Subject
Consider authorizing Change Order No. 1 for the Playground Equipment Replacement Project at Creekside Park Tot Lot.
Recommended Action
Authorize the City Manager to execute an amendment between the City of Cupertino and Miracle Play Systems, Inc., in the amount of $1,405.29; and Approve an amendment to the contract to increase the maximum compensation by $1,405.29 for a total contract amount of $223,601.25.
Background
The Annual Playground Equipment Replacement Project was established in Fiscal Year (FY) 2020-21, with the estimated project cost being $1,500,000 over five years. The purpose of the project is to replace older playground equipment that is dated and worn.
Discussion
On September 21, 2021, the City Council approved a contract with Miracle Play Systems, Inc. for $222,194.96. As part of the contract, Miracle Play Systems Inc. is to provide the City with a turnkey design, manufacturing, and installation for themed and accessible playground equipment and surfaces.
Change Order No. 1 is needed to address an unforeseen drainage condition in the swing area which will help to prevent degradation of rubber surfacing.
Sustainability Impact
No sustainability impacts.
Fiscal Impact
This action does not require additional funds. The project is funded through account 420-99-085 for playground equipment replacements, which has adequate funding to cover the change order. No budget adjustment is necessary. _____________________________________
