CITY OF DELANO
STAFF REPORT
December 19, 2022
Agenda Item: 13
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Tyson Davis, Chief of Police
SUBJECT: Authorization To Enter Into an Agreement with Flock Safety, Inc. (not to exceed $60,000) for 20 License Plate Reader cameras.
Recommendation:
Staff is recommending that the City Council approve as presented, a. Authorization to enter into an agreement with Flock Safety, Inc. (Not to exceed $60,000) for 20 License Plate Reader cameras.
Discussion:
The Delano Police Department Mission Statement is to maintain a professional workforce dedicated to the enhancement of quality of life through community partnership with an overall goal of reducing crime, minimizing fear, preserving peace, and improving traffic safety. Many unsolved cases involve vehicles that are subject to further investigation by the department. Effective use of surveillance technologies has become a critical component for both crime prevention and law enforcement. For example, the current City of Delano Camera System has assisted in investigations and solved many crimes, including homicides. Automated license plate readers (“ALPR”) have been used by many law enforcement agencies around the country to assist and further their investigations. Purchasing fixed position ALPR’s will assist in identifying license plates for a specific location or intersection of interest, 24 hours a day.
As part of the subscription Flock Safety Group Inc. is responsible for the installation and maintenance of the equipment. The technology and service identify objects from descriptions provided by internal “hot lists” and from notifications received via the National Crime Information Center (NCIC) and are California Justice Information Services compliant. Hot-list notifications are internal alerts created by the Delano Police personnel utilizing the Flock camera system software. Such notifications would alert Delano Police personnel to the identification and location of a vehicle linked to a reported welfare check and/or a criminal event. The 20 cameras subject to this agreement would be installed on pre-existing city owned traffic or light poles around City thoroughfares. The cost for this agreement is $57,000, which includes installation and one year subscription service.
The California Values Act and Senate Bill 34 restricts local law enforcement on sharing automated license plate reader data with any federal agency and agencies outside the State of California. The City of Delano Police Department will restrict the information collected from the ALPR cameras to only state, local and county agencies within the State of California, in accordance with State law and guidelines.
The Flock system is designed to only capture the license plate and photograph of the vehicle that passes through its view. The cameras are not triggered by the movement of pedestrians. The data captured is based on the vehicle moving within the view of the Flock camera and is not based on an individual’s race, color, clothing, or gender. Furthermore, these Flock cameras do not have facial recognition technology.
The department owns the data that is captured and is automatically deleted every 30 days, unless needed for an investigation, to limit liability. Investigators and Command Staff officers will have access to this database and software. It is the policy of this department that the information captured through the use of these ALPR’s are for official investigations only. Flock Safety Inc. will have access to this system for software updates and to guide investigators in its use as well as to troubleshoot any problems that may arise.
Budget Impact:
The Budget impact of this agreement is not to exceed $60,000.00 to be funded with Measure U funds. Authorization to allow the finance director to appropriate necessary funds to fund the requested new capital item within the police department budget.
