CITY COUNCIL STAFF REPORT
Meeting: July 19, 2022
Subject
Consider the appointment of Pamela Wu as City Manager and approval of an At-Will City Manager Employment Agreement; consider Proposed Amendments to the Appointed Employees’ Compensation Program.

Recommended Action

1. Consider adopting Resolution No. 22-XXX approving the At-Will City Manager Employment Agreement between the City of Cupertino and Pamela Wu, and authorize the Mayor to execute the contract; and

2. Consider adopting Resolution No. 22-XXX amending the Appointed Employees’ Compensation Program.

Discussion
After City Manager Jim Throop announced his resignation on June 22, 2022, the City Council revisited the candidates identified in the Fall 2021 City Manager recruitment and identified Pamela Wu as the most qualified candidate. Ms. Wu accepted Council’s offer of employment and has agreed to serve as City Manager.

Council may consider the appointment of Ms. Wu to serve as City Manager pursuant to the terms of the At-Will City Manager Employment Agreement between the City and Ms. Wu. (Attachment B.) Ms. Wu’s appointment would be effective on August 29, 2022.

Staff also proposes amendments to the Appointed Employees’ Compensation Program. (Attachment D-E.) The proposed amendments would conform the salary in the Appointed Employees’ Compensation Program to the proposed City Manager Employment Agreement. In addition, the proposed amendments would conform the Appointed Employees’ Compensation Program to amendments to the City Attorney’s employment agreement that will be considered separately at the July 19, 2022 regular meeting of the City Council.

Council may approve the City Manager Employment Agreement and the amendments to Appointed Employees’ Compensation Program by adopting the resolutions enclosed as Attachments A and C, respectively.

Sustainability Impact
No sustainability impacts.

Fiscal Impact
There is no fiscal impact. Salary and benefits costs for the City Manager were included in the FY 2022-23 Final Adopted Budget (100-12-120). Salary savings from the City Manager vacancy are sufficient to cover increased costs. _____________________________________
