Re: 2321 Geneva Avenue – Project Narrative and Density Bonus Our File No.: 11657.01
Dear Mr. Van Lonkhuysen,
Our office represents the owner of the property at 2321 Geneva Avenue (the “Property”). The owner is proposing a mixed-use project that will utilize the State Density Bonus Law (“DBL”) to provide 185 ownership units, including 34 housing units affordable to low-income residents (the “Project”). Utilization of the DBL will allow the Project to deliver affo rdable housing units with a greater level of affordability than would otherwise be required under the Daly City Municipal Code (“Code”). The revised Project would provide additional affordable units and a greater unit mix than previously proposed while maintaining a similar building envelope. This letter provides an updated overview of the proposed Project, approvals requested, density bonus under the DBL, and the modifications to development standards under the DBL.
Project Narrative
The Project involves the new construction of a seven-story mixed-use building spread over seven lots that are currently vacant. The P roject will utilize the DBL to provide 185 units, including 34 housing units affordable to low-income residents. The unit mix is 167 studios and 18 one-bedroom units. In addition, the Project proposes two commercial spaces on the ground floor totaling 3,667 square feet, a garage accommodating 82 parking spaces, and 197 bike parking spaces. The Project also includes 5,146 square feet of private open space on balconies and 7,159 square feet of common open space on the roof. The Project will require approval of the following entitlements: use permit, design review, a lot merger, and a condominium map.
Density Bonus Eligibility
The Property is currently located in the C-1 zoning district, which does not apply a numerical density limit. Instead, the density is limited by the other zoning constraints on the site, such as the

height limit and open space requirements . On the Property, the maximum allowable base density in a Code -compliant project would be 139 units and 73,137 square feet. Drawings illustrating a hypothetical base density project are attached as Exhibit A.1
The City’s Inclusionary Housing Ordinance requires that 28 units (20% of the base project ) be affordable to families whose income does not exceed 120% of the area median income (i.e., moderate income units). The Project sponsor proposes to provide 34 affordable housing units and further restrict them to be affordable to families earning up to 80% of area median income (i.e., low-income units). These 34 units represent 24% of the 139-unit base project, which would entitle the Project to a 50% density bonus.2 A 50% density bonus at this Property would allow up to 209 units and 109,706 square feet.
The proposed Project includes 185 of the 209 potential units. As noted below, additional height is required to provide the density bonus units. The Property is unusual in that it has street frontage on three sides and is located across the street from the Cow Palace, making this an appropriate location for a density bonus project. In addition, the massing was carefully designed to be sensitive to the residential properties that abut the rear property line by including stepped setbacks of 10-20 feet above the ground floor.
Level of Affordability of All Affordable Units and Proposals for Ensuring Affordability
As noted above, the 34 units would be affordable to families earning up to 80% of the area median income (i.e., low -income units) . Consistent with the City of Daly City Inclusionary Housing Ordinance and the DBL, the owner will ensure the affordability of the affordable housing units in the Project for a period of 55 years.
3 As provided in the Code, the owner will record a document against title in a form approved by the City Attorney that ensures the continued affordability of the inclusionary units.4
Requested Concessions, Waivers, and Modifications of Development Standards
Given that the Project will provide 24 % of the units at rates affordable to families making up to 80% of area median income (i.e., low-income units), the Project is entitled to three “concessions” under the DBL.
5 Concessions can include, among other things, a “ modification of zoning code requirements . . . that exceed the minimum building standards approved by the California Building Standards Commission . . . that results in identifiable and actual cost reductions, to provide for
1 Please note that the base project conforms with the definition of “building height” under Code section 17.04.010, which allows additional height below a view plane that extends at a 45-degree angle. 2 Code § 17.52.030(A); Gov. Code § 65915(f)(2).
3 Code § 17.47.130; Gov. Code § 65915(c)(1).
4 Code § 17.47.130.
5 Gov. Code § 65915(d)(2)(C).

affordable housing costs.”6 Here, the Project proposes to utilize the three available concessions to increase the floor -to-floor height, reduce the parking requirement, and reduce the open space requirement.
The DBL notes that “[i]n no case may a city… apply any development standard that will have the effect of physically precluding the construction of a development meeting the [affordability] criteria… at the densities or with the concessions or incentives permitted by this section .”7 This provision allows the application of concessions to the base density project prior to applications of any waivers (e.g., a waiver of the maximum height). Here, concessions for height to allow 10-foot floor-to-floor heights have been applied to both the hypothetical base density project as well as the proposed Project. Accommodating the additional five feet needed to provide 10- foot ceiling heights would otherwise require providing a base ment level, which would significantly increase construction costs. Because the requested increase in above- grade height will result in an identifiable and actual cost reduction, a concession is appropriate.
The Code requires one parking space for every studio unit and one and a half spaces for each one- bedroom unit, which would require the Project to provide 194 parking spaces.8 The DBL notes that projects providing at least 20% low -income units that are located within one half mile of a major transit stop can reduce the parking requirement to 0.5 spaces per unit at the developer’s request.9 The owner seeks to utilize this modified parking standard to lower the requirement to 93 parking spaces. The Project proposes to apply a concession to further reduce the parking by 11 spaces to match the 82 parking spaces that can be accommodated on site. Accommodating those additional 11 parking spaces would require the Project to include below grade parking or add additional height. Both options would signif icantly increase construction costs. Because the requested reduction in parking spaces will result in an identifiable and actual cost reduction , a concession is appropriate to reduce the parking requirement.
The Code requires 150 square feet of open space for each dwelling unit , which would result in a requirement of 27,750 total square feet of open space for a 185-unit project.10 The Project proposes a total of 12,305 square feet of open space through a combination of private balconies and a rooftop deck. Compliance with the full open space requirement would drastically increase construction costs by either requiring the Project to be much taller to accommodate additional common open space or to construct a significant number of additional balconies. Because the requested reduction of open space will result in an identifiable and actual cost reduction, a concession is appropriate to reduce the open space requirement.
6 Gov. Code § 65915(k)(1). Concessions also include “[o]ther regulatory incentives or concessions proposed by the developer or the city, county, or city and county that result in identifiable and actual cost reductions to provide for affordable housing costs.” Gov. Code § 65915(k)(3).
7 Gov. Code § 65915(e)(1) [emphasis added].
8 Code § 17.34.020(D).
9 Gov. Code § 65915(p)(2); the 8 (Bayshore) and 9/9R (San Bruno) lines both stop at Santos & Geneva at intervals less than 15 minutes apart during rush hour. (See https://www.sfmta.com/getting-around/muni/routes-stops.) 10 Code § 17.38.020(B).
Michael Van Lonkhuysen, Planning Manager
Community Development Department, Planning Division

The DBL also allows a project to apply unlimited “waivers” as necessary to allow for construction of the density bonus units. 11 Here, the Project is seeking a waiver for height to allow for the addition of two floors. Because the reduction of these two floors would physically preclude the construction of at least 31 units, thus preventing the Project from achieving the density permitted, a waiver is appropriate to allow for the additional height.
Conclusion
Application of the DBL to the Project would significantly increase the affordability of the required affordable housing units and move the City closer to its affordable housing goals. The owner has shaped this proposal to be sensitive to its neighbors and anticipated community concerns, seeking only a modest density bonus (the maximum possible density bonus of 50% would have yielded 209 units). Moreover, there are not many sites in the City like this one, large enough to allow for the addition of 46 density bonus units with only minimal changes to the massing as perceived from nearby properties. We look forward to discussing this proposal with you in more detail in the near future.
Very truly yours,
REUBEN, JUNIUS & ROSE, LLP

Re: “Bike Safety in San Mateo County: Making Bicycling Safer in the County” Dear Judge Fineman,
We are in the receipt of the Grand Jury’s final report entitled; “Bike Safety in San Mateo County: Making Bicycling Safer in the County.”
Pursuant to your July 10, 2023, request for response, the Daly City, City Council held a public meeting on September 25, 2023, and approved this response. The City of Daly City responds to the Grand Jury’s findings, conclusion and recommendations as follows:
Findings:
F1. Bicycle policy and the approach to ensuring/improving bicycle safety is not consistent across San Mateo County due, at least in part to:
a. Topography
b. Urban vs. suburban environments
c. Types of bicyclists (commuter, recreational)
d. Varying levels of enforcement of bicycle laws
e. Differing knowledge of bicycle laws and safe practices.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F2. Bicycle ridership as an alternative means of transportation (e.g., commuting to work, school, or transit hubs, running errands) is not increasing due, at least in part, to perceived safety issues.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F3. Bicycle accidents and incidents (such as near misses) are underreported, if reported at all.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F4. Only bicycle accidents or incidents that trigger a 911 call are consistently logged in the State (SWITRS) database and law enforcement agencies do not log bicycle accidents data consistently.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F5. The amount of enforcement of laws, as they pertain to bicyclists and how motorists and bicyclists interact, is inconsistent due to other priorities (e.g., criminal enforcement and general automobile traffic) and the requirement that a citation can generally only be written if the violation is witnessed by an officer.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F6. There is no official metric in San Mateo County and its cities to evaluate how safe it is to ride a bicycle.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F7. Bicycle safety education, for the bicyclist, pedestrians, and motorists, is not consistently offered across San Mateo County.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
F8. Communication between various entities with responsibility for bicycle safety, including Bicycle and Pedestrian Advisory Committees (BPACs), Law enforcement, City Transportation Planning, and Public Works departments, is not formalized, resulting in inefficiencies, and missed opportunities (e.g., funding form improvements, shared bike safety education, or improving signage).
Response: They City only partially agrees with this finding. The City of Daly City Public Works Department serves as liaison with the Daly City Bicycle/Pedestrian Advisory Committee and the Daly City Traffic Safety Committee. The Traffic Safety Committee is comprised of representatives from the City’s Department of Public Works Engineering and Maintenance Divisions, Economic Development Department Planning Division, Police Department, Fire Department, and Water and Wastewater Department. During the last year, Daly City was
awarded approximately $3.9 million in grant funds to implement bicycle and pedestrian improvements.
F9. City Bicycle and Pedestrian Master Plans or Active Transportation Plans, have not been adopted/created by all San Mateo County cities.
Response: They City agrees with this finding, relying on the Grand Jury’s representations in their report.
Recommendations:
R1. By December 2023, all law enforcement agencies and the County Sheriff should submit bicycle related data to SWITRS monthly, and regularly post and update their websites with all reported bicycle accident data.
Response: The City currently reports all applicable data to SWITRS and will evaluate options to post collision data on the website in the recommended timeframe, as that feature does not currently exist.
R2. By December 2023, all law enforcement agencies should begin sending warning letters to motorists for violations of the 3 ft. law.
Response: The recommendation has not yet been implemented, but it will be implemented in the timeframe recommended.
R3. By June 3, 2024, all law enforcement agencies should provide a means for citizens to report bicycle-related incidents that are not currently reported to law enforcement, similar to SMC Sheriff’s Department Online Crime Reporting portal.
Response: The recommendation has not yet been implemented, but it will be implemented in the timeframe recommended through our existing online crime reporting feature.
R4. By June 3, 2024, each city, town, and unincorporated SMC should offer a bike safety education program for riders and motorists about the laws and safety facts related to bicycles on the road.
Response: The recommendation has not yet been implemented but will be implemented in the timeframe recommended.
R5. By June 3, 2024, each city, town, and unincorporated SMC should update or generate a new Bicycle and Pedestrian Master Plan (or Active Transportation Plan) if their current plan is older than five years; consistent with the 2021 C/CAG San Mateo County Comprehensive Bicycle and Pedestrian Plan.
Response: The recommendation has been implemented. In February 2020, The City of Daly City contracted with Eisen & Letunic, who also partnered with Parisi Transportation Consulting to publish Walk Bike Daly City – City of Daly City Pedestrian and Bicycle Master Plan 2020.
R6. By June 3, 2024, each city, town, and county should apply (or reapply) online to generate the Bicycle Friendly Community Report Card.
Response: The recommendation has not yet been implemented, but it will be implemented in the timeframe recommended.
R7. By February 1, 2024, the County should meet with cities within the County that are willing to participate, to consider establishing a regional effort that integrates the cities’ bicycle plans and to discuss how the cities and County could work together to apply for grant opportunities as a region.
Response: The City of Daly City is willing to work with the County to coordinate efforts to integrate bicycle plans and apply for grant opportunities as a region. The respondent agrees with the findings and agrees to participate in any committees created by the County to support a regional effort to discuss grant opportunities.
The City of Daly City appreciates the opportunity to provide written responses to the San Mateo County Civil Grand Jurt Report, “Bike Safety in San Mateo County: Making Bicycling Safer in the County.”
