TRAFFIC SIGN AND PAVEMENT MARKING CONSTRUCTION NOTES:

ALL TRAFFIC CONTROL WORK FOR CONSTRUCTION SHALL CONFORM TO PART 6- TEMPORARY TRAFFIC CONTROL OF THE CA-MUTCD, ANY ADDENDUMS TO OR LATEST EDITION AND ALL O.S.H.A. REQUIREMENTS.

3. THE CONTRACTOR SHALL HAVE ALL TRAFFIC CONTROL SIGNS, DELINEATORS, ETC., PROPERLY INSTALLED PRIOR TO COMMENCING CONSTRUCTION.

4. THE CONTRACTOR SHALL MAINTAIN ALL TRAFFIC CONTROL SIGNS, DELINEATORS, ETC., TO ENSURE PROPER FLOW AND SAFETY OF TRAFFIC WHILE WORKING IN THE STREET.

5. ADDITIONAL TRAFFIC CONTROL DEVICES MAY BE REQUIRED IN THE FIELD. THE CONTRACTOR SHALL BE RESPONSIBLE

FOR ANY ADDITIONAL TRAFFIC CONTROL DEVICES REQUIRED BY THE CITY INSPECTOR/REPRESENTATIVES TO ASSURE PUBLIC SAFETY AT ALL TIMES.

6. THE CONTRACTOR SHALL UTILIZE A FLAGMAN DURING CONSTRUCTION WORK AS DEEMED NECESSARY BY THE AGENCY REPRESENTATIVE.

ARROW BOARDS SHALL BE USED ON ANY LANE CLOSURE ON ARTERIAL STREETS.

7. STRIPING SHALL BE CAT TRACKED AND APPROVED BY THE ENGINEER PRIOR TO FINAL INSTALLATION.

8. MAINTAIN ONE TRAFFIC LANE ON BOTH DIRECTIONS AT ALL TIMES.

9. ALL TRAFFIC LANES MUST BE OPEN ON WEEKENDS AND HOLIDAYS.

10. ANY DEVIATION TO THE TRAFFIC LANE REQUIREMENTS SHALL REQUIRE THE CITY ENGINEER'S APPROVAL A MINIMUM 24 HOURS ADVANCE NOTICE IS REQUIRED.

GENERAL NOTES
Scope of Work
All work shall comply with all applicable sections of the Standard Specifications for Public Works Construction, Caltrans standards, APWA standards, and all city standards. The work shall include all labor, materials, equipment and incidentals necessary for the installation of all work indicated in these plans and the specifications. Contractor shall verify specific conditions of the work to be performed with the invitation to bid.

Quality of Materials
Materials specified in the plans and specifications shall prevail when of a higher standard than those required to meet state and local codes.

Plan Background
These plans are based upon an electronic file of the existing project medians provided by the project engineer, aerial photos, and field measurements. Any existing trees, electrical, or irrigation equipment shown in the medians or in the edge of Right of Way areas shall be considered approximate which shall require the Contractor to verify the information in the field. Contractor shall verify all site information in the field and shall notify LOST WEST and the City representative immediately of any discrepancies or existing conditions which would effect project outcome as designed.

LOST WEST has prepared these plans and specifications as Project Landscape Architect. LOST WEST shall not be responsible for any work which is not explicitly detailed in these plans, and is not responsible for the work of any other company or person(s) providing services on this project either in the past or in the future. The contractor shall be solely responsible for determining the method and means of construction.

Existing Site Conditions
Contractor shall be responsible for contacting Underground Service Alert for the mark-out of utilities prior to the commencement of any work related to these plans. The mark-out shall be done with chalk-based paints only.

Contractor shall verify the location of all structures above and below ground within and adjacent to the project site prior to and during the course of work. Contractor shall inform City representative and LOST WEST immediately should discrepancies between the plans and actual site conditions be discovered which have a negative effect on the design or it's implementation.

Job-Site Conditions
Contractor shall maintain job-site in a weed free state during construction and the maintenance period by use of a non-selective herbicide. Contractor shall keep site neat and free of construction debris and unneeded equipment at all times.

Traffic Control
Traffic Contractor shall be in compliance with the requirements of the latest edition of MUTCD. Lane closures on major streets such as Slauson Avenue & Atlantic Blvd. shall be restricted to night work from 8PM to 6AM. No street closure is allowed.

Water Conservation
Water-use classifications were determined using the WUCOLS IV - WATER USE CLASSIFICATION OF LANDSCAPE SPECIES available at; https://ccuh.ucdavis.edu/wucols-db Specified Products
All products referenced or specified within the Plans, Specifications, and Bid Schedule shall be considered as, "Or Approved Equal", for which the Contractor may propose an alternative vendor for a particular product or service during the review of product submittals for the project. Alternative vendors or service providers will then be considered within the context of the design of the project and will be given equal consideration by LOST WEST.

General Demolition Notes

1. Contractor shall make an appraisal of the existing conditions in and near the project area and compare them with the project requirements. Contractor shall verify the extent of demolition required with the City representative.

2. Contractor shall document existing conditions in and near the project area with photos, videos, and /or drawings taken prior to the start of construction.

3. Hazards which are discovered or occur during demolition shall be brought to the attention of the City immediately, and all job activities in the hazard area shall cease until a course of action is determined by the City.

4. Contractor shall keep an inventory and record the condition of items to be removed. Any items that shall be removed and salvaged shall be clearly tagged and given to the City representative, or delivered for storage as designated by the City representative.

5. Contractor shall locate all existing utilities whether shown on the Plans or not as the first item of work, and protect all existing utilities and facilities from damage or disturbance. Contractor shall notify City representative immediately should any damage occur and assume full responsibility for the expense of any repair or replacement. Contractor shall notify City representative immediately should field conditions vary from those shown on the Plans.

6. Contractor shall notify the City representative when any unanticipated utility structure, conduit, pipeline, or any other structure or object is encountered, and shall provide City representative with a diagram or map of the object(s) before continuing with demolition work.

7. Contractor shall locate utility services within the project areas being demolished and coordinate with utility companies with the shut-off of those services during the course of the work. If services are required to be removed, relocated, or abandoned, Contractor shall provide temporary services that bypass the area to be demolished in order to maintain service to other areas of the site which are outside of the demolition area. Any pipe or conduit being removed that is embedded in a structure or paving that is not being removed shall be cut-off flush with the remaining structure and filled with epoxy or non-shrink grout so as to be invisible.

8. Contractor shall protect existing services, structures, and systems to remain against damage during demolition and during the construction of adjacent new improvements.

9. Inactive or abandoned utilities shall be disconnected and removed, or plugged/capped as directed by the local governing agency or the City representative.

10. Active utilities shall be protected at the expense of the Contractor and shall be maintained in operating condition during the work, including any existing irrigation systems that have been designated to remain in the Plans.

11. Contractor shall not proceed with construction when it is obvious that known obstructions exist that may not have been known during design. Such conditions shall be immediately brought to the attention of the City representative. Contractor shall assume responsibility for all revisions due to the failure to give said notification.

12. Contractor shall conduct debris removal at the same time as the demolition operations to ensure minimum interference with roads, streets, walks, and other adjacent facilities and users.

13. Contractor shall provide temporary barricades and other protection required to prevent injury to people and damage to adjacent facilities and structures to remain. Contractor shall provide temporary weather protection during demolition and construction to prevent water leakage or damage to structures or interior areas. Contractor shall protect work that is to remain or that is exposed during demolition, and shall cover and protect equipment that has not been removed.

14. Contractor shall provide and maintain shoring, bracing, and structural supports as required to protect the stability of construction and finishes to remain, adding new supports as required during the progression of demolition to prevent movement, settlement, or collapse.

15. Demolition and removal work shall be performed to prevent damage to any existing trees noted on the Plans to remain.

16. All work shall conform to the requirements of the latest adopted editions of the Uniform Building Code, the Standard Specifications for Public Construction, the Americans with Disabilities Act, and any and all other applicable local and state codes, ordinances, or regulations.

17. Contractor shall not use torches until work area is cleared of flammable materials. Verify contents of pipes or conduits prior to starting flame-cutting operations. Maintain fire watch and fire suppression devices during any flame-cutting operations.

18. Clear the site of grass, weeds, trash, debris, and inactive or abandoned facilities, within the area of construction of the improvements to the limits and depths as shown on the Plans.

19. Contractor shall remove tree and plant roots larger than 2 inches in diameter, rocks or concrete chunks larger than
4 inches in diameter, and any abandoned underground facilities verified by the City representative and/or their associated agency to a minimum depth of 12 inches below final finish grade.

20. Contractor shall remove demolished materials from the project site and legally dispose of them at the Contractor's expense in a lawful manner. The removal and transporting of demolition debris shall be done in a manner which prevents spillage on adjacent surfaces, areas, or roadways.

Contractor shall not allow demolished materials to accumulate on-site.

21. Contractor shall not burn demolished materials.

22. Contractor shall clean adjacent structures and improvements of dust, dirt, and debris caused by project demolition, and maintain adjacent areas in a state equivalent to the existing conditions prior to the beginning of demolition.

23. Contractor shall notify the City representative at least 48 hours in advance of any saw-cutting and/or concrete removal so that City representative can verify areas to be removed.

Project Specific Demolition Notes

1. In the event that an existing electrical pull box has been damaged or destroyed, the Contractor shall install a new Caltrans Pull Box of the same size and in the same location and restore any damaged wire/conduit connections to the next pull box. Cover of box shall be marked, "Electrical".

2. All above grade junction boxes (J-Boxes) shall be protected in place during the work.

3. Prior to the demolition of any paving, the Contractor shall find and preserve any existing survey monuments, and replace them as necessary during the construction operation.

4. Contractor shall exercise caution when removing existing decomposed granite within existing medians and during irrigation installation and soil prep to avoid damaging existing tree roots and electrical conduit.

Construction Notes -

1. All improvements within the public ROW shall be done in accordance with the Standard Specifications for Public Works Construction, latest adopted edition, and any supplemental specifications contained within the bid documents.

Bus Stop Improvements Notes

1. Measurements shall be made from the intersecting curb face.

2. Measurements shown in the middle of new site furnishings shall be to the on center point of the base plate or footing.

3. Measurements to the edge of the bench shall be to the outside edge of the bench.

4. Measurements from the edge of the Right of Way (ROW) shall be to the actual ROW line as determined by a Land Surveyor licensed to survey in the state of California.

5. Sections of concrete sidewalk saw-cut and removed shall be considered approximate. Cut locations shall be marked by City representative in the field prior to start of work.

6. Contractor shall saw-cut at back of curb and at ROW line when, in the opinion of the field inspector or City representative, the removal of the existing concrete paving could damage the curbing or adjacent curbing/paving on private property. Contractor shall be solely responsible for damage to curbing or adjacent private property improvements and shall repair any damaged areas to the field inspector's satisfaction at Contractors expense.

7. Installation of foundations for shade shelters and area pole lights shall be done in the presence of City representative and/or field inspector.

8. Contractor shall be responsible for pedestrian barricades and warning markers during all work within the public ROW until completed to the satisfaction of the City representative.

9. All work shall conform to applicable sections of the Standard Plans for Public Works Construction, latest adopted edition, and the Standard Specifications for Public Works Construction, latest adopted edition, as well as the details for each item in the Plans.

10. Bus shelters shall be installed so that they do not overhang into private property. Contractor shall consult with manufacturer for accurate measurements of back of shelter so that roof of shelter is aligned with the edge of ROW line in narrow areas, or One Inch inside of ROW line in wider sidewalk areas. The farthest extent of the shelter roof shall be no closer than Eighteen Inches to the face of the curb.

11. No bench or trash receptacle shall be closer than Three Feet to the back of the curb to maintain ADA compliance with the improvements.

12. New concrete paving shall be 2500psi at 28day min. strength w/ 4" max. slump; integrally colored; medium broom finish placed over properly leveled and compacted subgrade; see details New Atlantic Ave. Site Materials

General Irrigation Notes

1. Irrigation plan is diagrammatic. Conflicts w/ paving and planting shall be resolved by the Contractor in the field. The routing of pipe, the location of valves and the location of the controllers shall be approximate as shown on the Plans.

2. All piping under paving shall be installed in pipe sleeving per the detail. Coordinate sleeve installation w/ the City representative.

3. Any new backflow preventers shall be oriented parallel to the street in order to protect them as much as possible from vehicles entering the median.

4. All valve boxes for shut-off valves, irrigation valves, and quick couplers, shall be Christy's B03 with reinforced concrete covers, or approved equal, installed against, and level with, the back of curb or concrete paving strip in the areas shown on the Plans; see detail.

5. Contractor shall install irrigation system as shown. Substitution of components shall be subject to the review & approval of the City and Landscape Architect. Contractor shall be responsible for obtaining any and all permits.

6. Contractor shall protect the piping connections at both ends of the irrigation mainline piping when it extends under the roadbed between medians, which occurs in a few locations. This existing pipe shall be reused to connect new Schedule 40 PVC pipe from the new irrigation mainline to the irrigation in medians downstream. Damage or destruction to the existing pipe which makes reconnection to that pipe with the new irrigation mainline impossible and which results in boring or street cutting and patching to restore the connection between medians shall be the sole responsibility of the Contractor and all costs associated with the boring or cut/patch shall be paid for at the Contractor's expense.

7. The 12 total Quercus engelmannii - Pasadena Oak trees shall have just the RWS tree tube without the bubbler installed. Contractor shall cap the pipe inside the tube so that the Oak trees are only getting water from the surrounding drip and not the supplemental water from the tree bubbler stations.

1. Contractor shall exercise care during digging, resolving any utility or substructure conflicts in the field. Utilities locations shown are approximate. Contractor shall call USA for mark-out and notify City Representative of conflicts with new tree locations for field adjustment prior to digging tree pits.

2. After DG removal and rake out, Contractor shall collect one soil sample from any of the existing medians on Atlantic and send to a soil testing laboratory for a Soil Management Report. Contractor shall provide a copy of the report to the City and Project Landscape Architect, and shall follow the guidelines in the report for all soil prep.

3. Contractor shall install plantings per the plans, details and specifications, and any applicable manufacturers specifications.

4. All planting areas shall be covered with a 3" minimum deep layer of coarse woody bark mulch. Contractor shall provide sample of mulch to City Representative for approval prior to purchase and installation.

5. Prior to mulching, contractor shall rake out all planting areas and adjust fine grade as necessary to conform to existing drain inlets.

6. All new trees shall be planted with root barriers per the Tree Planting detail.

TRANSIT STOP CONSTRUCTION NOTES

1. Measurements shall be made from the intersecting curb face.

2. Measurements shown in the middle of new site furnishings shall be to the on center point of the base plate or footing.

3. Measurements to the edge of the bench shall be to the outside edge of the bench.

4. Measurements from the edge of the Right of Way (ROW) shall be to the actual ROW line as determined by a Land Surveyor licensed to survey in the state of California.

5. Sections of concrete sidewalk saw-cut and removed shall be considered approximate. Cut locations shall be marked by City representative in the field prior to start of work.

7. Installation of foundations for shade shelters and area pole lights shall be done in the presence of City representative and/or field inspector.

Contractor shall coordinate with utility companies prior to excavating for shelter and pole light foundations.

8. Contractor shall be responsible for pedestrian barricades and warning markers during all work within the public ROW until completed to the satisfaction of the City representative.

11. No bench or trash receptacle shall be closer than Three Feet to the back of the curb to maintain ADA compliance with the improvements.

12. New concrete paving for the Santa Ana, Cecelia, & Wilcox bus stops shall be 2500psi at 28day min. strength w/ 4" max. slump; plain grey; medium broom finish placed over properly leveled and compacted subgrade; see details Existing

Subject: Discussion to Consider the Community Development Block Grant (CDBG) Programs and Budget for CDBG Fiscal Year 25-26 and Potential for New Program

RECOMMENDATION
City staff recommends the City Council take the following action(s):

1. Receive a presentation from City staff regarding the recommended CDBG Programs; and

2. Discuss and provide feedback to City staff on the recommended FY 25-26 CDBG Programs and Potential New Programs; and

3. Direct City staff to return on January 21, 2024, to hold a public hearing to consider the adoption of the CDBG Fiscal Year 25-26 Programs.

BACKGROUND
The City of Cudahy (“City”) receives federal CDBG funds from the U.S. Department of Housing and Urban Development (“HUD”) as administered by the Los Angeles County Development Authority (“LACDA”). The funds must be used to meet national objectives to develop viable communities and to serve low- and moderate-income populations. Use of these funds also requires compliance with statutory requirements including financial, environmental review, procurement, construction, eligibility, reporting, and citizen participation. LACDA requires that all planning and budgeting documents for the FY 25-26 CDBG program year be submitted in February 2025. The submittals include City Council approval of the planning and budget documents, evidenced by a signed resolution and proof of public participation and noticing of a public hearing.

LACDA has advised the City that for FY 25-26, it should be expected to receive approximately $301,085 in CDBG funding. Additionally, approximately $99,000.00 in previously unspent, unallocated CDBG funds are available for reprogramming into CDBG FY 25-26. The City’s proposed CDBG allocation is a planning estimate only; LACDA will release final appropriations in spring 2025. The City’s final CDBG allocation is generally within five percent (5%) of the estimate provided.

DISCUSSION
The primary objectives of the CDBG program are to develop urban communities by supporting activities that create or enhance the following focus areas:

1. Decent housing; and

2. A suitable living environment; and

3. Economic opportunities.

The HUD regulations require all CDBG-funded activities to meet one of the three national objectives:

1. Benefit low-and very-low-income persons; or

2. Aid in the prevention or elimination of slums or blight; or

3. Meet other community development needs having urgency or posing a serious and immediate threat to the health or welfare of the community.

The program requires that a minimum of seventy percent (70%) of the program funds be spent on activities that benefit low and moderate‐income persons. CDBG offers grant recipients a high level of flexibility in choosing program activities. Cities are free to select those activities that best meet the needs of their communities, in accordance with the national objectives and other requirements of the CDBG Program. The general rule is that any activity not specifically authorized under the CDBG regulations and statute is ineligible to be assisted with CDBG funds.

PROPOSED FY 25-25 PROGRAMS AND PROJECTS AND FY 25-26 FUNDING ALLOCATION The following are the proposed FY 2024-25 CDBG activities for review, consideration, and feedback from the City Council. Table 2 below shows the proposed 25-26 funding allocation, including committing unallocated funds.

Continuing Programs:
• Owner-Occupied Housing Rehab. Currently, this program offers grants to owneroccupied housing units. This program is designed to assist existing low‐to‐moderateincome households with eligible rehabilitation work based on the order of priority: 1)

Correction of health and safety deficiencies; 2) Correction of code violations; 3) Repairs and alterations for supportive disabled occupants; 4) Repairs and alterations of energy efficiency; 5) Other eligible general rehabilitation work. The maximum grant amount allowed for a single-family residence is $20,000, a multi-family unit is $30,000 and mobile homes are $15,000. This program works in conjunction with the CDBG Code Enforcement Program.

Recommendation: Continue this program, however, expands the eligibility requirements to include rehabilitation of rental units. Tenant income (low and moderate income) would apply. Allocate $20,856 from the CDBG FY 25-26 Allocation and $35,000 from Unallocated funds. Further, a portion of this Program's total project budget will be allocated to as-needed general CDBG Administration costs.
• Business Assistance. This continuing program assists existing/potential new business owners in retaining, expanding, or opening a business in the City of Cudahy. The program assists business owners with completing applications for permits, and business licenses, and provides technical assistance through one‐to‐one consultations/training to address the needs of the City's business community. Some topics include but are not limited to business expansion plans, how to market your business, how to obtain a business loan, and how to strengthen your business. These services are provided to the business community by city staff, long‐time business owners, and commercial bank personnel. This program funding covers the partial salary and benefits of one (1) fulltime employee.

Recommendation: Continue this program and allocate $58,444.97 from the CDBG FY 25-26 Allocation.
• Code Enforcement. This continuing program assists in addressing the decline of residential and neighborhood commercial businesses that have been deemed deteriorating or deteriorated. These residential and neighborhood commercial businesses are in the following designated areas: Census Tracts 5338.06, 5343.01, 5343.02, 5344.03, 5344.04, 5344.05, and 5344.06. The most common violations that will be addressed through this CDBG‐funded activity are prohibited conditions, unsightliness, and building code violations. This program covers a partial or full salary and benefits of two (2) full-time employees, a community preservation officer, and a community preservation manager.

Recommendation: Continue this program and allocate $231,000 from the CDBG FY 25-25 Allocation.

The proposed CDBG programs for FY 2024-25 align with the following Strategic Plan goals:
• Goal A, Strategy #5. Pursue funding opportunities to assist Cudahy residents and small business.

• Goal C, Strategy #1. Increase the use of residential rehabilitation programs using Community Development Block Grant (CDBG) funds.

FINANCIAL IMPACT
The City Council is recommended to direct City staff to fund the above-mentioned CDBG FY 25- 26 programs and provide feedback on any new programs/projects utilizing the City’s CDBG Unallocated Funds. Based on the direction received City staff may amend the proposed CDBG FY 25-26 allocation program amounts and Unallocated Funds for review.

RECOMMENDATION
The City Council is requested to adopt Resolution No. 24-44, adding restrictions to the Statement of Investment Policy.

BACKGROUND

1. On November 7, 2023, the City Council adopted Resolution 23-48 affirming the City’s support and solidarity with the Palestinian people of Gaza and calling for an immediate de-escalation and cease-fire in Israel and occupied Palestine.

2. On June 11, 2024, the City Council adopted Resolution 24-22 affirming the City’s support and solidarity with Pro-Palestinian student protesters at public colleges and universities, their demand for full disclosure and divestment from war and occupation, and protection of their first amendment rights to peacefully assemble.

3. On June 4, 2024, the City Council approved Resolution 24-12 approving the Statement of Investment Policy

ANALYSIS
Pursuant to California Government Code Sections 53600 and 53630 et seq. and 53646, the City of Cudahy must adopt an annual investment policy by resolution.

The Statement of Investment Policy sets forth policies which shall govern the investment of the City’s funds. It will be used by the City’s Finance Director and other City officials and staff, as Item Number

well as all other third-party providers of investment or investment-related services. Its purpose is to direct the prudent investment and protection of the City’s funds and investment portfolio.

The policy has been updated to better align with the California Government Code 53601.

The ongoing Israeli-Palestinian conflict has resulted in significant loss of life and widespread humanitarian challenges. Casualties include a substantial number of civilians, including children. The food security situation is critical, with many individuals facing severe shortages, particularly among vulnerable populations.

Recent discoveries at various sites have raised concerns about civilian safety and the treatment of individuals during the conflict. Military actions have affected numerous facilities, including healthcare and educational institutions, resulting in significant damage and disruption to services. The situation continues to evolve, with various international bodies calling for efforts to address the humanitarian needs and promote a peaceful resolution.

Several major private organizations have provided financing for continued military action in the region that generates a profit for their entities.

In the Prohibited Investments and Transactions section of the Statement of Investment Policy will impose restrictions on allowable investment and transactions. The intent of the proposed changes is to ensure that the City does not directly invest in companies and their subsidiaries involved in the development and manufacturing of arms and weapons.

Proposed Changes:

The City shall not directly invest in companies involved in the arms and weapons manufacturing industries, who develop and manufacture such items as:
• All forms of munitions
• Artillery systems
• Fighter jets, attack helicopters, warplanes, and warships. • Firearms and accessories (scopes, sights)
• Military robots
• Missiles
• Military and commercial drones
• Software that supports drones and missiles systems (such as control actuation systems).
• Tactical body gear/body armor
• Tactical, military and armored vehicles; tank transportation

STATEMENT OF INVESTMENT POLICY
I. INTRODUCTION
The City Council of the City of Cudahy (the “City”) recognizes its responsibility to prudently direct the investment of the City’s funds on behalf of the City’s existing and future residents. The City Council further recognizes that the City’s investment assets are essential to the City’s financial strength, the effective implementation of long-range financial plans, and ultimately its ability to respond to the needs of the community.

The investment policies and practices of the City of Cudahy take into consideration that California statutes authorize the City of Cudahy to finance acquisition or construction of various projects and capital assets through the issuance and sale of municipal securities, including but not limited to general obligation bonds and revenue bonds. Depending on the type and the authority for the issuance and sale of the bond, the City’s general fund and/or certain sources of city revenue may be pledged as security for the bonds. The bonding and the resulting security interest in city funds and revenue may supercede all or portions of this Policy.

This Statement sets forth policies which shall govern the investment of the City’s funds.

It will be used by the City’s Finance Director and other City officials and staff, as well as all other third-party providers of investment or investment-related services. Its purpose is to direct the prudent investment and protection of the City’s funds and investment portfolio.

II. POLICY
It is the policy of the City to invest public funds in a manner which will provide the highest investment return with maximum security while meeting the daily cash flow demands of the City and conforming to all state and local statutes governing the investment of public funds and aligns with the City’s value statement.

III. SCOPE
This Investment Policy applies to all financial assets of the City of Cudahy. The following funds are covered by this Investment Policy and are accounted for in the City's Annual Comprehensive Financial Report:

This Investment Policy does not apply to proceeds of bond issues and retirement funds held in trusts.

IV. PRUDENCE
Investments shall be made in the context of the "Prudent Investor" standard pursuant to Government Code Section 53600.3 which states in relevant part that:
"When investing, reinvesting, purchasing, acquiring, exchanging, selling, and managing public funds, a trustee shall act with care, skill, prudence, and diligence under the circumstances then prevailing, that a prudent person acting in a like capacity and familiarity with those matters would use in the conduct of funds of a like character and with like aims, to safeguard the principal and maintain the liquidity needs of the agency.” All investments purchased shall have daily liquidity or a final stated maturity date, upon which the full principal value of the security will be received. Although the investment will mature at full principal value, it is recognized that the market will vary throughout the life of the security. In a diversified portfolio it must be further recognized that occasional measured losses are inevitable due to economic, bond market, or individual security credit analysis. These occasional losses must be evaluated and considered within the context of the overall return.

The "Prudent Investor" standard shall be applied in the context of managing an overall portfolio. Investment officers acting in accordance with written procedures and the investment policy and exercising due diligence shall be relieved of personal responsibility for an individual security’s credit risk or market price changes, provided deviations from expectations are reported in a timely fashion and appropriate action is taken to control adverse developments.

V. OBJECTIVE
The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, which enables the City to invest its funds to the fullest extent possible. The objective of the investment portfolio is to meet the short- and long-term cash flow demands of the City. To achieve this objective, the portfolio will be structured to provide safety of principal and liquidity, while attempting to receive the highest yield obtainable.

A. Safety of Principal
Safety of principal is the foremost objective of the City of Cudahy. Investments of the City shall be undertaken in a manner that seeks to ensure the preservation of capital in the overall portfolio. Each investment transaction shall seek to ensure that capital losses are avoided, whether from securities default, broker-dealer default, or erosion of market value. To attain this objective, the City will diversify its investments by investing funds among a variety of securities and approved financial institutions. The City shall seek to preserve principal by mitigating the two types of risk in order of importance: credit risk and market risk.

1. Credit Risk Credit risk, defined as the risk of loss due to failure of an issuer of a security, shall be mitigated by purchasing U.S. Treasuries or high-grade securities. All investments beyond Treasury securities will be diversified so that the failure of any one issuer would not unduly harm the City's cash flow. Credit risk shall also be mitigated by prequalifying financial institutions, broker/dealers, intermediaries, and advisors with which the City does business.

2. Market or Interest Rate Risk Interest rate risk is the risk that the market value of securities in the portfolio will fall due to changes in general interest rates. Interest rate risk may be mitigated by structuring the Funds so that securities mature to meet cash requirements for ongoing operations, thereby avoiding the need to sell securities on the open market prior to maturity, and by investing operating funds primarily in shorter-term securities. The cash flow is updated on a daily basis and will be considered prior to the investment of securities, which will reduce the necessity to sell investments for liquidity purposes. Long-term securities shall not be purchased for the sole purpose of short-term speculation. Securities shall not be sold prior to maturity with the following exceptions, 1) a security whose credit declines or is expected to decline may be sold IF there is a reasonable expectation that the prompt payment of principal and interest becomes unlikely. A temporary or modest decline in a security’s credit rating should not in and of itself trigger a liquidation, 2) a security swap would improve the quality, yield, or target duration in the portfolio, or 3) liquidity needs of the portfolio require that the security be sold. The weighted average maturity of the funds will be limited to three years or less. Purchases of investments will be restricted to securities with a final stated maturity not to exceed five (5) years.

B. Liquidity
This refers to the ability to "cash in" at any moment in time with a minimal chance of losing some portion of principal or accrued interest. Liquidity is an important quality especially when the need for unexpected funds occurs. The City’s investment portfolio will remain sufficiently liquid to enable the City to meet all operating requirements which might be reasonably anticipated.

C. Return On Investments
The City’s investment portfolio shall be designed with the objective of attaining a benchmark rate of return throughout budgetary and economic cycles, commensurate with the City’s investment risk constraints and the cash flow characteristics of the portfolio. A benchmark does not imply that the Finance Director will add additional risk to the portfolio in order to attain or exceed the benchmark.

VI. DELEGATION OF AUTHORITY
The City Council on an annual basis adopts a resolution approving the Investment Policy.

The Investment Policy authorizes the Finance Director to invest or deposit the City’s funds in accordance with California Government Code Sections 53600 and 53630 et seq. and all related State and Federal laws.

In the Finance Director’s absence, and subject to City Council approval, the Finance Director may assign investment responsibilities to the City Manager. The Finance Director will provide prior written notification to the City Manager and the City Council regarding the assignment of responsibilities. In the event that the Finance Director is unable to assign responsibility, the City Manager may select a designee. In addition, at the discretion of the Finance Director, cash monitoring and investment responsibilities can be assigned to a designated assistant and a surety bond will be obtained by the City for said assistant.

The responsibility for establishing, monitoring, and maintaining a strong system of investment controls and directing an independent audit of the investment function is delegated to the City Manager. The City Manager’s designee(s) may assist in carrying out these functions.

The City Council’s primary responsibilities over the investment function include establishing investment policies, annually reviewing such policies, reviewing monthly investment reports issued by the Finance Director and authorizing any deviations from the City’s Investment Policy.

As permitted by Government Code 53601, the Finance Director may delegate day-to-day investment decision making and execution authority to an investment advisor. Eligible investment advisors must be registered with the Securities and Exchange Commission (SEC) under the Investment Advisors Act of 1940. The advisor will follow the Policy and such other written instructions as are provided.

VII. ETHICS AND CONFLICTS OF INTEREST
The Finance Director and other employees involved in the investment process shall refrain from personal business activity that could conflict with proper execution of the investment program or which could impair their ability to make impartial investment decisions. The Finance Director and investment employees shall disclose any material interests in financial institutions with which they conduct business within their jurisdiction. They shall further disclose any large personal financial/investment positions that could be related to the performance of the investment portfolio and shall refrain from undertaking personal investment transactions with the same individual with whom business is conducted on behalf of the City. The Finance Director and investment employees are required to file annual disclosure statements as required by the Fair Political Practices Commission (FPPC). During the course of the year, if there is an event subject to disclosure that could impair the ability of the Finance Director or investment employees to make impartial decisions, the City Council will be notified in writing within 10 days of the event.

VIII. QUALIFIED DEALERS
The City shall transact investments only with banks, savings and loans, investment security dealers and the State of California Local Agency Investment Fund. The purchase by the City of any investment, other than those purchased directly from the issuer, shall be purchased directly from an institution licensed by the State as a broker/dealer, as defined in Section 25004 of the Corporations Code, who is a member of the Financial Industry Regulatory Authority (FINRA), or a member of a Federally regulated securities exchange, a National or State Chartered Bank, a Federal or Savings Association, or a brokerage firm designated as a Primary Government Dealer by the Federal Reserve Bank. Exceptions to this rule will be made only after thorough research and documented confirmation of financial strength and reputation and after approval by the City Manager. Investment staff shall investigate dealers who wish to do business with the City in order to determine if they are adequately capitalized, market securities appropriate to the City’s needs, and are recommended by managers of portfolios similar to the City’s.

The City shall at least annually send a copy of the current investment policy to all dealers approved to do business with the City. Confirmation of receipt of this policy shall be considered as evidence that the dealer understands the City’s investment policies and intends to show the City only appropriate investments.

IX. AUTHORIZED AND SUITABLE INVESTMENTS
The investments set forth in this section are authorized investments pursuant to Section 53601 et seq. of the Government Code and are authorized investments for the City subject, however, to the prohibitions set forth in Section X of this Investment Policy.

A. U.S. Treasury Instruments. United States Treasury notes, bonds, bills, or certificates of indebtedness, or those for which the faith and credit of the United States are pledged for the payment of principal and interest.

B. Federal Agency Securities. Federal agency or United States governmentsponsored enterprise obligations, participations, or other instruments, including those issued by or fully guaranteed as to principal and interest by federal agencies or United States government-sponsored enterprises.

C. Municipal Bonds
City Bonds – Bonds issued by the city, including bonds payable solely out of the revenues from a revenue-producing property owned, controlled, or operated by the City or by a department, board, agency, or authority of the City that is rated in a rating category of “A” long term, or “A-1” short term, the equivalent or higher by a nationally recognized statistical rating organization (NRSRO).

California State Bonds – Registered state warrants or treasury notes or bonds of the State of California, including bonds payable solely out of the revenues from a revenue-producing property owned, controlled, or operated by the State or by a department, board, agency, or authority of the State that are rated in a rating category of “A” long term, or “A-1” short term, the equivalent or higher by a NRSRO.

CA Local Agency Bonds. Bonds, notes, warrants, or other evidences of indebtedness of a local agency within this state, including bonds payable solely out of the revenues from a revenue-producing property owned, controlled, or operated by the local agency, or by a department, board, agency, or authority of the local agency that are rated in a rating category of “A” long term, or “A-1” short term, the equivalent or higher by a NRSRO.

Other 49 States’ Bonds – Bonds, notes, warrants, or other evidences of indebtness of any local agency within the State of California and any of the other 49 states, including bonds payable solely out of the revenues from a revenueproducing property owned, controlled, or operated by the local agency, or by a department, board, agency, or authority of the local agency that are rated in a rating category of “A” long term, or “A-1” short term, the equivalent or higher by a NRSRO.

D. Deposits. FDIC insured or fully collateralized bank deposits, including, but not limited to, demand deposit accounts, savings accounts, market rate accounts, and certificates of deposits in financial institutions located in California. The amount on deposit in any financial institution shall not exceed the shareholder’s equity. To be eligible to receive City deposits, the financial institution must have received a minimum overall satisfactory rating, under the Community Redevelopment Act, for meeting the credit needs of California Communities in its most recent evaluation. Bank deposits are required to be collateralized as specified under Government Code Section 53630 et seq.

The Finance Director may waive the collateralization requirements for any portion that is covered by federal deposit insurance. The City shall have a signed agreement with any depository accepting City funds per Government Code Section 53649. There is no limit on the percentage of the portfolio that may be invested in this category. However, a maximum of 10 percent of the portfolio may be invested in time deposits.

E. Negotiable Certificates of Deposit. Negotiable certificates of deposit issued by a nationally or state-chartered bank, a savings association or a federal association (as defined by section 5102 of the Financial Code), a state or federal credit union, or by a federally licensed or state-licensed branch of a foreign bank. Purchases are limited to securities rated in a rating category of “A” (long-term) or “A-1” (short-term) or their equivalents or better by an NRSRO. A maximum of 30% of the portfolio may be invested in this category.

F. Bankers’ Acceptance Notes. Bankers’ acceptances otherwise known as bills of exchange or time drafts that are drawn on and accepted by a commercial bank. Purchases of bankers’ acceptances shall not exceed 180 days’ maturity or 40 percent of the agency’s moneys that may be invested pursuant to this section. However, no more than 30 percent of the agency’s moneys may be invested in the bankers’ acceptances of any one commercial bank pursuant to this section.

G. Commercial Paper
Commercial paper of “prime” quality of the highest ranking or of the highest letter and number rating as provided for by a nationally recognized statistical rating organization (NRSRO). The entity that issues the commercial paper shall meet all of the following conditions in either paragraph (1) or (2):
(1) The entity meets the following criteria: (A) Is organized and operating in the United States as a general corporation; (B) Has total assets in excess of five hundred million dollars ($500,000,000), and (C) Has debt other than commercial paper, if any, that is rated in a rating category of “A” or its equivalent or better by an NRSRO.
(2) The entity meets the following criteria: (A) Is organized within the United States as a special purpose corporation, trust, or limited liability company, (B) Has program-wide credit enhancements including, but not limited to, overcollateralization, letters of credit, or a surety bond, and (C) Has commercial paper that is rated “A-1” or better, or the equivalent, by an NRSRO.

Purchases are limited to securities that have a maximum maturity of 270 days.

A maximum of 25% of the portfolio may be invested in this category.

H. Money Market Funds (“MMF”). Purchases are restricted to Government Money Market Funds. Furthermore, these Money Market Funds must have met either of the following criteria: (A) Attained the highest ranking or the highest letter and numerical rating provided by not less than two NRSROs, or (B) Retained an investment advisor with not less than five years’ experience and registered or exempt from registration with the SEC, with assets under management in excess of five hundred million dollars ($500,000,000). Whenever the City has any funds invested in a MMF, the Finance Director shall maintain on file a copy of the MMF’s current information statement. A maximum of 20% of the portfolio may be invested in this category.

I. State of California’s Local Agency Investment Fund (LAIF). The maximum amount invested in this category may not exceed the limit set by LAIF for operating accounts.

J. Joint Powers Authority Investment Pools. Joint Powers Authority Investment Pools are organized pursuant to Section 6509.7 of the Government Code that invests in the securities and obligations under Sections 53601 of the California Government Code.

To be eligible for City investments, the joint powers authority issuing the shares shall have retained an investment adviser that is registered or exempt from registration with the Securities and Exchange Commission, the adviser has not less than five years of experience investing in the securities and obligations authorized in under Section 53601 and the adviser has assets under management in excess of five hundred million dollars ($500,000,000).

X. PROHIBITED INVESTMENTS AND TRANSACTIONS
Investments not described herein, including, but not limited to range notes, reverse repurchase agreements, zero coupon bonds, inverse floaters, common stocks, futures, options, mortgage-derived, interest-only strips and derivatives are prohibited from use in the City’s investment portfolio.

The City shall not engage in securities lending, short selling, or other hedging strategies.

The City shall not purchase or sell securities on margin.

The City will not directly invest in companies and their subsidiaries involved in the development and manufacturing of arms and weapons.

• Tactical, military and armored vehicles; tank transportation XI. COLLATERALIZATION
Collateralization will be required on two types of investments: certificates of deposit and repurchase agreements. Deposits per institution are insured up to certain dollar amounts by the FDIC and Certificates of Deposit can be supported by either U.S. Government agency notes of mortgages currently held by the bank or savings and loan.

Collateral will always be held by an independent third party with whom the City has a current custodial agreement. A clearly marked evidence of ownership (safekeeping receipt) must be supplied to the City and retained. The right of collateral substitution is granted.

XII. SAFEKEEPING AND CUSTODY
All security transactions, including collateral for repurchase agreements, entered into by the City shall be conducted on a delivery-versus-payment basis. Securities will be held by a third party custodial designated by the Finance Director and evidenced by safekeeping receipts.

XIII. DIVERSIFICATION
The City operates its investment pool with many State and self-imposed constraints. It does not speculate. Assets shall be diversified to eliminate the risk of loss resulting from over concentration of assets in a specific maturity, a specific issuer, or a specific class of securities.

The City will diversify its investments by security type, institution, and maturity/call dates. With the exception of U.S. Treasury securities, federal agency securities and authorized pools, no more than 5% of the City’s total investment portfolio will be invested in a single security type or with a single financial institution.

XIV. MAXIMUM MATURITIES
To the extent possible, the City will attempt to match its investments with anticipated cash flow requirements. Unless matched to a specific cash flow, the City will not directly invest in securities maturing more than 5 years from the date of purchase.

Debt service reserve funds may be invested in securities exceeding five years if the maturity of such investments is made to coincide as nearly as practicable with the

expected use of the funds.

XV. INTERNAL CONTROL
The Finance Director shall establish an annual process of independent review by an external auditor. This review will provide internal control by assuring compliance with the City’s Investment Policy and for establishing internal controls that are designed to prevent losses due to fraud, negligence, and third-party misrepresentation.

Internal controls deemed most important shall include (but not limited to): avoidance of collusion; separation of duties and administrative controls; separating transaction authority from accounting and record keeping; custodial safekeeping; clear delegation of authority; management approval and review of investment transactions; specific limitations regarding securities losses and remedial action; written confirmation of telephone transactions; documentation of investment transactions and strategies; and monitoring of results.

XVI. PERFORMANCE STANDARDS
The investment portfolio shall be designed with the objective of obtaining a rate of return throughout budgetary and economic cycles, commensurate with the investment risk constraints and the cash flow needs.

The City’s investment strategy is passive. Passive investment portfolio management generally indicates that the Finance Director will purchase an instrument and hold it through to call or maturity, and then reinvest the monies. Although the City’s investment strategy is passive, this will not restrict the Finance Director from evaluating when swaps are appropriate or if the sale of an instrument is prudent prior to final maturity. Given this strategy, the basis used by the Finance Director to determine whether market yields are being achieved shall be the Local Agency Investment Funds (LAIF).

XVII. REPORTING
The Finance Director shall provide the City Council monthly investment reports which provide a clear picture of the status of the current investment portfolio. The management report shall include the type of investments, the issuers, maturity dates, par values, and the current market values of each component of the portfolio, including funds managed for the City by third party safekeeping custodians. The report will also include the source of the portfolio valuation. As specified in California Government Code Section 53646 (e), if all funds are placed in LAIF or FDIC-insured accounts, the foregoing report elements may be replaced by copies of the latest statements from such institutions. The report must also include a certification that the City will meet its expenditure obligations for the next six months as required by California Government Code Section 53646 (b)(3) and that the City’s portfolio is in compliance with this investment policy, or the manner in which the portfolio is not in compliance as required by California Government Code Section 53646 (b)(2). The Finance Director shall maintain a complete and timely record of all investment transactions.

RECOMMENDATION
The City Council is requested to appoint a representative to the Board of Trustees of the Greater Los Angeles County Vector Control District for two or four years.

BACKGROUND

1. On December 20, 2022, the City Council appointed Council Member Daisy Lomelí to the Greater Los Angeles County Vector Control District Board of Trustees for a two-year term.

2. On September 3, 2024, the City Council re-appointed Council Member Daisy Lomelí to the Greater Los Angeles County Vector Control District Board of Trustees for the remainder of her term.

3. On September 25, 2022, the Greater Los Angeles County Vector Control District sent a letter addressed to Mr. Alfonso Noyola, City Manager, requesting an appointment to the Greater Los Angeles County Vector Control District Board of Trustees.

ANALYSIS
The Greater Los Angeles County Vector Control District serves 6 million Los Angeles residents, promoting community health, comfort, and welfare through property inspections on a caseby-case basis of mosquito problems, community outreach, and disease surveillance.

Currently, Council Member Lomelí serves as the City representative on the Board of Trustees of the Greater Los Angeles County Vector Control District and is no longer interested in serving.

Greater Los Angeles County Vector Control District Board meetings occur every second Thursday of each month at 7:00 p.m. at the district’s headquarters at 12545 Florence Avenue, Santa Fe Springs.

There is a $100 stipend for attending the meeting. Board members must fill out Form 700 for assuming office, annual filing, and leaving office once the term is completed.

CONCLUSION
The City Council is requested to appoint a representative to the Greater Los Angeles County Vector Control District Board of Trustees. Doing so will continue to allow the City to be represented on the Board of Trustees.
