG 3 - $830,000 and Cycle 6 Regional ATP - $2,835,000), with project limits including Willow Pass Road between Parkside Drive and Landana Drive and Parkside Dr. between Willow Pass Road and Salvio.
These projects will implement bicycle and pedestrian safety, access to transit, and other needed traffic safety and pavement rehabilitation improvements along these two corridors. The awards of OBAG 3 and Cycle 6 Regional ATP funding are contingent upon the City of Concord meeting certain MTC requirements. As one of the requirements, the City must adopt Resolutions agreeing to comply with state housing laws, committing to local matching funds support in a total amount of $1,315,169 to secure these grants from MTC, and stating assurance to complete these two projects.
Recommended Action
1. Adopt a Resolution agreeing to comply with the State Surplus Lands Act, state laws regarding Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs), and State Density Bonus Law, and representing that the City of Concord is in compliance with these laws;

Background
In June 2022, the Contra Costa Transportation Authority (CCTA) released a call for projects for federal OBAG 3 funds seeking applications from their member agencies in Contra Costa County. OBAG 3 funds are administered by MTC for the nine county Bay Area counties through respective County Transportation Agencies, which is CCTA for the City of Concord. In July 2022, the City of Concord submitted two grant applications to CCTA with a total funding request of $6,751,800 in federal OBAG 3 funds to implement pedestrian, bicycle, road crossing, safe routes to school, and access to transit improvements, along with needed pavement rehabilitation on Galindo Street and Willow Pass Road within the City limits (see Attachment 1 – Projects Location Map).
Simultaneously, the City submitted grant applications to MTC seeking Cycle 6 Regional ATP funding for these two corridor improvement projects, in response to a separate call from MTC.
Based on a comprehensive review of grant applications conducted by review Committees at CCTA and later at MTC, Concord’s grant applications scored among the highest in Contra Costa County, which resulted in MTC selecting these two projects to award a total of $4,191,000 in OBAG 3 grant funds. This amount, fully funds the Galindo Street Multimodal Corridor project request of $3,361,000, and partially funds the Willow Pass Road Bikeway Connection Project request with $830,000 in grant funds. MTC has also selected the Willow Pass Road Bikeway Connection Project to award $2,835,000 in grant amount under Cycle 6 Regional ATP funding, which, together with the OBAG 3 grant, fully funds the Willow Pass Road Bikeway Project’s fund request.
Securing OBAG 3 and Cycle 6 Regional ATP grants require the City to commit approximately $1,315,169 in total local match funds to complete the Galindo Street Multimodal Corridor and Willow Pass Road Bikeway Connection projects. This staff report discusses meeting the OBAG 3 and Cycle 6 Regional ATP requirements by adopting four City Council Resolutions.

Both projects were recommended as top tier projects in the City’s adopted 2016 Bicycle, Pedestrian and Safe Routes to Transit Plan for conducting Complete Street Studies.
The complete street study for both corridors combined was completed in 2020. As part of the approval process, the recommendations from these studies were reviewed and supported by the Bicycle Pedestrian Advisory Committee prior to the City Council adoption in January 2020.
City Council Agenda Report
Agenda Item No. 4.e
April 25, 2023
Galindo Street Multimodal Corridor
The Galindo Street Multimodal Corridor Project will be implemented between Salvio Street and Clayton Road, and will include a combination of new Class I1 and Class II2 bike lanes on both sides of the roadway. The segment between Salvio Street and Willow Pass Road will include a raised landscaped median, Class II bike lanes with buffered striping, and green bicycle markings. The segment between Willow Pass Road and Clayton Road will include 6 feet of landscaping on both sides of the street separating 10-foot-wide Class I shared bicycle and pedestrian path from vehicular traffic. The project also includes installation of vertical delineators on the existing Class II bike lane on Clayton Road, from Galindo Street and Grant Street, converting it into a Class IV3 bike lane.
Subsequent to the adoption of these resolutions and after completion of project formalities including hiring a design consultant, the project will go into design by early 2024. Final design is anticipated to be completed by early 2025 and construction anticipated to start early 2026.
Willow Pass Road Bikeway Connection
The project will construct a protected Class IV bike lane along Willow Pass Road from Parkside Drive to Landana Drive and Class II bicycle lanes on Parkside Drive from Willow Pass Road to Salvio Street. Additionally, the project will install Rectangular Rapid Flashing Beacons (RRFB) and green conflict markings at a key intersection. This project fills a gap in the bicycle network that connects with planned and funded Downtown corridor improvements and ultimately provides a bikeway connection from the neighborhoods along the Willow Pass Road to the Downtown Concord BART station.
Subsequent to the adoption of these resolutions and after completion of project formalities including hiring a design consultant, the project will go into design by early 2024. Final design is anticipated to be completed by early 2026 and construction anticipated to start late summer 2026.
The City of Concord must adopt the proposed Resolutions (Attachments 1, 2, 3 and 4, respectively) to agree to comply with state housing laws (specifically, the Surplus Lands Act, laws regarding Accessory Dwelling Units and Junior Accessory Dwelling Units, and State Density Bonus Law), and demonstrate the City’s commitment to provide necessary matching funds ($1,315,169) for the Galindo Street Multimodal Corridor and Willow Pass Road Bikeway Connection projects, in order to receive the federal OBAG 3 grant in the amount of $4,191,000 and Regional ATP Cycle 6 grant in the amount of 1 Class I bike lanes are off-street facilities, dedicated exclusively to use by bicyclists, pedestrians, and in some cases, equestrians and other non- motorized travel.
2 Class II bike lanes delineates a portion of the road for bicyclists. 3 Class IV bike lanes are on-street facilities that are separated from vehicle traffic by some form of physical protection.

Please state your reason for applying, including qualifications for this position:
As a resident to Concord I feel it is important to get involved with the development of the community. My husband and I chose to live in Concord for one specific reason, affordability. Once we began to immerse ourselves in the community we discovered that there is so much more to living here than just economics.
We discovered the vast amounts of outdoor space, convenient shopping, restaurants representing foods from around the globe and so many community events and activities. We plan to be lifelong Concord residents so the development and progress of how the city continues to take shape matters to us. My husband and I have have owned a real estate appraisal company for 19 years and in that time have come to truly understand why people live where they live and what makes a community a community. We have worked with young people just starting out in adulthood make life decisions as well as the helped the elderly understand their options and resources to aid them within their community. Home and community are at the core of our business because security within these areas of life are what matters most to many people. My opinion of Concord is that it is a city where people can thrive and grow and I would be honored to be a part of and encourage.

Question applies to multiple boards
Considering your experience and activities in business, labor, professional, social, or other organizations, indicate the experience, technical training, and/or skills which qualify you for an appointment:
As of December 21,2022 I will be sworn in as a Planning Commissioner and I believe I was appointed by the city council because of my community involvement, professional familiarity of many of the details to be considered on the planning commission and involvement associated with my participation with the California Association of Realtors where many of the housing, social, and economic issues are discussed to provide guidance for local and state entities. Additionally, as a working real estate agent in the community, I have a unique opportunity to hear from existing residents and prospective future residents what they are looking for in a community. All aspects of my career and charitable work require me to listen effectively, communicate clearly and collaborate without ego for the purpose of uncovering the best solutions for the betterment of people, members or organizations. My training from the Pepperdine Davenport Institute and Center for California Real Estate Leadership in Government workshop series allowed me to learn more about local government structure and identify which issues typically fall under city, local, or state jurisdiction. I have had the opportunity to meet with sitting Senators, former US Attorney Generals and local leaders which has allowed me to understand the gravity of issues affecting our local community and their impact on a national level. I have participated with my local real estate association's strategic planning committee and I am currently the chair for the strategic planning committee for a cancer charity organization and those positions require me to think forward to help create and implement strategies that support and promote current and future success.
Why would you like to participate in the Concord Community Academy? I have participated in the Concord Community Academy in the past and found that it was incredibly valuable in helping me understand how the city functions, what amenities the city has to offer and what challenges and potential solutions the city faces. I would be happy to participate again either as a student or a resource for the program.

I have experience serving on various Boards and Committees in Contra Costa County and in the City of Concord. I like to make a difference and give back to our Community through my experiences and passion. I think I will be fit in this position because I know about our city's demographic, and have worked with many of the on several occasions through my business and work experience through the city.

I am qualified for Planning Commission because I have the short-term and long-term planning experience through my personal businesses, and have carried out these plans successfully through my drive and vision. For example, in the Economic Opportunity Council mentioned above, 88% of the CSBG funding we receive is supposed to go to the community below the poverty line, which was not actually happening before I became chairperson of the council. I worked with the staff and the board to make a positive change and plan to give as much money as possible to the deserving people. As the result of this, in the 2018-2019 year, we have gone from 14% (before my chairmanship) to 76% under my leadership, which is one of the biggest achievements done by anyone in the Council's history (which started in 1964).

Please state your reason for applying, including qualifications for this position:
Reason: City Planning Commissioners have a unique responsibility in shaping a city; because Concord is currently in a position to both grow and redevelop, I think that this would be a particularly engaging time to do this work. I think that I would bring value to the discussion, given my career experience and my personal interests, and I would appreciate the opportunity to learn more about the city I now call home.
I've always been interested in serving on the Planning Commission wherever I've lived but this is the first time that family circumstances make it possible for me to give the role the attention it deserves. Skills:
lead collaborative, cross-functional groups in creative thinking, problem-solving, strategic planning, research, analysis, and oral/written communications; build relationships across sectors and functions; set targets and produce outcomes in challenging circumstances. Work Experience: For 20 years I have worked in the fields of community economic development; affordable housing finance and development; commercial real estate analysis, feasibility, and consulting; and economic development and housing policy at both the city and state level. I am currently the Senior Community Investment Officer, Western Region, for the Corporation for Supportive Housing, where I lead the team in our Redesigning Access by Centering Equity (RACE) Initiative, which supports the efforts of emerging BIPOC housing developers. My previous position was Housing Development Officer for the City and County of Denver. Early in my career, I worked as a City Planner for the City of Pittsburgh (Pennsylvania). I have 15 years of project management and organizational management experience as founding CEO of two startup nonprofits (including the Texas Association of Community Development Corporations), as a community investment officer, and as a professional practice manager.

Question applies to multiple boards
Please state your reason for applying, including qualifications for this position:
I have been in the real estate industry for a decade now, doing real estate finance, development, and consulting for folks looking to build and expand their real estate portfolio. I often refer to the city's general plan to understand land use ordinances and abilities to grow and develop properties that will improve the city. I recently ran for city council and lost to Mayor Hoffmeister, and I'm sure you know. This event spurred me to stay involved in the overall betterment of concord. I'm raising a family here, and I'd like an opportunity, as a young person, to promote progress and have a say in how our city develops and moves forward.
Question applies to multiple boards
Considering your experience and activities in business, labor, professional, social, or other organizations, indicate the experience, technical training, and/or skills which qualify you for an appointment:
As stated above, I have been active in the real estate community for the last ten years. Serving on boards with the Contra Costa Association of Realtors, developing property locally, and helping families become homeowners. Before my time in real estate and attending college in Southern California, I built a house in Grass Valley. My father is a retired developer and has been a close advisor for my entire career. I believe the planning commission is a natural fit based on my experience in real estate and my passion for sustainable city planning and growth.

Why would you like to participate in the Concord Community Academy? I am an active member of the Concord community. I encourage folks to get engaged with local programs and events held by the city and know what's happening locally. I'd be proud to get involved in the Concord Community Academy and encourage the younger generation to do so. I have observed an overall lack of interest in civic activities among young people, which needs to change. I am an avid supporter of civic engagement at all levels and from a young age.

Planning Commission Interview Process
Supplemental Questions for Incumbents
Name: Jason Laub
1. If you were in the minority on any vote on an issue before the Planning Commission, please describe the point of disagreement in the case.
Concord Airport Self-Storage. I was uncomfortable with the proposed setback variance and required findings to support the variance request. I felt the requested variance was an issue that was self-inflicted by the applicant and could have been avoided. I moved for denial of the project. Motion was seconded by Commissioner Barbour. The motion failed and the project was approved with the proposed variance.
2. If you were in the majority on any vote on an issue before the Planning Commission, please describe the point that the other side disagreed with.
Heckmann Subdivision. One Commissioner disagreed with some findings for the project which he viewed as subjective. He was also uncomfortable with neighborhood transition requirements and what the project had proposed.
